CIRCULAR
Regulations on the collection, payment, management, and use of fees for railway driving license examination

Pursuant to the Railway Law No. 35/2005/QH12 dated June 14, 2005;
Pursuant to the Ordinance on Fees and Charges No. 38/2001/UBTVQH10 dated August 28, 2001;
Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges, and Decree No. 24/2006/NĐ-CP dated March 6, 2006 amending and supplementing certain articles of Decree No. 57/2002/NĐ-CP dated June 3, 2002;
Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Policy Department;
The Minister of Finance issues this Circular stipulating the regulations on the collection, payment, management, and use of fees for railway driving license examinations, as follows::
Article 1. Scope of application
1. Persons participating in the examination to obtain a railway driving license are the subjects required to pay the examination fee for obtaining a railway driving license as prescribed in this Circular.
2. The competent authority conducting the examination for issuing a railway driving license is the fee collection agency.
Article 2. Level of Collection
The amount of the initial examination fee is VND 400,000 per person per examination. The amount of the re-examination fee is VND 200,000 per person per examination.
Article 3. Management and Use of Fees
1. The examination fee for obtaining a railway driving license is a revenue item belonging to the state budget; the fee collection agency is entitled to retain 90% of the collected examination fees to cover the costs of organizing the examination and collecting fees as prescribed; the remaining 10% of the examination fees must be remitted to the state budget according to the current State Budget Classification.
2. Other matters related to registration, declaration, collection, payment, management, use, and public disclosure of the examination fee collection regime for obtaining a railway driving license, which are not specified in this Circular, shall be implemented in accordance with the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws on fees and charges, Circular No. 45/2006/TT-BTC dated May 25, 2006 amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002, Circular No. 28/2011/TT-BTC dated February 28, 2011 of the Ministry of Finance guiding the implementation of certain provisions of the Law on Tax Administration, guiding the implementation of Decree No. 85/2007/NĐ-CP dated May 25, 2007 and Decree No. 106/2010/NĐ-CP dated October 28, 2010 of the Government, Circular No. 153/2012/TT-BTC dated September 17, 2012 of the Ministry of Finance guiding the printing, issuance, management, and use of various types of receipts for fees and charges belonging to the state budget, and any subsequent amendments and supplements (if any).
Article 4. Organization of Implementation
1. This Circular takes effect from June 10, 2013.
2. Abolish the provisions regarding examination fees for railway drivers set out in Decision No. 17/2007/QĐ-BTC dated March 21, 2007 of the Minister of Finance stipulating the levels of collection, payment, management, and use of examination fees for railway drivers, license fees for railway driving licenses, and certificates of registration for railway transportation means.
3. In the course of implementation, if there are any difficulties, agencies, organizations, and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance./.
