CIRCULAR

Guidelines for financial regulations to prevent and control avian influenza and foot-and-mouth disease in livestock

Based on Decree No. 221/2013/NĐ-CP dated December 30, 2013 of the Government stipulating the system of applying administrative handling measures for placement in compulsory drug rehabilitation facilities (hereinafter referred to as Decree No. 221/2013/NĐ-CP);

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 738/QĐ-TTg dated May 18, 2006 of the Prime Minister on providing financial support for preventing and controlling foot-and-mouth disease in livestock;

The Ministry of Finance hereby provides guidance as follows:

I- GENERAL PROVISIONS

1. The subjects eligible for state budget financial support for preventing and controlling foot-and-mouth disease in livestock include:

1.1. Households and individuals raising pigs, cattle, buffalo, goats, sheep, deer, and antelopes who must implement mandatory vaccination against foot-and-mouth disease according to the guidelines of the Ministry of Agriculture and Rural Development.

1.2. Households and individuals, farms, and cooperatives raising livestock that must destroy livestock infected with foot-and-mouth disease as prescribed by the Ministry of Agriculture and Rural Development.

1.3. State-owned livestock breeding facilities.

1.4. Forces participating in preventing and controlling foot-and-mouth disease in livestock.

2. The state budget will provide support to the subjects mentioned in Clause 1, Part I of this Circular from May 1, 2006 until the competent authority announces the end of the epidemic.

II- SPECIFIC PROVISIONS

1. The content and level of financial support for preventing and controlling foot-and-mouth disease in livestock include:

1.1. Vaccine purchase costs (including transportation costs to the province as notified by the Ministry of Agriculture and Rural Development) shall be covered by the state budget to support households and individuals raising livestock as stipulated in Clause 1, Article 1 of Decision No. 738/QĐ-TTg dated May 18, 2006 of the Prime Minister on providing financial support for preventing and controlling foot-and-mouth disease in livestock.

1.2. Costs for vaccination work:

- Forces participating in vaccination and disease prevention work for foot-and-mouth disease in livestock shall be compensated at an average rate of VND 1,000 per pig vaccinated and VND 2,000 per head for other livestock. If the daily compensation for such forces is less than VND 50,000, it shall be paid at the rate of VND 50,000 per person per day.

1.3. Only support will be provided to forces performing quarantine checkpoint duties and chemical disinfection tasks in affected areas:

Forces performing quarantine checkpoint duties and chemical disinfection tasks in affected areas, as directed by local authorities, shall be supported up to VND 50,000 per person per working day and VND 100,000 per person per holiday or public holiday.

1.4. Costs for destroying livestock, with an average cost of VND 150,000 per head for cattle and buffalo, and VND 50,000 per head for pigs, goats, sheep, deer, and antelopes during the epidemic period as prescribed by the Ministry of Agriculture and Rural Development, to carry out the following tasks:

a) Purchase of chemicals for disinfection, sterilization, cleaning of animal shelters, environment, etc.; purchase of protective clothing for forces involved in the destruction of livestock according to the guidelines of the Ministry of Agriculture and Rural Development.

b) Compensation for forces directly involved in the destruction of livestock, with a maximum support rate of VND 50,000 per person per working day and VND 100,000 per person per holiday or public holiday.

Based on the support levels specified in Points 1.2, 1.3, and Subparagraph b of Point 1.4, Clause 1, Section II of this Circular and the actual situation in the locality (scope and severity of the epidemic, travel area, size of the livestock herd, number of staff participating in disease prevention and control, etc.), the Chairman of the Provincial People's Committee (hereinafter referred to as the Chairman of the Provincial People's Committee) shall decide specifically on the compensation levels for forces participating in disease prevention and control in the locality.

2. Direct financial support for households, individuals, farms, and cooperatives raising livestock that must destroy their livestock:

2.1. Households, individuals, farms, and cooperatives raising livestock that must destroy their livestock according to the guidelines of the Ministry of Agriculture and Rural Development shall be supported at the following rates:

- For pigs that must be destroyed: An average support rate of VND 10,000 per kilogram live weight.

- For cattle, buffalo, goats, sheep, deer, and antelopes that must be destroyed: An average support rate of VND 12,000 per kilogram live weight.

2.2. Based on the average support rates specified in Point 2.1, Clause 2, Section II of this Circular and based on the weight of the livestock that must be destroyed, the Chairman of the Provincial People's Committee shall specify the specific direct support levels for households, individuals, farms, and cooperatives raising livestock in accordance with the actual situation in the locality.

2.3. Livestock that must be destroyed must have confirmation from local authorities and veterinary agencies (regarding the quantity and weight of the livestock) as the basis for payment of support.

3. Sources of funds to ensure the prevention and control of foot-and-mouth disease:

3.1. The central budget will cover 100% of vaccine purchase costs (including transportation costs) for the containment zone; vaccine purchase costs and disease prevention and control costs for state-owned livestock breeding facilities, and 50% of vaccine purchase costs (including transportation costs) for the buffer zone to implement mandatory vaccination for livestock.

3.2. The central budget will support local budgets for the prevention and control of foot-and-mouth disease as specified in Clause 1 (excluding vaccine purchase costs) and Clause 2, Section II of this Circular according to the principle:

a) Providing 100% of the prevention and control costs for foot-and-mouth disease for provinces newly adjusted in administrative boundaries with additional balance funds from the central budget.

b) Providing 50% of the prevention and control costs for foot-and-mouth disease for the remaining provinces. In cases where the local budget (including vaccine purchase costs for the buffer zone) exceeds 50% of the local budget reserve for 2006 assigned by the Prime Minister, the central budget will supplement the excess amount over 50% of the local budget reserve for 2006 to ensure sufficient funding for the province.

c) The cities of Hanoi and Ho Chi Minh City shall proactively use their local budget reserves to implement.

d) For localities with incurred expenses for foot-and-mouth disease prevention and control work that are not significant (under 1 billion VND), the locality shall proactively use its local budget to address the issue.

3.3. The local budget shall ensure:

a) Funding for purchasing vaccines and for foot-and-mouth disease prevention and control for state-owned livestock breeding facilities under local management.

b) Supporting 50% of the funding for purchasing vaccines for households and individuals raising livestock as specified in Point 1.1, Clause 1, Section 1 of this Circular to vaccinate livestock in buffer zones according to mandatory vaccination regulations set by the Ministry of Agriculture and Rural Development; supporting 50% of the funding for culling livestock for the subjects as stipulated in Clause 2, Section II of this Circular; ensuring 50% of the funding for tasks specified in Points 1.2, 1.3, and 1.4, Clause 1, Section II of this Circular.

4. The establishment, decision-making, allocation, and settlement of the budget for ensuring foot-and-mouth disease prevention and control work for livestock shall be carried out in accordance with the State Budget Law and guiding documents.

5. Reporting system:

- Monthly and at the end of each outbreak, the Chairman of the Provincial People's Committee shall direct relevant agencies to compile the situation and results of prevention and control efforts; the amount of funds spent to ensure prevention and control work (details by source, level of expenditure, specific content of expenditure according to each type of livestock), report to the Ministry of Finance and the Ministry of Agriculture and Rural Development to determine the level of support from the central budget for each province and centrally-administered city, and consolidate reports to the Prime Minister on implementation results.

- The Ministry of Agriculture and Rural Development shall be responsible for compiling and reporting on the use of vaccines (details by each type of livestock, vaccine type, vaccination areas of localities and subordinate units), and the funding for foot-and-mouth disease prevention and control implemented by subordinate units of the Ministry of Agriculture and Rural Development, to be reported to the Ministry of Finance for consolidation and reporting to the Prime Minister as prescribed.

III. IMPLEMENTATION ORGANIZATION

1. Provincial People's Committees and People's Committees of centrally governed cities shall be responsible for:

1.1. Direct the Department of Agriculture and Rural Development to coordinate with relevant agencies to determine the demand for vaccine quantities and report to the Ministry of Agriculture and Rural Development and the Ministry of Finance as a basis for providing vaccines for vaccination.

1.2. Direct the Department of Finance to coordinate with the Department of Agriculture and Rural Development and relevant agencies to determine the funding needs for foot-and-mouth disease prevention and control work and develop financial plans for implementation. At the same time, report to the Provincial People's Committee to proactively use local budget sources and lawful financial resources to promptly meet the funding requirements for foot-and-mouth disease prevention and control for livestock as stipulated in this Circular.

1.3. Direct departments, sectors, and people's committees at all levels to effectively carry out foot-and-mouth disease prevention and control work for livestock; use the funding for prevention and control work efficiently and for the intended purpose and target groups; Direct people's committees at all levels, especially at the commune level, to cooperate with relevant agencies in the locality to publicly disclose national support policies; the quantity of foot-and-mouth disease vaccines used in the commune; the level of support for households raising livestock that must be culled before and after the competent authority's support decision is issued through mass media, in the commune, in the village, posted at the commune people's committee office, and in the village.

2. This Circular takes effect 15 days from the date of publication in the Official Gazette. During implementation, if there are difficulties, please report to the Ministry of Finance for review and appropriate amendments.
