TRANSFER THE BA BE NATIONAL PARK UNDER THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT TO THE PROVINCE OF BAC CAN PEOPLE'S COMMITTEE FOR MANAGEMENT d) To guide, monitor, inspect, and compile reports on the implementation of this Circular;

PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Based on the Law on Forest Protection and Development dated August 19, 1991;
Pursuant to the proposal of the Chairman of the People's Committee of Bac Can Province (document number 214/UB-TH dated April 2, 2002),
DECISION:
Article 1. TRANSFER THE BA BE NATIONAL PARK (located in Ba Be District, Bac Can Province) under the Ministry of Agriculture and Rural Development to the Bac Can Province People's Committee for direct management.
Article 2. The Ministry of Agriculture and Rural Development shall coordinate with the Ministry of Finance to conduct a comprehensive inventory and hand over the current status (forest area, infrastructure, finance, management staff, labor...) of the Ba Be National Park to the Bac Can Province People's Committee for management.
Article 3. The Chairman of the Bac Can Province People's Committee is responsible for organizing and directing the implementation of the protection and conservation of biodiversity at the Ba Be National Park in accordance with the provisions of the Prime Minister's Decision No. 245/1998/QĐ-TTg dated December 21, 1998 on the implementation of state management responsibilities at various levels regarding forests and forest land.
Article 4. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.
The Ministers of Agriculture and Rural Development, Planning and Investment, Finance, and the Chairman of the Bac Can Province People's Committee are responsible for implementing this Decision.
