Circular No. 44/2016/TT-BTTTT amends and supplements certain contents of Circular No. 27/2010/TT-BTTTT dated November 24, 2010, issued by the Minister of Information and Communications on the frequency band planning for the 2500-2690 MHz mobile communication system IMT in Vietnam.

AMENDMENTS AND SUPPLEMENTS AMENDMENTS AND COMPLEMENTS TO CERTAIN PROVISIONS OF THE CIRCULAR NO. 27/2010/TT-BTTTT DATED NOVEMBER 24, 2010 ISSUED BY THE MINISTER OF INFORMATION AND COMMUNICATION ON THE RADIO FREQUENCY BAND PLANNING FOR THE IMT MOBILE COMMUNICATION SYSTEM IN VIETNAM WITH THE BANDWIDTH OF 2500-2690 MHZ

WHEREAS, the Radio Frequency Law dated November 23, 2009;No. vng on November 23, 2009;

WHEREAS, Decision No. 71/2013/QD-TTg dated November 21, 2013 of the Prime Minister on the National Radio Frequency Plan;No. national radio frequency;

BASED ON THE DECREE NUMBER 05/2022/ND-CP dated January 7, 2022 amending and supplementing certain provisions of the Decree Number 53/2019/ND-CP dated June 17, 2019 of the Government; WHEREAS, Decree No. 132/2013/NĐ-CP dated October 16, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

AT THE PROPOSAL OF THE DIRECTOR OF THE NATIONAL RADIO FREQUENCY AGENCY;No. vng each with a width of 10 MHz.

THE MINISTER OF INFORMATION AND COMMUNICATIONS ISSUES THIS CIRCULAR TO AMEND AND SUPPLEMENT CERTAIN PROVISIONS OF CIRCULAR NO. 27/2010/TT-BTTTT DATED NOVEMBER 24, 2010 OF THE MINISTER OF INFORMATION AND COMMUNICATIONS ON THE RADIO FREQUENCY BAND PLANNING FOR THE IMT MOBILE COMMUNICATION SYSTEM IN VIETNAM WITH THE BANDWIDTH OF 2500-2690 MHZ.No. content of CircularNo. 27/2010/TT-BTTTT dated November 24, 2010 issued by the Minister of Information and Communications regarding the Radio Frequency Band Planning from 2500-2690 MHz for the IMT Mobile Communication System in Vietnam.

Article 1. Amend and supplement

"b) The radio frequency band of 2500-2690 MHz shall be allocated as follows:

For each operator of the IMT mobile communication system using the frequency division duplex (FDD) mode, one block A-A', A2-A2', B-B', C-C' according to specific provisions in the license for the use of the radio frequency band.1-A1’; A2-A2’; B-B’; C-C’ in accordance with specific provisions in the license for the use of the frequency band.

For the operator of the IMT mobile communication system using the time division duplex (TDD) mode, block D according to specific provisions in the license for the use of the radio frequency band.

d) Operators of the IMT mobile communication system licensed within the blocks A-A', A2-A2', B-B', C-C' and D shall cooperate with each other in the use of radio frequencies and apply measures to prevent harmful interference."1-A1’; A2-A2’; B-B’; C-C’ and D shall be responsible for coordinating with each other in the use of radio frequencies and applying measures to prevent harmful interference.”

Article 2. Effective date: January 02, 2017.

The Director of the Office, the Director of the National Radio Frequency Agency, the heads of agencies and units under the Ministry of Information and Communications, and related organizations and individuals are responsible for implementing this Circular.

3. In the course of implementation, if there are difficulties, organizations and individuals should promptly report to the Ministry of Information and Communications (National Radio Frequency Agency) for guidance or consideration and resolution.
