Pursuant to Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decision No. 2621/QĐ-TTg dated December 31, 2013 of the Prime Minister on amending and supplementing certain levels of support for production development as stipulated in Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government;

At the proposal of the Director of the Department of Cooperative and Rural Development Economy;

amending and supplementing certain provisions of Circular No. 22/2019/TT-BNNPTNT dated November 30, 2019 of the Minister of Agriculture and Rural Development guiding certain provisions of the Livestock Law on the management of breeds and breeding products of livestock. guidelines for implementing certain contents of support for production development as stipulated at Decision No. 2621/QĐ-TTg dated December 31, 2013 of the Prime Minister on amending and supplementing certain levels of support for production development as stipulated in Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government.

Article 1. Scope of Regulation and Applicability

1. Scope of Regulation: This Circular provides guidelines for implementing certain contents of support for production development regarding: forest protection and development; land reclamation, restoration, terraced field creation; crop and livestock species conversion with economic value according to planning; animal and poultry vaccination stipulated in Decision No. 2621/QĐ-TTg dated December 31, 2013 of the Prime Minister on amending and supplementing certain levels of support for production development as stipulated in Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government (hereinafter referred to as Decision No. 2621/QĐ-TTg).

2. Applicability: households residing and having permanent residence registration in the poor districts benefiting from production development support policies under Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government.

Article 2. Interpretation of Terms

1. Reclaimed land: Land that is currently left uncultivated, other land designated for agricultural production approved by competent authorities.

2. Restored land: Land previously used for agricultural production but abandoned, located within agricultural production planning approved by competent authorities.

3. Terraced field creation land: Land designated for agricultural production and planned as terraced fields approved by competent authorities.

Article 3. Support for Agricultural, Forestry, and Fishery Production Development

1. Forest Protection and Development Support

a) The level of support as prescribed in Clause 1, Article 1 of Decision No. 2621/QĐ-TTg.

b) Method of Support:

- Regarding forest protection contracts for protective forests and productive natural forests: apply according to Circular Joint No. 80/2013/TTLT-BTC-BNN dated June 14, 2013 of the Ministry of Finance and the Ministry of Agriculture and Rural Development guiding the use of funds for forest protection and development.

- Regarding afforestation and forest development: apply according to Circular Joint No. 10/2013/TTLT-BNNPTNT-BKHĐT dated February 1, 2013 of the Ministry of Agriculture and Rural Development and the Ministry of Planning and Investment guiding management and use of state budget investment capital to implement the Forest Protection Plan for the period 2011-2020 pursuant to Decision No. 57/QĐ-TTg dated January 9, 2012 of the Prime Minister.

2. Reclamation, Restoration, and Terraced Field Creation

a) The level of support as prescribed in Clause 2, Article 1 of Decision No. 2621/QĐ-TTg.

b) Method of Support: apply according to Circular Joint No. 04/2013/TTLT-UBDT-BTC-BTNMT dated November 18, 2013 of the Ministry of Ethnic Affairs, the Ministry of Finance, and the Ministry of Natural Resources and Environment guiding certain provisions of Decision No. 755/QĐ-TTg dated May 20, 2013 of the Prime Minister approving the policy of supporting residential land, production land, and drinking water for ethnic minority households and poor households in extremely difficult communes, villages, and towns.

3. Support for Economic Value Crop and Livestock Species Conversion According to Planning

Implement support through projects for economic value crop and livestock species conversion according to planning as stipulated in Article 4 of this Circular.

4. Animal and Poultry Vaccination

a) Content and level of support as prescribed in Clause 4, Article 1 of Decision No. 2621/QĐ-TTg.

For blue ear disease vaccine: only support for sow and boar vaccination; for avian influenza vaccine: only support for poultry vaccination in villages with previous outbreaks and high-risk areas.

b) Implementation Method:

- Vaccines for preventive vaccination are received according to plans from the Animal Health Sub-Department transferred by the Animal Health Department;

- Each year, the Department of Agriculture and Rural Development guides the People's Committee of the district and commune to organize statistics on the number of animals eligible for vaccination for each dangerous disease including foot-and-mouth disease, anthrax, and hemorrhagic septicemia in cattle and buffalo; swine fever and African swine fever in pigs; and avian influenza in poultry to serve as the basis for support;

- Three months before the vaccination campaign, the People's Committee of the commune organizes statistics and registers the number of animals; summarizes and submits for approval by the People's Committee of the district;

- The People's Committee of the district reviews different sources of vaccines to avoid overlap based on the number of animals reported by the communes; compiles the demand for preventive vaccination vaccines and submits it to the Department of Agriculture and Rural Development for consolidation and submission for approval by the provincial People's Committee; reports to the Ministry of Agriculture and Rural Development to receive vaccine support.

Article 4. Implementing project for economic value crop and livestock species conversion according to planning

1. Conditions for Implementation

a) For Projects for Economic Value Crop and Livestock Species Conversion According to Planning:

- Included in the plan of the People's Committee of the district for crop and livestock species conversion with economic value;

- Consistent with the socio-economic development planning, land use planning, agricultural production development, and new rural construction planning of the locality;

- Suitable to the conditions, characteristics, and production needs of households in the area;

- Ensuring transparency, democracy, and participation of households in the formulation and implementation of the project.

b) Participants in the Project for Economic Value Crop and Livestock Species Conversion:

- Possess land, labor, and production materials corresponding to the project content;

- Commit to comply with all registered production activities.

2. The project for economic value crop and livestock species conversion according to planning includes the following basic contents:

a) Objectives of the project;

b) Contents of the project;

c) Activities of the project;

d) Implementation organization of the project;

d) Inspect, evaluate, summarize and report on the results of implementing the project.

3. Support for households participating in the project

a) The content and level of support as prescribed in Clause 3, Article 1 of Decision No. 2621/QĐ-TTg.

b) Depending on the purpose, content of the project and specific conditions of the locality, participating households shall be supported with types of planting materials, livestock, and production inputs as follows:

- Planting materials and livestock with economic value listed in the catalog of permitted production and trading materials according to the regulations of the Ministry of Agriculture and Rural Development; suitable for planning, restructuring plans of the industry and local conditions;

- Fertilizers according to technical norms applicable to each type of planting material.

4. Methods of support

a) People's Committee at the district level: based on approved agricultural, forestry, and fisheries production planning and population resettlement plans and the orientation for socio-economic development of the locality, issue plans to adjust crop and livestock structures with economic value within the district.

b) People's Committee at the commune level: based on the district-level plans to adjust crop and livestock structures with economic value, develop projects to adjust crop and livestock structures with economic value within the commune.

The establishment, review, approval, and implementation of projects shall be carried out in accordance with the administrative procedures stipulated in Article 4 of Circular No. 46/2014/TT-BNNPTNT dated December 5, 2014, issued by the Ministry of Agriculture and Rural Development guiding the implementation of certain support measures for production development as provided for in Decision No. 551/QĐ-TTg dated April 4, 2013, of the Prime Minister approving Program 135 on infrastructure investment support and production development support for particularly difficult communes, border communes, safe area communes, and particularly difficult villages and hamlets. Review documents shall be submitted in accordance with the models attached to this Circular.

Article 5. Implementation

1. The Department of Cooperative Economy and Rural Development shall take the lead and coordinate with relevant units to perform the following tasks:

- Guide, inspect, urge the implementation of support for agricultural, forestry, and fisheries production development as provided for in Decision No. 2621/QĐ-TTg; propose adjustments and supplements to promote the implementation of support;

- Summarize the situation of implementation, periodically every six months and annually report the results to the agency responsible for implementing Resolution 30a;

- Guide localities to conduct mid-term and final reviews of support for agricultural, forestry, and fisheries production development as provided for in Decision No. 2621/QĐ-TTg; advise the Ministry of Agriculture and Rural Development on mid-term and final reviews of such support.

2. Provincial People's Committees

a) Specify some specific levels of support appropriate to local conditions as provided for in Article 1 of Decision No. 2621/QĐ-TTg.

b) Direct and instruct the Department of Agriculture and Rural Development to perform the following tasks:

- Provide detailed guidance on support for agricultural, forestry, and fisheries production development for poor districts in line with local realities; provide technical and economic norms and production procedures to implement production development contents; strengthen extension work, propaganda, training, and model building; inspect project implementation in the locality and report to the provincial People's Committee;

- Periodically every six months and annually compile and report the results of implementation in the locality to the Ministry of Agriculture and Rural Development as prescribed.

c) Allocate resources for support from the central government to poor districts, direct the integration of various sources of capital in the locality to implement support for agricultural, forestry, and fisheries production development.

d) Direct the People's Committees of poor districts to effectively implement support for agricultural, forestry, and fisheries production development in conjunction with agricultural sector restructuring and new rural construction.

3. People's Committee at the district level

a) Issue plans for adjusting crop and livestock structures with economic value according to planning in the district.

b) Implement the contents of support for agricultural, forestry, and fisheries production development in the district.

c) Review and approve projects for adjusting crop and livestock structures with economic value according to commune planning.

d) Inspect, supervise the implementation process; periodically every six months and annually compile and report the results of implementation in the district to the provincial People's Committee as prescribed.

4. People's Committee at the commune level

a) Implement the contents of support for agricultural, forestry, and fisheries production development in the commune.

b) Develop and implement projects for adjusting crop and livestock structures with economic value in the commune.

c) Implement projects democratically, transparently, and accurately targeting beneficiaries.

d) Inspect, urge, evaluate; periodically every six months and annually report the results of implementation in the commune to the district People's Committee.

Article 6. Effectiveness

1. This Circular takes effect from February 15, 2015. This Circular replaces the provisions in Clauses 1, 2, 3, and 6 of Section II of Circular No. 08/2009/TT-BNN dated February 26, 2009, issued by the Ministry of Agriculture and Rural Development guiding the implementation of certain support policies for agricultural, forestry, and fisheries production development under Resolution No. 30a/2008/NQ-CP dated December 27, 2008. Interest rate support provisions as provided for in Decision No. 2621/QĐ-TTg shall be implemented in accordance with Circular No. 28/2014/TT-NHNN dated October 1, 2014, of the State Bank of Vietnam amending and supplementing Circular No. 06/2009/TT-NHNN dated April 9, 2009, detailing interest rate preferential lending policies under the program supporting poor districts as provided for in Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government.

2. Any referenced documents that are amended, supplemented, or replaced shall be applied according to the amended, supplemented, or replacing documents.

3. In the course of implementation, if there are difficulties or obstacles, please report them to the Ministry of Agriculture and Rural Development (Department of Cooperative Economy and Rural Development) for supplementation and adjustment./.
