This Circular amends and supplements certain provisions regarding application forms, lists, and production licenses for tobacco products in Circular No. 57/2018/TT-BCT. The new forms will take effect from January 1, 2023, while the old forms will be applicable until the end of 2022.

AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 57/2018/TT-BCT DATED DECEMBER 26, 2018 ISSUED BY THE MINISTER OF INDUSTRY AND TRADE REGULATING IN DETAIL CERTAIN PROVISIONS OF DECREE(S) RELATED TO TOBACCO SALES
Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 67/2013/NĐ-CP dated June 27, 2013 of the Government detailing certain provisions and measures for implementing the Law on Prevention and Control of Harmful Effects of Tobacco with respect to tobacco sales, and Decree No. 106/2017/NĐ-CP dated September 14, 2017 amending and supplementing certain articles of Decree No. 67/2013/NĐ-CP dated June 27, 2013 of the Government;
Pursuant to Decree No. 08/2018/NĐ-CP dated January 15, 2018, issued by the Government, amending certain Decrees related to investment conditions within the scope of management by the Ministry of Industry and Trade;
Pursuant to Decree No. 17/2020/NĐ-CP dated February 5, 2020 of the Government amending and supplementing certain articles of Decrees related to investment conditions in the field under the management of the Ministry of Industry and Trade;
At the proposal of the Director of the Industry Department,
The Minister of Industry and Trade hereby issues this Circular amending and supplementing certain articles of Circular No. 57/2018/TT-BCT dated December 26, 2018 regulating in detail certain provisions of Decrees related to tobacco sales as follows:
Article 1. Amend Clause 2 and Clause 4 of Article 22 of Circular No. 57/2018/TT-BCT dated December 26, 2018 issued by the Minister of Industry and Trade regulating in detail certain provisions of Decrees related to tobacco sales as follows:
"2. The model application form and list of items for requesting a Production License for tobacco products and the model Production License for tobacco products of this Circular shall take effect from January 1, 2023.
4. The model application form and list of items for requesting a Production License for tobacco products and the model Production License for tobacco products of Circular No. 21/2013/TT-BCT shall continue to be applied until December 31, 2022."
Article 2. Effective Date
1. This Circular takes effect from January 1, 2021.
2. Repeal Clause 2 of Article 1 of Circular No. 28/2019/TT-BCT dated November 15, 2019 issued by the Minister of Industry and Trade amending and supplementing certain articles of Circular No. 57/2018/TT-BCT dated December 26, 2018 issued by the Minister of Industry and Trade regulating in detail certain provisions of Decrees related to tobacco sales./.
