Provisions on the evaluation and classification of "Learning Community" at the commune level

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 07/2013/NĐ-CP dated January 9, 2013 amending Point b Clause 13 Article 1 of Decree No. 31/2011/NĐ-CP dated May 11, 2011 amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

Pursuant to Decision No. 89/QĐ-TTg dated January 9, 2013 of the Prime Minister approving the Project "Building a Learning Society for the period 2012-2020";

At the request of the Director of the Department of Continuing Education;

After reaching consensus with the Vietnam Association for Promoting Education through Circular No. 419/CV-HKHVN dated November 6, 2014, the Minister of Education and Training issues this Circular providing for the evaluation and classification of "Learning Community" at the commune level.

Article 1. Scope of Regulation and Applicability

1. This Circular provides for the evaluation and classification of "Learning Community" at the commune level, including criteria, files, procedures, responsibilities for implementing the evaluation and classification of "Learning Community".

2. This Circular applies to communes, wards, towns (hereinafter referred to collectively as the commune level), relevant agencies, organizations, and individuals.

3. This Circular does not apply to the evaluation and classification of "Learning Community" at the village, hamlet, tribal group, neighborhood, and equivalent levels.

Article 2. Purpose

1. To encourage and motivate the movement of building "Learning Community" at the commune level; to create conditions and opportunities for everyone to engage in regular and lifelong learning.

2. To assist the commune level in self-evaluation to develop plans, adjust, and supplement plans for building "Learning Community" in accordance with local realities.

3. To assist people's committees at all levels in evaluating the current status of building "Learning Community" at the commune level and using it as a basis to propose appropriate measures to guide according to the actual situation of the locality.

Article 3. Criteria forevaluation and classification of "Learning Community"

1. Leadership and guidance by the Party Committee and administrative authorities at the commune level.

2. Activities of the steering committee for building a learning society at the commune level.

3. Participation and coordination of departments, mass organizations, and organizations within the commune level.

4. Network and activities of educational institutions and cultural facilities within the commune level.

5. Results of universal education and eradication of illiteracy.

6. Social equity in education.

7. Results of regular training and development of commune-level cadres and civil servants.

8. Results of regular learning of workers aged 15 and above.

9. Results of building "Scholarly Families"; "Promotion of Learning Communities/Village Learning Communities and Equivalent".

10. Results of building villages, hamlets, tribal groups, neighborhoods, and equivalents recognized as "Model Cultural Residential Areas".

11. Reduction in the rate of poor households.

12. Implementation of gender equality.

13. Ensuring hygiene and environmental protection.

14. Community health care.

15. Ensuring public security and social safety.

Article 4. Evaluation and Classification of "Learning Community"

1. The evaluation and classification of "Learning Community" at the commune level must be based on the results achieved, verified through appropriate evidence corresponding to the criteria stipulated in Article 3 of this Circular. Each criterion has specific contents to be evaluated at different levels of achievement, and the method of scoring is detailed in the Appendix "Guidelines for Evaluating and Scoring 'Learning Community' at the Commune Level" attached to this Circular.

2. The total maximum score for all criteria is 100 points. Criteria without appropriate evidence shall not be scored.

3. Classification

a) Excellent: Total score from 85 to 100, with no criterion receiving a score of 0;

b) Good: Total score from 70 to 84, with no criterion receiving a score of 0;

c) Average: Total score from 50 to 69, with no criterion receiving a score of 0;

d) Unsatisfactory: All other cases.

4. The time for inspection, evaluation, and classification of "Learning Community" at the commune level shall be conducted in December each year.

Article 5. Documentation for Evaluation and Classification of "Learning Community"

1. Documentation of the People's Committee at the commune level requesting the People's Committee at the district level to inspect, evaluate, and classify "Learning Community"

a) The proposal of the People's Committee at the commune level;

b) Report (accompanied by appropriate evidence corresponding to the criteria) on the evaluation of the results of building "Learning Community" at the commune level, confirmed by the Chairman of the People's Committee at the commune level;

c) Minutes of self-inspection, evaluation, and classification of "Learning Community" at the commune level;

Quantity of documentation: 01 (one) set.

2. Documentation of the Association for Promoting Education at the district level submitting to the Chairman of the People's Committee at the district level for decision to recognize the results of evaluation and classification of "Learning Community" at the commune level

a) The proposal of the Association for Promoting Education at the district level;

b) Minutes of inspection, evaluation, and classification of "Learning Community" at the commune level;

Quantity of documentation: 01 (one) set.

Article 6. Procedure for Evaluation and Classification of "Learning Community"

1. The Association for Promoting Education at the commune level shall take the lead in developing a plan for self-inspection and evaluation of the results of building "Learning Community" at the commune level, submit it to the Chairman of the People's Committee at the commune level for approval, and coordinate with relevant units to implement the approved plan.

2. Based on the results of self-inspection, the Association for Promoting Education at the commune level shall prepare the documentation and submit it to the Chairman of the People's Committee at the commune level for signature on the proposal requesting the People's Committee at the district level to inspect, evaluate, and classify the commune level.

3. Within 10 working days from the date of receipt of complete and valid documentation from the People's Committee at the commune level, the Chairman of the People's Committee at the district level shall instruct the Association for Promoting Education to develop a plan for inspection, evaluation, and classification of "Learning Community" at the commune level and submit it to the Chairman of the People's Committee at the district level for approval.

4. Based on the plan approved by the Chairman of the People's Committee at the district level, the Association for Promoting Education shall coordinate with relevant units to organize the inspection, evaluation, and classification of "Learning Community" at the commune level.

5. Within 5 working days from the date of completion of the inspection, the Association for Promoting Education shall prepare the documentation and submit it to the Chairman of the People's Committee at the district level for decision to recognize the results of evaluation and classification of "Learning Community" at the commune level and publicize them openly.

Article 7. Responsibility for Implementation

1. Provincial People's Committee

a) Direct relevant agencies to build and implement plans for constructing a learning society in the locality;

b) Based on the criteria and procedures for evaluating and classifying "Learning Community" at the commune level stipulated in this Circular and the Appendix on Guidelines for Evaluating and Scoring "Learning Community" at the commune level attached hereto, the People's Committee at the provincial level shall guide the People's Committee at the district level and relevant units to implement in accordance with the characteristics and circumstances of the locality.

2. Department of Education and Training

a) Take the lead and coordinate with the Association for Promoting Education at the provincial level and relevant agencies to advise the People's Committee at the provincial level on guiding the implementation of this Circular in the locality;

b) Organize inspections and audits of the evaluation and classification of "Learning Community" at the commune level within its jurisdiction.

3. The People's Committee at the district level shall direct the Association for Promoting Education at the district level, the Department of Education and Training, and relevant agencies to organize inspections, evaluations, and recognition of the results of building "Learning Community" at the commune level.

4. The People's Committee at the commune level shall direct the Association for Promoting Education at the commune level to cooperate with relevant units to build and implement plans for constructing "Learning Community" at the commune level; regularly consolidate and improve the results achieved.

Article 8. Implementation clause

1. This Circular takes effect from January 25, 2015.

2. The Heads of the Office, Directors of the Department of Continuing Education, Heads of relevant units under the Ministry of Education and Training; Chairmen of the People's Committees of provinces and centrally-administered cities; Directors of Departments of Education and Training; related agencies, organizations, and individuals are responsible for implementing this Circular./.
