Pursuant to the Road Traffic Law on November 13, 2008;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Transport Department,

The Minister of Transport issues this Circular amending and supplementing certain provisions of Circular No. 08/2009/TT-BGTVT dated June 23, 2009 of the Minister of Transport guiding the use of simple vehicles, motorcycles, two-wheeled motorbikes, three-wheeled motorbikes, and similar vehicles for passenger and cargo transportation.

Article 1. Amending and supplementing Article 5 of Circular No. 08/2009/TT-BGTVT as follows:

"Article 5. Transportation activities

1. The People's Committee of the province shall specify:

a) The scope, route, and operating hours for each type of vehicle;

b) The location for stopping and parking, and the activities of picking up and dropping off passengers and goods must ensure traffic order and safety;

c) The limit of loading goods onto simple vehicles, motorcycles, two-wheeled motorbikes, three-wheeled motorbikes, and similar vehicles when participating in road traffic must be appropriate to local conditions but shall not exceed the provisions set forth in Clause 2 of this Article.

2. The limits for the height, width, and length of loading goods onto simple vehicles, motorcycles, two-wheeled motorbikes, three-wheeled motorbikes, and similar vehicles are as follows:

a) Motorcycles, two-wheeled motorbikes, three-wheeled motorbikes, and similar vehicles shall not load goods or luggage exceeding 0.3 meters on either side of the carrier rack as designed by the manufacturer, and 0.5 meters behind the carrier rack; the height of loaded goods from the road surface shall not exceed 2.0 meters;

b) Simple vehicles shall not load goods exceeding one-third of the vehicle body length in front and behind; shall not exceed 0.4 meters on either side of the wheels, and shall not exceed 1.0 meter in front and behind the vehicle.

3. Simple vehicles, motorcycles, two-wheeled motorbikes, three-wheeled motorbikes, and similar vehicles transporting passengers and goods within the scope of a locality must comply with the regulations of that locality."

Article 2. Supplementing Clause 4 of Article 8 of Circular No. 08/2009/TT-BGTVT as follows:

"4. Abolishing Clause 4 and Clause 5 of Article 18 of Circular No. 07/2010/TT-BGTVT dated February 11, 2010 of the Minister of Transport regarding axle load limits, dimensional limits for roads, operation of overloaded vehicles, oversized vehicles, tracked vehicles on roads, transportation of extra-long and extra-heavy goods, and limits for loading goods onto transport vehicles when participating in road traffic."

Article 3. Effectiveness

This Circular takes effect from December 1, 2014.

Article 4. Organization of Implementation

The Head of the Ministry’s Office, the Inspector General, Heads of Departments, Directors of the Vietnam Highway Administration, Directors of Provincial and Central City Transport Departments, Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.
