CHAIRMAN

- PURSUANT TO DECREE NO. 57 OF MAY 3, 1946 ON THE ORGANIZATION OF MINISTRIES,
- PURSUANT TO DECREE NO. 34 OF MARCH 25, 1946 AND DECREE NO. 35-SL OF MARCH 15, 1947 ON THE ORGANIZATION OF THE MINISTRY OF NATIONAL DEFENSE;
- PURSUANT TO DECREE NO. 47-SL OF MAY 1, 1947 AND DECREE NO. 14-SL OF MARCH 12, 1949 ON THE ORGANIZATION OF THE GENERAL STAFF OF THE NATIONAL ARMED FORCES AND PEOPLE'S MILITIA OF VIETNAM;
- PURSUANT TO DECREE NO. 256-SL/M OF AUGUST 5, 1947 ON THE AUTHORITY AND TITLES OF THE CHIEF OF THE GENERAL STAFF OF THE NATIONAL ARMED FORCES AND PEOPLE'S MILITIA OF VIETNAM;

ISSUES THE DECREE:
CHAPTER ONE
GENERAL PROVISIONS
Article 1
THE MINISTRY OF NATIONAL DEFENSE SHALL HAVE THE FOLLOWING TASKS:
1- TO ORGANIZE AND ADMINISTER THE ARMED FORCES AND NATIONAL DEFENSE AGENCIES.
2- TO CONTROL THE PRODUCTION AGENCIES.
Article 2
1- THE CHIEF OF THE GENERAL STAFF IS RESPONSIBLE FOR COMMANDING THE ARMED FORCES AND PEOPLE'S MILITIA OF VIETNAM.
2- TO USE THE AGENCIES ASSISTING IN COMMAND.
3- TO DECIDE ON THE RELOCATION AND USE OF PRODUCTS.
Article 3
THE MINISTRY OF NATIONAL DEFENSE INCLUDES THE FOLLOWING AGENCIES:
1- THE AGENCIES DIRECTLY ASSISTING THE MINISTER:
OFFICE AND ADMINISTRATIVE AFFAIRS
2- THE SPECIALIZED AGENCIES FOR PRODUCTION.
3- THE GENERAL STAFF AND THE DEPARTMENTS ASSISTING IN COMMAND.
Article 4
THE MINISTRY OF NATIONAL DEFENSE HAS AN INSPECTION TEAM UNDER THE CONTROL OF A HEAD INSPECTOR AND ASSISTANT INSPECTORS. THE HEAD INSPECTOR OF THE ARMED FORCES AND THE ASSISTANT INSPECTORS ARE UNDER THE CONTROL OF THE CHIEF OF THE GENERAL STAFF.
ADDITIONALLY, THE CHIEF OF THE GENERAL STAFF HAS A NUMBER OF MILITARY ADVISORS APPOINTED BY HIMSELF.
CHAPTER TWO
OFFICE AND ADMINISTRATIVE AFFAIRS
Article 5
IN THE CONTROL AND ADMINISTRATION OF THE SPECIALIZED AGENCIES, THE MINISTER OF NATIONAL DEFENSE HAS AN ADMINISTRATIVE DIRECTOR WHO DIRECTLY ASSISTS.
Article 6
IN THE ORGANIZATION AND ADMINISTRATION OF THE ARMED FORCES AND THE AGENCIES BELONGING TO THE MINISTRY OF NATIONAL DEFENSE, EXCEPT FOR THE SPECIALIZED AGENCIES, THE MINISTER OF NATIONAL DEFENSE HAS A MILITARY DIRECTOR WHO DIRECTLY ASSISTS.

THE CHIEF OF THE GENERAL STAFF'S OFFICE IS UNDER THE CONTROL OF A DIRECTOR. THIS OFFICE HAS THE TASK OF ASSISTING THE CHIEF OF THE GENERAL STAFF IN COORDINATING MILITARY AND POLITICAL MATTERS IN COMMAND.
Article 8
THE ORGANIZATION OF THE ADMINISTRATIVE AND MILITARY DIRECTORATES WILL BE DETERMINED BY THE MINISTER OF NATIONAL DEFENSE.
CHAPTER THREE
THE SPECIALIZED AGENCIES
Article 9
THE SPECIALIZED AGENCIES INCLUDE:
1- THE WEAPONS AGENCY
2- THE MILITARY NEEDS AGENCY
3- THE MEDICAL AGENCY
Article 10
THE WEAPONS AGENCY HAS THE TASK OF SUPPLYING AND PRODUCING WEAPONS, AMMUNITION, AND WAR MATERIAL.
Article 11
THE MILITARY NEEDS AGENCY HAS THE TASK OF SUPPLYING AND PRODUCING MILITARY EQUIPMENT AND SUPPLIES.
Article 12
THE MEDICAL AGENCY HAS THE TASK OF SUPPLYING AND PRODUCING MEDICINES AND HEALTH CARE EQUIPMENT.
Article 13
THE ORGANIZATION OF THE SPECIALIZED AGENCIES WILL BE DETERMINED BY THE MINISTER OF NATIONAL DEFENSE.
CHAPTER FOUR
THE CHIEF OF THE GENERAL STAFF AND THE POLITICAL DEPARTMENT DIRECTOR
Article 14
THE CHIEF OF THE GENERAL STAFF DIRECTLY ASSISTS THE CHIEF OF THE GENERAL STAFF IN DEVELOPING COMBAT PLANS.
THE CHIEF OF THE GENERAL STAFF MANAGES THE GENERAL STAFF.
Article 15
THE POLITICAL DEPARTMENT DIRECTOR DIRECTLY ASSISTS THE CHIEF OF THE GENERAL STAFF IN DEVELOPING POLITICAL WORK PLANS IN THE ARMED FORCES AND DEPARTMENTS.
THE POLITICAL DEPARTMENT DIRECTOR MANAGES THE POLITICAL DEPARTMENT.
CHAPTER FIVE
THE DEPARTMENTS
Article 16
IN ADDITION TO THE GENERAL STAFF AND THE POLITICAL DEPARTMENT MENTIONED IN ARTICLES 14 AND 15, THE MINISTRY OF NATIONAL DEFENSE INCLUDES:
1- THE PEOPLE'S MILITIA DEPARTMENT
2- THE MILITARY TRAINING DEPARTMENT
3- THE MILITARY ADMINISTRATION DEPARTMENT
4- THE MILITARY JUSTICE DEPARTMENT
5- THE INTELLIGENCE DEPARTMENT
6- THE ARTILLERY DEPARTMENT
7- THE ENGINEER DEPARTMENT
8- THE WEAPONS DEPARTMENT
9- THE MILITARY NEEDS DEPARTMENT
10- THE MILITARY MEDICAL DEPARTMENT
11- THE INFORMATION AND COMMUNICATION DEPARTMENT
12- THE TRANSPORTATION DEPARTMENT.
EACH DEPARTMENT WILL BE MANAGED BY A DEPARTMENT DIRECTOR.
Article 17
THE PEOPLE'S MILITIA DEPARTMENT PROVIDES ADVICE ON THE ORGANIZATION AND LEADERSHIP OF THE PEOPLE'S MILITIA.
Article 18
THE MILITARY TRAINING DEPARTMENT HAS THE TASK OF TRAINING AND ENHANCING OFFICERS IN THE ARMED FORCES.
Article 19
THE MILITARY ADMINISTRATION DEPARTMENT HAS THE TASK OF STUDYING AND PROPOSING MILITARY REGULATIONS, OVERSEEING ALL PERSONNEL MATTERS IN THE ARMED FORCES, AND STUDYING THE MOBILIZATION OF RESOURCES FOR RESISTANCE.
Article 20
THE INTELLIGENCE DEPARTMENT HAS THE TASK OF INVESTIGATING THE ENEMY SITUATION, COLLECTING INFORMATION, PREVENTING AND COUNTERING SPY ACTIVITIES.
Article 22
THE ARTILLERY DEPARTMENT HAS THE TASK OF ORGANIZING THE ARTILLERY BRANCH AND PROVIDING ADVICE ON COMMANDING THAT BRANCH.
Article 23
THE ENGINEER DEPARTMENT HAS THE TASK OF SUPPLYING AND DISTRIBUTING EQUIPMENT FOR THE ARMED FORCES, ORGANIZING THE ENGINEER BRANCH, AND PROVIDING ADVICE ON COMMANDING THAT BRANCH.
"d) Within no more than one working day from the date of receiving the dossier submitted for administrative procedures by the specialized agency assigned by the Provincial People's Committee, the Chairman of the Provincial People's Committee shall issue a notification of the result of the inspection of plant-based food exports or a certificate at the request of the importing country."
THE WEAPONS DEPARTMENT HAS THE TASK OF ORGANIZING THE SUPPLY, DISTRIBUTION, AND MAINTENANCE OF WEAPONS, AMMUNITION, AND WAR MATERIAL.
Article 25
THE MILITARY NEEDS DEPARTMENT HAS THE TASK OF:
a- ORGANIZING THE SUPPLY, DISTRIBUTION, AND MAINTENANCE OF MILITARY EQUIPMENT AND SUPPLIES.
b- MANAGING ALL MILITARY NEEDS ACCOUNTING IN THE ARMED FORCES.
Article 26
THE MILITARY MEDICAL DEPARTMENT HAS THE TASK OF ORGANIZING HEALTH AND VETERINARY SERVICES IN THE ARMED FORCES.
Article 27
THE INFORMATION AND COMMUNICATION DEPARTMENT HAS THE TASK OF ORGANIZING INFORMATION AND COMMUNICATION IN THE ARMED FORCES IN ALL SECTORS.
Article 28
THE TRANSPORTATION DEPARTMENT HAS THE TASK OF ORGANIZING TRANSPORTATION IN THE ARMED FORCES IN ALL ASPECTS.
Article 29
THE ORGANIZATION OF THE GENERAL STAFF AND THE DEPARTMENTS WILL BE DETERMINED BY THE MINISTER OF NATIONAL DEFENSE AFTER CONSULTATION WITH THE CHIEF OF THE GENERAL STAFF.
CHAPTER SIX
ENFORCEMENT
Article 30.
Decrees No. 34 dated March 23, 1946, No. 35-SL dated March 15, 1947, and No. 47-SL dated May 1, 1947, and all provisions in previous decrees that are contrary to this decree, are hereby repealed.
Article 31
The Minister of National Defense and the Commander-in-Chief of the Vietnam National Army and People's Militia shall implement this decree.
