Provisions on training, capacity building, and aviation security instruction

Based on the Civil Aviation Law of Vietnam No. 66/2010/QH11 dated June 29, 2010;006/QH11 dated June 29, 2010;0The Law Amending and Supplementing Certain Articles of the Civil Aviation Law of Vietnam No. 61/2014/QH13 dated November 21, 2014;

On the basis of Decree No. 92/2015/ND-CP dated October 13, 2015 of the Government on aviation security;

On the basis of Decree No. 92/2016/ND-CP dated July 1, 2016 of the Government on business sectors subject to conditions within the civil aviation sector;

On the basis of Government Decree No. 12/2017/NĐ-CP dated 10 the 2 Article 2. The receipt, handling of reflections and petitions from individuals and organizations concerning administrative regulations shall be carried out in accordance with Decree No. 20/2008/NĐ-CP dated February 14, 2008 of the Government on the receipt, handling of reflections and petitions from individuals and organizations concerning administrative regulations (amended and supplemented by Decree No. 48/2013/NĐ-CP dated May 14, 2013 on amending and supplementing certain articles of decrees related to administrative procedure control and Decree No. 92/2017/NĐ-CP dated August 7, 2017 on amending and supplementing certain articles of decrees related to administrative procedure control).7 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Department of Personnel and the Director of the Civil Aviation Authority of Vietnam;

The Minister of Transport issues this Circular on training, capacity building, and aviation security instruction.

 

PART I

GENERAL PROVISIONS

           

Article 1. Scope of application

This Circular stipulates provisions on training, capacity building, and aviation security instruction in civil aviation activities.

 Article 2. Applicability

This Circular applies to organizations and individuals related to training, capacity building, and aviation security instruction in civil aviation activities in Vietnam.

Article 3. Duration of Instruction, Conversion of Instruction Time

1. The duration of instruction in the training program is measured in hours.

2. Conversion of instruction time: one theoretical hour equals 45 minutes; one practical hour equals 60 minutes.

SECURITY FORCES AIRCRAFT SECURITY

 

Section 1

PROGRAM TRAINING AND STAFF DEVELOPMENT

 

Article 4Chapter 1. Training Program for Security Screening Operations

1. Objective: to equip trainees with professional knowledge, skills, and attitudes in conducting security checks and screening for passengers, baggage, cargo, mail, and items loaded onto aircraft.

2. Participants: Vietnamese citizens aged 18 years or older with clear records, good health, and completion of secondary education or higher.

3. Duration of the course: 516 hours. Of which, theoretical instruction: 306 hours; practical instruction: 210 hours.

4. Allocation of Instruction Time for Courses:

 Article 5Chapter 2. Training Program for Security Control Operations

1. Objective: to equip trainees with professional knowledge, skills, and attitudes in conducting security control operations at terminals, public areas, airports, and restricted zones.

2. Participants: Vietnamese citizens aged 18 years or older with clear records, good health, and completion of secondary education or higher.

3. Duration of the course: 432 hours. Of which, theoretical instruction: 282 hours; practical instruction: 150 hours.

4. Allocation of Instruction Time for Courses:

Article 6Chapter 3. Training Program for Mobile Security Operations

1. Objective: to equip trainees with professional knowledge, skills, and attitudes in patrolling, guarding, escorting, crowd control, inspection, and search of aircraft and vehicles.

2. Participants: Vietnamese citizens aged 18 years or older with clear records, good health, and completion of secondary education or higher.

3. Duration: 456 hours. Of which, theoretical instruction: 278 hours; practical instruction: 178 hours.

4. Allocation of Instruction Time for Courses:

Article 7. Aviation Security Management Training Program

1. Objective: Equip trainees with knowledge, skills, and expertise in aviation security management.

2. Target Audience: Managers at all levels within the aviation security control forces of Vietnamese airport enterprises, airlines, service providers ensuring flight operations, aircraft maintenance and repair services enterprises, and common aviation business operators identified in the aviation security program and security regulations.

3. Duration: 40 hours of theoretical instruction.

4. Allocation of Instruction Time for Courses:

Article 8. Crisis management training program Aviation security

1. Objective: Equip trainees with knowledge, skills, and expertise to develop emergency plans for aviation security and measures to counter illegal interference in civil aviation operations.

2. Target Audience: Managers at all levels within the aviation security control forces of Vietnamese airport enterprises, airlines, service providers ensuring flight operations, and aircraft maintenance and repair services enterprises identified in the aviation security program and security regulations; managers of units participating in implementing countermeasures against illegal interference in civil aviation operations.

3. Duration: 24 hours of theoretical instruction.

4. Allocation of Instruction Time for Courses:

Article 9. Training Program on aviation security teaching skills

1. Objective: Equip trainees with knowledge, skills to prepare and use teaching materials and equipment, organize classes, and teaching methods regarding aviation security.

2. Target Audience: Individuals selected to be instructors for aviation security control forces or instructors teaching aviation security knowledge.

3. Duration: 56 hours. Of which, theoretical instruction: 38 hours; practical training: 18 hours.

4. Allocation of Instruction Time for Courses:

 Article 10. Security Surveillance Officer Professional Training Program

1. Objective: to equip trainees with aviation security knowledge, methods, skills, and inspection and supervision procedures.

2. Target Audience: individuals selected as aviation security surveillance officers or internal security surveillance officers who have at least one year of work experience in aviation security.

3. Duration: 56 hours. Of which, theoretical instruction: 40 hours; practical training: 16 hours.

REGULAR TRAINING PROGRAM

 

Article 11. Regular Training Program for Security Screening Operations

1. Objective: to update trainees on new knowledge, regulations, and enhance their practical skills in security screening operations.

2. Target Audience: security screening personnel.

3. Duration: 32 hours. Of which, theoretical instruction: 6 hours; practical training: 26 hours.

4. Allocation of Time for Courses:

Article 12. Regular Training Program for Security Control Operations

1. Objective: to update trainees on new knowledge, regulations, and enhance their practical skills in security control and supervision operations.

2. Target Audience: security control personnel.

3. Duration: 24 hours. Of which, theoretical instruction: 12 hours; practical training: 12 hours.

4. Allocation of Instruction Time for Courses:

Article 13. Regular Training Program for Mobile Security Operations

1. Objective: to update trainees on new knowledge, regulations, and enhance their practical skills in mobile security operations.

2. Target Audience: mobile security personnel.

3. Duration: 62 hours. Of which, theoretical instruction: 12 hours; practical training: 50 hours.

4. Allocation of Instruction Time for Courses:

Article 14. Regular Training Program for Aviation Security Management Operations

1. Objective: to update trainees on new knowledge and regulations regarding aviation security management.

2. Target Audience: management staff at various levels within the aviation security control force of Vietnamese airport enterprises, airlines, service providers ensuring flight operations, aircraft maintenance and repair enterprises, and general aviation business enterprises identified in the Aviation Security Program and Security Regulations who have completed the aviation security management operations training course.

3. Duration: 16 hours of theoretical instruction.

4. Allocation of Instruction Time for Courses:

Article 15. Regular Training Program for Air Security Teaching Business

1. Objective: To update trainees' knowledge and skills in preparing materials, using equipment, organizing classes, and teaching methods on air security.

2. Target Audience: Teachers instructing air security control forces and teachers imparting air security knowledge.

3. Duration:

a) Regular training for teaching business of air security control forces: 16 hours of theory;

b) Regular training for teaching business of air security knowledge: 8 hours of theory.

4. Allocation of Instruction Time for Courses:

Article 16. Regular Training Program for Air Security Supervisors

1. Objective: To update trainees' knowledge, skills, and inspection and supervision practices in air security.

2. Target Audience: Air security supervisors and internal security supervisors.

3. Duration: 16 hours of theoretical instruction.

4. Allocation of Instruction Time for Courses:

Article 17. Regular Training Duration

1. Air security screening personnel, air security control personnel, and mobile air security personnel must undergo regular training once every one year.

2. Air security screening personnel who allow dangerous items to pass through during their duties, and air security controllers who have not performed their duties continuously for six months must undergo regular training before resuming their duties.

3. Managers at all levels in the air security control force, air security teachers, air security supervisors, and internal security supervisors must undergo regular training once every two years.

ORGANIZATION OF TRAINING, ENRICHMENT, AND REGULAR TRAINING

AIR SECURITY CONTROL FORCE

 

Article 18. Textbooks and Materials

1. Training institutions for air security personnel must organize the compilation, review, and issuance of textbooks and materials for training, enrichment, and regular training of the air security control force in accordance with this Circular and the International Civil Aviation Organization's standards and recommended practices.

2. The content of textbooks and materials for training, enrichment, and regular training of the air security control force must comply with the provisions of this Circular and the International Civil Aviation Organization's standards and recommended practices.

3. Textbooks and materials for training programs of the air security control force must be managed as restricted security documents.

Article 19. Teachers Instructing the Air Security Control Force

1. Teachers instructing air security personnel must meet the provisions of Clause 2, Article 26 of Decree No. 92/2016/NĐ-CP dated July 1, 2016, of the Government regarding conditional business sectors in the civil aviation industry.

2. Teachers instructing enrichment programs on air security management, air security teaching, air security supervision, and crisis management must meet the provisions of Clause 1 of this Article and hold corresponding enrichment certificates for the teaching programs.

3. Teachers instructing regular training programs on air security management, air security teaching, and air security supervision must be selected by training institutions for air security personnel from experienced teachers and experts with extensive knowledge of air security.

4. Teachers instructing specialized aviation communication English, martial arts, weapons, and explosives must hold certificates issued by competent authorities.

5. Based on the criteria stipulated in Clauses 1, 2, and 3 of this Article, training institutions for air security personnel must compile a list of teachers instructing the air security control force and report it to the Vietnam Civil Aviation Administration for inspection and supervision.

Article 20. Material Bases and Training Equipment

1. The material bases and training equipment for the vocational training programs of aviation security officers must comply with the provisions set forth in Article 25 of Decree No. 92/2016/NĐ-CP dated July 1, 2016, stipulating conditions for business operations in the civil aviation sector.

2. The practical training equipment for the vocational training programs of aviation security officers includes:

a) Security screening teaching software;

b) X-ray scanning machines;

c) Metal detectors;

d) Hand-held metal detectors;

đ) Explosive detection devices;

e) Undercarriage inspection mirrors;

g) Models and replicas of weapons, explosives, and dangerous items;

h) Surveillance camera systems;

i) Other equipment related to the teaching and learning content.

3. The practical training equipment for the refresher courses on aviation security teaching and air security supervisors must be appropriate to the practical content.

Article 21. Examination, Issuance of Certificates, and Completion Certification

1. Inspection:

a) Theoretical examinations shall be conducted through one of the following methods: multiple-choice tests, written exams, or oral questioning. Practical examinations shall be carried out using available facilities, equipment, and materials, or simulation and hypothetical software. Students participating in the vocational training programs for security screening, security control, and mobile security must take a test at the end of each course, with a minimum examination time of 15 minutes;

b) Theoretical examination scores and practical examination scores will be calculated on a scale of 100 points. Students who achieve a score of 80 points or higher in both theoretical and practical examinations at the end of the course will be issued a completion certificate.

2. Issuance of Certificates:

a) Students completing vocational training programs for aviation security officers will be awarded a professional certificate by the vocational training institution according to the model specified in the Circular of the Minister of Transport regarding aviation personnel, vocational training institutions for aviation personnel, and language proficiency assessment centers for aviation personnel;

b) Students completing refresher courses on aviation security management, crisis management, aviation security teaching, and air security supervision will be awarded a completion certificate by the vocational training institution according to the model specified in Appendix 1 attached to this Circular;

c) Students completing regular vocational training programs for aviation security as stipulated from Article 11 to Article 16 of this Circular will be recognized in writing by the head of the vocational training institution.

3. Students participating in vocational training programs to obtain a second professional certificate or higher will be exempted from common subjects and common aviation security subjects in the training program.

4. Certificates and certifications issued by training institutions belonging to the International Civil Aviation Organization for individuals completing aviation security instructor (Aviation Security Instructor), aviation security supervisor (Aviation Security Inspector), aviation security management (Aviation Security Management), and crisis management (Crisis Management) training programs have equivalent value to the certificates specified in point b, Clause 2 of this Article.

Article 22. Records for training, education, instruction air security control forces

1. The components of the records for training and education of air security control forces include:

a) Results of final course examination;

b) Decision of the head of the training institution recognizing the completion of the course by the trainee;

c) Certificate of course completion (copy).

2. The components of the records for periodic instruction of air security control forces include:

a) Results of final course examination;

b) Decision of the head of the training institution recognizing the completion of the course by the trainee.

 

Chapter III

INSTRUCTION ON AIR SECURITY KNOWLEDGE

FOR SUBJECTS NOT BELONGING TO THE AIR SECURITY CONTROL FORCES

TRAINING PROGRAM ON AIR SECURITY KNOWLEDGE

 

 

Section 1

Chapter on the training program on air security knowledge

AIRCRAFT SECURITY

 

Article 23for flight crews Aviation security 1. Objective: to equip flight crews with necessary knowledge about air security and methods to handle related security situations.

2. Target group: flight crew members.

a) Training on air security knowledge for pilots and cabin crew: 32 hours of theoretical study, except for the subjects specified in point b, Clause 3 of this Article;

3. Duration:

b) Training on air security knowledge for cabin supervisors: 42 hours of theoretical study; if already holding certification from the program specified in point a, Clause 3 of this Article, corresponding courses may be exempted.

National laws and International Civil Aviation Organization standards on air security

3. Duration: 16 hours of theoretical instruction.

4. Allocation of Instruction Time for Courses:

Article 25for flight crews Aviation security 1. Objective: to equip trainees with necessary knowledge about air security and methods to handle related security situations relevant to their management and supervision tasks.

2. Target group: supervisors, managers, and representatives of airlines operating in Vietnam.

3. Duration: 16 hours of theoretical instruction.

4. Allocation of Instruction Time for Courses:

Article 27. Ground Service Personnel Flight Support Knowledge Training Program Aviation security for ground service personnel serving flights at Vietnamese airports

1. Objective: to equip trainees with necessary knowledge on aviation security and methods to handle security situations related to flight support duties.

2. Target group: ground service personnel serving flights at Vietnamese airports.

3. Duration: 16 hours of theoretical instruction.

4. Allocation of Instruction Time for Courses:

Article 28for flight crews Aviation security for aircraft maintenance and repair personnel

1. Objective: to equip trainees with necessary knowledge on aviation security and methods to handle security situations related to aircraft maintenance and repair duties.

2. Target group: aircraft maintenance and repair personnel.

Article 29. Knowledge Training Program Aviation security for Air Traffic Services Personnel

1. Objective: to equip trainees with necessary knowledge on aviation security and methods to handle security situations related to their duties.

2. Eligibility:

a) Non-routine personnel;

b) Aviation Information Personnel;

c) Information, Guidance, and Surveillance Personnel;

d) Aviation Meteorological Personnel;

e) Aviation Search and Rescue Personnel;

f) Airline Operations Scheduling and Utilization Personnel.

3. Duration: 16 hours of theoretical instruction.

4. Allocation of Instruction Time for Courses:

Article 30. Knowledge Training Program Aviation security for for Enterprises Providing Terminal and Cargo Handling Services

1. Objective: to equip trainees with necessary knowledge on aviation security and methods to handle security situations related to terminal and cargo handling services duties.

2. Target group: management, supervisory staff, and personnel of enterprises providing terminal and cargo handling services.

3. Duration:

a) Aviation Security Knowledge Training for Terminal and Cargo Handling Services Personnel: 16 hours of theory;

b) Aviation Security Knowledge Training for Management and Supervisory Staff of Enterprises Providing Terminal and Cargo Handling Services: 20 hours of theory. Those who have completed the program specified in point a of this clause shall be exempted from corresponding courses.

4. Allocation of Instruction Time for Courses:

a) Aviation Security Knowledge Training for Terminal and Cargo Handling Services Personnel:

b) Aviation Security Knowledge Training for Management and Supervisory Staff of Enterprises Providing Terminal and Cargo Handling Services:

Article 31. Training Program on Aviation Security Knowledge for Air Catering Enterprises Aviation security for air catering enterprises

1. Objective: Equip trainees with necessary knowledge about aviation security and methods to handle aviation security situations related to air catering services.

2. Target Audience: Managers, supervisors, and employees of air catering enterprises.

3. Duration:

a) Training on aviation security knowledge for employees of air catering enterprises working regularly in restricted areas according to the enterprise's aviation security regulations: 14 hours of theoretical instruction;

b) Training on aviation security knowledge for managers and supervisors of air catering enterprises: 20 hours of theoretical instruction. In cases where they have completed the program specified in point a of this clause, they are exempted from corresponding courses.

4. Allocation of Instruction Time for Courses:

Article 32. Training Program on Aviation Security Knowledge for Aircraft Cleaning Service Enterprises

1. Objective: Equip trainees with necessary knowledge about aviation security and methods to handle aviation security situations related to aircraft cleaning service operations.

2. Eligibility:

a) Aircraft cleaning service employees of aircraft cleaning service enterprises;

b) Managers and supervisors of aircraft cleaning service enterprises.

3. Duration:

a) Training on aviation security knowledge for aircraft cleaning service employees: 14 hours of theoretical instruction;

b) Training on aviation security knowledge for managers and supervisors: 18 hours of theoretical instruction. In cases where they have completed the program specified in point a of this clause, they are exempted from corresponding courses.

4. Allocation of Instruction Time for Courses:

a) Program for aircraft cleaning service employees:

Article 33. Training Program on Aviation Security Knowledge for Postal Service Enterprises

1. Objective: Equip trainees with necessary knowledge about aviation security and methods to handle aviation security situations related to postal service operations through air transport.

2. Target Audience: Managers, supervisors, and employees of postal service enterprises through air transport.

3. Duration:

a) Training on aviation security knowledge for employees of postal service enterprises through air transport: 8 hours of theoretical instruction;

b) Training on aviation security knowledge for managers and supervisors of postal service enterprises through air transport: 12 hours of theoretical instruction. In cases where they have completed the program specified in point a of this clause, they are exempted from corresponding courses.

4. Allocation of Instruction Time for Courses:

Article 34. Training Program on Aviation Security Knowledge for Air Service Providers' Security Personnel

1. Objective: Equip security personnel with necessary aviation security knowledge and methods to handle aviation security situations related to their duties.

2. Target Group: Security personnel of enterprises providing airport operation services, air catering services, aircraft fuel supply services, aircraft maintenance and repair facilities, and enterprises providing flight support services.

3. Duration: 16 hours of theoretical instruction.

4. Allocation of Instruction Time for Courses:

 Article 35. Training Program on Aviation Security Knowledge for Personnel Working Regularly in Restricted Areas

1. Objective: Equip trainees with necessary aviation security knowledge and methods to handle aviation security situations within restricted areas.

2. Eligibility:

a) Non-airline service personnel working in restricted areas of airports and airfields;

b) Aircraft technical service personnel engaged in maintenance and repair of equipment working in restricted areas of airports and airfields;

c) Personnel controlling and operating aircraft equipment operating regularly in restricted areas of airports and airfields;

d) Aircraft drivers and refuelers;

đ) Environmental cleaning service personnel working in restricted areas of airports and airfields.

3. Duration: Eight hours of theoretical training.

4. Allocation of Instruction Time for Courses:

Article 36. Duration of Training on Knowledge

The subjects of the aviation security knowledge training programs stipulated in this Circular must be trained in aviation security knowledge within three months from the date of signing the employment contract.

Section 2

REGULAR TRAINING PROGRAM

 

 Article 37. Periodic Training Program on Aviation Security for Flight Crews

1. Objective: Update trainees' knowledge on aviation security and methods to handle aviation security situations related to their duties.

a) Training on air security knowledge for pilots and cabin crew: 32 hours of theoretical study, except for the subjects specified in point b, Clause 3 of this Article;

3. Duration: Eight hours of theoretical training.

4. Allocation of Instruction Time for Courses:

Article 38. Periodic Training Program on Aviation Security for Airline Managers

1. Objective: Update trainees' knowledge on aviation security and methods to handle aviation security situations related to their duties.

2. Target Group: Managers certified as having completed aviation security knowledge training courses by airlines operating in Vietnam.

3. Duration: Eight hours of theoretical training.

4. Allocation of Instruction Time for Courses:

 

Article 39. Periodic Aviation Security Training Program for Supervisors, Managers, and Representatives of Airlines

1. Objective: Update trainees' knowledge on aviation security and methods to handle aviation security situations related to their duties.

2. Target group: supervisors, managers, and representatives of airlines operating in Vietnam who have completed the aviation security knowledge training course and obtained certification.

3. Duration: Eight hours of theoretical training.

4. Allocation of Instruction Time for Courses:

Article 40. Periodic Aviation Security Training Program for Ground Operations Staff of Airlines

1. Objective: to update trainees with necessary aviation security knowledge and methods to handle security situations related to their duties.

2. Target group: ground operations staff of airlines operating in Vietnam who have completed the aviation security knowledge training course and obtained certification.

3. Duration: Eight hours of theoretical training.

4. Allocation of Instruction Time for Courses:

Article 41. Periodic Aviation Security Training Program for Ground Handling Staff Serving Flights

1. Objective: to update trainees with aviation security knowledge and methods to handle security situations related to their duties.

2. Target group: ground service personnel serving flights at Vietnamese airports.

3. Duration: Eight hours of theoretical training.

4. Allocation of Instruction Time for Courses:

Article 42. Periodic Aviation Security Training Program for Maintenance Personnel repair, maintenance aircraft

1. Objective: Update trainees' knowledge on aviation security and methods to handle aviation security situations related to their duties.

2. Target group: personnel involved in aircraft and aircraft equipment repair and maintenance.

3. Duration: Eight hours of theoretical training.

4. Allocation of Instruction Time for Courses:

Article 43. Periodic Aviation Security Training Program for Air Traffic Control Personnel

1. Objective: to update trainees with necessary aviation security knowledge and methods to handle security situations related to their duties.

2. Eligibility:

a) Non-routine personnel;

b) Aviation Information Personnel;

c) Air traffic control information officers, air traffic controllers, and air traffic surveillance personnel;

d) Aviation Meteorological Personnel;

e) Aviation Search and Rescue Personnel;

f) Airline Operations Scheduling and Utilization Personnel.

3. Duration: Eight hours of theoretical training.

4. Allocation of Instruction Time for Courses:

Article 44. Periodic Aviation Security Training Program for for Enterprises Providing Terminal and Cargo Handling Services

1. Objective: to update trainees with necessary aviation security knowledge and methods to handle security situations related to their duties.

2. Target group: management, supervisory staff, and personnel of enterprises providing terminal and cargo handling services.

3. Duration: 8 hours of theoretical instruction.

4. Allocation of Instruction Time for Courses:

Article 45. Periodic Aviation Security Training Program for Air Catering Service Providers

1. Objective: to update trainees with necessary aviation security knowledge and methods to handle security situations related to their duties.

2. Target Audience: Managers, supervisors, and employees of air catering enterprises.

Article 46. Periodic Aviation Security Training Program for Aviation security for Aircraft Cleaning Service Providers

1. Objective: to update trainees with aviation security knowledge and methods to handle security situations related to their duties.

2. Target group: management, supervisory staff, and cleaning personnel of aircraft cleaning service providers.

3. Duration: Eight hours of theoretical training.

4. Allocation of Instruction Time for Courses:

Article 47. Periodic Aviation Security Training Program for Aviation security for Postal Service Providers

1. Objective: to update trainees with necessary aviation security knowledge and methods to handle security situations related to their duties.

2. Target Audience: Managers, supervisors, and employees of postal service enterprises through air transport.

3. Duration: Eight hours of theoretical training.

4. Allocation of Instruction Time for Courses:

Article 48. Periodic Aviation Security Training Program for Security Personnel of Airline Service Providers

1. Objective: to update trainees with necessary aviation security knowledge and methods to handle security situations related to their duties.

2. Target Group: Security personnel of enterprises providing airport operation services, air catering services, aircraft fuel supply services, aircraft maintenance and repair facilities, and enterprises providing flight support services.

3. Duration: Eight hours of theoretical training.

4. Allocation of Instruction Time for Courses:

Article 49. Periodic Aviation Security Training Program for Aviation security Persons Working Regularly in Restricted Areas

1. Objective: to update trainees with necessary aviation security knowledge and methods to handle security situations related to their duties.

2. Eligibility:

a) Non-airline service personnel working in restricted areas of airports and airfields;

b) Aircraft technical service personnel engaged in maintenance and repair of equipment working in restricted areas of airports and airfields;

c) Personnel controlling and operating aircraft equipment operating regularly in restricted areas of airports and airfields;

d) Aircraft drivers and refuelers;

đ) Environmental cleaning service personnel working in restricted areas of airports and airfields.

3. Duration: Eight hours of theoretical training.

4. Allocation of Instruction Time for Courses:

Article 50. Duration of Periodic Training

1. Flight crew members must undergo periodic training once every one year.

2. The target groups specified from Article 38 to Article 49 of this Circular must undergo periodic training once every three years.

TRAINING ORGANIZATION

AVIATION SECURITY KNOWLEDGE

Article 51. Textbooks and materials

1. Textbooks and materials for aviation security knowledge training must ensure the content stipulated in this Circular and the standards and practical recommendations of the International Civil Aviation Organization.

2. Textbooks and materials for aviation security knowledge training must be managed as restricted security documents.

Article 52. Instructors teaching aviation security knowledge

1. Standards for instructors teaching aviation security knowledge:

a) Hold a certificate of pedagogical training or a certificate of completion of an aviation security instructor training course from the International Civil Aviation Organization or the International Air Transport Association;

b) Hold a certificate of training for instructors teaching aviation security knowledge as prescribed in point b, Clause 4, Article 9 of this Circular and have five (5) years of work experience in the aviation industry.

2. Based on the standards prescribed in Clause 1 of this Article, units shall compile a list of instructors teaching aviation security knowledge to report to the Vietnam Civil Aviation Authority for inspection and supervision.

Article 53. Examination and Issuance of Training Certificates Aviation security

1. The examination for issuing certificates of aviation security knowledge training shall be conducted through one of the following methods: multiple choice questions, written test, or oral examination. The examination score will be calculated on a scale of 100 points.

2. Trainees who achieve a score of 80 points or higher will be issued a certificate of successful completion of the course according to the model prescribed in Appendix 2 attached to this Circular.

3. The training record for aviation security knowledge includes:

a) Examination results at the end of the course;

b) Decision of the head of the training unit recognizing the trainee's successful completion of the course;

c) Certificate of successful completion of the course (a copy).

4. The training record for periodic aviation security knowledge training includes:

a) Examination results at the end of the course;

b) Decision of the head of the training unit recognizing the trainee's successful completion of the course.

 

Chapter IV

RESPONSIBILITIES OF AUTHORITIES AND ORGANIZATIONS

IN TRAINING AND REHABILITATION, TRAINING

AIRCRAFT SECURITY

         

Article 54. Responsibilities of the Vietnam Civil Aviation Authority

1. Guide and supervise training institutions and organizations, entities, and individuals related to the implementation of this Circular in training and professional development of aviation security control forces.

2. Organize inspections of training, rehabilitation, and aviation security training activities of training institutions and organizations for aviation security personnel, enterprises, and units within the aviation industry.

3. International cooperation in aviation security training in Vietnam.

Article 55. Responsibilities of Training Institutions and Organizations for Professional Development of Aviation Security Personnel

1. Implement training, rehabilitation, and professional development of aviation security control forces, and aviation security knowledge training as prescribed in this Circular.

2. Compile a list of instructors teaching aviation security control forces and report to the Vietnam Civil Aviation Authority.

3. Develop, update, and issue training programs for aviation security control forces and aviation security knowledge training as prescribed in this Circular and report to the Vietnam Civil Aviation Authority.

4. Organize the compilation and review of textbooks and materials for training and professional development of aviation security control forces and aviation security knowledge training as prescribed in this Circular.

5. Implement measures to improve the quality of aviation security training; provide professional development and update aviation security knowledge, legal knowledge, and teaching skills for aviation security instructors.

6. Summarize the results of aviation security training activities and report to the Vietnam Civil Aviation Authority before December 15 each year.

7. Retain training records for aviation security training in accordance with the laws on archiving.

8. Be subject to inspection, audit, and supervision by the Ministry of Transport, the Vietnam Civil Aviation Authority, and other competent state agencies as prescribed by current regulations.

Article 56. Responsibilities of enterprises and units in training, upgrading, and security instruction for aviation

1. Enterprises and units in the aviation industry shall be responsible for:

a) Compiling a list of instructors teaching aviation security knowledge and developing training curricula for aviation security knowledge to report to the Civil Aviation Administration of Vietnam;

b) Implementing training on aviation security knowledge for internal staff;

c) Arranging for individuals specified in this Circular to participate in training, upgrading, and security instruction programs for aviation in accordance with regulations;

d) Retaining training records for aviation security knowledge in compliance with legal provisions on recordkeeping;

đ) Implementing measures to enhance the quality of aviation security training; upgrading and updating aviation security knowledge, legal knowledge, and teaching skills for aviation security instructors;

e) Annually reporting to the Civil Aviation Administration of Vietnam on the results of aviation security knowledge training before December 15;

g) Being subject to inspection, audit, and supervision by the Ministry of Transport, the Civil Aviation Administration of Vietnam, and other competent state agencies in accordance with current regulations;

2. Enterprises and units with aviation security personnel involved in air transport of dangerous goods must implement dangerous goods training in accordance with civil aviation safety laws concerning aircraft and aircraft operations;

3. Enterprises and units without aviation security knowledge instructors or curricula must cooperate with enterprises and units that meet the requirements for instructors and curricula to organize aviation security knowledge training courses for their own enterprises and units;

 

 

Chapter V

IMPLEMENTING PROVISIONS

Article 57. Effectiveness

This Circular takes effect from January 15, 2018, and replaces Circular No. 29/2014/TT-BGTVT dated July 29, 2014, issued by the Minister of Transport regarding training, upgrading, and security instruction for aviation;

Article 58. Implementation Organization

The Director of the Ministry's Office, the Director of the Ministry's Inspectorate, Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, and Heads of organizations and individuals concerned are responsible for implementing this Circular./.
