RESOLUTION

On the results of supervision on the implementation of policies and laws regarding residential land and production land for ethnic minority groups

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

BASED ON THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM IN 1992 AS AMENDED AND COMPLEMENTED BY RESOLUTION NO. 51/2001/QH10;

Pursuant to the Law on the Supervisory Activities of the National Assembly No. 05/2003/QH11;

Pursuant to Resolution No. 15/2011/QH13 of the National Assembly on the Supervision Program of the National Assembly in 2012;

Pursuant to Resolution No. 407/NQ-UBTVQH13 of the Standing Committee of the National Assembly on the Supervision Program of the Standing Committee of the National Assembly in 2012;

Based on the Report No. 238/BC-ĐGS dated September 12, 2012 of the Inspection Team of the Standing Committee of the National Assembly and the Report No. 219/BC-CP dated September 5, 2012 of the Government on the implementation of policies and laws regarding residential land and production land for ethnic minority groups during the period from 2002 to 2011,

RESOLUTION:

Article 1. Agreeing with the main contents of the report on the results of the inspection team of the Standing Committee of the National Assembly on the implementation of policies and laws regarding residential land and production land for ethnic minority groups, the achievements, shortcomings, causes, and recommendations; while emphasizing:

1. In the context of many difficulties facing the country, there is still a significant number of households of ethnic minorities lacking residential land and production land (558,485 households); however, with the highest determination, within ten years, the Government, ministries, sectors, and localities have focused on leading and directing the resolution of residential land and production land for 333,995 households (of which 148,059 households received support for residential land and 185,936 households received support for production land). This result is a very important and fundamental premise ensuring that poor ethnic minority households can stabilize their lives and production, feel secure and trust in the leadership of the Party and the State; contributing to strengthening and consolidating national unity, maintaining political security, social order, and safety in ethnic minority areas and border regions of the country.

2. The Government has issued a system of policies and laws regarding residential land and production land for ethnic minority groups. However, the implementation of these policies and laws still has some shortcomings and constraints such as: a large number of people still lack residential land and production land; the work of investigation and identification of beneficiaries of the policy is not accurate; some policies have similar content but are managed by different agencies; many policies have been implemented but none have yet completed their set goals and tasks; the work of inspection and guidance is not synchronized and timely; the work of publicizing policies and laws on residential land and production land, mobilizing internal resources of the people and the community is limited.

Article 2. The Standing Committee of the National Assembly requests the Government to implement the following tasks and solutions:

1. Review and study contents directly related to residential land and production land for ethnic minority groups, propose specific contents to improve the Land Law, Investment Law, Residence Law, Forest Protection and Development Law, and other relevant laws and ordinances. Inspect, review, and evaluate existing policies and projects concerning the provision of residential land and production land, promptly address the shortcomings and limitations mentioned in the supervision report;

2. Focus on directing the implementation to achieve the goal of fundamentally resolving the situation of households of ethnic minorities without residential land by the end of 2015. Study and issue policies to resolve production land issues linked to employment, taking into account the special difficulties of each region, striving to resolve 70% of the current shortage of production land by the end of 2015;

3. Improve state management over land; link the responsibilities of specialized state management agencies and local authorities at all levels with the implementation of policies and laws on residential land and production land for ethnic minority groups. Clarify the responsibilities of ministries, sectors, and local authorities at all levels in planning, directing, and implementing policies. Review the allocation, recovery, and leasing of land by forestry farms and enterprises in areas where many households of ethnic minorities lack residential land and production land. Strengthen inspection, auditing, and handling of violations of land laws, forest protection, and development;

4. Develop specific, unified policies and focus on directing the resolution of spontaneous migration. The Government directs comprehensive and in-depth research on the situation and natural and social characteristics of localities where people leave and those where people migrate spontaneously to reasonably address spontaneous migration, ensuring political, economic-social, defense-security, and environmental protection objectives with the highest feasibility; stipulate the responsibility of heads of local authorities at all levels in managing residents, land, and forests in localities affected by spontaneous migration; strive to fundamentally resolve this situation by the end of 2015.

Article 3. The Government, the Prime Minister, ministries, equivalent agencies, and People's Committees at all levels within their respective functions and powers shall direct and organize the implementation of this Resolution.

Article 4. The Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, the Delegations of the National Assembly, the Members of the National Assembly, and the People's Councils at all levels within their respective functions and powers shall supervise the implementation of this Resolution.

Article 5. This Resolution takes effect from the date of signature.
