Amending and supplementing some articles of Circular No. 11/2012/TT-BGTVT dated April 12, 2012issued by the Minister of Transport on professional standards, professional certificatesof seafarers and the minimum safe manning of Vietnamese ships

Pursuant to the Maritime Code of Vietnam dated June 14, 2005;
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978, as amended in 2010 (STCW Convention), to which Vietnam is a member;
At the proposal of the Director of the Personnel Department and the Director of the Vietnam Maritime Administration,
The Minister of Transport issues this Circular amending and supplementing some articles of Circular No. 11/2012/TT-BGTVT dated April 12, 2012 issued by the Minister of Transport on professional standards, professional certificates of seafarers and the minimum safe manning of Vietnamese ships.
Article 1. Amending and supplementing some articles of Circular No. 11/2012/TT-BGTVT dated April 12, 2012 issued by the Minister of Transport on professional standards, professional certificates of seafarers and the minimum safe manning of Vietnamese ships as follows:
1. Amending and supplementing Clause 18 of Article 3 as follows:
"18. The training record book is issued to seafarers with a university degree undergoing officer cadet training on deck vessels of 500 GT or more, or engine officers with main engine power of 750 kW or more, or to cadets undergoing officer cadet training on deck vessels of 500 GT or more, or engine officers with main engine power of 750 kW or more according to the maritime officer training program conducted by the Vietnam Maritime University under the Pilot Project for Maritime Officer Training approved by the Ministry of Transport; seafarers with a college degree or vocational college degree of 36 months undergoing officer cadet training in electrical engineering according to Table A-III/6 of the STCW Code."
2. Supplementing Point q of Clause 1 of Article 20 as follows:
"q. Chief cook, steward."
3. Amending and supplementing Clause 2 Article 21 as follows:
"2. Graduated from a major in ship navigation, marine engine operation, or marine electrical engineering at specialized maritime training institutions, or graduated from the maritime officer training program conducted by the Vietnam Maritime University under the Pilot Project for Maritime Officer Training approved by the Ministry of Transport."
4. Amending and supplementing Point a of Clause 1 of Article 27 as follows:
"a) Graduated from a major in ship navigation at a college level or vocational college level with a training period of 36 months, or graduated from the maritime officer training program in ship navigation conducted by the Vietnam Maritime University under the Pilot Project for Maritime Officer Training approved by the Ministry of Transport; in case of graduation from a major in ship navigation at a vocational college level or vocational college level with a training period of less than 36 months, or a technical college level with a training period of 24 months, then must complete the advanced training program prescribed by the Ministry of Transport."
5. Amending and supplementing Point a of Clause 1 of Article 34 as follows:
"a) Graduated from a major in marine engine operation at a college level or vocational college level with a training period of 36 months, or graduated from the maritime officer training program in marine engine operation conducted by the Vietnam Maritime University under the Pilot Project for Maritime Officer Training approved by the Ministry of Transport; in case of graduation from a major in marine engine operation at a vocational college level or vocational college level with a training period of less than 36 months, or a technical college level with a training period of 24 months, then must complete the advanced training program prescribed by the Ministry of Transport."
6. Amending and supplementing Point a of Clause 1 of Article 36 as follows:
"a) Graduated from a major in ship navigation at a technical college level with a training period of less than 24 months, or completed theoretical courses according to the maritime officer training program in ship navigation conducted by the Vietnam Maritime University under the Pilot Project for Maritime Officer Training approved by the Ministry of Transport; in case of graduation from a major in ship navigation at a basic vocational college level, must complete the advanced training program prescribed by the Ministry of Transport."
7. Amending and supplementing Point a of Clause 1 of Article 37 as follows:
"a) Graduated from a major in marine engine operation at a technical college level with a training period of less than 24 months, or completed theoretical courses according to the maritime officer training program in marine engine operation conducted by the Vietnam Maritime University under the Pilot Project for Maritime Officer Training approved by the Ministry of Transport; in case of graduation from a major in marine engine operation at a basic vocational college level, must complete the advanced training program prescribed by the Ministry of Transport."
8. Amending and supplementing Point b of Clause 2 of Article 55 as follows:
"b) Certified copy or photocopy with original for comparison of the Diploma of graduation from a major in training or Certificate of completion of the maritime officer training program, Certificate of advanced training, and Certificate of cross-training (if any)."
Article 2. Effective Date
This Circular takes effect from January 1, 2015.
Article 3. Implementation Organization
1. The Vietnam Maritime Administration is responsible for organizing the implementation of this Circular in coordination with relevant agencies.
2. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Maritime Administration, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
