CIRCULAR
Amending and supplementing certain provisions of Circular No. 28/2009/TT-BCT dated September 28, 2009 issued by the Minister of Industry and Trade to confirm tariff quotas for natural honey imports into Japan under the Agreement between the Socialist Republic of Vietnam and Japanon Economic PartnershipPursuant to Decree No. 78/2025/NĐ-CP dated April 1, 2025 of the Government detailing some articles and measures to organize and guide the implementation of the Law on Legislative Documents, amended and supplemented by some articles pursuant to Decree No. 187/2025/NĐ-CP dated July 1, 2025 of the Government;The Agreement between the Socialist Republic of Vietnam and Japan on Economic Partnership signed on December 25, 2008 in Tokyo, Japan;
Pursuant to the Law on Government Organization No. 63/2025/QH15;
Pursuant to the Law on Legislative Regulatory Documents No. 64/2025/QH15;
Pursuant to Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly on handling certain issues related to the restructuring of the state apparatus;
Pursuant to Decree No. 40/2025/NĐ-CP dated February 26, 2025, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
The Minister of Industry and Trade issues this Circular amending and supplementing certain provisions of Circular No. 28/2009/TT-BCT dated September 28, 2009 issued by the Minister of Industry and Trade to confirm tariff quotas for natural honey imports into Japan under the Agreement between the Socialist Republic of Vietnam and Japan on Economic Partnership.
Pursuant toAmending and supplementing certain provisions of Circular No. 28/2009/TT-BCT dated September 28, 2009 issued by the Minister of Industry and Trade to confirm tariff quotas for natural honey imports into Japan under the Agreement between the Socialist Republic of Vietnam and Japan on Economic Partnership
At the proposal of the Director of the Import-Export Department,
1. Amend Article 6 as follows:
Article 1. "Article 6. Principles for Confirming the Certificate of Tariff Quota
1. Businesses wishing to enjoy the preferential tax treatment provided by Japan under the tariff quota for natural honey imports into Japan under the Agreement between the Socialist Republic of Vietnam and Japan on Economic Partnership must submit their application at the licensing authority (Provincial People's Committee) where the exporting business is headquartered to be confirmed.
2. Based on the annual tariff quota allocated by Japan to Vietnam as stipulated in Appendix 2 of this Circular and based on the date of receipt of the registration for confirmation, the Certificate of Tariff Quota for the exporting business will be confirmed according to the principle that businesses registering earlier will be considered first, those registering later will be considered later. For the amount of natural honey registered for export exceeding the remaining quota for that year, the Provincial People's Committee will consider confirming the Certificate of Tariff Quota according to the remaining quota."
2. Amend Clause 3 of Article 7 as follows:
"3. In cases where enterprises fail to submit the documents specified in Clause 2 of this Article, the Ministry of Industry and Trade will notify and request Japan not to issue the Certificate of Tariff Quota for the importing enterprise in Japan after receiving the report from the Provincial People's Committee."
3. Amend Article 9 as follows:
"Article 9. Confirmation of the Certificate of Tariff Quota
1. The Provincial People's Committee shall complete the confirmation of the Certificate of Tariff Quota within three (03) working days from the date of receipt of a complete set of documents.
2. In case of non-confirmation, the Provincial People's Committee shall provide a written response stating the reasons."

“Article 10. Reconfirmation due to damage, loss, or destruction of the Quota Tariff Certificate
In the event that the Quota Tariff Certificate is torn, lost, or damaged, the trader may submit an application to the Provincial People's Committee requesting confirmation of a certified true copy of the original Quota Tariff Certificate. The Provincial People's Committee will confirm the copy based on the export documents kept at the Provincial People's Committee, and this copy must bear the phrase "CERTIFIED TRUE COPY" in the "REMARKS" section of the Quota Tariff Certificate. This copy shall be dated with the confirmation date of the original Quota Tariff Certificate. This certified copy shall be confirmed within the validity period of the original Quota Tariff Certificate.
5. Amend Article 11 as follows:
"Article 11. Return of the Quota Tariff Certificate due to non-export
In the case where the trader does not use the Quota Tariff Certificate they have requested confirmation for because the consignment of goods for which the Quota Tariff Certificate was applied for has not been exported or has been returned to Vietnam after export, the trader must return the previously confirmed Quota Tariff Certificate to the Provincial People's Committee that confirmed the Quota Tariff Certificate."
Article 2. Implementation clause
This Circular takes effect from September 3, 2025.
