PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decision regulates support policies for vocational training at the primary level and shorter than three months, including: Levels of support for training costs; levels of support for food expenses, travel expenses, and implementation of support policies for vocational training at the primary level and shorter than three months.
Article 2. Applicability
Article 1. Students who are women, rural workers, persons with disabilities participating in primary level training programs and shorter than three months, prioritizing persons with disabilities and those who are entitled to preferential policies for persons who have rendered meritorious service to the revolution, ethnic minority people, people from poor households, near-poor households, people from households whose agricultural land or business land has been reclaimed, unemployed female workers, fishermen; relevant agencies, organizations, and individuals.
Article 3. Principles of Support for Vocational Training at the Primary Level and Shorter Than Three Months
Clause 1. Students registering to participate in primary level training programs and shorter than three months may choose their profession and training institution. The implementation of support policies for students is carried out through the training institutions organizing primary level training programs and shorter than three months.
Clause 2. Each person can only be supported once under the policy stipulated in this Decision. Those who have already received support under other current national policies shall not continue to receive support under the policy stipulated in this Decision. However, those who have lost their jobs due to objective reasons and have been supported will be considered and decided by the People's Committee of the commune to continue receiving support for job transition according to the policy stipulated in this Decision, but not more than three times.
Chapter II
LEVELS OF SUPPORT FOR VOCATIONAL TRAINING AT THE PRIMARY LEVEL AND SHORTER THAN THREE MONTHS
Clause 1. Persons with disabilities: Maximum level of 6 million VND per person per course.
Clause 2. Ethnic minority people from poor households; people from poor households in particularly difficult communes, villages, and hamlets as defined by the Prime Minister: Maximum level of 4 million VND per person per course.
Clause 3. Ethnic minority people, those entitled to preferential policies for persons who have rendered meritorious service to the revolution, people from poor households, people from households whose agricultural land or business land has been reclaimed, unemployed female workers, fishermen: Maximum level of 3 million VND per person per course.
Clause 4. People from near-poor households: Maximum level of 2.5 million VND per person per course.
Clause 5. Female students and rural workers who do not fall under the categories specified in Clauses 1, 2, 3, and 4 of this Article: Maximum level of 2 million VND per person per course.
Clause 6. Fishermen studying the following professions: Operating steel-hulled vessels, new material vessels, modern fishing technology for vessels with main engine power of 400HP or more will be fully supported for training costs and implemented according to the regulations stipulated in the Government Decree.
Clause 7. In cases where students belong to multiple categories mentioned in Clauses 1, 2, 3, 4, 5, and 6 of this Article, they will only receive the highest level of support for training costs.
Clause 8. The training cost for each profession and specific levels of support for each category participating in primary level training programs and shorter than three months shall be approved by the Chairman of the Provincial People's Committee, the Chairman of the People's Committee of centrally-administered cities, and the heads of central agencies assigned to implement support policies for primary level training and shorter than three months, in accordance with the actual training program and time, and the characteristics of each region and locality.
For professions with actual training costs exceeding the maximum support levels stipulated in this Article, localities and training institutions shall proactively develop plans to mobilize additional funding from local budgets, corporate support, student contributions, and other legitimate sources of fundraising and sponsorship to ensure training costs.
Clause 9. In addition to the categories specified in Clauses 1, 2, 3, 4, and 5 of this Article, the People's Committees of provinces and centrally-administered cities may allocate and mobilize additional legitimate funding sources based on local conditions and budget capabilities to provide additional support for other groups with training needs.
1. Recipients of support: Persons entitled to preferential policies for those who have contributed to the revolution, persons with disabilities, ethnic minorities, poor households, near-poor households, households whose agricultural land or business land has been reclaimed, female workers who have lost their jobs and participate in vocational training programs at the primary level or less than three months.
2. Level of support:
a) The amount of meal support is 30,000 VND per person per day of actual study.
b) The amount of travel support is 200,000 VND per person per training course if the training location is more than 15 kilometers away from the place of residence.
For persons with disabilities and students residing in communes, villages, or hamlets in difficult or extremely difficult areas as defined by the Prime Minister: The amount of travel support is 300,000 VND per person per training course if the training location is more than 5 kilometers away from the place of residence.
3. In addition to the recipients and support levels specified in Clause 1 and 2 of this Article, ministries, sectors, localities, and training institutions shall mobilize additional funding sources based on their conditions and capabilities to provide additional support for meals and travel expenses for students during their training period.
Article 6. Funding for Implementing the Training Support Policy
1. The funding for implementing the training support policy at the primary level and for training programs under three months includes:
a) Central budget;
b) Local budget;
c) Support funds from organizations, individuals, enterprises, and other legitimate fundraising sources.
2. Ministries, sectors, and localities shall integrate and utilize allocated central and local budgets and other support sources to organize primary-level training and training programs under three months according to the policy stipulated in this Decision and the State Budget Law.
Chapter III
IMPLEMENTATION OF THE TRAINING SUPPORT POLICY FOR PRIMARY LEVEL TRAINING AND TRAINING UNDER THREE MONTHS
Article 7. Planning and Organizing Orders and Assigning Training Tasks
1. Annually, ministries, sectors, and localities shall organize the construction and approval of training plans for primary-level training and training programs under three months for eligible trainees based on labor demand, enterprise employment needs, and allocated training support funding.
The training plan includes: List of trades, level of training, number of trainees, training institution, training area, cost of training for each trade, budget estimate for funding requirements, and agencies assigned to implement the training support policy.
2. Agencies assigned to implement the training support policy for primary-level training and training programs under three months shall, based on approved training plans, proceed to place orders and assign training tasks to training institutions that meet the conditions for vocational education activities as prescribed.
3. The placement of orders and assignment of training tasks shall be carried out in accordance with the provisions of the Bidding Law, the State Budget Law, and related guiding documents.
Article 8. Implementation of the Training Support Policy for Trainees
1. Trainees submit an application to enroll in a trade to a training institution that meets the conditions for vocational education activities of their choice.
2. The training institution, based on the funding for its assigned training tasks, the procurement contract received, and the number of trainees eligible for training support as stipulated in this Decision, organizes primary-level training and training programs under three months for trainees and pays meal and travel expenses for trainees as specified in Article 5 of this Decision during the training period.
3. The training institution settles the training support funding with the agency assigned to implement the training support policy for primary-level training and training programs under three months based on the volume and results of the assigned tasks or according to the procurement contract for training.
Article 9. Responsibilities of Central Ministries and Sectors
1. Ministry of Labor, Invalids and Social Affairs
a) Guide ministries, sectors, and localities to develop plans and budget estimates for annual and five-year vocational training support programs at the primary level and under three months; consolidate these plans and financial needs and submit them to the Ministry of Finance and the Ministry of Planning and Investment for inclusion in the state budget plan to be submitted to the Prime Minister.
b) Guide the implementation of vocational training support, develop programs, organize training, and replicate models of primary-level vocational training and training under three months.
c) Coordinate with the Ministry of Finance to guide the management and use of funds for primary-level vocational training and training under three months.
d) Inspect and supervise the implementation of primary-level vocational training and training under three months; periodically compile and report on the situation every six months and annually to the Prime Minister.
2. Ministry of Finance
a) Take the lead and coordinate with the Ministry of Labor, Invalids, and Social Affairs to guide the management and use of funds for primary-level vocational training and training under three months.
b) Inspect and supervise the implementation of primary-level vocational training and training under three months and the management and use of funds for such training as stipulated in this Decision and the State Budget Law.
3. The Ministry of Planning and Investment
a) Guide the development of plans and allocate targets for primary-level vocational training and training under three months to ministries, sectors, and localities in implementing annual and five-year socio-economic plans.
b) Inspect and supervise the implementation of policies supporting primary-level vocational training and training under three months.
4. Other Ministries and Sectors
a) Direct vocational education institutions, enterprises, and other entities within their jurisdiction to actively participate in primary-level vocational training and training under three months according to the policies set forth in this Decision.
b) Inspect and supervise vocational education institutions, enterprises, and other entities within their jurisdiction in organizing primary-level vocational training and training under three months; periodically compile and report on the implementation situation every six months and annually to the Ministry of Labor, Invalids, and Social Affairs for consolidation and reporting to the Prime Minister.
Article 10. Responsibilities of Provincial People's Committees and Municipal People's Committees under the Central Government
1. Develop and approve lists of trades for training, costs for each trade, specific support levels for different groups, and annual and five-year training plans for primary-level vocational training and training under three months according to the policies set forth in this Decision.
2. Allocate funds from the local budget and integrate the use of funds from various programs and projects to support training according to the policies set forth in this Decision and the State Budget Law.
3. Direct and implement policies stipulated in this Decision, assign tasks or place orders for training to vocational education institutions, enterprises, and other entities that meet the conditions for vocational education activities, prioritizing enterprises that recruit trainees for employment and vocational education institutions, and training programs that meet quality certification standards.
4. Direct local radio, television, newspaper, and broadcasting agencies to have special sections promoting career guidance, vocational training, and job creation for workers.
5. Direct departments to organize activities supporting production organization, job creation, brand building, and product sales for workers after training.
6. Implement policies supporting primary-level vocational training and training under three months as stipulated in this Decision and bear responsibility for the results and effectiveness of vocational training in the locality.
7. Inspect and supervise the implementation of primary-level vocational training and training under three months in the locality; periodically compile and report on the implementation, results, and effectiveness of training every six months and annually to the Ministry of Labor, Invalids, and Social Affairs for consolidation and reporting to the Prime Minister.
Article 11. Responsibilities of training institutions in implementing the policy to support primary level training and training under three months
1. Organize admissions, conduct primary level training and training under three months for learners according to contracts and assigned training tasks in accordance with the regulations on vocational education.
2. Arrange time, location, and progress of training flexibly in accordance with the profession being trained, production processes, growth cycles of crops and livestock, and the conditions of learners.
3. Implement fully, accurately, and promptly the support for training for learners in accordance with the provisions of this Decision.
4. Manage and be responsible for the use of funds for contracted training and assigned training tasks in accordance with the laws.
5. Report on the results and effectiveness of primary level training and training under three months, and the use of training support funds to the agency assigning tasks or placing orders for training and the Department of Labor, Invalids and Social Affairs where the training organization is located.
Article 12. Effective Date
1. This Decision takes effect from January 1, 2016.
2. Subjects currently receiving training support but have not yet completed their training period when this Decision takes effect shall continue to receive support at the levels specified in this Decision.
3. This Decision replaces the provisions on the policy to support short-term vocational training costs for ethnic minority people stipulated in Clause 1, Article 3 of Decision No. 42/2012/QĐ-TTg dated October 8, 2012 of the Prime Minister; the policy to support short-term vocational training for workers from households whose agricultural land has been reclaimed as stipulated in Point a, Clause 1, Article 4 of Decision No. 52/2012/QĐ-TTg dated November 16, 2012 of the Prime Minister, and other provisions on supporting primary level training and training under three months that conflict with this Decision. 4. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial People's Committees under the central government, Heads of agencies, organizations, and individuals related to this matter are responsible for enforcing this Decision./.the date of November 16, 2012, of the Prime Minister and other provisions on support for primary level training and training under three months are contrary to this Decision.
4. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under central cities, Heads of agencies, organizations, and individuals related shall be responsible for implementing this Decision./.
