Competition and reward activities in the natural resources and environment sector shall be carried out in accordance with the principles stipulated in Clause 1, Article 6 of the Law on Competition and Rewards 2003; Clause 3, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards 2013; Article 3 of Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards (hereinafter referred to as Decree No. 42/2010/NĐ-CP); Article 2 of Decree No. 65/2014/NĐ-CP dated July 1, 2014 of the Government detailing the implementation of certain provisions of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards in 2013 (hereinafter referred to as Decree No. 65/2014/NĐ-CP) and Article 1 of Circular No. 07/2014/TT-BNV dated August 29, 2014 of the Ministry of Home Affairs guiding the implementation of certain provisions of Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards, Decree No. 39/2012/NĐ-CP dated April 27, 2012 of the Government amending and supplementing certain provisions of Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government and Decree No. 65/2014/NĐ-CP dated July 1, 2014 of the Government detailing the implementation of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards in 2013 (hereinafter referred to as Circular No. 07/2014/TT-BNV)., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP 2. Individuals and organizations under disciplinary action; under consideration for disciplinary action; with unresolved complaints or accusations shall not be considered for awarding competition titles and proposing rewards.ẽ đNo.1. Based on the characteristics of position, functions, tasks, nature of work, and scope of operation of the organization, the Minister of Natural Resources and Environment decides to establish Competition Blocks and Clusters in the natural resources and environment sector. Each Competition Block consists of several units directly under the Ministry, each Cluster consists of several Provincial Departments of Natural Resources and Environment. 1. A railway project exceeding its service life is a project that has been in operation and use for a longer period than the service life specified in the project design documents. 2. On the basis of nominations from Competition Blocks and Clusters (hereinafter referred to as Blocks and Clusters), the Director of the Department of Competition and Reward and Propaganda proposes to the Minister of Natural Resources and Environment to decide on recognizing Block Leaders, Cluster Leaders, Deputy Block Leaders, and Deputy Cluster Leaders. Block Leaders and Cluster Leaders lead and direct the activities of their respective Blocks and Clusters, are responsible for all activities within their Blocks and Clusters, chair and conclude meetings of their Blocks and Clusters, and propose rewards according to regulations.

Pursuant to Decree No. 21/2013/NĐ-CP dated March 4, 2013 of the Government stipulating functions, tasks, organization and operational mechanisms;onvề nhiệm vụ và cơ cấu tổ chức của Bộ Tài nguyên và Môi trường;

Deputy Block Leaders and Deputy Cluster Leaders assist Block Leaders and Cluster Leaders in implementing activities of their respective Blocks and Clusters when the leaders are absent or when necessary. Deputy Block Leaders and Deputy Cluster Leaders are responsible for their decisions before Block Leaders and Cluster Leaders and the law.u3. Blocks and Clusters perform specific tasks as follows:

The Minister of Natural Resources and Environment issues this Circular guiding a) Organize the launch and signing of competition agreements to respond to and implement competition movements launched by the Ministry of Natural Resources and Environment; set targets, contents, and methods to implement competition movements within their Blocks and Clusters;For power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.b) Organize appropriate and practical activities to share professional experiences, build new models, and exemplary cases within their Blocks and Clusters; evaluate the effectiveness and impact of competition movements, score and rank organizations participating in competitions within their Blocks and Clusters according to the ranking criteria and scoring system of the Ministry;

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

d) Nominate and honor outstanding collectives within their Blocks and Clusters to be considered for competition titles and appropriate reward forms.

1. Competition movements and the awarding of commendation titles.

2. Rewards and reward standards.

3. Authority to decide and confer; procedures and documents for nominating commendation titles and forms of reward.

4. The Competition and Reward Councils and the Innovation Councils at all levels.

5. The Competition and Reward Fund of the Ministry of Natural Resources and Environment; rights and obligations of individuals and organizations awarded commendation titles and forms of reward.

Article 2. Applicability

Individuals and organizations working in the natural resources and environment sector; individuals and organizations working outside the natural resources and environment sector; overseas Vietnamese; foreign organizations and individuals who have made contributions to the construction and development of the natural resources and environment sector; other related individuals and organizations.

Article 3. Principles of Competition and Reward

1. Competition and rewards in the natural resources and environment sector shall be implemented in accordance with the principles stipulated in Clause 1, Article 6 of the Law on Competition and Rewards 2003; Clause 3, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards 2013; Article 3 of Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards (hereinafter referred to as Decree No. 42/2010/ND-CP); Article 2 of Decree No. 65/2014/ND-CP dated July 1, 2014 of the Government detailing the implementation of certain provisions of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards 2013 (hereinafter referred to as Decree No. 65/2014/ND-CP) and Article 1 of Circular No. 07/2014/TT-BNV dated August 29, 2014 of the Ministry of Home Affairs guiding the implementation of certain provisions of Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards, Decree No. 39/2012/ND-CP dated April 27, 2012 of the Government amending and supplementing certain provisions of Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government and Decree No. 65/2014/ND-CP dated July 1, 2014 of the Government detailing the implementation of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards 2013 (hereinafter referred to as Circular No. 07/2014/TT-BNV).

2. Individuals and organizations under disciplinary action; being considered for disciplinary action; having complaints or denunciations that have not been verified and clarified shall not be considered for awarding commendation titles and proposing rewards.

Article 4. Competition Blocs, Competition Clusters of the Natural Resources and Environment Sector

1. Based on the characteristics of position, functions, tasks, nature of work, and scope of activities of the organization, the Minister of Natural Resources and Environment decides to establish Competition Blocks and Competition Clusters in the natural resources and environment sector. Each Competition Block consists of several subordinate units of the Ministry, each Competition Cluster consists of several Provincial Departments of Natural Resources and Environment.

2. On the basis of nominations and recommendations from the Competition Blocks and Clusters (hereinafter referred to as Competition Blocks and Clusters), the Director of the Department of Competition and Reward and Propaganda proposes to the Minister of Natural Resources and Environment to decide on recognizing the Block Leaders, Cluster Leaders, Deputy Block Leaders, and Deputy Cluster Leaders. The Block Leader and Cluster Leader lead and direct the activities of the Competition Block and Cluster, are responsible for all activities of the Competition Block and Cluster, chair and conclude meetings of the Competition Block and Cluster, and propose rewards according to regulations.

The Deputy Block Leader and Deputy Cluster Leader assist the Block Leader and Cluster Leader in implementing the activities of the Competition Block and Cluster when the leader is absent or when necessary. The Deputy Block Leader and Deputy Cluster Leader are responsible for their decisions before the Block Leader and Cluster Leader and before the law.

3. The Competition Blocks and Clusters shall perform specific tasks as follows:

a) Organizing the launch and signing of competition agreements to respond to and implement the competition movements initiated by the Ministry of Natural Resources and Environment; setting out targets, contents, and measures to implement the competition movement within the Competition Blocks and Clusters;

b) Organizing appropriate and practical activities to share professional experiences, build new models, and exemplary cases within the Competition Blocks and Clusters; evaluating the effectiveness and impact of the competition movement, scoring, and ranking organizations participating in the Competition Blocks and Clusters according to the ranking criteria and scoring standards set by the Ministry;

c) Summarize and conclude the annual competition movements and develop plans, directions, and tasks for organizing the competition movements of the Blocs and Clusters for the next year;

d) Selecting and honoring outstanding and exemplary collectives within the Competition Blocks and Clusters to nominate for commendation titles and appropriate forms of reward.

Article 5. Responsibilities in the work of competition and commendation Encouragement and Reward

1. Responsibilities of the Director of the Department of Competition, Commendation, and Propaganda:

a) Take the lead and coordinate with the Heads of relevant units under the Ministry to propose to the Minister on policies, plans, contents, and measures for organizing competitive movements; guide, urge, summarize, and conclude competitive movements and commendation work; draft and perfect legal normative documents on competition and commendation; promote, disseminate, guide, and organize the implementation of laws on competition and commendation; organize training for cadres and civil servants working in competition and commendation; build, nurture, promote, and expand exemplary models and good deeds in the industry; review files proposing to award commendation titles and commendation forms to be submitted to the Competition and Commendation Council of the Ministry or to the Minister for approval according to their authority or to higher authorities for approval; organize inspections on competition and commendation work within all units in the industry; coordinate in handling complaints and denunciations and advise and coordinate in organizing the presentation of commendation titles and forms according to the law;

b) Take the lead and coordinate with the Heads of relevant agencies, organizations, and units to implement databases on competition and awards;

c) Take the lead and coordinate with the Heads of relevant units under the Ministry to advise the Minister to issue criteria for scoring and ranking and organize scoring and ranking of Groups and Clusters according to the Ministry's competition scoring and ranking criteria.

2. Responsibilities of the Heads of units under the Ministry, Directors of Provincial Departments of Natural Resources and Environment:

a) Direct the establishment of content, criteria, and methods to organize competition movements suitable to the functions, tasks, organizational structures, management objects, and specific conditions of each agency, organization, and unit;

b) Launch competitive movements, organize and implement, urge, inspect, summarize, and conclude competitive movements within their agencies and units;

c) Identify, evaluate, and select individuals and groups with outstanding achievements to be awarded commendation titles and forms according to their authority or to be submitted to higher authorities for approval according to regulations;

d) Implement the application of information technology in competition and award activities;

d) Summarize and assess competition and commendation work, evaluate commendation titles and forms based on the results of evaluating cadres, civil servants, public officials, workers, administrative reform outcomes, and the completion of tasks by organizations annually or at the end of competitive movements.

3. Information and press agencies of the natural resources and environment sector have the responsibility to promote competition and commendation work; identify individuals and groups with outstanding achievements in competitive movements to set examples or introduce to various levels of Competition and Commendation Councils for commendation consideration; combat and criticize violations of laws on competition and commendation in the natural resources and environment sector.

Article 6. Invention

1. Inventions in the activities of the natural resources and environment sector (hereinafter referred to as inventions) are management, technical, operational solutions, or applications of technological progress (collectively referred to as solutions) that are new within the scope of the base, have been applied or tested at the base, and have the potential to bring practical benefits, recognized by the organization and not excluded from the objects subject to exclusion as stipulated in Clause 2, Article 3 of Decree No. 13/2012/NĐ-CP dated March 2, 2012 of the Government promulgating the Statute on Inventions.

2. Types of inventions:

a) National-level inventions are new solutions created or improved from previous solutions, applied in natural resources and environment activities, capable of bringing practical benefits and effectiveness to the entire country;

b) Ministry-level inventions are new solutions created or improved from previous solutions, applied in natural resources and environment activities, capable of bringing practical benefits and effectiveness to the natural resources and environment sector;

c) Base-level inventions are new solutions created or improved from previous solutions applied in natural resources and environment activities, capable of bringing practical benefits and effectiveness to the operations of the unit.

3. Authority to examine and evaluate inventions:

a) The Ministry of Natural Resources and Environment Invention Council has the task of advising the Minister to objectively and honestly examine and evaluate the extent and impact of Ministry-level and national-level inventions;

b) The base-level invention council has the task of assisting unit heads to examine and evaluate the impact of base-level inventions.

4. Conditions, procedures, and formalities for examining and recognizing inventions shall be implemented in accordance with Decree No. 13/2012/NĐ-CP dated March 2, 2012 of the Government promulgating the Statute on Inventions; Circular No. 18/2013/TT-BKHCN dated August 1, 2013 of the Minister of Science and Technology guiding the implementation of certain provisions of the Statute on Inventions issued pursuant to Decree No. 13/2012/NĐ-CP.

Chapter II

COMPETITION MOVEMENT AND EVALUATION FOR COMPETITION AWARDS

Article 7. Forms and contents of organizing competitive movements

1. Regular competition is a form of competition based on the functions and tasks assigned to individuals and groups to organize and launch, aiming to perform daily, monthly, quarterly, and annual tasks well within agencies and units. The subjects of regular competition are individuals within a group, groups within the same agency, organization, or unit, or between units within a Group or Cluster or throughout the industry.

The organization of regular competition movements must clearly define objectives, requirements, goals, specific indicators at the unit level or according to the Group or Cluster to launch competition movements and sign competition agreements. At the end of the year, the unit head, Groups, and Clusters will conduct summaries, evaluations, and propose commendation titles and forms according to regulations.

2. Special topic competition (or periodic competition) is a form of competition aimed at performing key tasks determined within a specific period or organizing competition to strive to complete urgent tasks of the unit. Agencies, organizations, and units can only launch special topic (or periodic) competitions after clearly defining the objectives, requirements, indicators, contents, and timeframes.

a) Upon the expiration of the term for organizing the campaign of competition and emulation within the sector, units, Groups, Clusters shall conduct a summary, evaluation, and propose commendation titles and forms of reward according to their authority. In cases where the campaign is organized nationwide, when summarizing and concluding the campaign lasting three years or more, the Ministry shall select individuals and collectives with outstanding achievements to propose the Prime Minister award Certificates of Merit; for campaigns lasting five years or more, the Ministry shall select individuals and collectives with exceptionally outstanding achievements to propose the State President consider awarding the "Labor Medal" third class.

b) When organizing a campaign of competition and emulation within the sector lasting three years or more, the Ministry of Natural Resources and Environment shall send the plan to organize and launch the campaign of competition and emulation to the Central Steering Committee for Competition and Emulation for consolidation and guidance on rewarding.

3. The content of organizing the campaign of competition and emulation in the natural resources and environment sector shall be implemented in accordance with Article 7 of Decree No. 42/2010/ND-CP; Article 3 of Circular No. 07/2014/TT-BNV.

Annually, the Minister of Natural Resources and Environment shall direct the development of the content, criteria, and plans to organize and launch regular campaigns of competition and emulation and campaigns of competition and emulation by topics within the entire sector. The campaign of competition and emulation must have a theme, clear content, and criteria that are appropriate to reality; the content closely aligns with political tasks, key and urgent tasks of the sector, specific and practical methods of competition and emulation suitable to the conditions and capabilities of participation of agencies, organizations, units, and individuals.

Article 8. Commendation Titles

1. For individuals: "Advanced Worker", "Model Worker at the Grassroots Level", "Model Worker in the Natural Resources and Environment Sector", "National Model Worker".

2. For collectives: "Advanced Worker Collective", "Outstanding Worker Collective", "Flag of Competition and Emulation of the Ministry of Natural Resources and Environment", "Flag of Competition and Emulation of the Government".

Article 9. Criteria for commendation titles

1. The title "Advanced Worker" is awarded annually to individuals meeting the criteria specified in Article 5 of Decree No. 65/2014/ND-CP.

2. The title "Model Worker at the Grassroots Level" is awarded annually to individuals meeting the criteria stipulated in Article 4 of Decree No. 65/2014/ND-CP.

The ratio of individuals recognized with the title "Model Worker at the Grassroots Level" shall not exceed 15% of the total number of individuals achieving the title "Advanced Worker".

3. The title "Model Worker in the Natural Resources and Environment Sector" is awarded to individuals meeting the criteria specified in Clause 1, Article 14 of Decree No. 42/2010/ND-CP.

4. The title "National Model Worker" is awarded to individuals meeting the criteria specified in Article 3 of Decree No. 65/2014/ND-CP.

5. The title "Advanced Worker Collective" is awarded annually to collectives meeting the criteria specified in Clause 1, Article 28 of the Law on Competition and Emulation.

6. The title "Outstanding Worker Collective" is awarded annually to collectives meeting the criteria specified in Clause 1, Article 27 of the Law on Competition and Emulation.

The Minister of Natural Resources and Environment awards the title "Outstanding Worker Collective" annually to: subordinate units of the Ministry; organizations under the Departments, Inspectorate of the Ministry, Office of the Ministry, General Departments, Bureaus, Institutes, Schools, National Hydro-Meteorological Center, National Center for Water Resources Planning and Investigation, Vietnam National Resources and Environment Corporation, Southern Vietnam National Resources and Environment Joint Stock Company, Vietnam National Resources and Environment Publishing House Joint Stock Company; organizations under the Regional Hydro-Meteorological Stations belonging to the National Hydro-Meteorological Center; organizations under the Associations belonging to the Vietnam General Department of Geology and Mineral Resources and the National Center for Water Resources Planning and Investigation.

7. The title "Flag of Competition and Emulation of the Ministry of Natural Resources and Environment" is awarded annually to collectives that have registered for competition and emulation, are exemplary and outstanding in the campaign of competition and emulation of the sector, have achieved the title "Outstanding Worker Collective" and meet the criteria specified in Article 26 of the Law on Competition and Emulation and Article 16 of Decree No. 42/2010/ND-CP.

The Minister of Natural Resources and Environment awards the title "Flag of Competition and Emulation of the Ministry of Natural Resources and Environment" to exemplary and outstanding collectives in the Groups, Clusters of competition and emulation; exemplary and outstanding organizations in the campaign of competition and emulation of the General Departments, Bureaus, Institutes, Schools, National Hydro-Meteorological Center, National Center for Water Resources Planning and Investigation, Inspectorate of the Ministry, Office of the Ministry, Vietnam National Resources and Environment Corporation, Southern Vietnam National Resources and Environment Joint Stock Company, Vietnam National Resources and Environment Publishing House Joint Stock Company.

8. The title "Flag of Competition and Emulation of the Government" is awarded annually to collectives under the Ministry that have registered for competition and emulation, are the most exemplary and outstanding in the campaign of competition and emulation of the Ministry of Natural Resources and Environment, have achieved the title "Flag of Competition and Emulation of the Ministry of Natural Resources and Environment" and meet the criteria specified in Article 25 of the Law on Competition and Emulation and Article 16 of Decree No. 42/2010/ND-CP of the Government.

The number of collectives proposed for consideration for the "Flag of Competition and Emulation of the Government" shall not exceed 20% of the total number of collectives awarded the "Flag of Competition and Emulation of the Ministry of Natural Resources and Environment".

Article 10. Registration of Commendation Titles and Signing of Competition Agreements

1. Annually, after the Minister launches the competition movement, units under the Ministry shall register for commendation titles and submit one copy of the competition registration to the Ministry of Natural Resources and Environment (through the Department of Mobilization, Awards, and Propaganda) for all titles, and send one copy to the Competition Group (for the title "Flag of Competition of the Ministry of Natural Resources and Environment" and "Flag of Competition of the Government") before February 28 each year for monitoring and as a basis for awarding commendation titles.

2. Provincial Departments of Natural Resources and Environment directly under the central government shall register for commendation titles and submit one copy of the competition registration to the Ministry of Natural Resources and Environment (through the Department of Mobilization, Awards, and Propaganda) for the title "Excellence Warrior of the Natural Resources and Environment Industry"; send one copy to the Competition Cluster (for the title "Flag of Competition of the Ministry of Natural Resources and Environment") before February 28 each year for monitoring and as a basis for awarding commendation titles.

3. Competition Groups and Clusters shall organize the signing of competition agreements among units within their respective groups and clusters, demonstrating their determination to respond to and implement the competition movement launched by the Ministry of Natural Resources and Environment; clearly define targets, contents, and measures for implementation; submit the competition registration of the Competition Groups and Clusters and the signed competition agreement to the Ministry of Natural Resources and Environment (through the Department of Mobilization, Awards, and Propaganda) before March 10 each year for monitoring and as a basis for awarding commendation titles.

4. The Department of Mobilization, Awards, and Propaganda shall compile the competition registrations of units directly under the Ministry, provincial Departments of Natural Resources and Environment, and Competition Groups and Clusters, and submit them to the Minister for approval; for national-level commendation titles, the Ministry shall submit the competition registration to the Government before March 15 each year.

Chapter III

RECOGNITION AND CRITERIA FOR RECOGNITION

Article 11. Types of Awards

1. Regular awards are annual awards given to individuals and collectives who have achieved outstanding results at the end of the execution of tasks and plans for the year or multiple years.

2. Special topic awards (or campaign awards) are awards given to individuals and collectives who have achieved outstanding results after the completion of a competition period, a program, or a special topic initiated by the President, Prime Minister, Minister, or heads of agencies, organizations, and units.

3. Unexpected awards are awards given to individuals and collectives who have achieved unexpected outstanding results in labor and production; bravery in rescuing people or state property.

4. Awards for dedication during the process of contribution are awards given to individuals holding leadership and management positions in state agencies and public institutions under the Ministry of Natural Resources and Environment, who have made significant contributions and outstanding achievements to the revolutionary cause of the Party and the nation.

5. Other appropriate forms of encouragement: Commemorative Medal "For the Natural Resources and Environment Cause", Merit Plaque...

Article 12. Orders, Medals, "Prime Minister's Award", National Honor Titles, "Ho Chi Minh Prize", "State Prize"

Criteria for considering Orders, Medals, "Prime Minister's Award", National Honor Titles, "Ho Chi Minh Prize", and "State Prize" shall be implemented according to the provisions of the Law on Mobilization and Awards; Decree No. 42/2010/ND-CP; Decree No. 39/2012/ND-CP; Decree No. 65/2014/ND-CP; and Circular No. 07/2014/TT-BNV.

Article 13. Certificates of Merit from the Minister of Natural Resources and Environment

1. The Minister of Natural Resources and Environment's Certificate of Merit shall be awarded to individuals who model exemplary compliance with the Party's policies, state laws, and industry regulations, achieving one of the following criteria:

a) Completing two consecutive years of outstanding performance, during which they propose two grassroots-level initiatives;

b) Achieving many commendable results in specialized competition movements initiated by the natural resources and environment sector;

c) Achieving outstanding unexpected results with significant impact in specific fields within the natural resources and environment sector;

d) Contributing to the development of the natural resources and environment sector.

2. The Minister of Natural Resources and Environment's Certificate of Merit shall be awarded to collectives that model exemplary compliance with the Party's policies, state laws, and industry regulations, maintain internal unity, and achieve one of the following criteria:

a) Completing two consecutive years of outstanding performance, effectively implementing grassroots democratic regulations, organizing competition movements well; caring for the material and spiritual lives of members within the collective; practicing thrift; fully implementing systems and policies for all members of the collective;

b) Achieving many commendable results in specialized competition movements initiated by the natural resources and environment sector;

c) Achieving outstanding unexpected results with significant impact in specific fields within the natural resources and environment sector;

d) Contributing to the development of the natural resources and environment sector.

Article 14. Commendation Certificate

The heads of units under the Ministry that have accounts and seals, and the Directors of Provincial Departments of Natural Resources and Environment directly under the central government may present commendation certificates to individuals and groups in accordance with Articles 74 and 75 of the Law on Competition and Reward.

Article 15. Reward for Dedication Process

1. Forms of reward for dedication process shall be presented or posthumously awarded to individuals who have outstanding achievements and meet the following criteria:

a) Officials and civil servants holding leadership positions at agencies and units within the natural resources and environment sector, meeting the standards and conditions stipulated in Decree No. 65/2014/NĐ-CP regarding Orders and Medals when preparing for retirement, retired, or deceased, having made significant contributions and outstanding achievements during their service to the revolutionary cause of the Party and the nation;

b) Officials and civil servants who have been awarded Orders and Medals for their achievements in work, if the time spent in their position meets the standards set out in Decree No. 65/2014/NĐ-CP, they will not be considered for further rewards for dedication; in cases where they meet higher standards for rewards than those previously received, procedures for awarding dedication rewards shall be carried out according to regulations.

2. Standards, tenure, equivalent positions, and conditions for applying rewards for dedication processes shall be implemented in accordance with Articles 11 and 12 of Circular No. 07/2014/TT-BNV.

Chapter IV

AUTHORITY TO DECIDE AND PRESENT AWARDS; PROCEDURES AND DOCUMENTS

REVIEW OF COMPETITION AWARDS AND REWARD FORMS

Article 16. Authority to Decide on Awarding Competition Titles and Reward Forms

1. The authority to decide on awarding titles such as "National Model Competitor", "Flag of Government Competition", Orders, Medals, State Honorary Titles, "Ho Chi Minh Prize", "State Prize", and "Prime Minister's Commendation" shall be carried out in accordance with Articles 77 and 78 of the Law on Competition and Reward.

2. The Minister of Natural Resources and Environment decides to award competition titles, reward forms, and other forms of encouragement as specified in Clause 2 of Article 101 of the Law on Competition and Reward, specifically as follows:

a) Present: "Commendation Certificate of the Minister of Natural Resources and Environment", Commemorative Medal "For the Cause of Natural Resources and Environment"; "Flag of Competition of the Ministry of Natural Resources and Environment", "Model Competitor of the Natural Resources and Environment Sector", Title "Outstanding Labor Collective" for collectives and individuals proposed by subordinate units of the Ministry;

b) Present: title "Model Competitor at the Base Level", title "Advanced Worker", and "Advanced Labor Collective" for individuals and collectives under the Ministries' Departments, Party Committee Office, Trade Union Office, and Youth League Office of the Ministry of Natural Resources and Environment;

c) Present "Flag of Competition of the Ministry of Natural Resources and Environment" to units under the Ministry with outstanding and excellent achievements in annual competition movements selected by competition blocs;

d) Present "Flag of Competition of the Ministry of Natural Resources and Environment" to Provincial Departments of Natural Resources and Environment with outstanding and excellent achievements in annual competition movements selected by competition clusters; present "Commendation Certificate of the Minister of Natural Resources and Environment" to individuals and collectives in the local natural resources and environment sector when they achieve merits in thematic or spontaneous competition movements initiated by the natural resources and environment sector; present titles "Model Competitor of the Natural Resources and Environment Sector" and Commemorative Medal "For the Cause of Natural Resources and Environment" to individuals in the local natural resources and environment sector based on proposals from Provincial Departments of Natural Resources and Environment;

e) Present "Commendation Certificate of the Minister of Natural Resources and Environment" and Commemorative Medal "For the Cause of Natural Resources and Environment" to individuals and collectives working outside the natural resources and environment sector, overseas Vietnamese, foreign organizations, and individuals;

3. The Director of the Ministry's Office and the Inspector General of the Ministry may present Commendation Certificates, titles "Advanced Worker", and "Advanced Labor Collective" to individuals and collectives, and "Model Competitor at the Base Level" to individuals within their jurisdiction.

4. Heads of General Departments, National Hydro-Meteorological Center, and National Center for Water Resources Planning and Investigation may present competition titles and reward forms in accordance with Article 80 of the Law on Competition and Reward. Specifically as follows:

a) Title "Advanced Worker" and "Advanced Labor Collective" for individuals and collectives under units without accounts and seals;

b) Title "Model Competitor at the Base Level" for individuals within their jurisdiction;

c) Commendation Certificate for individuals and collectives within their jurisdiction;

d) Heads of units with accounts and seals under General Departments, National Hydro-Meteorological Center, and National Center for Water Resources Planning and Investigation may present titles "Advanced Worker" and "Advanced Labor Collective" to individuals and collectives within their jurisdiction.

5. Vietnam Natural Resources and Environment Corporation, Southern Natural Resources and Environment Corporation may present competition titles and reward forms in accordance with Article 80 of the Law on Competition and Reward. Specifically as follows:

a) The General Director of the Corporation and the General Director of the Company may present title "Advanced Worker" to individuals and collectives under the administrative unit and dependent units; present title "Model Competitor at the Base Level" to individuals and Commendation Certificate to individuals and collectives within their jurisdiction;

b) The Director of independent accounting units (Company, Factory, Center...) may present title "Advanced Labor Collective" and "Advanced Worker" to individuals and collectives within their jurisdiction.

6. The heads of the Departments, Institutes, Schools, Centers (except for the National Hydro-meteorological Center and the National Center for Water Resources Planning and Investigation), specialized offices, enterprises under the Ministry (except for Vietnam Natural Resources and Environment Corporation and Southern Natural Resources and Environment Corporation) shall present commendation awards and forms of recognition in accordance with Article 80 of the Law on Encouragement and Reward, specifically as follows: the title "Advanced Labor Collective", "Advanced Laborer", "Model Worker at the Grassroots Level", and Certificate of Merit for individuals and collectives within their management scope.

7. The Directors of Provincial Departments of Natural Resources and Environment shall present the titles "Advanced Labor Collective", "Advanced Laborer", "Model Worker at the Grassroots Level", and Certificate of Merit for individuals and collectives within their management scope in accordance with the guidance of the People's Committee of the province or centrally governed city.

Article 17. Procedures for considering and recommending commendation titles and forms of recognition

1. For the title "Heroic Laborer": The head of the unit under the Ministry shall submit to the Minister of Natural Resources and Environment (through the Department of Encouragement, Reward, and Propaganda) for approval of the proposal to confer the title "Heroic Laborer". The Department of Encouragement, Reward, and Propaganda shall seek the opinion of the First Deputy Chairman of the Ministry of Natural Resources and Environment's Encouragement and Reward Council before submitting to the Minister for approval of the proposal to confer the title "Heroic Laborer".

Based on the Minister's opinion, the Department of Encouragement, Reward, and Propaganda shall notify the unit in writing. After receiving the application file for conferring the title "Heroic Laborer", the Department of Encouragement, Reward, and Propaganda shall examine the file, assess achievements, and seek opinions from related units before compiling and submitting to the Ministry of Natural Resources and Environment's Encouragement and Reward Council for examination. Based on the examination results of the Council, the Department of Encouragement, Reward, and Propaganda shall submit to the Party Cadre and Civil Servants' Council of the Ministry of Natural Resources and Environment for examination before submitting to the Minister for decision.

2. For the title "National Model Worker": The head of the unit under the Ministry shall submit to the Ministry of Natural Resources and Environment (through the Department of Encouragement, Reward, and Propaganda). After receiving the file, the Department of Encouragement, Reward, and Propaganda shall examine the file, assess achievements, and seek opinions from related units before compiling and submitting to the Ministry's Initiative Council and the Ministry of Natural Resources and Environment's Encouragement and Reward Council for examination. Based on the examination results of the Councils, the Department of Encouragement, Reward, and Propaganda shall submit to the Party Cadre and Civil Servants' Council of the Ministry of Natural Resources and Environment for examination before submitting to the Minister for consideration and submission to the Prime Minister.

3. For the title "Natural Resources and Environment Sector Model Worker": The head of the unit under the Ministry, the Director of Provincial Departments of Natural Resources and Environment shall submit to the Ministry of Natural Resources and Environment (through the Department of Encouragement, Reward, and Propaganda). After receiving the file, the Department of Encouragement, Reward, and Propaganda shall examine the file, assess achievements, and if necessary, seek opinions from related units before compiling and submitting to the Ministry's Initiative Council and the Ministry of Natural Resources and Environment's Encouragement and Reward Council for examination. Based on the examination results of the Council, the Department of Encouragement, Reward, and Propaganda shall seek the opinion of the First Deputy Chairman of the Ministry of Natural Resources and Environment's Encouragement and Reward Council before submitting to the Minister for decision.

4. For the title "Flag of Competition of the Ministry of Natural Resources and Environment": The head of the unit under the Ministry, the Head of the Group, Cluster of Competition shall submit to the Ministry of Natural Resources and Environment (through the Department of Encouragement, Reward, and Propaganda). Based on the competition registration, based on the proposals of the units and the veneration of the Groups, Clusters of Competition, the Department of Encouragement, Reward, and Propaganda shall examine the file, assess achievements, and if necessary, seek opinions from some related units before submitting to the Ministry of Natural Resources and Environment's Encouragement and Reward Council for examination. Based on the examination results of the Council, the Department of Encouragement, Reward, and Propaganda shall seek the opinion of the First Deputy Chairman of the Ministry of Natural Resources and Environment's Encouragement and Reward Council before submitting to the Minister for decision.

5. For the "Golden Star Medal", "Ho Chi Minh Medal", "Independence Medal": The head of the units under the Ministry shall submit to the Ministry of Natural Resources and Environment (through the Department of Encouragement, Reward, and Propaganda). After receiving the file, the Department of Encouragement, Reward, and Propaganda shall examine the file, assess achievements, and seek opinions from related units before compiling and submitting to the Ministry of Natural Resources and Environment's Encouragement and Reward Council for examination. Based on the examination results of the Councils, the Department of Encouragement, Reward, and Propaganda shall submit to the Party Cadre and Civil Servants' Council of the Ministry of Natural Resources and Environment for examination before submitting to the Minister for decision.

6. For the "Labor Medal": The head of the units under the Ministry shall submit to the Ministry of Natural Resources and Environment (through the Department of Encouragement, Reward, and Propaganda). After receiving the file, the Department of Encouragement, Reward, and Propaganda shall examine the file, assess achievements, and if necessary, seek opinions from related units before compiling and submitting to the Ministry's Initiative Council (for individual proposals for "Labor Medals" of various grades) and the Ministry of Natural Resources and Environment's Encouragement and Reward Council for examination. Based on the examination results of the Councils, the Department of Encouragement, Reward, and Propaganda shall seek the opinion of the First Deputy Chairman of the Ministry of Natural Resources and Environment's Encouragement and Reward Council before submitting to the Minister for decision.

7. For the "Prime Minister's Commendation" and the title "Government Flag of Excellence": The heads of units under the Ministry shall submit to the Ministry of Natural Resources and Environment (through the Department of Mobilization, Awards, and Propaganda). After receiving the dossier, the Department of Mobilization, Awards, and Propaganda will review the dossier, assess achievements, seek opinions from related units before compiling and submitting to the Ministry of Natural Resources and Environment Mobilization, Awards Council for examination. Based on the examination results of the Council, the Department of Mobilization, Awards, and Propaganda will submit to the First Deputy Chairman of the Ministry of Natural Resources and Environment Mobilization, Awards Council for comments before submitting to the Minister for decision.

8. For the title "Outstanding Labor Collective" and the "Ministry of Natural Resources and Environment Director's Commendation": The heads of units under the Ministry shall submit to the Ministry of Natural Resources and Environment (through the Department of Mobilization, Awards, and Propaganda). The Department of Mobilization, Awards, and Propaganda will review the dossier, assess achievements, and if necessary, seek opinions from some related units before submitting to the First Deputy Chairman of the Ministry of Natural Resources and Environment Mobilization, Awards Council for comments, then submit to the Minister for decision.

9. For the title "Model Striver at the Grassroots Level", the title "Advanced Worker", and the "Advanced Labor Collective" for individuals and collectives under the Departments, Party Committee Office, Trade Union Office, Youth League Office of the Communist Youth of Ho Chi Minh, the heads of units under the Ministry shall submit to the Ministry of Natural Resources and Environment (through the Department of Mobilization, Awards, and Propaganda). The Department of Mobilization, Awards, and Propaganda will review the dossier, assess achievements, and if necessary, seek opinions from some related units before submitting to the First Deputy Chairman of the Ministry of Natural Resources and Environment Mobilization, Awards Council for comments, then submit to the Minister for decision.

10. For the proposal to award the Friendship Medal to foreign individuals who have made significant contributions to the construction and development of the natural resources and environment sector in Vietnam, and to present or posthumously present the Friendship Order to foreign individuals; the Friendship Order to foreign organizations that have made great contributions to the construction and development of the natural resources and environment sector in Vietnam: The head of the agency, organization, or unit directly collaborating with the individual or organization shall submit to the Ministry of Natural Resources and Environment (through the Department of Mobilization, Awards, and Propaganda). The Department of Mobilization, Awards, and Propaganda will assess, and if necessary, seek opinions from some related units before submitting to the First Deputy Chairman of the Ministry of Natural Resources and Environment Mobilization, Awards Council for comments, then submit to the Minister for decision.

11. Commendation for dedication

a) In cases where officials have retired or passed away:

- For cadres who are leaders of the Ministry of Natural Resources and Environment who have retired or passed away, the Cadre Organization Department of the Ministry of Natural Resources and Environment is responsible for preparing the commendation dossier according to regulations;

- For other cadres, the head of the unit where the cadre was managed before retirement or passing away is responsible for processing the commendation request. In cases where the last working unit of the cadre eligible for commendation has been dissolved, split, merged, or consolidated, the head of the unit taking over the responsibilities of that unit is responsible for preparing the commendation dossier;

The Department of Mobilization, Awards, and Propaganda is responsible for assessing, compiling, and seeking confirmation opinions from the Cadre Organization Department (except in cases proposed by the Cadre Organization Department), submitting to the Ministry of Natural Resources and Environment Mobilization, Awards Council for examination; based on the examination results of the Ministry of Natural Resources and Environment Mobilization, Awards Council, the Department of Mobilization, Awards, and Propaganda will submit to the Minister for decision.

b) For cadres preparing to retire:

- In cases where cadres are leaders of the Ministry of Natural Resources and Environment preparing to retire, the Ministry of Natural Resources and Environment Office is responsible for processing the commendation request according to regulations;

- For other cadres, when the cadre receives notice of retirement, the head of the unit prepares the commendation dossier for cadres meeting the criteria within the unit. The Department of Mobilization, Awards, and Propaganda compiles and seeks confirmation opinions from the Cadre Organization Department (except in cases proposed by the Cadre Organization Department), submits to the Ministry of Natural Resources and Environment Mobilization, Awards Council for examination, then submits to the Minister for decision;

c) The Cadre Organization Department is responsible for confirming in writing the time served in position and disciplinary measures, reasons, and time of disciplinary action (if any) and equivalent positions of the person proposed for commendation (for cases managed by the Cadre Organization Department); coordinating with relevant units to resolve complaints (if any) regarding commendation of cadres with long-term dedication in the natural resources and environment sector.

12. For the "Ho Chi Minh Award", "State Award", implementation shall be carried out according to the provisions of Decree No. 78/2014/ND-CP dated July 30, 2014 of the Government on the Ho Chi Minh Award, State Award, and other awards in science and technology, the titles "People's Teacher", "Excellent Teacher" shall be implemented according to the provisions of the Law on Mobilization and Awards; Decree No. 27/2015/ND-CP dated March 10, 2015 of the Government on the presentation of the titles "People's Teacher", "Excellent Teacher" and other relevant legal documents.

13. Annually, the Ministry of Natural Resources and Environment Office shall take the lead and coordinate with the Department of Mobilization, Awards, and Propaganda to prepare dossiers and propose commendation titles and forms of recognition for the leaders of the Ministry of Natural Resources and Environment for submission to the Ministry of Natural Resources and Environment Mobilization, Awards Council for examination and commendation.

14. Provincial Departments of Natural Resources and Environment under centrally governed cities and provinces proposing to examine and present commendation titles and forms of recognition annually ("National Model Striver", "Government Flag of Excellence", Orders, Medals, National Honorary Titles, "Ho Chi Minh Award", "State Award", "Prime Minister's Commendation") shall submit through the provincial people's committees.

15. The awarding of the Commemorative Medal "For the Cause of Natural Resources and Environment" shall be carried out in accordance with the provisions of Circular No. 18/2015/TT-BTNMT dated April 16, 2015, issued by the Minister of Natural Resources and Environment on the awarding of the Commemorative Medal "For the Cause of Natural Resources and Environment".

Article 18. Application dossier for commendation titles

1. Commendation titles and forms of reward within the authority of the heads of units shall be implemented based on the Law on Competition and Rewards, the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards, Decree No. 42/2010/NĐ-CP, Decree No. 39/2012/NĐ-CP, Decree No. 65/2014/NĐ-CP, Circular No. 07/2014/TT-BNV, and this Circular by the heads of units.

2. The application dossier for the title of "Advanced Labor Collective", the title of "Advanced Worker", and the title of "Model Worker at the Grassroots Level" for individuals and collectives under the Departments, Party Committee Office of the Ministry, Trade Union Office of the Ministry, and Youth League Office of Ho Chi Minh Communist Youth Union under the authority of the Minister includes:

a) A proposal to recognize the titles;

b) Reports on achievements of individuals and collectives;

c) Decisions recognizing grassroots-level scientific research topics and initiatives (for the title of "Model Worker at the Grassroots Level");

d) Minutes of meetings with secret ballot results from the Competition and Reward Council of the unit with a voting rate of 70% or more, calculated based on the total number of members of the unit's Council (if Council members are absent, opinions are obtained through ballots).

3. The application dossier for the title of "Model Worker at the Grassroots Level" under the authority of the heads of units includes:

a) A proposal to recognize the title of "Model Worker at the Grassroots Level";

b) Report on achievements of the individual;

c) Decisions recognizing grassroots-level scientific research topics and initiatives;

d) Minutes of meetings with secret ballot results from the Competition and Reward Council of the unit with a voting rate of 70% or more, calculated based on the total number of members of the unit's Council (if Council members are absent, opinions are obtained through ballots).

4. The application dossier for the title of "Model Worker in the Natural Resources and Environment Sector" includes:

a) A proposal for rewards from the head of the unit accompanied by a list of individuals proposed for rewards;

b) A summary report on achievements of individuals proposed for rewards. The achievement report is kept at the unit;

c) Decisions recognizing scientific research topics and initiatives;

d) Minutes of meetings with secret ballot results from the Competition and Reward Council of the unit with a voting rate of 70% or more, calculated based on the total number of members of the unit's Council (if Council members are absent, opinions are obtained through ballots).

5. The application dossier for the title of "National Model Worker" includes:

a) A proposal for rewards from the head of the unit accompanied by a list of individuals proposed for rewards;

b) Three reports on achievements of individuals confirmed by the rewarding unit;

c) Decisions recognizing scientific research topics and initiatives;

d) Minutes of meetings with secret ballot results from the Competition and Reward Council of the unit with a voting rate of 90% or more, calculated based on the total number of members of the unit's Council (if Council members are absent, opinions are obtained through ballots);

đ) Documents confirming the implementation of the Party's policies and state laws during the period of achievement for rewards from the People's Committee of the commune, ward, or town where the individual resides;

e) Certificates confirming the fulfillment of state budget payment obligations during the period of achievement for rewards for individuals who are heads of independent accounting public institutions;

6. The application dossier for the title of "Outstanding Labor Collective" includes:

a) A proposal for rewards from the head of the unit accompanied by a list of collectives proposed for rewards;

b) A summary report on achievements of collectives proposed for rewards. The achievement report is kept at the unit;

c) Minutes of meetings with secret ballot results from the Competition and Reward Council of the unit with a voting rate of 70% or more, calculated based on the total number of members of the unit's Council (if Council members are absent, opinions are obtained through ballots).

7. The application dossier for the title of "Flag of Excellence of the Ministry of Natural Resources and Environment" includes:

a) A proposal for rewards from the head of the unit or the Head of the Competition Group or Cluster accompanied by a list of collectives proposed for rewards;

b) A summary report on achievements of collectives proposed for rewards. The achievement report is kept at the unit;

c) Minutes of meetings of the Competition Group or Cluster with secret ballot results with a voting rate of 70% or more, calculated based on the total number of members of the Competition Group or Cluster (if members of the Competition Group or Cluster are absent, opinions are obtained through ballots).

8. The application dossier for the title of "Flag of Excellence of the Government" includes:

a) A proposal for rewards from the head of the unit or the Head of the Competition Group accompanied by a list of collectives proposed for rewards;

b) Three reports on achievements of collectives confirmed by the rewarding unit;

c) Minutes of meetings of the Competition Group with secret ballot results with a voting rate of 70% or more, calculated based on the total number of members of the Competition Group (if members of the Competition Group are absent, opinions are obtained through ballots);

d) Documents confirming the implementation of the Party's policies and state laws during the year of proposed rewards from the People's Committee of the commune, ward, or town where the agency's headquarters is located for units with independent headquarters;

đ) Certificates confirming the fulfillment of state budget payment obligations for the year of proposed rewards for independent accounting public institutions.

9. The application dossier for the title of "Heroic Laborer" includes:

a) A proposal from the head of the unit accompanied by a list of individuals and collectives proposed for rewards;

b) Four reports on achievements of cases proposed for rewards confirmed by the rewarding unit;

c) Minutes of meetings with secret ballot results from the Competition and Reward Council of the unit with a voting rate of 90% or more, calculated based on the total number of members of the unit's Council (if Council members are absent, opinions are obtained through ballots).

10. In addition to the application dossier sent via official communication as stipulated in Clause 2, 3, 4, 5, 6, 7, 8, and 9 of this Article, organizations and units must also send an electronic file of the application dossier (in .doc format for proposals, lists, and reports on achievements of individuals and collectives proposed for rewards, and in .pdf format for other related dossiers) to the email of the Department of Competition and Reward and Propaganda ([email protected]).

Article 19. Documents for Proposing Awards

1. Documents for proposing "Certificate of Merit from the Minister of Natural Resources and Environment" for individuals include:

a) A proposal for rewards from the head of the unit accompanied by a list of individuals proposed for rewards;

b) Summary report on the achievements of the individual being proposed for commendation; achievement reports kept at the unit;

c) Decision recognizing initiatives, research topics at the grassroots level (if any);

d) Minutes of the meeting of the Unit's Competition and Commendation Council.

2. Documents for proposing "Certificate of Merit from the Minister of Natural Resources and Environment" for groups include:

a) Proposal for commendation submitted by the Head of the unit along with a list of the group being proposed for commendation;

b) A summary report on achievements of collectives proposed for rewards. The achievement report is kept at the unit;

c) Minutes of the meeting of the Unit's Competition and Commendation Council.

3. Documents for proposing "Certificate of Merit from the Prime Minister" for individuals include:

a) A proposal for rewards from the head of the unit accompanied by a list of individuals proposed for rewards;

b) Three reports on the achievements of the individual being proposed for commendation;

c) Decision recognizing initiatives, research topics at the grassroots level (if any);

d) Minutes of the meeting accompanied by the results of secret ballot voting of the Unit's Competition and Commendation Council with a voting rate of 70% or more, based on the total number of council members (if council members are absent, their opinions are obtained through ballots);

đ) Confirmation document regarding the implementation of Party policies and state laws during the period considered for commendation achievements issued by the People's Committee of the commune, ward, town where the individual resides;

e) Confirmation document on the fulfillment of the obligation to pay state budget within the period considered for commendation achievements for individuals who are Heads of independent public service units.

4. Documents for proposing "Certificate of Merit from the Prime Minister" for groups include:

a) Proposal for commendation submitted by the Head of the unit along with a list of the group being proposed for commendation;

b) Three reports on the achievements of the group being proposed for commendation;

c) Minutes of the meeting accompanied by the results of secret ballot voting of the Unit's Competition and Commendation Council with a voting rate of 70% or more, based on the total number of council members (if council members are absent, their opinions are obtained through ballots);

d) Confirmation document regarding the implementation of Party policies and state laws during the period considered for commendation achievements issued by the People's Committee of the commune, ward, town where the unit's headquarters is located for units with independent headquarters;

đ) Confirmation document on the fulfillment of the obligation to pay state budget within the period considered for commendation achievements for independent public service units.

5. Documents for proposing various types and levels of Orders for individuals include:

a) A proposal for rewards from the head of the unit accompanied by a list of individuals proposed for rewards;

b) Four reports on the achievements of the individual being proposed for commendation, clearly stating the decision number, date, and year of recognition of initiatives (if any). The achievement report must highlight outstanding achievements with nationwide influence;

c) Decision recognizing initiatives, research topics at the ministerial level for individuals proposed for "Labor Order" at various levels (if any);

d) Minutes of the meeting accompanied by the results of secret ballot voting of the Unit's Competition and Commendation Council with a voting rate of 70% or more, based on the total number of council members (if council members are absent, their opinions are obtained through ballots);

đ) Documents confirming the implementation of the Party's policies and state laws during the period of achievement for rewards from the People's Committee of the commune, ward, or town where the individual resides;

e) Confirmation document on the fulfillment of the obligation to pay state budget within the period considered for commendation achievements for individuals who are Heads of independent public service units.

6. Documents for proposing various types and levels of Orders for groups include:

a) Proposal for commendation submitted by the Head of the unit along with a list of the group being proposed for commendation;

b) Four reports on the achievements of the group being proposed for commendation;

c) Minutes accompanied by the results of secret ballot voting of the Unit's Competition and Commendation Council must have a voting rate of 70% or more, based on the total number of council members (if council members are absent, their opinions are obtained through ballots);

d) Confirmation document regarding the implementation of Party policies and state laws during the period considered for commendation achievements issued by the People's Committee of the commune, ward, town where the unit's headquarters is located for units with independent headquarters;

đ) Confirmation document on the fulfillment of the obligation to pay state budget within the period considered for commendation achievements for independent public service units.

7. Documents for proposing Medals include:

a) Proposal for commendation submitted by the Head of the unit along with a list of those proposed for commendation;

b) Cross-reference list of cases proposed for commendation with confirmation from the Head of the unit (signed and stamped).

8. Documents for commending long-term contributions

a) For retired or deceased officials, including:

- Proposal from the Head of the unit along with a list of individuals proposed for commendation. The Cadre Organization Department is responsible for submitting commendation files for officials who are Leaders of the Ministry of Natural Resources and Environment.

- Four reports on the achievements of the individual, confirmed by the Head of the unit submitting them. In cases where the official has passed away but meets the criteria for commendation, the unit should proactively coordinate with the Cadre Organization Department to prepare the achievement report;

b) For officials about to retire, including:

- Proposal from the Head of the unit along with a list of individuals proposed for commendation. The Ministry Office is responsible for submitting commendation proposal files for officials who are Leaders of the Ministry of Natural Resources and Environment;

- Four reports on the achievements of the individual, confirmed by the Head of the unit submitting them;

- Minutes of the meeting of the Unit's Competition and Commendation Council (except in cases of commendation for Leaders of the Ministry of Natural Resources and Environment).

9. Documents for commendations outside the sector include:

a) Proposal for commendation submitted by the Head of the unit under the Ministry directly related to the individual or group, along with a list of individuals or groups proposed for commendation;

b) Reports on the achievements of the individual or group with outstanding contributions to the natural resources and environment sector.

10. In addition to the documents sent according to the official communication regulations stipulated in this Article, agencies, organizations, and units must also send an electronic file of the submitted documents (in .doc format for proposals, lists, and achievement reports of individuals and groups proposed for commendation, and in .pdf format for other related documents) to the email box of the Department of Competition, Commendation, and Publicity ([email protected]).

Article 20. Documents for Proposing Awards through Simplified Procedures

1. Rewards through simplified procedures are implemented for individuals and collectives when the following conditions are met:

a) The rewards serve political requirements, timely encouraging and motivating the masses;

b) Individuals and groups who have achieved outstanding and exceptional achievements in work, study, or operations;

c) Achievements and merits are clear.

2. Documents for proposing rewards through simplified procedures include:

a) A report accompanied by a list of individuals and groups proposed for awards;

b) A summary of achievements from the directly managing agency or unit, clearly stating the actions, achievements, and merits of the individuals and groups proposed for awards through simplified procedures.

3. In addition to the set of documents sent via official communication as stipulated in Clause 2 of this Article, agencies, organizations, and units must also send an electronic file of the submitted documents (in .doc format for reports, lists, and achievement reports of proposed award recipients, and in .pdf format for other related documents) to the email box of the Department of Mobilization, Awards, and Propaganda ([email protected]).

Article 21. Time Limit for Submission of Documents and Sample Forms for Proposing Awards and Honors

1. Documents proposing annual awards and honors should be submitted to the Ministry before January 31 of the following year.

2. For cases proposing awards for outstanding and specialized achievements: immediately after achieving such accomplishments or upon completion of the specialized period, the head of the agency, organization, or unit has the responsibility to prepare and submit documents for review and decision on awards to the competent authority.

3. The sample forms for proposing awards and honors are specified in the Appendix attached to this Circular.

Article 22. Receipt, Review, and Presentation of Award Proposals

1. Agencies and units are responsible for submitting complete documents within the prescribed time limit. The Department of Mobilization, Awards, and Propaganda will receive and review documents for proposing awards and honors within the purview of the Minister, and documents for proposing awards and honors according to regulations. For documents not in compliance with regulations, within two working days from the date of receipt, the Department of Mobilization, Awards, and Propaganda shall notify the submitting unit to correct the documents and resubmit them within three working days from the date of notification.

2. Within fifteen working days from the date of receiving documents for proposing the "Advanced Labor Collective" title, "Advanced Worker" title, and "Commendation Soldier of the Ministry" title (for collectives and individuals under the Departments, Party Committee Office of the Ministry, Trade Union Office of the Ministry, Youth League Office of Ho Chi Minh Communist Youth), twenty working days from the date of receiving documents for proposing the "Outstanding Labor Collective" title, "Ministry of Natural Resources and Environment Commendation", thirty working days from the date of receiving documents for proposing the "Flag of Excellence of the Ministry of Natural Resources and Environment", "Excellence Soldier of the Natural Resources and Environment Sector", "Flag of Excellence of the Government", "Prime Minister's Commendation", "Labor Medal" at all levels; forty-five working days from the date of receiving documents for proposing the "National Excellence Soldier" title, "Heroic Laborer", "Independence Order" at all levels, "Ho Chi Minh Order", "Golden Star Order", the Department of Mobilization, Awards, and Propaganda shall review the documents and present them to the Mobilization and Awards Council of the Ministry of Natural Resources and Environment, except in cases decided by the Minister of Natural Resources and Environment.

3. At the latest five working days after the Mobilization and Awards Council of the Ministry of Natural Resources and Environment convenes to review or seeks opinions from its members, the Department of Mobilization, Awards, and Propaganda must complete all required procedures to submit to the Minister, except in special cases decided by the Minister of Natural Resources and Environment.

Article 23. Approval of Awards

1. The Ministry of Natural Resources and Environment shall approve awards based on the recommendations of the Central Steering Committee for Competitions and Awards, the Chairpersons of the People's Committees of provinces and centrally-run cities.

2. Upon receipt of the proposal for approval from the Central Steering Committee for Competitions and Awards, the Department of Competitions, Awards, and Propaganda shall be responsible for drafting the approval document, soliciting opinions from members of the Standing Council for Competitions and Awards of the Ministry, relevant units, and Deputy Ministers in charge of the agencies, units, and localities.

3. The Department of Competitions, Awards, and Propaganda shall compile all participating opinions and finalize the draft approval document, submitting it to the Minister or Deputy Minister in charge for review and decision.

Article 24. Award Presentation Ceremony

1. The ceremony for presenting Orders, Medals, State Honorary Titles, "Ho Chi Minh Prize," "State Prize," "Prime Minister's Flag of Excellence," "National Model Worker," and "Prime Minister's Commendation" shall be conducted in accordance with the provisions of Government Decree No. 145/2013/NĐ-CP dated October 29, 2013, concerning the organization of commemorative days; award presentation ceremonies; reception rituals and foreign guest reception.

2. For Orders, Medals, State Honorary Titles, "Ho Chi Minh Prize," "State Prize," and "National Model Worker": upon receiving the award decision, the heads of units under the Ministry shall prepare plans for receiving and submit them to the Minister (through the Department of Competitions, Awards, and Propaganda). After receiving the Minister's instructions, the Department of Competitions, Awards, and Propaganda shall coordinate with the unit to organize the announcement and presentation.

3. For "Prime Minister's Flag of Excellence" and "Prime Minister's Commendation": after receiving the award decision, the heads of units under the Ministry shall prepare plans and coordinate with the Department of Competitions, Awards, and Propaganda to advise the Minister on organizing the reception.

4. Regarding the organization of the announcement and presentation of national-level awards to individuals and groups within the Ministry of Natural Resources and Environment: the heads of units within the Ministry shall prepare plans and coordinate with the Department of Competitions, Awards, and Propaganda to advise the Minister on organizing the reception.

5. For commendations and awards within the authority of the Minister of Natural Resources and Environment, the heads of units under the Ministry shall prepare plans and seek the Minister's opinion to decide.

6. Announcements and presentations of commendations and awards provide opportunities to honor exemplary individuals and groups, thus their organization must ensure solemnity, effectiveness, economy, and avoid ostentatious displays and waste. When organizing, they should combine with other activities of the unit to save time and costs.

Article 25. Management and Archiving of Award Files

1. The Department of Competitions, Awards, and Propaganda shall be responsible for managing and archiving files, recording ledgers, and tracking state-level commendations and awards within the authority of the Minister, as well as those within the authority of the Ministry. It shall transfer award files to the Ministry's Office Archives Department in accordance with current laws on archives.

2. Relevant agencies and units shall be responsible for organizing the management and archiving of files, recording ledgers, and tracking commendations and awards for individuals and groups within their units. Decisions on granting commendations and awards by units under the Ministry must be sent to the Department of Competitions, Awards, and Propaganda within fifteen days from the date of issuance.

3. Commendation and reward files shall be stored on paper and electronically in accordance with the provisions of the law.

Chapter V

COMPETITION AND AWARD COUNCILS AT ALL LEVELS

Article 26. The Competition and Reward Council of the Ministry of Natural Resources and Environment

1. The Competition and Reward Council of the Ministry of Natural Resources and Environment shall be established by the Minister of Natural Resources and Environment, providing advisory services to the Minister of Natural Resources and Environment on competition and reward work.

2. The members of the Competition and Reward Council of the Ministry of Natural Resources and Environment include:

a) Chairman: The Minister of Natural Resources and Environment;

b) First Vice-Chairman: The Deputy Minister of Natural Resources and Environment responsible for competition and reward work;

c) Vice Chairman in charge: Director of the Department of Competition, Reward, and Propaganda;

d) Vice-Chairman: The Permanent Secretary of the Party Committee of the Ministry of Natural Resources and Environment; the Chairman of the Trade Union of the Ministry of Natural Resources and Environment;

d) Members: Head of the Ministry's Office, Inspector General of the Ministry, Directors of the Departments of Organization and Cadres, Planning, Finance, Legal Affairs, Science and Technology, International Cooperation, Secretary of the Ho Chi Minh Communist Youth Union of the Ministry of Natural Resources and Environment, and one Deputy Director of the Department of Competition, Reward, and Propaganda, Member - Secretary of the Council.

3. The Council operates according to the Regulation on Operation issued by the Minister of Natural Resources and Environment.

Article 27. Competition and Reward Councils of Units

1. The Competition and Reward Councils of units shall be established by the heads of the units, providing advisory services to the heads of the units on competition and reward activities.

2. The members of the Competition and Reward Councils of units include:

a) Chairman: The head of the unit;

b) Vice Chairman: Chairman of the Trade Union of the unit or deputy head of the unit (in cases where the head of the unit concurrently serves as the Chairman of the Trade Union);

c) Members: Representatives of the Party Committee (Branch Committee) and other members who are key cadres of the unit decided by the head of the unit based on the principle that the total number of Council members (Chairman, Vice Chairmen, and Members) does not exceed nine people; staff working on competition and reward, Member - Secretary of the Council.

3. The Competition and Reward Councils of units operate according to the Regulation on Operation issued by the head of the agency or unit.

Article 28. The Innovation Council of the Ministry of Natural Resources and Environment

1. The Innovation Council of the Ministry of Natural Resources and Environment shall be established by the Minister of Natural Resources and Environment, tasked with advising the Minister to objectively and truthfully assess the level and scope of impact of innovation at the ministerial and national levels, serving as a basis for the Minister to decide to recognize innovations for individuals proposed for awards of "Labor Medal" in various classes, "National Model Worker", "Model Worker in Natural Resources and Environment".

2. The members of the Innovation Council of the Ministry of Natural Resources and Environment include:

a) Chairman: The Deputy Minister of Natural Resources and Environment responsible for competition and reward work;

b) Permanent Vice-Chairman: The Director of the Department of Competition and Reward and Propaganda;

c) Vice-Chairman: The Director of the Department of Science and Technology;

d) Members: Chairman of the Trade Union of the Ministry and some people with expertise in fields related to the content of the innovation; one staff member from the Department of Competition, Reward, and Propaganda, Member - Secretary of the Council.

3. The Innovation Council of the Ministry of Natural Resources and Environment operates according to the Regulation on Operation issued by the Minister of Natural Resources and Environment.

Article 29. The Innovation Council at the Base Level

1. The Innovation Council at the base level shall be established by the head of the unit, tasked with assisting the head of the unit to assess the level of impact of innovation at the base level, serving as a basis for the head of the unit to decide to recognize innovations for individuals proposed for awards of "Prime Minister's Commendation", "Minister of Natural Resources and Environment's Commendation", "Base Model Worker".

2. The members of the grassroots initiative council include:

a) Chairman: Head of the unit or deputy head of the unit;

b) Vice-Chairman: Representative of the leadership of the organization assisting the Head of the Unit in implementing commendation activities;

c) Members and Secretary are decided by the head of the unit including those with expertise in fields related to the content of the innovation.

3. The Innovation Council at the base level operates according to the Regulation on Operation issued by the head of the unit.

Chapter VI

COMPETITION AND REWARD FUNDS AND RIGHTS AND OBLIGATIONS OF INDIVIDUALS AND GROUPS AWARDED COMPETITION TITLES AND REWARD FORMS

AWARDED COMPETITION TITLES AND REWARD FORMS

Article 30. Sources and Levels of Contributions to the Competition and Award Fund

1. The Competition and Award Fund of the Ministry of Natural Resources and Environment shall be formed from state budget funds, contributions from individuals and organizations within and outside the country, and other lawful sources of income.

2. The establishment of the Competition and Award Fund of the Ministry of Natural Resources and Environment shall be carried out as follows:

a) Annually, based on the state budget expenditure plan approved by the competent authority; based on the total salary fund according to rank and grade of officers, civil servants, and public officials within the establishment and the annual approved wages of contractual workers according to the state-defined pay scale (excluding the salaries and wages of units that fully self-finance their operations); the results of implementing the Competition and Award Fund in the previous year and the projected total expenditure for the current year, the Minister of Natural Resources and Environment shall decide the level of contribution to the Competition and Award Fund of the Ministry of Natural Resources and Environment and the level of contribution to the Competition and Award Fund of subordinate budgetary units from the state budget, with a maximum level equal to 20% of the total salary fund according to rank and grade of officers, civil servants, and public officials within the establishment and the annual approved wages mentioned above;

b) The Department of Competition and Awards and Propaganda shall be responsible for proposing the budget estimate of the Competition and Award Fund of the Ministry;

c) The Finance Department shall take the lead and coordinate with the Department of Competition and Awards to be responsible for allocating financial resources for competition and award activities of the Ministry in accordance with Clause 1 of Article 67 of Decree No. 42/2010/ND-CP and Point b of Clause 1 of Article 3 of Circular No. 71/2011/TT-BTC dated May 24, 2011 of the Ministry of Finance guiding the establishment, management, and utilization of the Competition and Award Fund under Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Competition and Awards.

d) The contribution to the Competition and Award Fund of the Ministry from affiliated enterprises and self-financing public service units shall be as follows:

- For self-financing public service units directly under the Ministry, they shall contribute from their own Competition and Award Fund to the Ministry's Competition and Award Fund. The minimum contribution rate shall be 20% of the annual Competition and Award Fund of the unit.

- For self-financing public service units directly under secondary budgetary units, they shall annually contribute a minimum of 20% of their Competition and Award Fund to the secondary budgetary unit. The secondary budgetary unit (various General Departments, Bureaus, Centers) shall retain 10% to create its own Competition and Award Fund and 10% to contribute to the Ministry's Competition and Award Fund.

- For enterprises directly under the Ministry, they shall annually contribute 5% of their Competition and Award Fund to the Ministry's Competition and Award Fund (the contribution rate from the Competition and Award Fund of companies directly under the Vietnam National Resources and Environment Corporation to the Corporation shall be determined by the Corporation).

3. The Ministry of Natural Resources and Environment encourages individuals, organizations, and provincial-level Departments of Natural Resources and Environment to support and contribute up to a maximum of 10% of their respective organization's Competition and Award Fund to supplement, build, and develop the Competition and Award Fund of the Ministry of Natural Resources and Environment.

Article 31. Management and use of the Competition and Reward Fund

1. The content and level of expenditure for competition and rewards in the natural resources and environment sector shall be implemented in accordance with the provisions of Article 4 of Circular No. 71/2011/TT-BTC dated May 24, 2011 of the Ministry of Finance guiding the establishment, management, and use of the Competition and Reward Fund pursuant to Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing the implementation of certain articles of the Law on Competition and Rewards and current financial laws.

2. The Department of Competition and Reward and Propaganda shall be responsible for advising the Minister to use the Ministry's Competition and Reward Fund for its intended purpose and target groups to organize competition movements and reward work; complete settlement documents and vouchers with the Ministry's Office; monitor the payment of rewards and other expenses serving competition and reward activities as prescribed.

3. The Ministry's Office shall be responsible for implementing the expenditure items, settling the expenditure items under the Competition and Reward Fund in accordance with regulations.

Article 32. Rights and Obligations of Collectives and Individuals in Competition and Rewards

1. The rights of collectives and individuals in competition and rewards in the natural resources and environment sector shall be implemented in accordance with the provisions of Article 78 of Decree No. 42/2010/NĐ-CP and the following rights:

a) Individuals and collectives receiving commendation titles and reward forms shall receive certificates, diplomas, diploma frames, and monetary rewards or commemorative gifts as prescribed; they have the right to retain, display, and have the obligation to preserve award items, not to rent or lend them. Collectives may use the symbols of commendation titles and reward forms on their unit’s documents and materials;

b) Individuals receiving commendation titles and reward forms shall be considered for early salary grade promotion, prioritized for participation in civil service grade advancement exams according to the regulations of the Ministry and the early salary grade promotion rules of the unit, prioritized for research, study, and training to improve professional skills both domestically and internationally according to the Ministry's cadre training and development management regulations, and other incentive systems currently in effect, while being honored on the Ministry's media and recorded in the traditional gold book of the Ministry of Natural Resources and Environment;

c) Commendation titles and reward forms for individuals are one of the bases for considering, evaluating, planning, appointing, and reappointing cadres annually;

d) Individuals and collectives have the right to refuse to accept commendation titles or reward forms that are not commensurate with achievements and do not meet the standards and procedures stipulated by law.

2. The obligations of individuals and collectives in competition and rewards in the natural resources and environment sector shall be implemented in accordance with the provisions of Article 79 of Decree No. 42/2010/NĐ-CP and the following obligations:

a) Individuals and collectives awarded commendation titles and reward forms by competent authorities shall continue to maintain and promote their achievements, contributing to inspiring patriotic competition movements, encouraging other collectives and individuals to strive and fulfill their assigned tasks, worthy of the awarded commendation titles and reward forms;

b) Individuals and collectives have the responsibility to identify outstanding collectives and individuals, exemplary models, and good deeds to promptly propose rewards or report and denounce individuals and collectives engaging in fraudulent behavior or violations of the law on competition and rewards;

c) Individuals and collectives proposed for commendation titles and reward forms must fully and timely implement the procedural requirements and deadlines for submitting reward application documents as prescribed in this Circular and related laws on competition and rewards.

Article 33. Issuance, Replacement, Recovery of Award Items and Confirmation of Awards

Clause 1. State award items and Ministry of Natural Resources and Environment award items shall only be issued once to individuals or groups receiving awards. The issuance, replacement, confirmation, and recovery of award items must ensure accuracy and timeliness.

2. Issuance of reward objects

Point a) National award items: The Ministry of Natural Resources and Environment shall be responsible for receiving national award items from the Central Board of Competitions and Rewards after the President's or Prime Minister's Decision on rewarding has been made. When there are national award items, the Ministry will notify units to collect the award items within thirty days at the Ministry (through the Department of Competitions, Rewards, and Propaganda);

Point b) Ministry-level award items: After the Minister of Natural Resources and Environment's Decision on rewarding has been made, the Ministry will notify units to collect the award items within thirty days at the Ministry (through the Department of Competitions, Rewards, and Propaganda).

Clause 3. Confirmation of Reward Forms and Replacement of Award Items

Point a) For national award items: Individuals or groups requiring confirmation or replacement of national award items shall submit a request to the Ministry for examination, appraisal, confirmation, and consolidation of the request to the Central Board of Competitions and Rewards for examination, confirmation, or replacement of award items in accordance with regulations;

Point b) Replacement of ministry-level award items: Individuals or groups requiring confirmation or replacement of ministry-level award items shall submit a request to the Ministry for examination, confirmation, or replacement of award items in accordance with regulations.

Clause 4. Recovery of Award Items

Point a) The recovery of award items shall be carried out when there is a Decision to adjust or recover the form of reward made by the decision-making authority;

Point b) Upon receipt of a Decision to adjust the form of reward, the Ministry shall carry out the recovery of previously awarded items and organize the presentation of new award items.

Point c) Upon receipt of a Decision to recover the form of reward, the Ministry shall carry out the recovery of previously awarded items. For national award items, the Ministry shall return the recovered award items to the Central Board of Competitions and Rewards in accordance with regulations.

Chapter VII

IMPLEMENTING PROVISIONS

Article 34. Effective Date

This Circular takes effect from January 1, 2016, and replaces Circular No. 38/2011/TT-BTNMT dated October 20, 2011, issued by the Minister of Natural Resources and Environment guiding the implementation of competition and reward work in the natural resources and environment sector.

Article 35. Organization a) Report to the Ministry of Natural Resources and Environment on the results of training and upgrading, including listing the teaching staff participating in teaching, evaluating the participation of trainees in the training process, the results of organizing examinations for completing the training and upgrading program on land valuation business, the issuance of Certificates and the use of Certificate codes, summarizing the feedback from trainees on the quality of the training and upgrading program on land valuation business, and other relevant matters.

Clause 1. The Department of Competitions, Rewards, and Propaganda is the Standing Office of the Ministry of Natural Resources and Environment's Competition and Reward Council, responsible for leading and coordinating with relevant units under the Ministry to assist the Minister of Natural Resources and Environment in guiding, inspecting, and urging units under the Ministry, provincial Departments of Natural Resources and Environment to implement this Circular.

Clause 2. Heads of units directly under the Ministry, Directors of provincial Departments of Natural Resources and Environment shall regularly conduct mid-year, annual, or post-competition reviews, summaries, and evaluations of competition and reward work and submit reports to the Ministry (through the Department of Competitions, Rewards, and Propaganda).

Clause 3. Chiefs of Competition Groups, Heads of units under the Ministry, Directors of provincial Departments of Natural Resources and Environment within their assigned tasks and authorities are responsible for implementing this Circular./.
