REGULATIONS ON THE WORKING REGIME FOR TEACHERS
Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

The Minister of Education and Training issues this Circular to regulate the working regime for teachers.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Circular regulates the working regime for teachers, including: Tasks of teacher positions; regulations on working hours, standard teaching hours, and scientific research time.
2. This Circular applies to teachers at national universities, regional universities, academies, universities, colleges within the national education system (hereinafter referred to collectively as higher education institutions) and related organizations and individuals.
Article 2. Purpose
1. To serve as a basis for the heads of higher education institutions to assign, arrange, utilize, improve the quality and efficiency of labor for teachers.
2. To serve as a basis for educational management agencies to inspect, assess, evaluate, build policies, training programs, and teacher development programs.
3. To serve as a basis for teachers to develop teaching plans, scientific research plans, and learning and professional development plans.
4. To serve as a basis for the heads of higher education institutions to annually evaluate and classify teachers and ensure transparency, fairness, and democracy in the implementation of teacher regimes, policies, rights, and obligations.
Article 3. Tasks of Teacher Positions
1. The tasks of teacher positions shall be implemented in accordance with the provisions of Joint Circular No. 36/2014/TTLT-BGDĐT-BNV dated November 28, 2014 of the Minister of Education and Training and the Minister of Home Affairs stipulating job code and qualification standards for teaching staff in public higher education institutions.
2. Teachers holding the titles of associate professor and professor, in addition to performing the tasks of teachers as prescribed in Clause 1 of this Article, must also perform tasks as prescribed in Decision No. 174/2008/QĐ-TTg dated December 31, 2008 of the Prime Minister promulgating the criteria, procedures for appointment and removal of the titles of professor and associate professor; Decision No. 20/2012/QĐ-TTg dated April 27, 2012 of the Prime Minister amending and supplementing some articles of the criteria, procedures for appointment and removal of the titles of professor and associate professor promulgated together with Decision No. 174/2008/QĐ-TTg dated December 31, 2008 of the Prime Minister.
Chapter II
REGULATIONS ON WORKING TIME, STANDARD TEACHING HOURS, AND SCIENTIFIC RESEARCH TIME
Article 4. Provisions on working hours
1. The working hours of lecturers shall be implemented according to a weekly work schedule of 40 hours and shall be determined based on the academic year.
2. The total quota of working hours of lecturers in one academic year for performing teaching tasks, scientific research, training and other tasks within the institution is 1760 hours after deducting the number of days off as prescribed.
Article 5. Provisions on standard teaching hours and conversion to standard hours
1. Provisions on standard teaching hours
a) Standard teaching hours (hereinafter referred to collectively as standard hours) are units of time converted to perform an equivalent task for a theoretical lecture session at the college or university level directly in class under the annual system, including necessary labor time before, during, and after the lecture session;
b) The standard hour quota for lecturers in one academic year is 270 standard hours; of which, direct classroom standard hours must account for at least 50% of the prescribed quota.
2. Conversion to standard hours
a) One theoretical lecture session in class for 40 students is calculated as 1.0 standard hour. Depending on the scale of the class and specific working conditions for each class in different majors, a theoretical lecture session in class may be multiplied by a factor when calculating standard hours but not exceeding 1.5;
b) One specialized lecture session, theoretical lecture session for master's and doctoral training classes, and one foreign language lecture session for non-language subjects are calculated as 1.5 to 2.0 standard hours;
c) One tutorial session, practical session, experimental session, or discussion session in class is calculated as a maximum of 1.0 standard hour;
d) Supervision of internships: one day of work is calculated as a maximum of 2.5 standard hours;
đ) Supervision of bachelor's thesis or graduation project: one thesis or project is calculated as a maximum of 25 standard hours;
e) Supervision of master's thesis: one thesis is calculated as a maximum of 70 standard hours;
g) Supervision of doctoral dissertation: one dissertation is calculated as a maximum of 200 standard hours.
3. The conversion of actual time spent on examination duties, marking final exams; marking bachelor's thesis or graduation projects; reviewing and marking master's theses, doctoral dissertations to standard hours shall be stipulated by the head of the higher education institution.
Article 6. Standard hour quotas for lecturers appointed to leadership positions or concurrently performing management tasks, party, and mass organization tasks in higher education institutions
Lecturers appointed to leadership positions or concurrently performing management tasks, party, and mass organization tasks in higher education institutions have the obligation to teach according to the following quotas (calculated as a percentage of the standard hour quota prescribed in Point b Clause 1 Article 5 of this Circular):

Article 7. Provisions on scientific research
1. Lecturers must allocate at least one-third of their total annual working time to scientific research tasks.
2. The assignment and implementation of scientific research tasks for lecturers must be appropriate to the conditions, scientific potential, direction of scientific and technological activities of higher education institutions, and the lecturers' professional capabilities. The head of the higher education institution shall specifically assign scientific research tasks to lecturers of the unit.
3. Each year, lecturers must complete the assigned scientific research tasks corresponding to their rank or position. The results of lecturers' scientific research are evaluated through specific research products, at a minimum, one institutional-level scientific research project or equivalent that has been accepted with satisfactory requirements or one article published in a peer-reviewed scientific journal or one scientific report presented at a specialized scientific seminar.
4. For lecturers who fail to complete the assigned scientific research tasks as stipulated, the head of the higher education institution shall consider the evaluation of the performance results during the academic year, the classification of competition, and the resolution of related policies based on the specific level and circumstances.
Article 8. Application Provisions
1. During the probationary period or trial period, lecturers shall only perform up to 50% of the standard hour quota specified in Point b Clause 1 Article 5 of this Circular.
2. Lecturers teaching, conducting scientific research, engaging in professional activities, and performing other tasks beyond the quota shall enjoy the overtime work system according to the law.
3. Lecturers holding multiple positions shall apply the lowest standard hour quota among the positions held as stipulated in Article 6 of this Circular.
4. Lecturers during maternity leave or long-term medical leave shall have their tasks reduced in proportion to the duration of leave received under social insurance benefits. Female lecturers with young children shall have their tasks reduced in proportion to the working hours reduced according to the current Labor Code.
Chapter III
IMPLEMENTATION
Article 9. Responsibilities of the head of higher education institutions
The head of the higher education institution shall issue detailed regulations on the working system of lecturers at the institution based on the provisions of this Circular, the characteristics of each department and major, and the specific conditions of the unit.
Article 10. Provisions on implementation
1. This Circular takes effect from March 25, 2015. This Circular replaces Decision No. 64/2008/QĐ-BGDĐT dated November 28, 2008 of the Minister of Education and Training on the Working System for Lecturers; Circular No. 36/2010/TT-BGDĐT dated December 15, 2010 of the Minister of Education and Training amending and supplementing certain articles of the Working System for Lecturers issued together with Decision No. 64/2008/QĐ-BGDĐT dated November 28, 2008 of the Minister of Education and Training; and Circular No. 18/2012/TT-BGDĐT dated May 31, 2012 of the Minister of Education and Training on the Working System for Lecturers in the arts, music education, and fine arts education.
2. The Director of the Office, the Director of the Department of Teachers and School Management Staff, the Heads of relevant units under the Ministry of Education and Training, and
the Heads of higher education institutions are responsible for implementing this Circular./.
