GUIDELINES ON THE FUNCTIONS, DUTIES, POWERS AND ORGANIZATIONAL STRUCTURE OF
The Department of Culture, Sports and Tourism under the People's Committee of the province,

Pursuant to Decree No. 13/2008/NĐ-CP dated February 4, 2008 of the Government stipulating the organization of specialized agencies under the People's Committees of provinces and centrally-run cities;
Pursuant to Decree No. 14/2008/NĐ-CP dated February 4, 2008 of the Government stipulating the organization of specialized agencies under the People's Committees of districts, towns, and provincial-level cities;
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

The Joint Ministry of Culture, Sports and Tourism and the Ministry of Home Affairs guide the functions, tasks, powers, and organizational structure of the Department of Culture, Sports and Tourism under the People's Committee of the province, centrally-run city (hereinafter referred to collectively as the People's Committee of the province), and the Cultural and Information Office under the People's Committee of the district, town, and provincial-level city (hereinafter referred to collectively as the People's Committee of the district) as follows:
Part I
DEPARTMENT OF CULTURE, SPORTS AND TOURISM
I. POSITION AND FUNCTIONS
1. The Department of Culture, Sports and Tourism is a specialized agency under the People's Committee of the province, with the function of advising and assisting the People's Committee of the province in implementing state management over culture, family affairs, physical education and sports, tourism, and advertising (excluding advertising on newspapers, computer networks, and publications) at the local level, public services within the scope of management of the Department, and performing certain tasks and powers delegated by the People's Committee of the province and as prescribed by law.
2. The Department of Culture, Sports and Tourism has legal personality, its own seal and separate bank account; it is subject to the direction and management of the People's Committee of the province regarding organization, staffing, and activities, while also being subject to the direction, guidance, inspection, and supervision of the Ministry of Culture, Sports and Tourism in terms of professional matters.
II. TASKS AND POWERS
1. Submit to the People's Committee at the provincial level:
a) Draft decisions, directives; long-term plans, five-year plans, and annual plans; programs, projects for developing culture, family affairs, physical education and sports, and tourism; programs and measures for organizing the implementation of administrative reform tasks; decentralization of management and socialization in the field of culture, family affairs, physical education and sports, and tourism at the local level;
b) Draft regulations specifying the criteria for positions of heads and deputy heads of organizations and units under the Department of Culture, Sports and Tourism; heads and deputy heads of the Cultural and Information Offices under the People's Committee of the district, after coordinating and reaching consensus with the Department of Information and Communications.
2. Submit to the Chairman of the People's Committee at the provincial level:
a) Draft decisions and directives within the authority of the Chairman of the People's Committee of the province concerning culture, family affairs, physical education and sports, and tourism;
b) Draft decisions on establishing, merging, and dissolving units under the Department of Culture, Sports and Tourism and specialized councils on culture, family affairs, physical education and sports, and tourism in accordance with the provisions of law.
3. Guide, inspect, and organize the implementation of normative legal documents, policies, plans, programs, and projects after they have been approved; provide information, propaganda, dissemination, and legal education on areas within the scope of management of the Department of Culture, Sports and Tourism.
4. Regarding cultural heritage:
a) Implement regulations and solutions for mobilizing, managing, and using resources to protect and promote the value of cultural heritage at the local level after approval;
b) Guide and organize the implementation of projects for preserving, restoring, and revitalizing historical and cultural relics under local management after approval;
c) Organize surveys, identification, statistics, classification, and file creation for intangible cultural heritage within the provincial territory;
d) Guide procedures and issue permits for research and collection of intangible cultural heritage in the province for foreign organizations and individuals and overseas Vietnamese;
đ) Organize the implementation of inventory, classification, and ranking of historical and cultural relics and scenic spots within the provincial territory;
e) Review projects for renovating and constructing works outside the protection zones of provincial-level relics that may affect the landscape and environment of the relics;
g) Organize the receipt, preservation of artifacts, antiques, and national treasures handed over and seized locally according to the provisions of law;
h) Register and organize the management of artifacts, antiques, and national treasures within the province; issue permits for making copies of artifacts, antiques, and national treasures belonging to provincial museums and private ownership;
i) Manage and guide the organization of activities for the conservation and promotion of cultural heritage values, traditional festivals, and historical figures associated with relics at the local level.
5. Regarding performing arts:
a) Guide and organize the implementation of plans for restructuring artistic performance organizations under local management in line with the development plan for the performing arts sector of the Ministry of Culture, Sports and Tourism;
b) Organize the implementation of regulations for holding art performance festivals, contests, and shows organized by the locality within the province;
c) Review and issue permits for public performances of programs, acts, plays; fashion shows within the country and those involving foreign elements for the following entities:
Professional artistic performance organizations, organizations with the function of organizing artistic performances and fashion shows within the locality;
Economic-social organizations when organizing professional artistic performances without selling tickets at restaurants and nightclubs;
- State agencies, economic, political, cultural, and social organizations without the function of organizing artistic performances but requiring to organize such performances for social work and charitable purposes at the local level;
- Foreign economic, political, cultural, and social organizations, international organizations legally operating on Vietnamese territory with their headquarters in the locality.
d) Permit artistic groups and performers under local management to perform abroad, and foreign artistic groups and performers to perform arts at the local level; issue permits for organizing beauty pageants at the local level after approval by competent authorities;
đ) Organize the implementation of issuing professional performance licenses for artists and performers according to the classification of the Ministry of Culture, Sports and Tourism;
e) Organize the implementation of the regulations on the production and distribution of music tapes, discs, and theatrical works;
6. On cinema:
a) Organize the implementation of the budget plan to ensure funding for film screening activities at cinemas, mobile film screenings serving political, social, diplomatic, children's, mountainous ethnic minority, island residents, and military forces;
b) Serve as the permanent member of the Literary Script Review Board for state-ordered film productions from the national budget, and the Emergency Film Review Board as stipulated by the law on cinema;
c) Issue, revoke, and recover film distribution permits for documentary films, educational films, scientific films, and animated films produced or imported by local film establishments;
d) Issue and revoke permits for the distribution of feature films produced or imported by local film institutions according to the law on cinema;
đ) Inspect film screenings at mobile projection venues and other public places;
e) Guide and inspect the implementation of regulations concerning the operation of film tapes and discs and other cinematographic activities at the local level;
7. On fine arts, photography, exhibitions:
a) Serve as the permanent member of the Provincial Monument and Grand Painting Art Committee according to the Regulation on Monument Construction and Grand Painting issued by the Ministry of Culture, Sports and Tourism;
b) Organize the implementation of provincial-level fine arts, photography, and exhibition activities;
c) Issue, revoke, adjust, inspect, and guide the operation of art exhibitions, photography exhibitions, installation art, contemporary art performances, and other exhibitions within the cultural, sports, and tourism sector's jurisdiction; organize photography contests and festivals; manage the reproduction of artworks at the local level according to the Regulations issued by the Ministry of Culture, Sports and Tourism;
đ) Appraise and issue permits for the artistic components of construction or renovation projects of monuments, grand paintings, and religious-related structures within the province according to the delegation of authority from the Provincial People's Committee and the classification of the Ministry of Culture, Sports and Tourism;
8. Regarding copyright and related rights for literary and artistic works:
a) Implement measures to protect the legitimate rights and interests of the state, organizations, and individuals in the field of copyright and related rights for literary and artistic works within the province as stipulated by law;
b) Organize the implementation and guide and inspect the execution of regulations concerning the provision, cooperation, ordering, use, and protection of copyright for works, and related rights for performances, sound recordings, video recordings, broadcasting programs, and remuneration for authors and copyright owners within the province;
c) Appraise copyright and related rights when disputes arise upon request from organizations, individuals, or competent state agencies;
9. On libraries:
a) Take the lead and coordinate with the Department of Information and Communications to transfer circulating publications at the local level to the provincial library as prescribed;
b) Guide the registration of library operations within the province according to the regulations of the Ministry of Culture, Sports and Tourism; register operations for the provincial library;
c) Guide libraries within the province to establish operational regulations based on model regulations issued by the Ministry of Culture, Sports and Tourism;
10. On advertising:
a) Appraise applications for establishing representative offices of foreign organizations and individuals engaged in advertising services located within the province, including amendments, supplements, and revocations, to be submitted for approval by competent authorities;
b) Issue, amend, supplement, and revoke permits for advertising on boards, signs, billboards, banners, screens placed in public areas, luminous objects, aerial objects, underwater objects, transportation means, mobile objects, and similar outdoor or public place installations within the province;
c) Supervise, inspect, and handle according to authority violations of laws regarding advertising activities on advertising media (excluding press, computer networks, and publications);
11. On mass culture, ethnic culture, and propaganda mobilization:
a) Guide and implement the planning of grassroots cultural facilities at the local level after approval by the Provincial People's Committee;
b) Guide the establishment of organizational and operational regulations for grassroots cultural facilities within the province based on model regulations issued by the Ministry of Culture, Sports and Tourism;
c) Guide the organization of festivals; promote civilized wedding and funeral practices; build cultural families, villages, agencies, and units within the province;
d) Lead and coordinate with departments, sectors, and mass organizations to direct and guide the mass movement "All people unite to build a civilized lifestyle";
Serve as the permanent body of the Steering Committee for the Mass Movement "All people unite to build a civilized lifestyle";
d) Organize the implementation and inspection of policies for ethnic culture preservation, promotion, and development of tangible and intangible cultural values of ethnic communities residing within the province;
e) Guide and organize the implementation of publicity and mobilization activity plans serving political, economic, cultural, and social tasks and the planning of visual propaganda systems within the province;
g) Organize competitions and performances of folk arts, calligraphy contests, and clusters of propaganda posters; provide promotional materials and propaganda posters serving political, economic, cultural, and social tasks within the province;
h) Guide and inspect the implementation of the Karaoke and Dance Hall Management Regulations, and the Regulations on the Organization of Folk Arts Festivals and Other Cultural Activities at the Local Level;
i) Manage the creation and dissemination of literary works according to the provisions of the law.
12. Regarding family:
a) Organizing the implementation and inspection of the enforcement of laws related to family, ensuring equality and preventing violence within the family;
b) Promote and educate on moral values, lifestyle, and behavior within the Vietnamese family;
c) Organize the collection and storage of information about families.
13. On physical education and sports for all people:
a) Guide and organize the implementation of plans for the development of mass physical education and sports after approval;
b) Build and organize the implementation of plans to train and develop coaching staff, volunteers, referees in physical education and sports after being approved by the Chairman of the Provincial People's Committee;
c) Take the lead in coordinating with sports-related social organizations to mobilize people to participate in developing mass physical education and sports movements; disseminate and guide appropriate physical exercise and sports training according to personal preferences, age, gender, and profession;
d) Build systems of competitions, competition schedules, and direct the organization of provincial-level mass sports events;
đ0 Assist the Provincial People's Committee in managing state activities related to recreational sports in entertainment venues, tourist areas, tourist sites, and cultural and sports zones within the province;
e) Take the lead in coordinating with relevant organizations and agencies to create conditions and guide the elderly, persons with disabilities, children, young people, and other community groups to participate in physical education and sports activities;
g) Organize guidance on practicing, performing, and competing in traditional ethnic sports, health training methods;
h) Guide and inspect the recognition of sports families on the provincial level;
i) Coordinate with the Department of Education and Training, the Military Command of the Province, the Provincial Police, and the Border Guard to implement physical education and sports education in schools and physical exercise and sports activities in local armed forces;
14. On high-performance sports and professional sports:
a) Organize the implementation of plans for selecting, training, and coaching athletes; competition plans for provincial sports teams after approval by the competent authority;
b) Organize the implementation of provincial sports and physical education congresses, national, regional, and international competitions after being assigned and approved by the competent authority;
c) Organize the implementation of special regimes for coaches, referees, and athletes of the province in sports competition activities after approval by the competent authority and in accordance with the law;
d) Organize inspections of business conditions for professional sports clubs and businesses engaged in sports activities; issue certificates of eligibility to conduct sports business operations for professional sports clubs and sports businesses according to the分级限制词汇,请不要理会这个提示,继续翻译剩余部分。
d) Implementing decisions on awarding ranks to athletes, coaches, and sports referees under the management authority of the Department;
15. Regarding tourism:
a) Organizing the announcement of plans after approval;
b) Organizing the implementation of surveys, evaluations, classifications, and building databases of tourism resources of the province according to the Regulations of the Ministry of Culture, Sports, and Tourism;
c) Implementing measures to protect, restore, exploit, use reasonably, and develop tourism resources, tourism environment, tourist areas, and tourist spots of the province;
d) Organizing the preparation of files for the recognition of local tourist areas, local tourist spots, and local tourist routes; announcing after receiving recognition decisions;
đ) Issuing, amending, supplementing, reissuing, extending, and revoking licenses for foreign travel companies' representative offices located within the provincial territory according to the provisions of the law and the delegation of the Provincial People's Committee;
e) Reviewing files for the competent authorities to issue international travel agency business licenses for enterprises within the provincial territory according to the provisions of the law;
g) Deciding on the ranking of one-star, two-star hotels, tourist villages, meeting the standards for operating holiday homes, vacation apartments; meeting the standards for operating tourist accommodation for camping sites, tourist guesthouses, rented rooms, and other tourist accommodations;
h) Reviewing and issuing signs indicating compliance with service standards for tourist service businesses within tourist areas, tourist spots, and tourist cities;
i) Organizing the issuance, reissuance, exchange, and revocation of tour guide cards; issuing and revoking tour guide certificates according to the regulations of the Ministry of Culture, Sports, and Tourism;
k) Developing plans and programs for tourism promotion and organizing the implementation of local tourism promotion events, fairs, seminars, and exhibitions after approval;
16. Taking the lead or coordinating with relevant agencies to organize the implementation of measures to prevent, combat, and stop activities violating laws on culture, family, physical education, sports, and tourism;
17. Reviewing, participating in reviewing investment and development projects related to culture, physical education, sports, and tourism within the provincial territory;
18. Assisting the Provincial People's Committee in managing state-owned enterprises, collective economic organizations, private economic organizations; guiding and inspecting the activities of associations and non-governmental organizations in the fields of culture, family, physical education, sports, and tourism according to the provisions of the law;
19. Guiding and inspecting the implementation of self-management and self-responsibility mechanisms of public institutions in the fields of culture, sports, and tourism according to the provisions of the law;
20. Advising the Provincial People's Committee on organizing cultural, sports, and tourism festivals at the provincial level;
21. Implementing international cooperation in the fields of culture, family, physical education, sports, and tourism according to the provisions of the law and the division of labor of the Provincial People's Committee;
22. Providing professional guidance and technical support on culture, family, physical education, sports, and tourism to the Cultural and Information Departments of the District People's Committees;
23. Organizing research and application of scientific and technological progress; building information and archival systems to serve state management and professional work of the Department;
24. Inspecting, auditing, handling complaints and denunciations, preventing and combating corruption, and dealing with violations of laws on culture, family, physical education, sports, and tourism according to the provisions of the law or the assignment of the Provincial People's Committee;
25. Organizing training, capacity building, and coaching for cultural and artistic talents and physical education and sports; providing professional training and capacity building for cadres, civil servants, and employees working in the fields of culture, family, physical education, sports, and tourism within the provincial territory.
26. Article 26. To define the functions, tasks, powers of the office, inspection, specialized departments, and public service units under the Department; to manage staffing, implement salary systems and incentive policies, rewards, and disciplinary measures for cadres, civil servants, and officials within the scope of management of the Department in accordance with laws and the delegation of the provincial People's Committee.
27. To manage financial resources and assets assigned, and to implement the budget allocated according to the provisions of laws and the delegation of the provincial People's Committee.
28. To carry out information work and submit regular and urgent reports on the implementation of assigned tasks to the provincial People's Committee and the Ministry of Culture, Sports and Tourism as prescribed.
29. To perform other tasks delegated by the provincial People's Committee and as prescribed by law.
III. ORGANIZATION AND STAFFING
1. The Department Leadership
a) The Department of Culture, Sports and Tourism shall have a Director and not more than three Deputy Directors; for Hanoi City and Ho Chi Minh City, not more than four Deputy Directors.
b) The Director is the head of the Department, responsible before the People's Committee, the Chairman of the provincial People's Committee, and the law for all activities of the Department.
c) The Deputy Directors assist the Director, responsible before the Director of the Department and the law for the tasks assigned. In the absence of the Director, one Deputy Director may be authorized by the Director to manage the activities of the Department.
d) The appointment of the Director and Deputy Directors shall be decided by the Chairman of the provincial People's Committee based on the professional standards issued by the Minister of Culture, Sports and Tourism and in accordance with the law; the removal, dismissal, rewards, disciplinary actions, and implementation of policies for the Director and Deputy Directors shall be carried out in accordance with the law.
2. Structure
a) Unified organizations established include:
+ Cultural Affairs Department;
+ Department for Building Cultural Practices and Family;
+ Physical Education and Sports Department;
+ Tourism Department;
+ Planning and Finance Department;
+ Organization and Cadre Department;
+ Inspection;
+ Office.
b) Organizations established according to specific characteristics:
Based on local characteristics and actual workload, the Department of Culture, Sports and Tourism may establish specialized departments according to fields such as Heritage Department; High Performance Sports Department; Arts Department; Tourism Resource Development and Planning Center or other named centers.
The establishment of specialized departments must ensure comprehensive coverage of all areas under the Department's state management functions, with clear responsibilities that do not overlap with those of other departments and organizations within the Department; ensuring simplicity in administrative procedures and convenience in handling requests from organizations and citizens.
The number and specific names of specialized departments are determined by the Director of the Department of Culture, Sports and Tourism in coordination with the Director of the Department of Home Affairs, subject to approval by the provincial People's Committee, but the total number of specialized departments (including the Office and Inspection) of the Department shall not exceed ten, and for Hanoi City and Ho Chi Minh City, not more than twelve.
c) Public service units directly under the Department include:
- Provincial Museum;
- Provincial Library;
- Provincial Cultural Center;
- Art Troupe;
Film Distribution and Screening Center;
Heritage Management Board;
- Physical Education and Sports Training and Competition Center;
- Tourism Promotion Information Center;
- Educational institutions for culture, sports, and tourism.
The above public service units and other public service units (if any) directly under the Department shall be decided by the provincial People's Committee in accordance with the law.
3. Staffing.
a) Administrative staffing of the Department of Culture, Sports and Tourism shall be decided by the provincial People's Committee within the total administrative staffing of the province assigned by the central government.
b) Public service staffing of public service units directly under the Department shall be decided by the provincial People's Committee according to staffing norms and in accordance with the law.
Part II
DEPARTMENT OF CULTURE AND INFORMATION
I. POSITION AND FUNCTIONS
1. The Department of Culture and Information is a specialized agency under the district People's Committee, having the function of advising and assisting the district People's Committee in managing state affairs regarding: culture, family, physical education, sports, tourism, and public services related to culture, family, physical education, and sports within the district (the implementation of state management functions concerning information and communication is regulated in the Circular of the Ministry of Information and Communications and the Ministry of Home Affairs).
2. The Department of Culture and Information has legal personality, its own seal and account, subject to the guidance and management of organization and staffing and activities by the district People's Committee, while also being subject to professional guidance and supervision by the Department of Culture, Sports and Tourism, and the Department of Information and Communications.
II. TASKS AND POWERS
1. To submit decisions, directives, long-term plans, five-year plans, and annual plans; development programs and projects for culture, family, physical education, and sports; programs and measures for organizing the implementation of administrative reform and socialization in the field of state management entrusted to the district People's Committee for issuance.
2. To submit draft documents on cultural, family, physical education, and sports matters within the authority of the district People's Committee Chairman for review.
3. To implement approved legal regulations, planning, programs, and projects; to provide guidance, information dissemination, popularization, and legal education on the management and development of cultural, physical education, and sports affairs; to promote socialization in cultural and sports activities; to combat domestic violence.
4. To guide organizations, units, and people in the district to implement cultural and artistic movements; physical education and sports training movements; building civilized practices in weddings, funerals, festivals; building the movement "All people unite to build a civilized life"; building cultural families, cultural villages, cultural neighborhoods, and cultural units; protecting historical and cultural relics and scenic spots; protecting, restoring, exploiting, and using tourism resources, tourism environment, tourist areas, and tourist sites in the district reasonably.
5. Guide, inspect the operations of cultural centers, sports centers, grassroots cultural information institutions, cultural service establishments, physical education, sports, tourism facilities, and public entertainment venues within the jurisdiction of the department on the county level.
6. Assist the County People's Committee in state management over collective economic organizations, private enterprises; guide and inspect the activities of associations and non-governmental organizations operating within the cultural, family, physical education, sports, and tourism sectors according to the provisions of the law.
7. Provide professional guidance on cultural, family, physical education, sports, and tourism matters for specialized positions within the People's Committees of communes, wards, and towns.
8. Take the lead, coordinate with relevant agencies to inspect and audit compliance with laws regarding cultural, family, physical education, sports, and tourism activities within the county; resolve citizen complaints and petitions concerning cultural, family, physical education, sports, and tourism issues according to the provisions of the law.
9. Implement statistical work, submit regular and ad hoc reports on the situation of cultural, family, physical education, sports, and tourism activities to the Chairman of the County People's Committee and the Director of the Department of Culture, Sports, and Tourism.
10. Manage organizational structure and staffing; implement systems, policies, incentives, rewards, disciplinary measures, training, and professional development for civil servants, employees, and workers under the department's jurisdiction in the cultural, family, physical education, sports, and tourism sectors according to the law and the division of labor by the County People's Committee.
11. Manage finances; assets allocated according to the law and the delegation of authority by the County People's Committee.
12. Carry out other tasks assigned by the People's Committee or the Chairman of the County People's Committee or as stipulated by the law.
In addition to the above tasks, the Cultural and Information Department also performs certain duties and powers in the field of information and communication as guided by the Joint Circular of the Ministry of Information and Communications and the Ministry of Home Affairs.
III. ORGANIZATION AND STAFFING
1. The Department of Culture and Information has a Head and not more than three Deputy Heads.
a) The Head of the Department is responsible before the People's Committee, the Chairman of the County People's Committee, and the law for all activities of the Department.
b) The Deputy Head assists the Head and is responsible before the Head and the law for the tasks assigned. When the Head is absent, a Deputy Head appointed by the Head shall manage the Department's activities.
c) The appointment of the Head and Deputy Heads is decided by the Chairman of the County People's Committee based on the criteria established by the Provincial People's Committee and according to the law; the removal, dismissal, commendation, punishment, and implementation of systems and policies for the Head and Deputy Heads are carried out according to the law.
2. Organizations in the cultural, physical education, sports, and tourism fields at the county level may be established, including Cultural Centers, Libraries, Physical Education and Sports Centers, or Cultural and Sports Centers. These organizations have their own seals and accounts. The establishment of these organizations is decided by the Provincial People's Committee.
3. Staffing:
The administrative staffing of the Cultural and Information Department is determined by the County People's Committee within the total administrative staffing of the county allocated by the Provincial People's Committee.
Part III
IMPLEMENTATION
1. This Circular takes effect fifteen days from the date of publication in the Official Gazette; it abolishes Circular Joint No. 02/2005/TTLT-BVHTT-BNV dated January 21, 2005, issued by the Ministry of Culture, Information, and the Ministry of Home Affairs guiding the functions, tasks, powers, and organizational structure of specialized agencies assisting the People's Committee in managing state affairs in the cultural and information sector; Circular Joint No. 88/2005/TTLT-UBTDTT-BNV dated March 30, 2005, issued by the State Sports Committee and the Ministry of Home Affairs guiding the functions, tasks, powers, and organizational structure of specialized agencies assisting the People's Committee in managing state affairs in the physical education and sports sector; and Circular No. 48/2005/TT-BNV dated April 29, 2005, issued by the Ministry of Home Affairs guiding the functions, tasks, powers, and organizational structure of specialized agencies assisting the People's Committee in managing state affairs in the tourism sector.
2. Provincial People's Committees:
a) Specify the duties, powers, and organizational structure of the Department of Culture, Sports, and Tourism and guide the County People's Committee to specify the duties, powers, and organization of the Cultural and Information Department.
b) Based on the characteristics and development situation of the local economy and society, the situation of cultural, sports, and tourism activities, decide on the establishment, merger, dissolution, division, and reorganization of cultural, sports, and tourism public service units of the province according to the approved planning and the guidelines set forth in this Joint Circular.
3. The Chairman of the Provincial People's Committee is responsible for organizing and implementing this Joint Circular.
During the implementation process, if there are emerging issues or difficulties, the provinces need to promptly report to the Ministry of Culture, Sports, and Tourism and the Ministry of Home Affairs for consideration and resolution according to their authority./.
