Decision No. 49/2003/QĐ-BVHTT on amending and supplementing Decision No. 18/2002/QĐ-BVHTT dated July 29, 2002 promulgating the regulations on issuing permits, inspection, examination, and handling violations related to importing foreign television programs.

DECISION

Regarding the amendment and supplementation of Decision No. 18/2002/QĐ-BVHTT dated July 29, 2002 on the issuance of permits, inspection, and supervision,handling violations related to the reception of foreign television programs In accordance with Decree No. 63/2003/NĐ-CP dated June 11, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture and Information;

THE MINISTER OF CULTURE AND INFORMATION

In accordance with the Press Law dated December 28, 1989 and the Law Amending and Supplementing Certain Provisions of the Press Law dated June 12, 1999;

In accordance with Decree No. 51/2002/NĐ-CP dated April 26, 2002 of the Government detailing the implementation of the Press Law and the Law Amending and Supplementing Certain Provisions of the Press Law;

In accordance with Decision No. 150/2003/QĐ-TTg dated July 22, 2003 of the Prime Minister amending and supplementing Decision No. 46/2001/QĐ-TTg on the management of export and import goods during the period of 2001-2005 and Decision No. 79/2002/QĐ-TTg on the management of the reception of foreign television programs;

Amend and supplement Article 13, Section E, Chapter I and Article 14, Article 15, Chapter II of the Regulation on the issuance of permits, inspection, and supervision, handling violations related to the reception of foreign television programs issued together with Decision No. 18/2002/QĐ-BVHTT dated July 29, 2002 as follows:

Upon the proposal of the Director of the Press Department under the Ministry of Culture and Information,

 DECISION:

Article 1. "Section E: Import and business of satellite direct broadcast receiving equipment (TVRO)

The importing and business entities of satellite direct broadcast receiving equipment (TVRO) must apply for permission and obtain written approval from the Ministry of Culture and Information for each consignment of imported and business equipment.

Article 13:

The importing and business entities of satellite direct broadcast receiving equipment (TVRO) submit applications for import and business permits for TVRO equipment to the Department of Press under the Ministry of Culture and Information.

The application for import and business permit for TVRO equipment must clearly state the purpose of import and business, the name of the equipment, technical specifications of the equipment, origin of the equipment, quantity, type, model.

The documents include:

Price list, catalog of the equipment and technical documentation attached.

A copy of the registration certificate for the entity engaged in installation and repair of satellite direct broadcast receiving equipment (TVRO) issued by the Ministry of Culture and Information.

Inspection and supervision The specialized inspection agency of culture and information performs its specialized inspection functions as prescribed by law. The Department of Press under the Ministry of Culture and Information is responsible for organizing regular annual inspections or spot checks on the issuance and use of permits for the reception of foreign television programs directly from satellites; the import and business of TVRO equipment; the provision and distribution of foreign television program decoders; the installation and repair of satellite direct broadcast receiving equipment.

Article 14:

Reporting system1. Provincial Departments of Culture and Information have the responsibility to: Send one (01) copy of the permit for the reception of foreign television programs directly from satellites issued to organizations and individuals within their jurisdiction to the Department of Press under the Ministry of Culture and Information. Implement a semi-annual and annual reporting system on the issuance and use of permits for the reception of foreign television programs directly from satellites within their jurisdiction to the Department of Press under the Ministry of Culture and Information.2. Representatives in Vietnam distributing foreign television program decoders have the responsibility to report annually on the number of decoders provided and the recipients thereof to the Department of Press under the Ministry of Culture and Information.3. Organizations and entities engaged in the business of installation and repair of satellite direct broadcast receiving equipment have the responsibility to report annually on the number and list, address of the recipients who have been installed and repaired satellite direct broadcast receiving equipment by the organization or entity to the Department of Press under the Ministry of Culture and Information.4. Organizations and entities importing and business of satellite direct broadcast receiving equipment have the responsibility to report annually on the import and business of TVRO equipment approved by the Ministry of Culture and Information for import and business."

Article 15:

The Director of the Department of Press, the Inspector General of the Ministry of Culture and Information, the Directors of Provincial Departments of Culture and Information, and all organizations and individuals are responsible for implementing this Decision.

Article 2. The Director of the Press Department, the Inspector General of the Ministry of Culture and Information, the Directors of the Departments of Culture and Information of provinces and centrally governed cities, and all organizations and individuals are responsible for implementing this Decision.

Article 3. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER ITS PUBLICATION IN THE OFFICIAL GAZETTE.
