DEPARTMENT OF HEALTH

Article 1. Position and Functions

3. ADVISE AND ORGANIZE THE IMPLEMENTATION OF LEGISLATIVE ACTIVITY; REVIEW, SYSTEMATIZE, CHECK AND HANDLE LEGISLATIVE ACTS, PROMOTE AND EDUCATE THE PUBLIC ABOUT THE LAW, MONITOR THE IMPLEMENTATION OF THE LAW, PLAN, PROGRAMME, PROJECT, AND SCHEME ON HEALTH UNDER THE DEPARTMENT OF HEALTH'S MANAGEMENT AT THE LOCAL LEVEL IN ACCORDANCE WITH THE LAWS.

4. CONFIRM THE CONTENT OF ADVERTISEMENTS FOR PRODUCTS, GOODS, SERVICES WITH SPECIAL MANAGEMENT BY THE DEPARTMENT OF HEALTH IN ACCORDANCE WITH THE LAWS.

b) DIRECT AND ORGANIZE THE SUPERVISION OF TRANSMISSIBLE DISEASES, NON-TRANSMISSABLE DISEASES, DISEASES OF UNKNOWN CAUSE, EARLY DETECTION AND HANDLING OF TRANSMISSIBLE DISEASES THAT CAUSE EPIDEMICS; IMPLEMENT REPORTING OF EPIDEMIC SITUATIONS IN ACCORDANCE WITH THE LAWS; ADVISE THE PROVINCE PEOPLE'S COMMITTEE ON THE DECLARATION OF EPIDEMICS AND END OF EPIDEMICS IN ACCORDANCE WITH THE LAWS;

c) DIRECT AND ORGANIZE THE IMPLEMENTATION OF VACCINATION AND USE OF MEDICAL SUPPLIES FOR TARGET GROUPS IN ACCORDANCE WITH THE LAWS; ORGANIZE THE RECEIPT OF APPLICATIONS AND ISSUE CERTIFICATES OF ELIGIBILITY FOR VACCINATION IN THE PROVINCE IN ACCORDANCE WITH THE LAWS;

d) ISSUE, RENEW, REVOKE BIOLOGICAL SAFETY CERTIFICATES FOR LABORATORIES IN ACCORDANCE WITH THE LAWS;

đ) SERVE AS THE POINT OF CONTACT FOR TACKLING THE HARMFUL EFFECTS OF TOBACCO, ALCOHOL ABUSE AND ALCOHOLIC BEVERAGES WITH HIGH ALCOHOL CONTENT IN THE PROVINCE;

e) SERVE AS THE STANDING COMMITTEE FOR DISEASE PREVENTION AND CONTROL, HIV/AIDS PREVENTION AND CONTROL IN THE PROVINCE.

7. REGARDING CLINICAL CARE AND REHABILITATION:

a) DIRECT, GUIDE AND OVERSEE THE IMPLEMENTATION OF LEGISLATIVE ACTS, PROFESSIONAL REGULATIONS AND NATIONAL TECHNICAL STANDARDS FOR HEALTH CARE FACILITIES, REHABILITATION CENTERS, MEDICAL FORENSIC AND PSYCHIATRIC FORENSIC INSTITUTES ACCORDING TO THE LEVEL OF MANAGEMENT AND TECHNICAL LINEAGE;

b) ISSUE, RENEW, SUSPEND, REVOKE LICENSES FOR HEALTH CARE PRACTICE AND LICENSES FOR HEALTH CARE FACILITIES AND DRUG SUBSTITUTION TREATMENT FACILITIES IN ACCORDANCE WITH THE LAWS.

a) Direct, guide, and evaluate the implementation of specialized regulations and national technical standards concerning infectious disease prevention and control; HIV/AIDS; prevention and treatment of opiate addiction; non-communicable diseases; occupational diseases, accidents, and injuries; environmental health, school health, hygiene and labor health; community nutrition; border health quarantine; chemicals, insecticides, and bactericides used in household and medical fields within the province;

b) Direct and organize the surveillance of infectious diseases, non-communicable diseases, diseases with unknown causes, early detection, and handling of infectious diseases causing epidemics; implement notifications of epidemic situations according to the provisions of the law; advise the provincial People's Committee on declaring epidemics and the end of epidemics according to the provisions of the law;

c) Direct and organize the implementation of vaccination and the use of medical products for specified groups according to the provisions of the law; organize the acceptance of applications, issuance of certificates meeting vaccination conditions within the province according to the provisions of the law;

d) Issue, reissue, and revoke biosafety certificates for laboratories according to the provisions of the law;

đ) Serve as the focal point for tobacco harm reduction work, alcohol abuse prevention, and harmful effects of alcoholic beverages and other alcoholic drinks within the province;

e) Act as the permanent member of the Provincial Steering Committee for Disease Prevention and Control, and HIV/AIDS Prevention and Control;

7. On medical examination and treatment, and rehabilitation:

a) Direct, guide, and monitor the implementation of regulatory legal documents, specialized regulations, and national technical standards for medical examination and treatment facilities, rehabilitation centers, medical examinations, forensic medicine, and forensic psychiatric examinations according to the management levels and technical tiers;

b) Issue, reissue, suspend, and revoke medical practice licenses for medical examination and treatment facilities and drug substitution treatment facilities for opiate addiction according to the provisions of the law; issue, reissue, adjust, suspend, and revoke operating permits for medical examination and treatment facilities according to the provisions of the law;

c) Permit healthcare facilities to apply new techniques and methods in accordance with the provisions of the law.

8. On traditional medicine:

a) Organize the implementation of the inheritance, promotion, and integration of traditional medicine with modern medicine in disease prevention, diagnosis, treatment, rehabilitation, staff training, scientific research, and the production of traditional medicine at the local level;

b) Direct, guide, and monitor the implementation of regulatory documents, professional regulations, and national technical standards for healthcare facilities and rehabilitation centers using traditional medicine within the province according to the分级授权；

c) Issue, reissue, suspend, and revoke practice certificates for traditional medicine practitioners and issue, reissue, adjust, suspend, and revoke operating permits for healthcare facilities practicing traditional medicine in accordance with the provisions of the law.

9. Regarding pharmaceuticals and cosmetics:

a) Guide the implementation and supervise the quality of medicines and cosmetics on the local territory. Direct and monitor the recall of medicines as stipulated;

b) Direct and implement the management of pharmaceutical business operations and pharmacy practice (issuing, suspending, and revoking pharmacy practice certificates), issuing certificates of qualification for pharmaceutical business operations, and issuing cosmetic registration numbers in accordance with the provisions of the law;

c) Implement drug pricing and tendering in accordance with the provisions of the law;

d) Direct and guide the organization to carry out hospital pharmacy work and other tasks in accordance with the authorized jurisdictional division;

10. Regarding food safety:

a) Take the lead in drafting and submitting to the competent authority for promulgation local technical standards concerning food safety for special food products of the locality in accordance with the provisions of the law;

b) Supervise the quality of products and food additive, food processing aid, container, packaging material, bottled water, natural mineral water, health food, nutritionally enriched food, and other food product manufacturing and trading establishments on the local territory according to the division of responsibilities by the Ministry of Health;

c) Organize the acceptance of conformity declarations or confirmations of compliance with food safety regulations; issue certificates of food safety compliance for food service establishments and food product manufacturing and trading establishments in accordance with the provisions of the law;

d) Manage food safety on the local territory; manage conditions ensuring safety for small-scale food production and trading establishments, street food vendors, food service establishments, and food safety at local markets and other entities according to the division of management responsibilities;

e) Serve as the permanent member of the Interdepartmental Steering Committee on Food Safety at the local level;

11. On medical equipment and health facilities:

Guide and evaluate the implementation of legal provisions concerning medical equipment and health facilities.

12. On population and family planning and reproductive health:

a) Organize the implementation of indicators and performance measures in the field of population and family planning; direct and guide national technical standards, professional procedures, and services related to reproductive health care and family planning;

b) Organize the implementation and guide, inspect, supervise, and evaluate the implementation of policies, programs, projects, models related to the field of population and family planning and reproductive health care;

c) Decide to permit the implementation of gender determination techniques and assisted reproductive technology in accordance with the provisions of the law;

d) Serve as the permanent member of the Population and Family Planning Work Steering Committee of the province;

13. On health insurance:

Advise, direct, and guide the implementation of health insurance policies and laws;

14. On health workforce training:

a) Organize the implementation of plans for health workforce training and development policies on the provincial level;

b) Manage health workforce training institutions according to the division of labor by the Provincial People's Committee;

15. Assist the Provincial People's Committee in managing state affairs regarding enterprises, collective economic organizations, private economic organizations; guide and inspect activities of associations and non-governmental organizations participating in health activities in the locality in accordance with the law;

16. Implement the administrative reform program in the health sector according to the goals set by the Provincial People's Committee's administrative reform program;

17. Implement international cooperation in the field of health care according to the division of labor or delegation from the Provincial People's Committee.

18. Be responsible for providing professional guidance and supervision on areas under the management of the Department of Health to the Health Departments of district, county, city, and provincial-level municipal people's committees;

19. Organize research, application of scientific and technological progress and technology; build information systems and archives to serve state management and professional work in the health sector;

20. Inspect, investigate, handle violations, resolve complaints and accusations, prevent corruption, promote thrift, and combat waste in the health sector in accordance with the law and according to the division of labor or delegation by the Provincial People's Committee;

21. Specify the functions, tasks, and powers of organizations under the Department in accordance with the functions, tasks, and powers of the Department of Health; specify the functions, tasks, organizational structure, and working relationships of public service units directly under the Department according to the general guidelines of the Ministry of Health, the Ministry of Home Affairs, and relevant ministries, and in accordance with the provisions of the Provincial People's Committee;

22. Manage the organizational structure, civil servant quota, job classification, position establishment, and staffing levels based on occupational titles and number of employees in public service units directly under the Department; implement salary systems and incentive policies, training, rewards, and disciplinary actions for civil servants, public officials, and workers under the Department's jurisdiction in accordance with the law and according to the division of labor or delegation by the Provincial People's Committee;

23. Guide and inspect the implementation of self-management and self-responsibility mechanisms of public service units in accordance with the law;

24. Manage and be responsible for financial resources and assets assigned according to the law and according to the division of labor or delegation by the Provincial People's Committee.

25. Implement periodic and ad hoc information and reporting tasks on the implementation of assigned duties to the Provincial People's Committee and the Ministry of Health.

26. Perform other tasks assigned by the Provincial People's Committee, the Chairman of the Provincial People's Committee, and as stipulated by law.

đ) Based on the regulations on the delegation of organizational and cadre management, the Director of the Department decides or submits to the competent authority for decisions regarding the appointment and dismissal of heads and deputy heads of units under the Department according to the position standards set by the provincial people's committee;

1. Leadership of the Department of Health:

a) The Department of Health has a Director and not more than three Deputy Directors;

b) The Director of the Department of Health is the head of the Department, accountable to the Provincial People's Committee, the Chairman of the Provincial People's Committee, and under the law for the performance of state management functions, tasks, and authorities in the field of health within the province; responsible for reporting work to the Provincial People's Committee, the Chairman of the Provincial People's Committee, and the Minister of Health; report to the Provincial People's Council, respond to voters' suggestions, and answer questions from provincial People's Council representatives;

c) The Deputy Director of the Department of Health assists the Director in directing certain aspects of work, accountable to the Director and under the law for the assigned tasks. When the Director is absent, one Deputy Director may be delegated by the Director to manage the activities of the Department;

d) The appointment of the Director and Deputy Directors of the Department of Health is decided by the Chairman of the Provincial People's Committee according to the position standards issued by the Ministry of Health and as stipulated by law. The Director and Deputy Directors of the Department of Health shall not concurrently hold the position of Head of subordinate units with legal personality (except where higher legal documents provide otherwise);

đ) The removal, transfer, rotation, commendation, disciplinary action, resignation, retirement, and implementation of policies for the Director and Deputy Directors of the Department of Health are decided by the Chairman of the Provincial People's Committee according to the law;

e) The Director of the Department of Health decides or submits to the competent authority for decision on the appointment and removal of heads and deputy heads of organizations, agencies, and units under and directly under the Department according to the分级授权由省人民政府批准的标准和条件。

2. Organizations providing comprehensive advisory services and specialized professional affairs under the Department of Health:

a) Office;

In cases where the Department of Finance has fewer specialized departments than those listed above, the provincial people's committee decides on adjustments to the names and functions of the departments to ensure comprehensive coverage of all areas under management and compliance with legal provisions.

c) Personnel Organization Department;

d) Medical Affairs Department;

đ) Pharmaceutical Affairs Department;

e) Planning and Finance Department.

Based on the nature, characteristics, and management requirements of each locality, the Director of the Department of Health, in collaboration with the Director of the Department of Civil Service Management and Administration, shall submit to the Chairman of the Provincial People's Committee for decision on establishing the Private Medical Practice Management Department or another organization with a different name, ensuring comprehensive coverage of all areas under management. The number of departments under the Department of Health shall not exceed seven.

3. Agencies directly under the Department of Health:

a) Population and Family Planning Agency;

b) Food Safety and Sanitation Agency.

These agencies have legal personality, their own seals, bank accounts, and organizational structures with no more than three departments.

4. Publicly funded institutions directly under the Department of Health:

Based on local characteristics and actual needs, the Director of the Department of Health, in collaboration with the Director of the Department of Civil Service Management and Administration, shall submit to the Provincial People's Committee for decision on establishing publicly funded institutions under the Department according to the approved planning and legal provisions:

a) In the field of preventive healthcare and specialties: Implement the model of the Provincial Center for Disease Control based on merging centers with similar functions; specialty centers and hospitals with beds can be transferred to the Provincial General Hospital or established as specialty hospitals when there is a need and sufficient resources;

b) In the fields of medical examination and treatment and rehabilitation: Provincial General Hospitals, Regional General Hospitals, Traditional Medicine Hospitals at the provincial level, and specialty hospitals at the provincial level suitable for local needs and actual conditions. A general hospital at the county level should only be established when there is a genuine need, conditions, and it meets the standard of a Class II hospital or above approved by the competent authority;

c) In the field of Testing: Drug, Cosmetic, and Food Testing Centers;

d) In the field of Forensic Medicine: Forensic Medicine Centers;

đ) In the field of Medical Appraisal: Medical Appraisal Centers;

e) In the field of Training: Colleges or Vocational Schools of Health;

g) County Health Centers: Uniformly organized at the county level, performing preventive healthcare, medical examination and treatment, and rehabilitation functions; regional multi-disciplinary clinics, area midwifery houses (if any), and village health stations, town health stations, and township health stations within the county are units under the County Health Center.

5. Staffing:

a) Civil servant staffing and the number of personnel working in publicly funded institutions of the Department of Health are allocated based on job positions linked to functions, tasks, scope of operations, and within the total civil servant staffing of administrative organs and organizations, and the number of personnel working in publicly funded institutions of provinces and centrally-administered cities approved or ratified by the competent authority;

b) Based on functions, tasks, organizational structure, list of job positions, civil service grade structure, and professional title structure approved by the competent authority, the Department of Health, in collaboration with the Department of Civil Service Management and Administration, annually builds plans for civil servant staffing and the number of personnel working in publicly funded institutions to be submitted to the Provincial People's Committee for approval by the competent authority according to legal provisions to ensure the fulfillment of assigned tasks.

Chapter II

HEALTH DEPARTMENT

1. The position and functions of the Social and Cultural Department shall be carried out in accordance with Article 11 of Decree No. 150/2025/NĐ-CP.

The Health Office is a specialized agency under the County People's Committee, responsible for advising and assisting the County People's Committee in implementing state management in the field of health, including: Preventive healthcare; medical examination and treatment, rehabilitation; traditional medicine; reproductive health; medical equipment; pharmaceuticals; cosmetics; food safety; health insurance; population and family planning on the local territory.

2. The Health Office is subject to the direction and management of organizational structure, staffing, and activities by the County People's Committee, while also being subject to professional guidance, inspection, and audit by the Department of Health.

Article 5. Tasks and Powers

1. Submit to the People's Committee at the district level for issuance of decisions, directives; master plans, five-year plans, annual plans, and other documents; programs and measures to organize the implementation of administrative reform tasks within the scope of authority defined by the People's Council and the People's Committee at the district level in the field of health care.

2. Implement laws, regulations, master plans, and plans after they have been approved by competent authorities; disseminate information, promote, educate on laws; monitor the enforcement of laws within the assigned field.

3. Assist the People's Committee at the district level in implementing and being responsible for the examination, registration, and issuance of various types of permits and certificates in the field of health care within their jurisdiction as prescribed by law and according to the division of labor by the People's Committee at the district level.

4. Assist the People's Committee at the district level in managing state affairs concerning enterprises, collective economic organizations, private economic organizations; guide and inspect associations and non-governmental organizations participating in activities in the field of health care within the district according to the provisions of the law.

5. Provide professional guidance and business operations regarding the assigned management field to cadres and civil servants at commune, ward, town levels.

6. Organize the application of scientific and technological advancements; establish information systems and archives to serve state management and professional operations within the assigned field.

7. Carry out regular and extraordinary reporting on the implementation of assigned tasks according to the regulations of the People's Committee at the district level and the Department of Health.

8. Conduct inspections, participate in audits concerning the assigned field for organizations and individuals in the implementation of legal provisions; resolve complaints and denunciations; prevent corruption, practice thrift, and combat waste according to the law and the division of labor by the People's Committee at the district level.

9. Manage organizational structures, job positions, civil servant quotas, salary systems, incentive policies, rewards, disciplinary actions, training, and professional development for civil servants within the scope of management as prescribed by law and according to the division of labor by the People's Committee at the district level.

10. Manage and be responsible for finances and assets assigned according to the law and the division of labor by the People's Committee at the district level.

11. Perform other tasks assigned by the People's Committee at the district level or as prescribed by law.

Article 6. Organization and Staffing

1. Organization

a) The Health Office has a Director, not more than two Deputy Directors, and specialized civil servants;

b) The Director is the head of the Health Office, accountable to the People's Committee at the district level, the Chairman of the People's Committee at the district level, and the law for all activities of the Health Office;

c) Deputy Directors assist the Director in directing certain aspects of work and are accountable to the Director for assigned tasks. In the absence of the Director, one Deputy Director appointed by the Director shall manage the office's activities;

d) The appointment, transfer, rotation, reward, punishment, removal from office, resignation, and implementation of policies for the Director and Deputy Directors are decided by the Chairman of the People's Committee at the district level according to the law.

2. Quota

a) The quota of civil servants of the Health Office is allocated based on job positions according to functions, tasks, scope of operation, and falls within the total quota of civil servants in administrative agencies and organizations under the People's Committee at the district level assigned by the competent authority;

b) Based on functions, tasks, and the list of job positions, the structure of civil service grades approved by the competent authority, the Health Office annually develops a plan for the civil servant quota according to the law to ensure the fulfillment of assigned tasks.

Chapter III

IMPLEMENTATION

Article 7. Effective Date

1. This Circular takes effect from January 25, 2016.

2. Circular Jointly Issued No. 03/2008/TTLT-BYT-BNV dated April 25, 2008, jointly issued by the Ministry of Health and the Ministry of Home Affairs guiding the functions, tasks, powers, and organizational structure of the Department of Health and the Health Office under the People's Committee at the provincial and district levels ceases to be effective from the date this Circular takes effect.

3. The functions, tasks, and organizational structure of local population and family planning continue to operate stably until replaced by a new document issued by the competent state agency.

Article 8. Responsibility for Implementation

The People's Committee at the provincial level is responsible for organizing and implementing this Circular; specifying the functions, powers, and organizational structure of the Department of Health; guiding the People's Committee at the district level to specify the functions, powers, and organizational structure of the Health Office;

During the implementation process, if there are emerging issues or difficulties, the People's Committee at the provincial level shall promptly reflect them to the Ministry of Health and the Ministry of Civil Affairs for consideration and resolution according to their authority./.
