CIRCULAR

Regulations on types of forms and documents for extradition work and transfer work of persons serving criminal penalties under the authority of people's public security forces Based on Criminal Procedure Code No. 101/2015/QH13, amended and supplemented by Decree No. 02/2021/QH15, Decree No. 34/2024/QH15, Decree No. 59/2024/QH15, and Decree No. 99/2025/QH15;

Based on Extradition Law No. 100/2025/QH15;

Based on Transfer of Persons Serving Criminal Penalties Law No. 101/2025/QH15;

Based on Decree No. 128/2025/QH15 on the Implementation of Temporary Detention, Custody, and Prohibition from Leaving Place of Residence;

Based on Circular No. 78/2025/NĐ-CP on Detailed Provisions for Certain Articles and Measures to Organize, Guide, and Implement the Law on Issuance of Normative Legal Documents, amended and supplemented by Circular No. 187/2025/NĐ-CP;

Based on Circular No.

/2025/NĐ-CP 02on Functions, Powers, Organizational Structure of the Ministry of Public Security, amended and supplemented by Circular No. 11/2025/NĐ-CP In accordance with the proposal of the Director of the Legal and Administrative Reform Department, Justice; The Minister of Public Security promulgates this circular on regulations for types of forms and documents in extradition work and transfer work of persons serving criminal penalties under the authority of people's public security forces.;

Article 1. Scope of Application

This Circular regulates the issuance, management, and use of various types of forms and documents in extradition work and transfer work of persons serving criminal penalties under the authority of people's public security forces. Article 2. Applicability

This Circular applies to units within the Ministry of Public Security; provincial and municipal public security agencies (hereinafter collectively referred to as public security units at all levels); personnel with authority in the people's public security force responsible for establishing, managing, using various types of forms and documents in extradition work and transfer work of persons serving criminal penalties, and relevant organizations and individuals.

Article 3. Types of Forms and Documents in Extradition Work

The following forms are attached to this Circular for the implementation of extradition work:

1. Record Book for Tracking Extradition Case Files (Model No. 01);

2. Request for Extradition/Temporary Extradition from Vietnam to Foreign Countries (Model No. 02);

3. Emergency Detention Order Before an Extradition Request is Made (Model No. 03);

Article 5. Use of Various Types of Forms and Records

The various types of forms and records used in extradition work and the transfer of persons serving sentences, which fall under the authority of the People's Public Security, as provided for in Articles 3 and 4 of this Circular, shall be printed on A4 paper or by electronic document format and must be used according to the specifications and content of each form. In case of using an electronic document format, it must ensure authenticity, integrity, accessibility, searchability, storage capability, and printability as required by relevant laws.

Article 6. Effectiveness

1. This Circular shall take effect from July 1, 2026.

2. This Circular shall replace Circular No. 43/2019/TT-BCA dated October 1, 2019 by the Minister of Public Security on various types of form templates for extradition work and the transfer of persons serving sentences, which fall under the authority of the People's Public Security.

Article 7. Transitional Provisions

1. Requests for extradition and requests for the transfer of persons serving sentences shall continue to be processed in accordance with the forms specified in Circular No. 43/2019/TT-BCA prior to the effectiveness of this Circular.

2. Where any laws or regulations referred to in this Circular are amended, supplemented, replaced, or promulgated anew, the relevant provisions concerning this Circular shall also be changed accordingly.

Article 8. Implementation Responsibility

1. The Department of Legal Affairs and Administrative Reform, Justice has the responsibility to advise on, organize implementation, supervise, guide inspections for the execution; manage and guide the use of various types of form templates and records in extradition work and the transfer of persons serving sentences, which fall under the authority of the People's Public Security.

2. The heads of units within the Ministry, Directors of Provincial Public Security Bureaus, and relevant organizations and individuals shall bear responsibility for implementing this Circular.

3. In the process of implementing this Circular, public security organs at all levels shall report their implementation results annually in their extradition work reports (from December 15 of the previous year to December 14 of the reporting year); promptly report difficulties and issues to the Ministry (through the Department of Legal Affairs and Administrative Reform, Justice) for timely guidance and resolution.

IV. TIME LIMITS FOR CRIMINAL PROSECUTION OR ENFORCEMENT OF CRIMINAL SENTENCE

- Article 27 of the Criminal Code of the Socialist Republic of Vietnam provides for “time limits for criminal prosecution” as follows: (for requests for extradition to prosecute)

1. The time limit for criminal prosecution is a period prescribed by this Code, after which no criminal prosecution can be initiated against the perpetrator.

2. Time limits for criminal prosecution are as follows:

a) 05 years for less serious crimes;

b) 10 years for serious crimes;

c) 15 years for very serious crimes;

d) 20 years for particularly serious crimes.

3. The time limit for criminal prosecution is calculated from the date of commission of the crime. If, within the period prescribed in paragraph 2 above, the perpetrator commits a new offense with a maximum sentence under this Code exceeding one year imprisonment, then the time limit for the old offense is recalculated from the date of the new offense.

If, within the period prescribed in paragraph 2 above, the perpetrator intentionally evades and there is an arrest warrant issued against them, then the time limit is recalculated from the date they surrender or are apprehended.

- Article 60 of the Criminal Code of the Socialist Republic of Vietnam provides for “time limits for enforcement of a sentence” as follows: (for requests for extradition to enforce a criminal sentence)

1. The time limit for enforcing a criminal sentence is a period prescribed by this Code, after which the person convicted or commercial entity convicted no longer has to serve the sentence.

2. Time limits for enforcement of a criminal sentence are as follows:ự for persons sentenced as follows:

for persons convicted are as follows:

a) 05 years for cases involving fines, non-custodial reform, or imprisonment up to three years;

b) 10 years for cases involving imprisonment from more than three years to fifteen years;

c) 15 years for cases involving imprisonment from more than fifteen years to thirty years;

d) 20 years for cases involving life imprisonment or death penalty.

3. The time limit for enforcement of a criminal sentence for commercial entities is 05 years.

4. Time limits for enforcing a criminal sentence are calculated from the date the judgment becomes legally effective. If, within the periods prescribed in paragraphs 2 and 3 above, the person convicted or commercial entity convicted commits a new offense, then the time limit is recalculated from the date of the new offense.

5. Within the period prescribed in paragraph 2 above, if the person convicted intentionally evades and there is an arrest warrant issued against them, then the time limit is recalculated from the date they surrender or are apprehended.

2. According to the provisions mentioned above, the time limits for criminal prosecution/enforcement of a sentence for …(4)… have not expired. The subject does not have the right to be exempted from criminal prosecution/enforcement of a sentence.

V. SUMMARY OF THE CASE

A summary of the case is provided as a basis for making an extradition request, focusing on key elements related to the subject and the criminal acts they are requested to be extradited for, the context of the case, and the damages caused by the subject … Detailed specifics of the entire case may cause difficulties for foreign competent authorities in following up and reviewing the case.

Providing detailed information about the conduct is the basis for determining the crime and its constituent elements. For example, when determining a crime based on intent or negligence, if extradition requests involve more than one crime, each offense must have separate specific information. This aims to support foreign competent authorities in evaluating and determining whether the "double criminality" principle is met according to the laws of that country.

VII. STATUS OF CRIMINAL PROCEEDINGS AGAINST ...(4)...

Fill in detailed information about the status of Vietnamese criminal proceedings against the person sought for extradition, i.e., whether an arrest warrant has been issued and if so, whether it has already been executed or not? VIII. RELATED COMMITMENTS

According to the Constitution of the Socialist Republic of Vietnam, Vietnamese citizens have the right to freely travel and reside within the country, the right to leave the country and return from abroad. (4) Quyết định hoặc lệnh cho phép chuyển giao của cơ quan có thẩm quyền của nước ngoài và Tòa án nhân dân có thẩm quyền của Việt Nam.

(5) Nêu rõ thời gian, ngày tháng năm, giờ, địa điểm bàn giao (ví dụ như tại các cửa khẩu sân bay quốc tế hoặc cửa khẩu quốc tế đường bộ…).

(6) Cơ quan của nước ngoài thực hiện việc tiếp nhận (ví dụ như Bộ Tư pháp, cơ quan thi hành án nước ngoài…).

(7) Nêu thông tin theo đúng hồ sơ, bản án đã có hiệu lực pháp luật đối với người được chuyển giao.
