Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006 and the Law Amending and Supplementing Certain Provisions of the Civil Aviation Law of Vietnam dated November 21, 2014;

Pursuant to the Price Law dated June 20, 2012;

Pursuant to Decree No. 177/2013/ND-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Price Law and Decree No. 149/2016/NĐ-CP dated November 11, 2016 of the Government amending and supplementing certain provisions of Decree No. 177/2013/NĐ-CP;

Pursuant to Decree No. 102/2015/NĐ-CP of the Government dated October 20, 2015 on management and operation of civil airports;

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

PURSUANT TO THE PROPOSAL OF THE DIRECTOR OF THE TRANSPORT DEPARTMENT AND THE DIRECTOR OF THE VIETNAM CIVIL AVIATION ADMINISTRATION;

The Minister of Transport issues this Circular stipulating levels and ranges of certain specialized aviation services at Vietnamese airports.

PART I

GENERAL PROVISIONS

Article 1. Scope of application

This Circular stipulates levels and ranges of certain specialized aviation services, including:

1. Aviation services with state-set prices

a) Air traffic control service for departure and arrival;

b) Air traffic control service for flights passing through airspace managed by Vietnam;

c) Takeoff and landing service for aircraft;

d) Air security service;

đ) Passenger service;

2. Aviation services with state-set price ranges

a) Aircraft parking area rental services;

b) Passenger check-in counter rental services;

c) Baggage conveyor belt rental services;

d) Aisle bridge rental services for boarding and deplaning passengers;

đ) Comprehensive ground technical service package at airports (for airports still applying the comprehensive package method);

e) Automatic baggage sorting service for departure;

g) Service using underground fueling system infrastructure at airports;

h) Aircraft fueling service.

3. Non-aviation services with state-set price ranges

a) Terminal passenger area rental service;

b) Cargo terminal rental service;

c) Essential basic service at passenger terminals.

Article 2. Applicability

This Circular applies to organizations and individuals providing, using, and managing prices for the specialized aviation services specified in Article 1 of this Circular.

Article 3. Definitions

In this Circular, the following terms shall be understood as follows:

1. Point of takeoff or landing is an airport or dedicated airport where aircraft perform takeoff or landing activities;

2. Flight is the operation of an aircraft from takeoff at one point to landing at another point immediately thereafter;

3. International flight is a flight with a point of landing or takeoff outside the territory of Vietnam;

4. Domestic flight is a flight with both points of takeoff and landing within the territory of Vietnam;

5. Carrier is an organization or individual using aircraft owned by themselves or leased from others to carry out passenger and cargo transportation and general aviation operations;

6. Charter flight is a charter flight of Vietnam and a foreign charter flight according to the laws on ensuring charter flight operations;

7. Official flight is a military aircraft flight, a specialized customs or police aircraft flight, and a civilian aircraft flight used entirely for state official purposes;

8. Distance of air traffic control over Vietnamese airspace is the distance of air traffic control calculated from the entry point to the exit point of air routes within Vietnamese airspace;

9. Distance of air traffic control over Vietnamese airspace and controlled airspace managed by Vietnam is the distance of air traffic control calculated from the entry point to the exit point of air routes managed by Vietnam;

10. Distance of air traffic control over controlled airspace managed by Vietnam is the distance of air traffic control not included in the air routes mentioned in Clause 8 and Clause 9 of this Article;

11. Scheduled flight is a commercial flight regularly operated according to the published schedule on the booking and ticketing system of the carrier;

12. Unscheduled flight is a commercial flight that is not a scheduled flight as defined in Clause 11 of this Article;

13. Airport transfer flight is a non-commercial flight (no revenue generated);

14. Maximum takeoff weight (MTOW) is the maximum takeoff weight recorded in the aircraft operating manual;

15. Shipment goods are goods with the place of origin in Vietnam;

16. Designed seat is the number of passenger seats installed on the aircraft according to the manufacturer's specifications;

17. Base airport is an airport where aircraft overnight park, announced by the Civil Aviation Administration of Vietnam for carriers to operate in Vietnam.

Article 4. Regulations on payment for service usage and unit of cargo volume

1. Levels and ranges stipulated in this Circular (excluding the range for essential basic services) do not include value-added tax.

2. For aviation services

a) Services provided for international flights: the currency for service usage fees is US dollars (USD). The listing and payment of service usage fees shall be carried out in accordance with the laws on foreign exchange.

b) Services provided for domestic flights: the currency for service usage fees is Vietnamese dong (VND). The listing and payment of service usage fees shall be conducted in Vietnamese dong (VND).

3. For non-aviation services

a) In the restricted area of the international terminal: the service price is set in US dollars (USD). The listing and payment of service usage fees shall be carried out in accordance with the laws on foreign exchange.

b) At domestic terminals and areas outside the restricted area of the international terminal: the service price is set in Vietnamese dong (VND). The listing and payment of service usage fees shall be conducted in Vietnamese dong (VND).

4. Organizations and individuals using specialized aviation services are responsible for fully paying the service usage fees to the service provider.

5. Unit of cargo volume (including packaging)

a) Minimum volume for pricing of cargo security service at airports: 01 ton.

b) For single consignment (less than 1 ton): calculated based on the actual volume of the consignment.

Article 5. Regulations on groups of airports and operational time frames

1. Vietnamese airports are divided into three groups as follows:

a) Group A consists of airports operating 24/24 hours;

b) Group B consists of airports not belonging to Group A and Group C as specified in point a and point c of this clause;

c) Group C consists of airports serving economic and social purposes, including: Con Dao Airport, Dien Bien Airport, Ca Mau Airport, Rach Gia Airport.

2. The operating time frame at airports shall be determined as follows:

a) Peak hours are defined as time frames where the actual number of flights reaches 90% or more of the airport's operational limit.

b) Off-peak hours are defined as time frames where the actual number of flights is between 0-30% of the airport's operational limit.

c) Normal hours will be the remaining time frames that have flights other than those specified for peak and off-peak hours.

Article 6. Cases where service usage fees are not collected

1. Subjects exempt from payment for aircraft takeoff and landing services; air traffic control services for departure and arrival; air traffic control services for overflight through airspace managed by Vietnam

a) Official aircraft flights (excluding combined official and commercial transport flights).

b) Government business flights.

c) Search and rescue flights, humanitarian aid cargo transportation, flood relief, disaster relief, and other humanitarian missions.

d) Flights that return to land within 30 minutes after takeoff due to any reason.

2. Subjects exempt from payment for aviation security service usage fees

a. Diplomatic mail, humanitarian aid cargo.

b. Goods and spare parts exported for repair and supplies of airlines serving flights (excluding duty-free goods sold on flights).

c. Passengers traveling on flights exempted from service usage fees under Clause 1 of this Article.

d. Transit passengers staying up to 24 hours (excluding domestic-international transit passengers and vice versa): applicable only if the inbound and outbound segments are issued on the same passenger ticket and baggage ticket.

e. Flight crew members (including cases of airport transfers).

f. Children under two years old: calculated based on the departure time of the first flight segment.

3. Subjects exempt from payment for passenger service usage fees

a. Passengers traveling on flights exempted from service usage fees under Clause 1 of this Article.

b. Transit passengers staying up to 24 hours (excluding domestic-international transit passengers and vice versa): applicable only if the inbound and outbound segments are issued on the same passenger ticket and baggage ticket.

c. Flight crew members (including cases of airport transfers).

d. Children under two years old: calculated based on the departure time of the first flight segment.

Article 7. Cases for price adjustment

1. The level of price adjustment for carriers with a total monthly bill amount for aircraft takeoff and landing services, departure and arrival air traffic control services, as follows:

a) For services provided for international flights

c) The service usage fee amount is calculated separately for international and domestic flight services. Calculation period: one month.

2. The level of price adjustment for pilot training and training activities conducted in Vietnam as follows:

a) No service usage fees for departure and arrival air traffic control and aircraft takeoff and landing services during the first 36 months from the date the training facility conducts its first pilot training and training flight.

b) After the period specified in Point a of this Clause, the departure and arrival air traffic control service fee shall be applied according to Point b of Clause 5, Article 9 of this Circular, and the aircraft takeoff and landing service fee according to Point b of Clause 6, Article 11 of this Circular.

3. The level of price adjustment for aircraft takeoff and landing services and departure and arrival air traffic control services for Vietnamese airlines participating in the air transport market for the first time: apply a 50% rate of the prescribed price; applicable period: 36 months from the start of operation.

4. The level of price adjustment for aircraft takeoff and landing services and departure and arrival air traffic control services for airlines operating regular international flights to and from Vietnam when there is no other airline operating regularly for at least 12 months:

a) At Noi Bai International Airport, Tan Son Nhat International Airport, Da Nang International Airport: apply a 90% rate of the prescribed price; applicable period: 12 months from the start of operation.

b) At other airports: apply a 50% rate of the prescribed price; applicable period: 24 months from the start of operation.

5. In cases where an airline is subject to multiple levels of price adjustment according to Clauses 3 and 4 of this Article, the highest level of adjustment shall be applied.

Article 8. Provisions regarding the method of collecting passenger security assurance service usage fees and passenger service usage fees at airports

1. The cost of passenger security assurance services, baggage security assurance services, and passenger service usage fees at Vietnamese airports shall be collected through carriers operating flights to and from Vietnam. Passengers pay for passenger security assurance services, baggage security assurance services, and passenger service usage fees together with the cost of air transport services.

2. Carriers pay for passenger security assurance service usage fees and passenger service usage fees to the service provider unit for passenger terminal services and security assurance services on a monthly basis (transfer costs are borne by the party paying the service usage fees).

3. The service provider unit for passenger services and passenger and baggage security assurance services issues a "Collection Notice" based on the passenger list of each flight. The amount in the "Collection Notice" is determined according to the formula:

The commission fee for collection shall be determined at a rate of 1.5% (inclusive of value-added tax) on the monthly payment amount made by the airline for each period of service usage fees for passenger services and passenger security services. The collection commission only applies to regular flights.

5. Any excess (+) or shortage (-) amounts have been verified and reconciled: Airlines have the right to request verification and reconciliation if errors or mistakes are found in the "Collection Notice". Verification, reconciliation, and repayment of any difference amount (if applicable) shall be carried out immediately in the next period following the disputed payment period.

6. Documentation proving eligibility for exemption or discount: passenger manifest and specific aviation documents in electronic form.

7. Payment between the service provider and the airline shall be conducted according to the contract signed between both parties.

8. For passengers traveling on domestic connecting international flights

a) Domestic leg: collect service usage fees for passenger security and passenger services as stipulated at the departure airport.

b) International leg: collect service usage fees for passenger security and passenger services as stipulated at the transit airport.

9. For passengers traveling on international connecting domestic flights: collect service usage fees for passenger security and passenger services as stipulated at the transit airport.

Chapter II

REGULATIONS ON PRICES AND SPECIFIC PRICE RANGES

Section 1

AIRPORT SERVICE FEES

5. Special pricing regulations in certain cases

a) Charge at 50% of the price specified in Clause 3 and Clause 4 of this Article (based on the flight route from takeoff point to landing point) corresponding to the MTOW for: vertical takeoff aircraft and other non-aircraft flying devices, aircraft flying visually during flight; aircraft forced to land at alternate landing points (not the intended landing point) due to force majeure (weather, technical issues, passenger rescue, terrorism, crime...); aircraft conducting equipment calibration flights, technical landing, or transferring airports to landing or taking off points in Vietnam.

b) Charge at 30% of the price specified in Clause 3 and Clause 4 of this Article for: aircraft conducting pilot training flights (not combined with commercial operations); aircraft that must return to the departure point after 30 minutes or more of takeoff due to reasons not related to air traffic control.

c) In case of takeoff and landing at the same point, the price will be calculated based on the actual flight range (S) using the formula: S = Vht × T × 70%. Where:

Vht is the published cruise speed of the aircraft in the manufacturer's documentation (km/h);

T is the actual flight time of the aircraft;

In case of air traffic control error, the service provider and the user of air traffic control services shall negotiate reasonably to settle the actual costs incurred due to the aircraft returning to the departure point.

Article 10. Price level Air traffic control services over Vietnamese airspace

1. Objectives for collecting service usage fees: entities providing air traffic control services over Vietnamese airspace.

4. The service fee level for domestic flights landing at airports in Group A and Group B: based on the landing time of each flight according to the schedule approved by the Civil Aviation Administration of Vietnam.

5. The service fee level for flights landing at airports in Group C: collected at 60% of the rate specified for normal hours corresponding to the Maximum Takeoff Weight (MTOW) for flights landing at airports in Groups A and B as stipulated in Clause 3 and Clause 4 of this Article.

6. Provisions for calculating fees in certain special cases

a) Collected at 50% of the rate specified in Clause 3, Clause 4, and Clause 5 of this Article corresponding to the MTOW for: vertical takeoff aircraft and other non-aircraft flying objects; aircraft conducting visual flight rules operations; aircraft landing at alternate airports due to force majeure reasons (weather, technical issues, passenger emergency, terrorism, crime...); aircraft performing calibration flights and technical landings; aircraft transferring airports to various points of departure or arrival within Vietnam.

b) Collected at 30% of the rate specified in Clause 3, Clause 4, and Clause 5 of this Article for: aircraft conducting pilot training flights (non-commercial); aircraft that must return to the departure point more than 30 minutes after takeoff not due to the fault of the airport operator.

In case of fault of the airport operator, the airport operator shall negotiate with relevant units to reasonably settle actual costs incurred due to the aircraft having to return to the departure airport.

Article 12. Air transportation security service fee level

1. Object collecting payment for service usage: entities providing air transportation security services.

2. Object paying for service usage: organizations and individuals using air transportation security services.

3. Security service fee level for passengers and baggage

b) Special case pricing provisions: children aged from 2 to under 12 years old (at the time of the first leg departure) are charged at 50% of the rate specified in point a of this clause.

c) Service contents include: passenger and baggage security screening; aircraft security protection; security for delayed and missed connection passengers; management and supervision of refused entry passengers staying up to 24 hours; passenger and baggage identification before boarding; guarding and maintaining order in the airport area.

4. Security service fee level for refused entry passengers staying for 24 hours or longer

b) Pricing provisions

The aforementioned rates apply to a maximum of one security officer equipped with support equipment. The service usage period starts from when both parties hand over and sign the transfer document until when both parties reclaim the refused entry passengers and sign the transfer document. The minimum usage period for one service session is one hour, less than 60 minutes is counted as one hour. Over 10 hours is priced per day.

The carrier with refused entry passengers staying for 24 hours or longer is responsible for paying the service fee to the service provider organization.

5. Security service fee level for cargo and mail

The carrier using cargo and mail security services is responsible for paying the service fee to the service provider organization.

6. Security service fee level for cargo that has been screened and moved into restricted areas at the airport

a) Service fee level: 120,000 VND/ton.

Organizations and individuals using the service are responsible for paying the service fee to the service provider organization.

7. Security service fee level for vehicles transporting cargo and equipment entering restricted areas at the airport

a) Service fee level: 30,000 VND/vehicle trip.

b) Service contents: vehicle transport inspection and security seal check for catering, fuel, and goods serving aviation operations before entering the airfield.

Organizations and individuals using vehicles to transport cargo and equipment into restricted areas are responsible for paying the service fee to the service provider organization.

Article 13. Passenger service fee level at the airport

1. Object collecting payment for service usage: entities licensed to provide air services (operating passenger terminals) providing passenger services.

2. Object paying for service usage: passengers departing on flights from passenger terminals at Vietnamese airports.

4. Pricing Rules for Special Cases: children aged from 2 to under 12 years old (at the time of departure for the first leg) shall be charged at 50% of the applicable price stipulated in Clause 3 of this Article.

FRAMEWORK FOR AIR TRANSPORT SERVICE PRICES

REGULATED BY THE STATE

Article 14. FRAMEWORK FOR AIRPORT STAND CHARGES

1. Entities subject to payment for service usage: units granted licenses to provide air transport services (operating airport areas) providing aircraft parking services.

2. Entities responsible for paying for service usage: carriers requiring such services at Vietnamese airports.

3. Service Framework

a) For international flights at Airports Group A and B

c) In cases where aircraft park for both international and domestic flights: the parking fee per flight will be determined as the average of the fees applicable to international and domestic flights respectively.

d) The framework applicable to flights at Airports Group C: collected at 70% of the corresponding rates at Airports Groups A and B as stipulated in Points a and b of this Clause.

4. The framework applicable to flights by carriers choosing Vietnamese airports as their base: applied at 50% of the corresponding rates for domestic flights as stipulated in Points b and d of Clause 3 of this Article.

5. In cases of force majeure, if aircraft must park at airports other than their base: apply a charge of 50% of the current rate for the corresponding type of aircraft.

6. Parking time is calculated from the moment the chocks are placed on the wheels until they are removed.

Parking time over 18 hours up to 24 hours is counted as one day; for aircraft parked over 24 hours and taking off within the next 24 hours, an additional day is counted. This method will be applied to calculate parking time for subsequent 24-hour periods.

Article 15. FRAMEWORK FOR PASSENGER BOARDING BRIDGE RENTAL SERVICES

1. Entities subject to payment for service usage: units granted licenses to provide air transport services (providing passenger boarding bridge rental services).

2. Entities responsible for paying for service usage: carriers and ground service providers requiring such services at Vietnamese airports.

Article 16. FRAMEWORK FOR PASSENGER CHECK-IN COUNTER RENTAL SERVICES

1. Entities subject to payment for service usage: units granted licenses to provide air transport services (passenger terminal operation services).

2. Entities responsible for paying for service usage: carriers and ground service providers requiring such services at Vietnamese airports.

3. The framework for renting passenger check-in counters applies in two ways: monthly and per flight, depending on the customer's choice.

a) For international flights at Airports Group A and B

c) The framework applicable to flights at Airports Group C: collected at 70% of the corresponding rates at Airports Groups A and B as stipulated in Points a and b of this Clause.

4. The framework for renting various types of passenger check-in counters including boarding counters, service desks, transit counters: charged at 20% of the corresponding rate for passenger ticket check-in counters at Airports Groups A and B as stipulated in Points a and b of Clause 3 of this Article.

5. Contents of the rental service for check-in counters include:

a) Counter layout space.

b) Counters.

c) Computers and related equipment (excluding specialized computer software).

d) Counter signage boards.

đ) Conveyors attached to counters.

e) Electricity and water supply for the counter area.

g) Repair and management costs related to the counters.

6. The duration of counter usage and the number of counters for each flight are agreed upon between the airport and the customer based on industry practices, the airport's counter provision capacity, and the carrier's regulations regarding check-in procedures.

7. If counters are used for both international and domestic flights: the monthly rental price is determined as the average of the monthly rental prices applicable to international and domestic flights.

Article 17. FRAMEWORK FOR PASSENGER LUGGAGE CONVEYOR RENTAL SERVICES

1. Entities subject to payment for service usage: units granted licenses to provide air transport services (passenger terminal operation services).

2. Entities responsible for paying for service usage: organizations and individuals using baggage conveyors at airports without automated baggage handling systems.

Article 19. Price range for comprehensive ground service package at Category C airports

2. Object paying for service usage: domestic carriers with the need to use these services at Category C airports and airfields.

4. Service contents include:

a) Aircraft takeoff and landing service (accounting for 20% of the comprehensive ground service package price); aircraft guidance fee (if applicable);

b) Ground commercial technical service (based on ensuring the minimum needs of the flight and the actual capacity of each airport);

c) Terminal facility usage service directly related to flight services and rental fees for airline representative offices (excluding parking lots);

d) Aircraft parking space (during the first two hours of free parking).

Article 20. Price range for aviation fuel loading service

1. Object collecting payment for service usage: units granted permission to provide aviation fuel services.

2. Object paying for service usage: carriers requiring the use of specialized vehicle fuel loading services (vehicles containing fuel and pumping systems) at Vietnamese airports.

Article 22. Regulations on land classification

Land classifications at airports specified in this Circular shall be implemented according to operational documentation of airport infrastructure approved by the Civil Aviation Administration of Vietnam in accordance with regulations on airport operation management.

Article 23. Rent price range for terminal passenger area land

1. Object collecting payment for service usage: units granted permission to provide air services (operating passenger terminals).

2. Object paying for service usage: organizations and individuals providing services and carriers requiring the rental of land in passenger terminals.

3. Rent price range for setting up airline representative offices in passenger terminal areas

a) At Noi Bai, Da Nang, Tan Son Nhat, Cam Ranh, Cat Bi, Vinh, Can Tho, Lien Khuong, Phu Bai, Phu Quoc, Buon Ma Thuot airports.

The above price range does not include service costs. Enterprises providing basic essential services shall independently determine service costs but must not exceed 15% of the maximum price stipulated in Clause 2 of this Article.

Chapter III

IMPLEMENTING PROVISIONS

Article 26. Responsibilities of the Civil Aviation Authority of Vietnam

1. Announce airports operating 24/24 hours. Proactively update and announce adjustments to peak and off-peak hours at airports in accordance with operational conditions during each period.

2. Announce the list of air routes passing through airspace under Vietnamese management based on reports from units providing air traffic control services in Vietnamese-controlled airspace.

3. Announce the list of airports categorized by annual refueling volume once a year based on reports from enterprises providing aviation fuel refueling services.

Article 27. Responsibilities of organizations and individuals providing services

1. Implement the price levels and price ranges stipulated in this Circular, while publicly posting and declaring prices according to Circular No. 36/2015/TT-BGTVT dated July 24, 2015, issued by the Minister of Transport on domestic air transport service pricing and specialized aviation service pricing, and Circular No. 07/2017/TT-BGTVT dated March 14, 2017, issued by the Minister of Transport amending and supplementing certain provisions of Circular No. 36/2015/TT-BGTVT.

2. Proactively apply price adjustment levels as prescribed in Article 7 of this Circular.

3. Units providing air traffic control services determine the list of air routes passing through Vietnamese-controlled airspace, report to the Civil Aviation Authority of Vietnam.

4. Enterprises providing aviation fuel refueling services report to the Civil Aviation Authority of Vietnam data on annual refueling volumes at each airport before March 15 of the following year.

5. Air carriers conducting flights to or from Vietnamese airports are responsible for providing valid legal documentation certifying the maximum takeoff weight of aircraft to service providers.

6. Units holding licenses to provide air services (operating passenger terminals and cargo terminals) currently operating at other airports or newly constructed and offering terminal space rental services propose price range levels for terminal space rental services to the Civil Aviation Authority of Vietnam for submission to the Minister of Transport for consideration and decision to amend and supplement this Circular.

Article 28. Effectiveness and Implementation

1. This Circular takes effect from March 15, 2020.

2. Repeal the following decisions of the Minister of Transport: Decision No. 4405/QĐ-BGTVT dated December 15, 2015, promulgating air traffic control service fees for air routes passing through Vietnamese-controlled airspace; Decision No. 3065/QĐ-BGTVT dated September 30, 2016, promulgating price ranges for aviation fuel refueling services and infrastructure usage fees for underground fuel systems at airports; Decision No. 4224/QĐ-BGTVT dated December 29, 2016, promulgating price ranges for some non-aviation services at Vietnamese airports; Decision No. 1522/QĐ-BGTVT dated May 26, 2017, amending and supplementing price ranges for some non-aviation services at Vietnamese airports promulgated in Decision No. 4224/QĐ-BGTVT dated December 29, 2016; Decision No. 2345/QĐ-BGTVT dated August 8, 2017, promulgating price levels and price ranges for some specialized aviation services at airports and Articles 1, 2, 3, 4, and 5 promulgated in Decision No. 4213/QĐ-BGTVT dated December 28, 2016, promulgating air traffic control service fees and flight support service fees.

3. In cases where laws and regulations cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the amended, supplemented, or replaced laws and regulations.

4. The Director of the Office, the Inspector General, Heads of Departments, the Director of the Civil Aviation Authority of Vietnam, Heads of agencies, organizations, and related individuals are responsible for implementing this Circular./.
