Regulations on functions, tasks, powers, and organizational structure of the Remote Sensing Center

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Resolution No. 02/2002/QH11 dated August 5, 2002 of the National Assembly of the Socialist Republic of Vietnam, Session I, Term XI, stipulating the list of ministries and ministerial-level agencies of the Government;

Considering the proposal of the Head of the Cadre and Civil Service Department,

At the proposal of the Minister and Head of the National Ethnic Committee and the Minister of Home Affairs,

DECREE:

Article 1. Position and Functions

The National Ethnic Committee is a ministerial-level agency of the Government with the function of managing state affairs in the field of ethnic work throughout the country; managing state services and representing the state's ownership interest in enterprises with state capital under its management in accordance with the law.

Article 2. Tasks and Powers

The National Ethnic Committee is responsible for performing the tasks and powers prescribed in Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government on the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, and the following specific tasks and powers:

1. Submit draft laws, ordinances, and other draft regulatory legal documents concerning ethnic issues to the Government and the Prime Minister;

2. Submit strategic plans, development plans, long-term plans, five-year plans, annual plans, national target programs, action programs, and important projects within the scope of ethnic work to the Government and the Prime Minister;

3. Issue decisions, directives, and circulars within the scope of state management of the National Ethnic Committee;

4. Direct, guide, inspect, and be responsible for implementing regulatory legal documents, strategies, plans, programs, and other legal documents within the scope of the committee’s management after approval; provide information, propaganda, dissemination, and education on legal matters related to ethnic issues;

5. Investigate, research, and compile data on the origin, history, development of ethnic groups, tribes, clans; characteristics, ethnic components, economic and social conditions, cultural life, customs, traditions, and other issues related to ethnic groups;

6. Coordinate activities with ministries, ministerial-level agencies, government agencies, provincial People's Committees, municipal People's Committees directly under the Central Government, and central political-social organizations and social organizations in the implementation of Party and State policies on ethnic rights, including language and writing; on education development, expanding public awareness, prioritizing training and capacity building for ethnic minority cadres; on health care for ethnic minorities;

7. Take the lead and coordinate with ministries, ministerial-level agencies, and government agencies to build and implement the national program on ethnic issues; organize and direct the implementation of policies ensuring equality, unity, and social justice among ethnic groups, combating all forms of discrimination and division among ethnic groups;

8. Take the lead and coordinate with ministries, ministerial-level agencies, government agencies, and local authorities to direct the implementation of pilot model projects and preferential policies in areas with special difficulties in socio-economic conditions assigned by the Government; summarize practical experiences and replicate effective development models;

Coordinate with ministries, ministerial-level agencies, and government agencies in implementing specific policies and preferential measures for comprehensive development in politics, economy, culture, society, and national defense and security in ethnic minority and mountainous regions; prioritize investment in infrastructure construction, economic and social development programs, and commodity economy development in ethnic minority areas, remote and far-flung areas;

9. Direct, guide, and inspect the implementation of settlement work for ethnic minority populations;

10. Organize and direct the implementation of specific measures to maintain, preserve, and develop ethnic groups;

11. Take the lead and coordinate with relevant ministries and sectors to assist the Government in determining criteria for classifying areas according to levels of development in ethnic and mountainous regions and adjust these criteria to suit the pace of development at different periods;

12. Welcome and visit ethnic minority populations; coordinate with ministries, sectors, and localities to resolve legitimate wishes of ethnic minorities in accordance with regulations and policies;

Organize meetings between ethnic groups to exchange experiences and enhance the great unity of the Vietnamese nation;

Direct and guide the establishment of exemplary collectives and individuals who are ethnic minorities and serve as role models in implementing Party and State policies, acting as nuclei in maintaining social order, reinforcing national defense, and security;

13. Take the lead and coordinate with the Ministry of Home Affairs and the Ministry of Education and Training in organizing the implementation of planning and training programs for ethnic minority cadres;

14. Participate in appraising investment proposals and projects related to socio-economic development in ethnic minority areas; appraise and inspect the implementation of investment projects in the field of ethnicity;

15. Take the lead and coordinate with relevant ministries and sectors in renewing and strengthening propaganda and mobilization work to encourage ethnic minorities to implement policies, laws, and regulations on ethnicity;

16. Implement international cooperation in the field of ethnic work in accordance with the law;

17. Organize and direct the implementation of scientific research plans in the field of ethnic work;

18. Perform specific duties and powers within the scope of representing the state's ownership interest in enterprises with state capital under its management in accordance with the law;

19. Inspect, investigate, settle complaints, accusations, combat corruption and negative practices, and handle violations of law in the field of ethnic work within the committee's jurisdiction;

20. Decide and direct the implementation of the administrative reform program of the committee in accordance with the goals and content of the State administrative reform program approved by the Prime Minister;

21. Manage organizational structures and staffing; direct the implementation of salary systems and incentive, reward, and disciplinary policies for civil servants and employees under the committee's management; train and enhance professional skills for civil servants, employees, and those engaged in ethnic work;

22. Managing financial resources and assets assigned, and organizing the implementation of the budget allocated as prescribed by law.

Article 3. Organizational structure of the committee

a) Organizations assisting the Minister, Chairman of the Committee in performing state management functions:

1. Department of Ethnic Policies;

2. Department of Ethnic Work in Northwest Region (referred to as Department of Localities I);

3. Department of Ethnic Work in Central Highlands Region (referred to as Department of Localities II);

4. Department of Ethnic Work in Mekong Delta Region (referred to as Department of Localities III);

5. Propaganda Department;

6. Legal Affairs Department;

7. Department of Planning and Finance;

8. THE INTERNATIONAL COOPERATION DEPARTMENT;

9. Department of Organization and Cadres;

10. Inspectorate;

11. Office.

b) Scientific and technological organizations under the Committee:

1. Institute of Ethnic Groups;

2. Ethnic Work Vocational Training School;

3. Computing Center;

4. Ethnic Journal;

5. Ethnic and Development Newspaper.

Article 4. Deputy member concurrently holding office

The Deputy member concurrently holding office of the Ethnic Committee shall be decided by the Minister, Chairman of the Ethnic Committee upon submission to the Prime Minister.

Article 5. Effectiveness

This Decree shall take effect fifteen days after its publication in the Official Gazette.

This Decree replaces Decree No. 59/1998/NĐ-CP dated August 13, 1998 of the Government on the functions, tasks, powers, and organizational structure of the Ethnic Committee and Mountainous Regions.

Article 6. Responsibility for Implementation

The Minister, Chairman of the Ethnic Committee, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decree./.
