Guidelines for issuing visas, extending temporary residence permits, and issuing residence cards for foreigners in Vietnam under the authority of the Ministry of Foreign Affairs
Circular No. 04/2016/TT-BNG dated June 30, 2016, issued by the Minister of Foreign Affairs, guiding procedures for issuing visas, extending temporary residence permits, and issuing residence cards for foreigners in Vietnam under the authority of the Ministry of Foreign Affairs, effective from September 1, 2016, has been amended and supplemented by:

Pursuant to the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam dated June 16, 2014;
Pursuant to the Law on Legislative Acts dated June 3, 2008;
Pursuant to Decree No. 58/2013/NĐ-CP dated June 11, 2013, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs;
Pursuant to Decree No. 64/2015/NĐ-CP dated August 6, 2015, of the Government stipulating mechanisms for coordination among ministries, ministerial-level agencies, provincial people's committees, and centrally governed municipalities in managing entry, exit, transit, and residence of foreigners in Vietnam;
The Minister of Foreign Affairs issues this Circular guiding procedures for issuing visas, residence cards, and extending temporary residence permits for foreigners in Vietnam under the authority of the Ministry of Foreign Affairs[1].
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular guides certain contents regarding the issuance of visas, extension of temporary residence permits, and issuance of residence cards for foreigners in Vietnam under the authority of the Ministry of Foreign Affairs as prescribed in Clause 1, Clause 2, Clause 3, and Clause 4 of Article 8 of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam (hereinafter referred to as the Law on Entry and Exit).
Article 2. Applicability
This Circular applies to foreigners within the management authority of the Ministry of Foreign Affairs entering and residing in Vietnam and relevant agencies, organizations, and individuals.
Chapter II
AUTHORITY AND PROCEDURES FOR ISSUING VISAS, EXTENDING TEMPORARY RESIDENCE PERMITS, AND ISSUING RESIDENCE CARDS
Article 3. Authority of relevant agencies in issuing visas, extending temporary residence permits, and issuing residence cards
1. The Consular Department, Ministry of Foreign Affairs (hereinafter referred to as the Consular Department) receives and processes applications/notifications for issuing visas and extending temporary residence permits for foreigners as prescribed in Clause 1, Clause 2, Clause 3, and Clause 4 of Article 8 of the Law on Entry and Exit.
2.[2] The National Reception and Foreign Language Interpretation Department, Ministry of Foreign Affairs[3] receives and processes applications for issuing residence cards for foreigners as prescribed in Clause 3 of Article 8 of the Law on Entry and Exit (excluding members of foreign diplomatic missions with offices south of Da Nang City and their spouses, children under 18 years old, and accompanying domestic helpers during their term of service).
3.[4] The Department of Foreign Affairs, Ho Chi Minh City, Ministry of Foreign Affairs (hereinafter referred to as the Department of Foreign Affairs, Ho Chi Minh City):
a) Receives and processes applications/notifications for issuing visas and extending temporary residence permits for foreigners as prescribed in Clause 1, Clause 2, Clause 3, and Clause 4 of Article 8 of the Law on Entry and Exit in provinces and cities south of Da Nang City.
b) Receives and processes applications for issuing residence cards for members of foreign diplomatic missions in provinces and cities south of Da Nang City and their spouses, children under 18 years old, and accompanying domestic helpers during their term of service.
4. Overseas representative offices of Vietnam:
a) Receive applications/notifications for issuing visas according to Clause 2 of Article 4 of this Circular, passports or travel documents equivalent to passports (hereinafter referred to as passports), and visa application forms (according to Model NA1 issued together with Circular No. 04/2015/TT-BCA dated January 5, 2015, of the Ministry of Public Security stipulating models of documents related to entry, exit, and residence of foreigners in Vietnam - hereinafter referred to as Circular No. 04/2015/TT-BCA) of foreigners as prescribed in Clause 1, Clause 2, Clause 3, and Clause 4 of Article 8 of the Law on Entry and Exit to transfer information to the Consular Department or the Department of Foreign Affairs, Ho Chi Minh City for processing according to their respective authorities.
b) Issue visas for foreigners as prescribed in Clause 1, Clause 2, Clause 3, and Clause 4 of Article 8 of the Law on Entry and Exit based on notifications from the Consular Department or the Department of Foreign Affairs, Ho Chi Minh City.
Article 4. Procedures for Processing Applications/Notifications for Visa Issuance
1. Organizations or entities inviting or guaranteeing foreign nationals to enter Vietnam in accordance with Clause 2 and Clause 3, Article 15 of the Law on Entry and Exit shall directly submit the notification/application for visa issuance to the Consular Department or the Department of Foreign Affairs, Ho Chi Minh City.
The Ministry of Foreign Affairs (or other agencies as prescribed by the sending country) of countries where foreign nationals fall under Clauses 1, 2, 3, and 4, Article 8 of the Law on Entry and Exit may submit applications for visa issuance along with passports and visa application forms (in accordance with Form NA1 issued together with Circular 04/2015/TT-BCA) of relevant foreign nationals to Vietnamese representative offices abroad or concurrently accredited countries.
Vietnamese representative offices overseas shall transfer information to the Consular Department or the Department of Foreign Affairs, Ho Chi Minh City within one working day from the date of receipt of all required documents to process notifications/applications for visa issuance according to their authority.
2. Documents for notifications/applications for visa issuance include:
a) A letter or diplomatic note notifying/applying for visa issuance, clearly stating: full name, date of birth, nationality, gender, passport number and code, issue date - expiration date of the passport, occupation, position, purpose of entry, validity period of the visa, type of visa, and place of receiving the visa of the foreign national.
b) In cases where foreign nationals are visiting members of foreign diplomatic missions in Vietnam, in addition to the documents specified in point a, Clause 2 of this Article, it is necessary to supplement one copy of the identification card of the relevant member of the diplomatic mission.
c) In cases where foreign nationals are contractual employees working at foreign diplomatic missions in Vietnam, in addition to the documents specified in point a, Clause 2 of this Article, it is necessary to supplement one copy of a valid labor contract.
d) In cases where foreign nationals belong to the increased staffing of foreign diplomatic missions in Vietnam, in addition to the documents specified in point a, Clause 2 of this Article, it is necessary to supplement a diplomatic note from the Ministry of Foreign Affairs of the sending country notifying about the increase in staffing.
3. Processing notifications/applications for visa issuance:
a) The Consular Department or the Department of Foreign Affairs, Ho Chi Minh City shall notify the Immigration Management Department of the Ministry of Public Security (hereinafter referred to as the Immigration Management Department) and Vietnamese representative offices abroad about the issuance of visas for foreign nationals falling under Clauses 1 and 2, Article 8 of the Law on Entry and Exit within one working day from the date of receipt of complete and valid documents.
b)[5] (Repealed)
c) The Consular Department or the Department of Foreign Affairs, Ho Chi Minh City shall notify in writing the Immigration Management Department of the Ministry of Public Security within one working day from the date of receipt of complete and valid documents for the issuance of visas for foreign nationals falling under Clause 4, Article 8 of the Law on Entry and Exit.
The Consular Department or the Department of Foreign Affairs, Ho Chi Minh City shall respond to organizations or entities applying for visas, and simultaneously notify Vietnamese representative offices abroad about the issuance of visas for foreign nationals two working days after notifying the Immigration Management Department if there is no objection from that agency.
Notifications from the Consular Department or the Department of Foreign Affairs, Ho Chi Minh City to Vietnamese representative offices abroad regarding the issuance of visas for foreign nationals shall include the following information: full name, date of birth, nationality, gender, passport number and code, issue date - expiration date of the passport, occupation, position, purpose of entry, validity period of the visa, type of visa, place of receiving the visa of the foreign national, and other information (if necessary).
4. Implementation of Visa Issuance:
a) Vietnamese representative offices abroad shall issue visas for foreign nationals within one working day from the date of receipt of notifications as stipulated in point d, Clause 3 of this Article, passports, and visa application forms (in accordance with Form NA1 issued together with Circular 04/2015/TT-BCA) of the foreign national.
b) In cases where foreign nationals are approved for visa issuance at border gates, the agency receiving the application as stipulated in Clause 1 of this Article shall notify the organization or entity applying for visa issuance about the foreign national's receipt of the visa at the border gate.
5. The Minister of Foreign Affairs shall decide or authorize the Director of the Consular Department to decide on the reciprocal application of processing timeframes and components of applications for visa issuance with foreign counterparts, in accordance with the Law on Entry and Exit.
Article 5. Procedures for Processing Requests to Extend Temporary Stay
1. Foreign nationals who have been issued visas marked NG1, NG2, and NG4, upon entry into Vietnam, if they require an extension of their temporary stay, must submit a notification/application for extension of temporary stay through the inviting or sponsoring organization to the Consular Department or the Ho Chi Minh City Department of Foreign Affairs.
2. Documents for Notification/Application for Extension of Temporary Stay:
a) A written document or diplomatic note notifying/applying for an extension of temporary stay, specifying: full name, date of birth, nationality, gender, passport number and type, issue and expiration dates of the passport, occupation, position, purpose of entry, requested duration of temporary stay extension, and need for issuance of a new visa (if applicable).
b) The foreign national's passport valid for more than 30 days beyond the requested temporary stay extension period.
c) A visa application form or application for extension of temporary stay (according to Form NA5 issued together with Circular 04/2015/TT-BCA), confirmed and stamped by the inviting or sponsoring organization.
d) For foreign nationals entering Vietnam to visit members of foreign diplomatic missions in Vietnam, attach a copy of the identification card of such member issued by the National Reception and Interpretation Service or the Ho Chi Minh City Department of Foreign Affairs.[6] or the Ho Chi Minh City Department of Foreign Affairs.
e) For foreign nationals who are contractual employees working at foreign diplomatic missions in Vietnam, attach a copy of a valid labor contract.
3. Processing Requests for Extension of Temporary Stay:
a) Within five working days from the date of receipt of complete and valid documents as stipulated in Clause 2 of this Article, the Consular Department or the Ho Chi Minh City Department of Foreign Affairs will consider extending the temporary stay and issuing a new visa (if necessary) for the foreign national.
b) The extended temporary stay period and the validity period of the new visa (if issued) shall be consistent with the purpose of entry and the request of the inviting or sponsoring organization, and shall not exceed twelve months, being shorter than the passport validity period of the foreign national by at least thirty days.
c) For those specified in Point d, Clause 2 of this Article, the extended temporary stay period and the validity period of the new visa (if issued) shall comply with the provisions of Point b, Clause 3 of this Article and shall be consistent with the validity period of the identification card of the member of the foreign diplomatic mission in Vietnam issued by the National Reception and Interpretation Service.[7] or the Ho Chi Minh City Department of Foreign Affairs.
4.[8] Foreign nationals who entered Vietnam without a visa under the provisions of Clauses 1, 2, 3, and 4 of Article 8 of the Law on Exit and Entry shall have their temporary stay extended and multiple-entry visas issued based on the documents submitted according to Clause 2 of this Article, except where international treaties to which Vietnam is a party provide otherwise.
5. The Director of the Consular Department decides on the extension of temporary stay and issuance of a new visa (if necessary) for foreign nationals who entered Vietnam with a SQ visa under the provisions of Clauses 1, 2, 3, and 4 of Article 8 of the Law on Exit and Entry.
6. The Minister of Foreign Affairs decides or delegates the Director of the Consular Department to decide on reciprocal measures with foreign counterparts regarding the extension of temporary stay for foreign nationals, in accordance with the Law on Exit and Entry.
Article 6. Procedures for Issuing Temporary Residence Cards
1. The inviting and sponsoring entities for foreigners as stipulated in Clause 3, Article 8 of the Law on Entry and Exit shall submit applications for issuing temporary residence cards to the competent authority as prescribed in this Circular.
2. Documents required for application for issuance of a temporary residence card include:
a) A diplomatic note requesting issuance of a temporary residence card from the foreign representative office in Vietnam, clearly stating the following information: full name, date of birth, nationality, gender, passport number and code, occupation, and position of the applicant (refer to Model NA6 issued together with Circular No. 04/2015/TT-BCA).
In cases where there is a change or addition to the staff of the foreign representative office in Vietnam, the diplomatic note requesting issuance of a temporary residence card must clearly state the full name and title of the person replacing or being added to the staff.
b) An application form for issuance of a temporary residence card (Model NA8 issued together with Circular No. 04/2015/TT-BCA), confirmed by the authorized person and stamped by the foreign representative office in Vietnam.
c) Valid passport of the foreigner.
d) For cases where the foreigner belongs to the category of increased staff of the foreign representative office in Vietnam, in addition to the documents specified in points a, b, and c of Clause 1 of this Article, it is necessary to supplement a diplomatic note from the Ministry of Foreign Affairs of the sending country notifying about the increase in staff.
3. Issuance of Temporary Residence Cards:
Within five working days from the date of receipt of complete and valid documents as prescribed in Clause 2 of this Article, the National Reception and Protocol Service and International Translation Department[9] or the Ho Chi Minh City Department of Foreign Affairs will consider issuing temporary residence cards to foreigners.
4.[10] The temporary residence card has the code NG3, with a validity period not exceeding five years and shorter than the remaining validity period of the passport by at least thirty days.
When the temporary residence card expires, a new temporary residence card will be considered for issuance upon request of the foreign representative office in Vietnam.
5. The National Reception and Protocol Service and International Translation Department[11] and the Ho Chi Minh City Department of Foreign Affairs shall transfer the list of persons who have been issued temporary residence cards to the immigration management agency according to the provisions of Clause 2, Article 7 of Decree No. 64/2015/NĐ-CP of the Government on mechanisms for coordination among ministries, ministerial-level agencies, provincial people's committees, and centrally-administered city people's committees in managing entry, exit, transit, and residence of foreigners in Vietnam.
6. The Minister of Foreign Affairs decides or delegates the Director of the National Reception and Protocol Service and International Translation Department[12] to decide on reciprocity with foreign counterparts regarding the processing time and components of the application for issuance of a temporary residence card, in accordance with the Law on Entry and Exit.
Chapter III
IMPLEMENTING PROVISIONS
Article 7. Transitional Provisions
1. Visas, residence certificates, and temporary residence cards valid before the effective date of this Circular remain valid until their expiration date.
2. Applications for visas, temporary residence cards, and extension of temporary residence submitted before the effective date of this Circular but not yet processed shall be handled by the competent authority of the Ministry of Foreign Affairs according to the provisions of this Circular.
Article 8. Implementation organization
1. The Consular Department is responsible for:
a) Guiding overseas Vietnamese representative offices and related agencies in issuing visas and extending temporary residence according to this Circular.
b) Reporting annually to the Minister of Foreign Affairs on the situation of visa issuance and temporary residence extension according to this Circular.
2. The National Reception and Protocol Service and International Translation Department[13] are responsible for:
a) Guiding foreign representative offices in Vietnam and related agencies on procedures for issuing temporary residence cards according to this Circular.
b) Reporting annually to the Minister of Foreign Affairs on the situation of temporary residence card issuance according to this Circular.
3. The Ho Chi Minh City Department of Foreign Affairs is responsible for reporting monthly, quarterly, and annually on visa issuance and temporary residence extension to the Consular Department; and on temporary residence card issuance to the National Reception and Protocol Service and International Translation Department.[14].
4. Overseas Vietnamese representative offices are responsible for:
a) Issuing visas based on notifications from the Consular Department or the Ho Chi Minh City Department of Foreign Affairs.
b) Reporting monthly, quarterly, and annually on visa issuance for foreigners under the jurisdiction of the Ministry of Foreign Affairs to the Consular Department.
Article 9. Effective Date[15]
This Circular takes effect from September 1, 2016.
Article 10. Responsibility for Implementation
The Consular Department Director, the National Reception and Protocol Service and International Translation Department Director,[16]the Ho Chi Minh City Department of Foreign Affairs Director, and the heads of overseas Vietnamese representative offices and units under the Ministry are responsible for implementing this Circular. During implementation, if there are any difficulties, relevant agencies shall report to the Ministry of Foreign Affairs (through the Consular Department for visa issuance and temporary residence extension procedures; through the National Reception and Protocol Service and International Translation Department[17] for temporary residence card issuance procedures) for timely guidance.

Based on Decree No. 28/2025/NĐ-CP dated February 24, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs;

[6] The phrase "National Reception Bureau" is replaced by the phrase "National Reception Bureau and Foreign Language Interpreting" according to the provisions of Clause 1, Article 1 of Circular No. 04/2025/TT-BNG dated June 13, 2025 of the Ministry of Foreign Affairs amending and supplementing some articles of Circular No. 04/2016/TT-BNG dated June 30, 2016 of the Minister of Foreign Affairs guiding procedures for issuing visas, extending temporary residence, and issuing temporary residence cards for foreigners in Vietnam within the jurisdiction of the Ministry of Foreign Affairs and Decision No. 2985/2007/QĐ-BNG dated November 29, 2007 of the Minister of Foreign Affairs promulgating the Regulations on the organization and operation of the Fund for the Protection of Vietnamese Citizens and Legal Entities Abroad, which shall take effect from July 13, 2025.

[8] This Clause is amended according to the provisions of Clause 4, Article 1 of Circular No. 04/2025/TT-BNG dated June 13, 2025 of the Ministry of Foreign Affairs amending and supplementing some articles of Circular No. 04/2016/TT-BNG dated June 30, 2016 of the Minister of Foreign Affairs guiding procedures for issuing visas, extending temporary residence, and issuing temporary residence cards for foreigners in Vietnam within the jurisdiction of the Ministry of Foreign Affairs and Decision No. 2985/2007/QĐ-BNG dated November 29, 2007 of the Minister of Foreign Affairs promulgating the Regulations on the organization and operation of the Fund for the Protection of Vietnamese Citizens and Legal Entities Abroad, which shall take effect from July 13, 2025.

[15] Article 3 of Circular No. 04/2025/TT-BNG dated June 13, 2025, issued by the Ministry of Foreign Affairs to amend and supplement certain provisions of Circular No. 04/2016/TT-BNG dated June 30, 2016, issued by the Minister of Foreign Affairs guiding procedures for issuing visas, extending temporary residence permits, and issuing temporary residence cards for foreigners in Vietnam within the jurisdiction of the Ministry of Foreign Affairs, and Decision No. 2985/2007/QĐ-BNG dated November 29, 2007, issued by the Minister of Foreign Affairs promulgating the Regulations on the organization and operation of the Fund for the Protection of Vietnamese Citizens and Legal Entities Abroad, shall take effect from July 13, 2025, and is stipulated as follows:
"Article 3. Implementation Provisions
1. This Circular shall take effect from July 13, 2025.
2. During the implementation process, if there are any difficulties or new matters arise, the diplomatic missions shall promptly report to the Ministry of Foreign Affairs for timely guidance.
[16] The phrase "National Reception Bureau" is replaced by the phrase "National Reception Bureau and Foreign Language Interpreting" according to the provisions of Clause 1, Article 1 of Circular No. 04/2025/TT-BNG dated June 13, 2025 of the Ministry of Foreign Affairs amending and supplementing some articles of Circular No. 04/2016/TT-BNG dated June 30, 2016 of the Minister of Foreign Affairs guiding procedures for issuing visas, extending temporary residence, and issuing temporary residence cards for foreigners in Vietnam within the jurisdiction of the Ministry of Foreign Affairs and Decision No. 2985/2007/QĐ-BNG dated November 29, 2007 of the Minister of Foreign Affairs promulgating the Regulations on the organization and operation of the Fund for the Protection of Vietnamese Citizens and Legal Entities Abroad, which shall take effect from July 13, 2025.
[17] The term "National Reception Bureau" shall be replaced by the term "National Reception Bureau and Foreign Interpretation" as provided for in Clause 1 of Article 1 of Circular No. 04/2025/TT-BNG dated June 13, 2025, issued by the Ministry of Foreign Affairs to amend and supplement certain provisions of Circular No. 04/2016/TT-BNG dated June 30, 2016, issued by the Minister of Foreign Affairs guiding procedures for issuing visas, extending temporary residence permits, and issuing temporary residence cards for foreigners in Vietnam within the jurisdiction of the Ministry of Foreign Affairs, and Decision No. 2985/2007/QĐ-BNG dated November 29, 2007, issued by the Minister of Foreign Affairs promulgating the Regulations on the organization and operation of the Fund for the Protection of Vietnamese Citizens and Legal Entities Abroad, which shall take effect from July 13, 2025.
