CIRCULAR

Regulations on job code, occupational standards, and salary grading for support staff in special education in public educational institutions

Pursuant to the Civil Servant Law dated November 15, 2010; and the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Civil Servant Law dated November 25, 2019;

Based on the proposal of the Director of the Cadre and Civil Servant Department;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary regulations for civil servants, public officials, and members of the armed forces; Decree No. 17/2013/NĐ-CP dated February 19, 2013 and Decree No. 117/2016/NĐ-CP dated July 21, 2016 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 on salary regulations for civil servants, public officials, and members of the armed forces;

BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;

At the proposal of the Director of the Personnel Department and the Director of the Vietnam Highway Administration;

The Minister of Transport issues this Circular stipulating job code, occupational standards, and salary grading for public officials specializing in technical engineering for roads and technical engineering for ferry terminals.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates job codes, occupational standards, and salary grading for public officials specializing in technical engineering for roads and technical engineering for ferry terminals.

2. This Circular applies to public officials specializing in technical engineering for roads and technical engineering for ferry terminals at state-owned public institutions.

3. Non-public service organizations and related entities may apply this Circular.

Article 2. Job codes for public officials specializing in technical engineering for roads and technical engineering for ferry terminals

Article 3. General standards for professional ethics

1. Adhering to the Party's guidelines, policies, and State laws.

To be conscious of improving moral conduct, maintaining professional integrity, honor, and reputation; not to abuse work positions or assigned tasks for personal gain; to foster unity, creativity, readiness to absorb new knowledge, self-improvement; to have a sense of cooperation, assistance to colleagues, sharing of work experience; actively participate in scientific research topics, technical improvements to develop the profession and enhance competence.

Chapter II

OCCUPATIONAL STANDARDS

Section 1. OCCUPATIONAL TITLES FOR PUBLIC OFFICIALS SPECIALIZING IN TECHNICAL ENGINEERING FOR ROADS

Article 4. Technical Engineer for Roads Class I - Job Code: V.12.21.01

1. Duties:

a) To lead the implementation of technical and technological tasks within the functions and responsibilities of state-owned public institutions specializing in technical engineering for roads as prescribed by law;

b) To lead the research, proposal, development of policies, directions, plans for the application of science and technology within the assigned tasks;

c) To lead the development of operational management regulations for technical engineering for roads within the assigned tasks;

d) To lead the research and development of research topics, projects, and scientific works related to the functions and responsibilities of state-owned public institutions specializing in technical engineering for roads;

đ) To lead the compilation and development of professional guidance materials; specialized training, vocational training, or dissemination of knowledge and experience within the assigned tasks;

e) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate in professional development according to the occupational standards for public officials specializing in technical engineering for roads.

3. Qualifications regarding professional expertise and skills:

a) Profound understanding of the Party's guidelines, policies, State laws, development orientation, and tasks of the sector and field;

b) Profound understanding of economic and technical information both domestically and internationally, technological levels, advancements in construction materials within the sector and field;

c) Possess in-depth knowledge of technical engineering for roads; understand and have experience in developing, applying, and implementing technology within the assigned tasks; possess writing and presentation skills; effectively handle assigned tasks;

d) Possess research capabilities, practical summarization, and the ability to propose solutions for strategic planning, policy-making, and development plans in the road sector;

đ) Possess the ability to develop and implement projects, programs related to the road sector; analytical, synthesis, systematization skills, and the ability to propose methods to improve or resolve practical issues within the scope of work; organizational skills to enhance the quality and effectiveness of work;

e) Basic computer skills; proficiency in foreign languages or ethnic minority languages if working in areas with ethnic minorities as required by the job position.

a) Have held the occupational title of Technical Engineer for Roads Class II and equivalent for at least six years. In cases of equivalent time, they must have held the occupational title of Technical Engineer for Roads Class II for at least one year (twelve months) up to the deadline for submitting registration applications for the exam or promotion;

b) During the period holding the occupational title of Technical Engineer for Roads Class II and equivalent, they must have led the development of at least one topic, project, program, or scientific and technological plan at the ministry or provincial level that has been issued, accepted, or led the development of at least two topics, projects, programs, or scientific and technological plans at the institutional level that have been issued and accepted by the competent authority.

Article 5. Highway Technician Level II - Code: V.12.21.02

1. Duties:

a) Lead or participate in performing technical and technological tasks within the functions and responsibilities of public service units specializing in highway engineering as prescribed by law;

b) Lead or participate in researching and establishing management regulations for specialized technical operations in highway engineering within the assigned tasks;

c) Lead or participate in researching topics, projects, scientific research works related to the functions and responsibilities of public service units specializing in highway engineering;

d) Participate in researching, proposing, and establishing policies, directions, plans for the development and application of science and technology within the assigned tasks;

đ) Lead or participate in organizing the compilation and establishment of professional guidance materials; training, enhancing professional skills or disseminating knowledge and experience within the assigned tasks;

e) Implement operational procedures, monitor and manage professional activities, compile and establish reports, statistics, and manage archival files within the assigned tasks;

g) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate in professional development according to the occupational standards for public officials specializing in technical engineering for roads.

3. Qualifications regarding professional expertise and skills:

a) Profound understanding of the Party's guidelines, policies, State laws, development orientation, and tasks of the sector and field;

b) Master economic and technical information both domestically and internationally, the level of technology in the industry, advancements in construction materials within the specialized field of highway engineering;

c) Possess in-depth knowledge about the specialized field of highway engineering; have understanding and experience in developing, applying, and implementing technology within the assigned tasks;

d) Have organizational implementation capabilities, research abilities, practical summarization skills, and propose solutions to improve quality and efficiency of work within the assigned tasks;

đ) Have basic computer technology skills, be able to use foreign languages or ethnic minority languages for civil servants working in ethnic minority regions according to job requirements;

a) Have held the position of Civil Servant Highway Technician Level III and equivalent for at least nine years (excluding probationary and trial periods). In cases with equivalent time, they must have held the position of Civil Servant Highway Technician Level III for at least one year (12 months) up to the deadline for submitting examination registration or promotion application forms;

b) During the period holding the position of Civil Servant Highway Technician Level III and equivalent, they must have participated in building at least one topic, project, program of scientific and technological research at the grassroots level that has been issued or accepted by the competent authority;

Article 6. Highway Technician Level III - Code: V.12.21.03

1. Duties:

a) Participate in building plans, master plans, and specialized technical operation regulations within the assigned tasks;

b) Participate in researching and proposing policies, directions, plans for development and application of science and technology within the scope of assigned duties;

c) Carry out specialized technical operation activities: survey, data collection, database construction; inspection, testing, appraisal, load testing, experimental construction; assess damage levels of road construction; provide technical, scientific, and technological advice; cooperate in rescue, traffic assurance, and emergency repair of bridge and road construction;

d) Guide, supervise, participate in inspections, statistics, information collection, management, and archiving of documents on issues related to the assigned tasks;

đ) Participate in building internal regulations;

e) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate in professional development according to the occupational standards for public officials specializing in technical engineering for roads.

3. Qualifications regarding professional expertise and skills:

a) Profound understanding of the Party's guidelines, policies, State laws, development orientation, and tasks of the sector and field;

b) Understand technical procedures, standards, quotas, safety and labor protection techniques; be proficient in specialized technical operations and have basic knowledge of a related technical field; understand the development, application, and implementation of specialized technology; understand methods of organization and implementation within the assigned tasks;

c) Have writing and presentation skills for assigned tasks;

d) Have the ability to summarize practical experiences and propose solutions to improve the quality and efficiency of work within the assigned tasks;

đ) Have basic computer technology skills; be able to use foreign languages or ethnic minority languages for civil servants working in ethnic minority regions according to job requirements;

Article 7. Highway Technician Level IV - Code: V.12.21.04

1. Duties:

a) Perform technical tasks in experimental work, application, and testing of new materials and structures within the field of highways; manage and use testing equipment.

b) Advise on the implementation of assigned tasks in accordance with the law; participate, support, and serve in the deployment of tasks such as planning and implementing operational plans based on management regulations of the industry and field.

c) Analyze, evaluate, report, and propose solutions according to management requirements and objectives; organize statistical documentation, data, and manage, store files and documents within the scope of assigned tasks as prescribed.

d) Carry out other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a college degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate in professional development according to the occupational standards for public officials specializing in technical engineering for roads.

3. Qualifications regarding professional expertise and skills:

a) Master the Party's policies, guidelines, and state laws; understand the basic orientation and development tasks of economic technology in the industry and unit.

b) Possess specialized knowledge and the ability to perform technical tasks within the scope of assigned tasks.

c) Understand the features, operating principles, and be proficient in using specialized technical equipment for experimental work.

d) Have the ability to manage, use, and maintain equipment, prevent fires during practical and experimental activities.

đ) Understand administrative procedures and management operations.

e) Basic computer skills; proficiency in foreign languages or ethnic minority languages if working in areas with ethnic minorities as required by the job position.

Section 2. OCCUPATIONAL TITLES OF TECHNICAL CIVIL SERVICE PROFESSIONALS IN FERRY TERMINAL ENGINEERING

Article 8. Ferry Terminal Engineering Technician Level II - Code: V.12.22.02

1. Duties:

a) Lead or participate in implementing technical tasks within the functions and responsibilities of public service units in ferry terminal engineering as stipulated by law.

b) Lead or participate in researching and drafting operational management regulations in the field of ferry terminal engineering within the scope of assigned tasks.

c) Lead or participate in researching topics, projects, and scientific research works related to the functions and responsibilities of public service units in ferry terminal engineering.

d) Lead or participate in establishing technical standards, economic-technical norms in the ferry terminal field; study, propose, and establish policies, plans for developing and applying science and technology within the scope of assigned tasks.

đ) Lead or participate in organizing the compilation and establishment of professional guidance materials; training, enhancing professional skills or disseminating knowledge and experience within the assigned tasks;

e) Implement operational procedures, oversee professional activities, compile, build reports, statistics, manage, and store files and documents within the scope of assigned tasks as prescribed.

g) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate for training in accordance with the occupational title standards for technical civil service professionals in ferry terminal engineering.

3. Qualifications regarding professional expertise and skills:

a) Master the Party's policies, guidelines, and state laws; thoroughly understand the orientation and development tasks of the industry and field.

b) Be well-informed about domestic and international economic-technical information, technological levels of the industry, and advancements in science and technology in the ferry terminal engineering field.

c) Possess in-depth knowledge in the ferry terminal engineering field; have understanding and experience in developing, applying, and deploying technology within the scope of assigned tasks.

d) Have the ability to research, summarize practical experiences, and propose solutions to improve the quality and efficiency of work within the scope of assigned tasks.

đ) Have basic computer technology skills; be able to use foreign languages or ethnic minority languages for civil servants working in ethnic minority regions according to job requirements;

a) Have held the occupational title of Ferry Terminal Engineering Technician Level III and equivalent for at least nine years (excluding probationary and trial periods). In cases with equivalent time, they must have held the occupational title of Ferry Terminal Engineering Technician Level III for at least one year (12 months) up to the deadline for submitting examination registration or promotion application forms.

b) During the period of holding the occupational title of Ferry Terminal Engineering Technician Level III and equivalent, they must have participated in building at least one topic, project, program, or scientific and technological activity at the grassroots level that has been issued or accepted by the competent authority, which the employing agency was responsible for researching and building.

Article 9. Third-Class Ferry Terminal Technician - Code: V.12.22.03

1. Duties:

a) Participate in developing plans, master plans, and specialized technical regulations for ferry terminal operations within the assigned tasks.

b) Participate in researching and proposing policies, directions, plans for development and application of science and technology within the scope of assigned duties;

c) Carry out specialized technical activities: managing, maintaining, operating river-crossing vessels and components of the ferry terminal; inspecting and determining the extent of damage to the ferry terminal structures and formulating repair plans; minor hull repairs on ferries; registering inspections for ferries, tugboats, floating terminals, and guide bridges; regular maintenance of machinery and equipment, and performing other urgent repair work.

d) Guide, supervise, participate in inspections, statistics, information collection, management, and archiving of documents on issues related to the assigned tasks;

đ) Participate in building internal regulations;

e) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate for training in accordance with the occupational title standards for technical civil service professionals in ferry terminal engineering.

3. Qualifications regarding professional expertise and skills:

a) Master the Party's policies, guidelines, and state laws; understand the development direction and tasks of the industry and sector.

b) Understand technical procedures, standards, quotas, safety techniques, labor protection, be proficient in specialized technical operations of ferry terminals; have knowledge about development, application, and implementation of specialized technology; understand methods of organization and implementation within the scope of assigned tasks.

c) Have writing and presentation skills for assigned tasks;

d) Have the ability to summarize practical experiences and propose solutions to improve the quality and efficiency of work within the assigned tasks;

đ) Have basic computer technology skills, be able to use foreign languages or ethnic minority languages for civil servants working in ethnic minority regions according to job requirements;

Chapter III

SALARY GRADING FOR PROFESSIONAL TITLES OF TECHNICAL CIVIL SERVICE STAFF IN THE ROAD ENGINEERING FIELD AND FERRY TERMINAL TECHNICAL FIELD

Article 10. Principles for salary grading of professional titles of technical civil service staff in the road engineering field and ferry terminal technical field

1. The appointment and salary grading of professional titles of technical civil service staff in the road engineering field and ferry terminal technical field must be based on the job position, responsibilities, and specialized technical operations currently undertaken by the staff member and meet all the criteria stipulated in this Circular.

2. When transferring to a professional title of technical civil service staff in the road engineering field and ferry terminal technical field, it shall not combine with salary grade increase or promotion of professional title.

Article 11. Salary Grading for Professional Titles of Technical Civil Service Staff in the Road Engineering Field and Ferry Terminal Technical Field

1. From the date this Circular takes effect, in cases where civil servants do not yet meet the conditions and criteria for appointment to professional titles of technical civil service staff in the road engineering field and ferry terminal technical field as prescribed in Articles 4, 5, 6, 7, 8, and 9 of this Circular, the following measures shall be implemented:

a) If the civil servant has less than five years (60 months) until retirement, they will continue to hold their current rank or professional title and be graded according to the current salary scale.

b) If the civil servant has five years (60 months) or more until retirement, within three years (36 months), the employing agency shall be responsible for arranging training to ensure that the civil servant meets the criteria for the professional title of technical civil service staff in the road engineering field and ferry terminal technical field as stipulated in this Circular. After the specified period, if the civil servant does not meet the criteria stipulated in this Circular, the head of the public institution shall consider assigning alternative suitable positions or implementing policies as prescribed.

2. The professional titles of technical civil service staff in the road engineering field and ferry terminal technical field prescribed in this Circular shall apply the Specialized Professional Salary Scale for State-Owned Public Institutions' Cadres and Staff (Table 3) issued together with Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the salary system for cadres, civil servants, staff members, and armed forces personnel, as follows:

a) The First-Class Road Engineer professional title shall apply the salary coefficient of Category A3, Group 1 (A3.1) from coefficient 6.20 to coefficient 8.00.

b) The Second-Class Road Engineer professional title and the Second-Class Ferry Terminal Engineer professional title shall apply the salary coefficient of Category A2, Group 1 (A2.1) from coefficient 4.40 to coefficient 6.78.

c) The Third-Class Road Engineer professional title and the Third-Class Ferry Terminal Engineer professional title shall apply the salary coefficient of Category A1 from coefficient 2.34 to coefficient 4.98.

d) The Fourth-Class Road Engineer professional title shall apply the salary coefficient of Category A0 from coefficient 2.10 to coefficient 4.89.

3. The salary grading of technical civil service staff in the road engineering field and ferry terminal technical field who are currently holding civil servant or staff ranks shall be transferred to the professional titles of technical civil service staff in the road engineering field and ferry terminal technical field prescribed in this Circular, and shall be carried out according to the guidance provided in Clause 2, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs on salary grading when upgrading, changing ranks, or changing categories of civil servants and staff members, as follows:

a) Grade the First-Class Road Engineer professional title (code V.12.21.01) for staff members currently holding Category A3, Group 1 (A3.1).

b) Grade the Second-Class Road Engineer professional title (code V.12.21.02) and the Second-Class Ferry Terminal Engineer professional title (code V.12.22.02) for staff members currently holding Category A2, Group 1 (A2.1).

c) Grade the Third-Class Road Engineer professional title (code V.12.21.03) and the Third-Class Ferry Terminal Engineer professional title (code V.12.22.03) for staff members currently holding Category A1.

d) Grade the Fourth-Class Road Engineer professional title (code V.12.21.04) for staff members currently holding Category A0.

Chapter IV

IMPLEMENTING PROVISIONS

Article 12. Effective Date

1. This Circular takes effect from March 1, 2023.

2. In cases where the legal normative documents referred to in this Circular are amended, supplemented, or replaced, they shall be implemented according to the provisions of the amended, supplemented, or replacing legal normative documents.

Article 13. Implementation Organization

The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Heads of agencies, units, organizations, and individuals concerned shall be responsible for implementing this Circular./.
