Regulations on physical education activities động in schools

Pursuant to the Education Law dated June 14, 2019;
Pursuant to the Higher Education Law dated June 18, 2012; the Law Amending and Supplementing Certain Provisions of the Higher Education Law dated November 19, 2018;
Pursuant to the Law on Physical Education and Sports dated November 29, 2006; the Law Amending and Supplementing Certain Provisions of the Law on Physical Education and Sports dated June 14, 2018;
Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to the Government Decree No. 11/2015/NĐ-CP dated January 31, 2015 stipulating physical education and sports activities in schools;
At the proposal of the Director of the Department of Physical Education;
The Minister of Education and Training issues this Circular toprovisions on sports activities in schools.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates sports activities in schools, including: the organization of sports activities; tasks and rights of teachers and lecturers teaching Physical Education subjects (hereinafter referred to collectively as teachers and lecturers of Physical Education) and students; finance and infrastructure.
Article 2. Applicability
Article 1. This Circular applies to primary schools, secondary schools, high schools, general schools with multiple levels, boarding schools for ethnic minorities, semi-boarding schools for ethnic minorities, preparatory universities, specialized schools, gifted schools; universities, academies, university colleges, teacher training colleges, secondary teacher training colleges (hereinafter referred to collectively as schools); agencies, organizations, and individuals related thereto.
Article 2. This Circular does not apply to schools and classes for persons with disabilities; reformatory schools; sports talent schools; schools training specialized sports.
Chapter II
CONTENTS OF ORGANIZING SPORTS ACTIVITIES
IN SCHOOLS
Article 3. Sports clubs
Clause 1. Establish, manage, and develop sports clubs for various disciplines based on the actual conditions of the school and the needs, preferences, and health conditions of students and trainees. Each school shall have at least one regularly operating sports club.
Clause 2. Reasonably allocate time, integrate sports club activities with Physical Education subjects in the educational programs of all levels and training degrees to ensure continuity and contribute to the comprehensive development of physical fitness and school sports.
Clause 3. Organize the development of swimming, traditional martial arts, and ethnic sports suitable to local traditions and actual conditions.
Article 4. Training and Competitions
Clause 1. Establish and maintain regular training of talented teams in each sport discipline as the core of the school's sports activities.
Clause 2. Regularly organize morning exercises and intermission exercises; effectively utilize the school's infrastructure and integrate music-based exercise routines to create a lively and engaging atmosphere that attracts students' active participation.
Clause 3. Organize at least one sports competition annually for students and trainees, with competition content and formats appropriate to the psychological and physiological characteristics of the age group and the school's infrastructure; select students and trainees to participate in domestic and international sports competitions.
Article 5. Guidance and Education to Enhance Skills in Participating in Sports Activities
Clause 1. Guide and educate to enhance awareness about safety skills for both instructors and participants in physical education and sports activities.
Clause 2. Integrate with relevant projects and programs to ensure proper nutrition and strengthen physical activities for students and trainees to improve health, height, and physical strength.
Clause 3. Strengthen the application of information technology to collect various physical education and sports exercises to diversify training content and forms. Guide students, trainees, and parents to safely and effectively exploit online information for physical education and sports activities.
Clause 4. Train and enhance teachers and lecturers of Physical Education with knowledge and skills to identify and nurture sports talents within the school.
Clause 5. Organize counseling and guidance for students to participate in training and competitions in various sports to enhance physical strength and develop physical fitness.
Chapter III
TASKS AND RIGHTS OF PHYSICAL EDUCATION TEACHERS AND STUDENTS
AND TRAINERS
Article 6. Physical Education Teachers and Lecturers
1. Duties of Physical Education Teachers and Lecturers
a) Advise school leadership to diversify forms of organizing sports activities; be the core in organizing sports activities; manage, direct, and guide the establishment of sports clubs, maintain and develop sports movements within the school.
b) Based on students' needs and actual conditions of the school, proactively advise on mobilizing resources of physical education teachers and lecturers within the school and invite external instructors to participate in guiding specialized activities to effectively organize sports activities.
c) Identify and nurture students with athletic talent to participate in sports competitions at grassroots, national, and international levels; propose specific solutions to assist students with weak physical fitness who have not met the curriculum requirements for Physical Education subjects, who have not met the standards for physical fitness assessment and classification; students with congenital diseases are exempted or allowed to participate in training with appropriate content and forms.
d) Perform other duties of teachers as currently prescribed.
2. Rights of Physical Education Teachers and Lecturers
a) Be provided opportunities for training, upgrading knowledge and expertise in professional skills, methods, forms, and techniques for organizing sports activities within the school.
b) Be given conditions to participate in coaching work for school teams.
c) Enjoy rights and benefits of teachers and lecturers and other systems in the field of physical education and sports as currently prescribed.
Article 7. Students
1. Duties of Students
a) Participate in exercise and sports competition activities according to the school's plan and educational management agencies at all levels; join sports clubs based on personal interests and age characteristics. Student participation in sports competition activities proposed by other organizations must be approved by the school.
b) Annually complete physical fitness assessment and classification contents as currently prescribed.
c) Perform other student duties as currently prescribed.
2. Rights of Students
a) Students are entitled to participate in sports activities within the school; selected and sent to participate in competitions and congresses at grassroots, national, and international levels.
b) Students with athletic talent are eligible for selection and training at sports schools as prescribed.
c) Students winning gold, silver, and bronze medals in national-level sports competitions organized by educational management agencies and students who are members of the national team participating in regional, continental, and world sports competitions are entitled to preferential treatment and encouragement when participating in high school entrance exams, high school graduation exams, university and college admissions according to current regulations.
d) University students winning gold, silver, and bronze medals in national-level sports competitions organized by educational management agencies and students who are members of the national team participating in regional, continental, and world sports competitions are exempt from the Physical Education subject in that academic year.
e) Be assisted by the school, teachers, and lecturers to complete the Physical Education course and meet the physical fitness assessment and classification standards for students. Students with congenital diseases are allowed to participate in training with appropriate content and forms.
f) Students selected by the school and educational management agencies at all levels to participate in sports competitions, if they miss more than the prescribed time, the school is responsible for organizing supplementary teaching to ensure they meet the conditions for examinations and credits as prescribed.
g) Students who are athletes concentrated in national team training or training centers for athletes in provinces, cities, sectors, and the country are provided favorable conditions by educational management agencies at all levels to continue regular studies to ensure completion of general education programs and training levels appropriate to their age with suitable forms.
h) Enjoy other student rights as currently prescribed.
Chapter IV
FINANCIAL AND INFRASTRUCTURE
Article 8. Finance
1. Annual state budget sources to organize sports activities.
2. Sponsorship and support from domestic and foreign organizations and individuals in accordance with the law; other legitimate funding sources for training and competition activities.
3. Revenue from exploiting services of school sports facilities for new construction, maintenance, and development of sports movements within the school, prioritizing the needs of students' study and training.
Article 9. Physical Infrastructure
1. Departments, sectors, mass organizations, and localities shall create conditions for schools to use: training fields, multi-purpose training halls, training rooms, swimming pools, and sports equipment within their jurisdiction to serve physical education and sports activities in schools.
2. Strengthen socialization efforts to attract organizations and individuals to participate in investing in building, upgrading, and renovating sports facilities and training equipment in schools and communities to meet the needs of student sports activities.
Chapter V
IMPLEMENTATION
Article 10. Responsibilities of Departments of Education and Training
1. Annually, inspect and evaluate the implementation of this Circular to grasp the current situation, promptly guide, instruct, and propose competent authorities to adjust regulations in line with reality.
2. Organize training courses to enhance professional and vocational skills, and send management staff and physical education teachers to training sessions, workshops to update information and improve professional and vocational skills.
3. Create conditions to increase new construction, repair, and improve the quantity and quality of infrastructure serving learning, training, and competition activities of various sports for students.
4. Annually, direct and organize sports competitions at different levels for students with appropriate scale and form according to practical conditions to develop school sports movements. Send delegations to participate in sports competitions organized by the Ministry of Education and Training and the Vietnam Student Sports Association.
5. Direct, inspect, and organize the Phu Dong Health Festival periodically:
a) School level: Organize once a year on the occasion of celebrating holidays.
c) Provincial and centrally-administered city level: Depending on the actual conditions of each locality, organize every two years or every four years.
d) National Phu Dong Health Festival: Organize every four years.
Article 11. Responsibilities of Schools
1. Strictly implement this Circular and the guidance and instructions of higher-level educational management agencies.
2. Implement the assessment and classification of students' and trainees' physical fitness as prescribed.
3. Arrange physical education teachers to guide, organize, and manage sports clubs and sports competition activities.
4. Develop plans and create conditions for physical education teachers to be trained and further educated to improve their professional and vocational skills; participate in scientific research; guide and organize sports training and competition activities; train teams to participate in sports competitions at various levels.
5. Develop plans to organize sports activities for students and trainees in the school and send delegations to participate in sports competition activities organized by educational management agencies at all levels, the Vietnam Student Sports Association, and the Vietnam University and Professional Sports Association.
6. Annually, plan the construction, renovation, preservation, and utilization of infrastructure; purchase and supplement physical education and sports equipment to serve physical education subjects and sports activities.
Article 12. Responsibilities of the Vietnam Student Sports Association and the Vietnam University and Professional Sports Association
1. Organize and participate in domestic national and international sports competitions for students and trainees according to the plans and directives of the Ministry of Education and Training.
2. Represent Vietnamese students and trainees as official members in accordance with the regulations of regional, continental, and world student and trainee sports organizations.
Article 13. Responsibilities of People's Committees at all levels
1. Allocate funds, create favorable conditions regarding land funds and investment in sports facilities to serve physical education and school sports work; mobilize resources and promote socialization in line with specific local conditions to develop school sports.
2. Integrate planning and development plans for physical education and school sports within their jurisdiction in accordance with the socio-economic development tasks of the locality.
3. Direct educational management agencies to cooperate with physical education and sports management agencies to utilize physical education and sports infrastructure, equipment, and tools in the locality to serve physical education and school sports work.
4. Support investment in building physical education and sports infrastructure, equipment, and tools to serve physical education and school sports for educational institutions in remote, border, island, and particularly difficult economic and social condition areas.
5. Approve plans and allocate funds for educational management agencies at all levels to organize sports competitions for students, managers, teachers, and participate in sports activities organized by the Ministry of Education and Training, the Vietnam Student Sports Association, and the Vietnam University and Professional Sports Association.
Chapter VI
IMPLEMENTATION PROVISIONS
Article 14. Effective Date
1. This Circular takes effect from February 15, 2021.
2. This Circular replaces the provisions on sports activities content in Decision No. 14/2001/QD-BGDĐT dated May 3, 2001 of the Minister of Education and Training on the issuance of the Physical Education and School Health Regulations; it also replaces Decision No. 72/2008/QD-BGDĐT dated December 23, 2008 of the Minister of Education and Training on the organization of extracurricular sports activities for students and trainees.
Article 15. Responsibility for Implementation
The Director of the Office, the Head of the Department of Physical Education, the Heads of units under the Ministry of Education and Training; the Directors of the Departments of Education and Training, Education, Science, and Technology of Bac Lieu Province; the Rectors of universities and academies; the Principals of university and college teacher training schools, secondary teacher training schools; relevant organizations and individuals are responsible for implementing this Circular.
