Guidelines on competition and reward activities for students in vocational training institutions

Pursuant to the Law on Competition and Reward dated November 26, 2003 and the Law Amending and Supplementing Certain Articles of the Law on Competition and Reward dated June 14, 2005;
Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;
Pursuant to the Government Decree No. 121/2005/ND-CP dated September 30, 2005 detailing and guiding the implementation of certain articles of the Law on Competition and Reward and the Law Amending and Supplementing Certain Articles of the Law on Competition and Reward;
The Ministry of Labor, Invalids and Social Affairs hereby issues guidelines on competition and reward activities for students in vocational training institutions as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Circular guides the organization of competition movements; forms and criteria for rewarding individuals and groups of students in vocational colleges, technical secondary schools, public vocational training centers, private vocational training centers, and those with foreign investment (hereinafter referred to collectively as vocational training institutions).
Article 2. This Circular applies to students, individual students, and student groups in vocational training institutions, specifically:
a) Individual regular students (hereinafter referred to as individuals);
b) Student classes;
c) Student groups established by the head of the vocational training institution or formed and recognized according to the provisions of the law.
Article 2. Purpose of competition and reward activities in vocational training institutions
1. To encourage, motivate, and honor individuals, student classes, and student groups who enthusiastically compete in studying, actively cultivate moral character, healthy lifestyle, complete their study tasks excellently, participate actively in activities organized by the vocational training institution, and uphold the tradition of patriotism.
2. To guide students in studying and cultivating themselves to have good physical health, a healthy lifestyle, discipline, industrial work habits, excellent expertise, and become exemplary workers in the country's industrialization and modernization process.
Chapter II
ORGANIZING THE MOVEMENT OF COMPETITION AND LEADERSHIP
Article 3. Forms of organizing competition movements
1. Periodic or sudden competitions: initiated by the vocational training institution or responding to the directives of higher authorities based on themes, special topics, contests, programs, or urgent tasks of the industry or locality within a specific period.
2. Regular competitions: initiated by the vocational training institution to perform daily, monthly, quarterly, semester, academic year, or course tasks of individuals and student classes at the highest level.
Article 4. Content of Organizing Competitive Motivation Movements
1. Launching competition movements among students, student classes, and student groups to strive to complete their study and cultivation tasks excellently.
2. Launching competition movements to respond to and implement well the themes, special topics, contests, programs, or urgent tasks.
3. Implementing measures to mobilize students to participate in competition movements; monitoring, directing, drawing lessons, and disseminating good experiences for students, student classes, and student groups participating in competition movements.
4. Summarizing, concluding, and evaluating the results of competition movements; selecting and publicly rewarding outstanding individuals, student classes, and student groups.
Chapter III
REWARDING
Article 5. Immediate Awards
1. Immediate awards may be granted to individuals, classes of students, or student groups who have achieved notable accomplishments that require timely recognition and encouragement.
2. The content and form of immediate awards shall be implemented according to Clause 1 of Article 19 of Decision No. 26/2007/QĐ-BLĐTBXH dated December 24, 2007, issued by the Minister of Labor, Invalids, and Social Affairs on the issuance of regulations for student work in regular vocational training institutions (hereinafter referred to as Decision No. 26).
Article 6. Regular Awards
1. Regular awards may be granted to individuals and classes of students who have achieved notable results in their studies and self-discipline.
2. The content and form of regular awards for individuals and classes of students shall be implemented according to Clause 2 of Article 19 of Decision No. 26.
Article 7. Time for Reviewing and Awarding Awards
1. Awards given periodically or immediately shall be reviewed and awarded when summarizing the outcomes of competition periods, topics, special themes, contests, programs, and outstanding achievements.
2. Regular awards shall be reviewed and awarded at the end of each semester or academic year (for intermediate and higher vocational students) or course (for basic vocational students).
Chapter IV
COMPETITION AND AWARD COUNCILS AND PROCEDURES FOR REVIEWING AWARDS
Article 8. Competition and Award Councils
The organizational structure, functions, tasks, and operational procedures of Competition and Award Councils shall be implemented according to Article 24 of Decision No. 26.
Article 9. Procedures for Reviewing Periodic and Immediate Awards
1. Based on the achievements of individuals, classes of students, or student groups in activities and competition movements related to specific topics, special themes, contests, programs, or outstanding achievements, awards shall be reviewed.
2. The procedures for reviewing periodic and immediate awards shall be guided by the Competition and Award Councils of vocational training institutions based on specific activities and competition movements and outstanding achievements.
Article 10. Procedures for Reviewing Regular Awards
Registration for competition, procedures for reviewing regular awards for individuals and classes of students shall be implemented according to Article 20 of Decision No. 26.
Article 11. Authority to Decide on Commendation Titles and Awards
1. The heads of vocational training institutions shall decide to grant certificates of merit and levels of awards to individuals; classes of students, or student groups who achieve notable results in regular competition movements; other commendation titles and awards according to periodic or immediate criteria in accordance with laws on competition and awards.
2. The heads of vocational training institutions have the right to propose to higher authorities to award individuals, classes of students, or student groups who achieve particularly notable results according to the law.
Article 12. Benefits for Individuals and Groups Receiving Awards
1. In addition to recognizing commendation titles and presenting certificates of merit, individuals, classes of students, or student groups receiving awards from the head of the vocational training institution may also receive monetary or material rewards.
2. Commendation titles and awards for individual achievements in regular, periodic, or immediate studies and self-discipline shall be recorded in the student's file.
Chapter V
FUND FOR COMPETITION AND REWARD
Article 13. Sources of the competition and reward fund
The competition and reward fund shall be raised or allocated from:
1. Sources of the competition and reward fund raised or allocated from the state budget (for public vocational training institutions) shall be implemented according to Point d Clause 1 Section II Circular No. 73/2006/TT-BTC dated August 15, 2006 of the Ministry of Finance guiding the establishment, management, and use of the competition and reward fund.
2. Tuition revenue from regular programs, the allocation rate is decided by the head of the vocational training institution.
3. Revenue from the activities of the vocational training institution; support from domestic and foreign organizations and other lawful sources of revenue.
Article 14. Use of the competition and reward fund
1. The expenditure level for each type of reward is decided by the head of the vocational training institution based on the regulations and provisions on competition and rewards of the vocational training institution that have been approved and in accordance with the law.
2. The cash award accompanying commendation titles is allocated from the competition and reward fund of the vocational training institution and clearly stated in the reward decision.
Article 15. Management of the competition and reward fund
The competition and reward fund of the vocational training institution shall be managed in accordance with the law; the source of allocation, ratio, and specific allocation rate are decided by the head of the vocational training institution based on the annual budget estimate. Settlement is based on actual expenditures consistent with regulations, policies, and current provisions.
Chapter VI
IMPLEMENTING PROVISIONS
Article 16. Effective Date
This Circular takes effect 45 days from the date of signature.
Article 17. Responsibility for Implementation
1. Based on the provisions of this Circular, vocational training institutions and related units are responsible for implementation.
2. During the implementation process, any arising issues or difficulties; obstacles (if any) need to be promptly reported to the Ministry of Labor, Invalids and Social Affairs for study, supplementation, and amendment./.
