CIRCULAR
Issuing national technical regulations on imported waste for production materials
from foreign countries

Pursuant to the Environmental Protection Law dated November 17, 2020;
Pursuant to the Atomic Energy Law dated June 3, 2008;
Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;
Pursuant to the Standards and Technical Regulations Law dated June 29, 2006;
Pursuant to Decree No. 142/2020/NĐ-CP dated December 9, 2020 of the Government stipulating the conduct of radiation work and support services for atomic energy applications;
Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing implementation of certain provisions of the Standards and Technical Regulations Law;
Pursuant to Decree No. 78/2018/NĐ-CP dated May 16, 2018 of the Government amending and supplementing certain provisions of Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing implementation of certain provisions of the Standards and Technical Regulations Law;
Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;
Pursuant to Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government amending and supplementing certain provisions of Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;
Pursuant to Decree No. 154/2018/NĐ-CP dated November 9, 2018 of the Government amending, supplementing, and abolishing certain provisions regarding investment and business conditions under the management of the Ministry of Science and Technology and certain inspection regulations;
Pursuant to Decree No. 68/2022/NĐ-CP dated September 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
Pursuant to Decree No. 08/2022/NĐ-CP dated January 10, 2022 of the Government detailing certain provisions of the Law on Environmental Protection;
Pursuant to Decision No. 13/2023/QĐ-TTg dated May 22, 2023 of the Prime Minister promulgating the List of imported waste permitted for importation from foreign countries as production materials;
At the proposal of the Director of the Environmental Pollution Control Department;
The Minister of Natural Resources and Environment issues this Circular to issue national technical regulations on imported waste from foreign countries for production materials.
Article 1. Attached to this Circular are three (03) national technical regulations on imported waste from foreign countries for production materials, including:
1. QCVN 31:2024/BTNMT - National technical regulation on imported iron, steel, and cast scrap for production materials;
2. QCVN 65:2024/BTNMT - National technical regulation on imported glass scrap for production materials;
3. QCVN 66:2024/BTNMT - National technical regulation on imported colored metal scrap for production materials.
Article 2. Implementation clause
This Circular shall take effect six (06) months from the date of issuance.
From the date this Circular takes effect, the following circulars shall cease to be effective, except as provided in Clause 4 of this Article:
a) Circular No. 09/2018/TT-BTNMT dated September 14, 2018 of the Minister of Natural Resources and Environment promulgating national technical regulations on environmental protection;
b) Circular No. 01/2019/TT-BTNMT dated March 8, 2019 of the Minister of Natural Resources and Environment stipulating the cessation of effectiveness of certain provisions of Circular No. 08/2018/TT-BTNMT dated September 14, 2018 and Circular No. 09/2018/TT-BTNMT dated September 14, 2018 of the Minister of Natural Resources and Environment promulgating national technical regulations on environmental protection.
From the date this Circular takes effect, QCVN 31:2018/BTNMT - National technical regulation on environmental protection for imported iron and steel scrap for production materials issued together with Circular No. 08/2018/TT-BTNMT dated September 14, 2018 of the Minister of Natural Resources and Environment promulgating national technical regulations on environmental protection shall cease to be effective, except as provided in Clause 4 of this Article.
Transitional Provisions:
a) Iron, steel, glass, and colored metal scrap permitted for importation from foreign countries according to environmental protection certificates issued by competent authorities before the effective date of Decision No. 13/2023/QĐ-TTg dated May 22, 2023 of the Prime Minister promulgating the List of imported waste permitted for importation from foreign countries as production materials shall continue to apply the technical regulations QCVN 31:2018/BTNMT, QCVN 65:2018/BTNMT, QCVN 66:2018/BTNMT (issued together with Circular No. 08/2018/TT-BTNMT dated September 14, 2018 and Circular No. 09/2018/TT-BTNMT dated September 14, 2018 of the Minister of Natural Resources and Environment promulgating national technical regulations on environmental protection) until the expiration of the environmental permit component or environmental permit, unless organizations or individuals importing scrap from foreign countries for production materials request application according to this Circular;
b) Imported iron, steel, glass, and colored metal scrap shipments that have completed customs procedures before the effective date of this Circular shall continue to be reviewed and resolved according to the provisions of Circular No. 08/2018/TT-BTNMT dated September 14, 2018 and Circular No. 09/2018/TT-BTNMT dated September 14, 2018 of the Minister of Natural Resources and Environment promulgating national technical regulations on environmental protection, unless organizations or individuals importing scrap from foreign countries for production materials request application according to this Circular.
Article 3. Implementation Organization
1. Ministries, ministerial-level agencies, government agencies, provincial People's Committees, and related organizations and individuals are responsible for implementing this Circular.
2. In case the legal normative documents serving as the basis cited in this Circular are amended, supplemented, or replaced, they shall be applied according to the amended, supplemented, or replacing legal normative documents./.
