Circular No. 53/2025/TT-BYT amends Circular No. 43/2025/TT-BYT guiding the functions, tasks, powers, and organizational structure of Commune Health Stations under provinces and centrally-run cities.

CIRCULAR

Amending and supplementing certain articles of Circular No. 43/2025/TT-BYT dated November 15, 2025, issued by the Minister of Health guiding the functions, tasks, powers, and organizational structure of Commune Health Stations, Ward Health Stations, and Special Administrative Region Health Stations under provinces and centrally governed cities

Pursuant to the Law on Government Organization No. 63/2025/QH15;

Pursuant to the Law on Local Administration Organization No. 72/2025/QH15;

Pursuant to Resolution No. 190/2025/QH15 dated February 19, 2025, of the National Assembly on handling some issues related to the restructuring of state administrative apparatus;

Pursuant to Decree No. 283/2025/NĐ-CP dated October 31, 2025, of the Government amending and supplementing certain articles of Decree No. 120/2020/NĐ-CP dated October 7, 2020, of the Government on the establishment, reorganization, and dissolution of public service organizations;

Pursuant to Decree No. 42/2025/NĐ-CP dated February 27, 2025, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

At the proposal of the Director of the Personnel Organization Department;

The Minister of Health promulgates this Circular amending and supplementing certain articles of Circular No. 43/2025/TT-BYT dated November 15, 2025, issued by the Minister of Health guiding the functions, tasks, powers, and organizational structure of Commune Health Stations, Ward Health Stations, and Special Administrative Region Health Stations under provinces and centrally governed cities.

Article 1. Amending and supplementing certain articles of Circular No. 43/2025/TT-BYT

1. Amending and supplementing Clause 2 of Article 5 as follows:

"2. The organizational structure directly subordinate to the Commune Health Station includes organizations to perform the following basic functions:

a) Administrative, financial, and human resources;

b) Population, children, social welfare;

c) Disease prevention, food safety;

d) Outpatient and inpatient care;

e) Pharmacy, medical equipment, clinical laboratory;

Based on the population size, natural area, and actual conditions of the locality, the People's Committee at the commune level decides specifically on the name, number, form of organization (department, office, team, unit) of the organizations under the Commune Health Station and the number of health points to implement all or part of the functions and tasks of the Commune Health Station, ensuring efficiency, effectiveness, suitability for each locality, and compliance with the criteria and conditions for establishment as prescribed by law."

2. Amending and supplementing Clause 2 of Article 8 as follows:

"2. When implementing the restructuring of the local government apparatus according to a two-level system, the Commune Health Station:

a) Shall be reimbursed for outpatient and inpatient care costs under health insurance according to the service fee for outpatient and inpatient care under health insurance already defined and approved by the competent authority before the Commune Health Station was reorganized, merged, renamed, until the new service fees for the newly organized facilities are defined and approved by the competent authority;

b) In cases where a new or renewed or amended license for operation must be issued in accordance with the Law on Medical Examination and Treatment, during the process of issuing a new or renewed or amended license for operation, the licenses for operation previously issued to the Commune Health Station before it was reorganized, merged, renamed shall continue to be used for both old and new facilities to provide medical examination and treatment services and maintain the validity of health insurance medical examination and treatment contracts signed before the signing of new health insurance medical examination and treatment contracts for the new facility based on the new license for operation. If the Commune Health Station does not change its place of operation, it shall complete the procedures to amend the license for operation due to changes in name and address. The Commune Health Station is responsible for ensuring the quality of medical examination and treatment services;

c) Registration for initial medical examination and treatment under health insurance of insured persons and the number of health insurance cards allocated to the initial medical examination and treatment facilities, the transfer of patients between the Commune Health Station and other medical examination and treatment facilities within the locality before the reorganization, merger, renaming shall continue to be used for the new facility in accordance with the guidance of the Department of Health;

d) The facility code, seal of the facility, and seal of the facility named in the contract for medical examination and treatment under health insurance before the reorganization, merger, renaming shall continue to be used until the new facility receives a new code and seal; in cases where the old seal has been revoked but a new seal has not yet been issued, the completion of the procedures may be delayed until the new seal and digital signature are available.

e) Shall submit electronic data not later than seven days from the time specified in Article 6 and Article 7 of Circular No. 48/2017/TT-BYT dated December 28, 2017, issued by the Minister of Health, provide for the extraction and transfer of electronic data in the management and settlement of medical examination and treatment costs under health insurance until operations stabilize;

e) Based on practical requirements at the local level, the People's Committee of the province or centrally governed city shall decide on measures to handle arising situations to ensure the stable operation of commune health stations during the transitional period when restructuring, merging, renaming, or changing names occur; assign the lead unit responsible for representing and handling arising issues from contract implementation, payment, settlement of medical examination and treatment costs under health insurance, patient transfers between health facilities providing medical examination and treatment under health insurance, procurement, ensuring drug and medical equipment supply, and resolving arising difficulties related to the handover process until the commune health station obtains a new operating permit and signs a new health insurance medical examination and treatment contract.

Article 2. Effective Date

This Circular takes effect from January 1, 2026.

During implementation, if any arising issues, difficulties, or obstacles occur, it is requested that agencies, organizations, and individuals promptly report them to the Ministry of Health (through the Department of Organization and Cadres) for consideration and resolution.
