DECISION OF THE PRIME MINISTER
Issuing the Regulation on Management and Operation of Technical-Economic Programs:
Information Technology, Biotechnology, Materials Technology, and Automation Technology
PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
Based on the Government's Resolutions: No. 49/CP dated August 4, 1993 on developing Information Technology, No. 18/CP dated March 11, 1994 on developing Biotechnology, No. 88/CP dated December 31, 1996 on developing Science and Technology of Materials, and No. 27/CP dated March 28, 1997 on applying and developing Automation Technology to serve industrialization and modernization of the country;
Based on Decision No. 531/TTg dated August 8, 1996 of the Prime Minister on Managing National Programs;
Approves the Agreement between the Government of the Socialist Republic of Vietnam and the Government of the Argentine Republic on cooperation in the use of nuclear energy for peaceful purposes, signed in Hanoi on November 19, 2001.
DECISION:
Article 1The Regulation on Management and Operation of Technical-Economic Programs for developing and applying Information Technology, Biotechnology, Materials Technology, and Automation Technology to serve the period of industrialization and modernization of the country is hereby issued together with this Decision.
Article 2. This Decision shall take effect fifteen days from the date of signature.
Article 3. Ministers in charge of the Program兼任技术经济计划主任,各部部长、直属国务院的机构首长、国务院所属机关首长、省和中央直辖市人民委员会主席对执行本决定负责。

MANAGEMENT AND OPERATION OF TECHNICAL-ECONOMIC PROGRAMS:
INFORMATION TECHNOLOGY, BIOTECHNOLOGY, MATERIALS
TECHNOLOGY AND AUTOMATION TECHNOLOGY
(Issued together with Decision No. 54/1998/QĐ-TTg dated March 3, 1998)

I. GENERAL PROVISIONS
Article 1. A Technical-Economic Program (hereinafter referred to as the Program) is a comprehensive system of scientific and technological production activities, investment policies, and measures, in which technology serves as the driving force for development to achieve specific economic goals.
The Program must create sufficient technological capacity to ensure the competitiveness of key products or technologies and serve as the backbone for the country's industrialization and modernization efforts.
This Regulation applies to Technical-Economic Programs on Information Technology, Biotechnology, Materials Technology, and Automation Technology.
Article 2. The Program includes technical-economic projects aimed at achieving the goals of each phase and the overall objectives of the Program. The management object is the Program's goal, and the investment plan is implemented according to the project.
A Program project is a set of activities carried out to accomplish a specific task within a defined budget and timeframe, aiming to achieve one or more clearly stated goals in the Program.
The general content of the Program includes scientific and technological activities of technical-economic projects, building scientific and technological potential, formulating policies, preliminary feasibility studies for producing key products, and other measures to implement the Program's goals.
Investment in producing key products according to the Program's direction is the responsibility of enterprises. The State supports enterprises through preferential policies and may provide partial funding from the budget. Budgetary support funds are determined and supplemented in the source of funds applied for advanced technology or new technology in production. Enterprises receive assistance in science and technology (technical advice, technology transfer, staff training, establishment of science and technology agencies, etc.).
Article 3. The Steering Committee of the Program, established pursuant to the Prime Minister's Decision, shall be responsible for the development, implementation guidance, management, and effectiveness of the Program's activities. The Program will exist throughout the period of industrialization and modernization of the country and will be developed based on the principle of openness, allowing adjustments or supplements to its content if the balance conditions or objectives change. The Program will be divided into phases and incorporated into the five-year and annual plans of the State.
II. DEVELOPMENT OF THE PROGRAM
Article 4. Based on the Strategy for Socio-Economic Development and the Strategy for Science and Technology Development until 2020, the Steering Committees of the Programs shall organize the development of an overall plan until 2020, aiming to achieve the general goal of industrializing and modernizing the country and setting specific goals for each five-year phase. In the short term, the Program's objectives for the 1998-2005 period must be determined.
Article 5. The steps to determine the content of the Program include:
Assessing the current situation of the field that the Program aims to address;
Developing long-term and short-term objectives of the Program, basic indicators to be achieved within a specific timeframe;
Selecting key products and technologies for producing the selected products;
Developing scientific and technological resources aligned with the direction of developing key products;
Studying and building pre-feasibility projects for producing key products;
Determining the total capital and methods for mobilizing funds for the Program, including allocating capital annually;
Building policies and measures to ensure the implementation of the Program, organizing the production of key products;
Developing plans, schedules, and organizational assignments for implementing the Program;
Integrating tasks from the four Programs within the same area;
Implementing international cooperation.
Article 6. Based on the objectives and content of the Program approved by the Prime Minister, Ministries, State-owned Corporations, provinces, and centrally-administered cities shall develop and approve Technical-Economic Projects according to current regulations as a basis for considering and arranging plans. Investment plans for projects must be consolidated in the socio-economic development plans of Ministries, State-owned Corporations, provinces, and centrally-administered cities.
Article 7. During the process of developing annual and five-year plans, if there are changes in balance conditions or Program objectives, the Steering Committee of the Program shall submit to the Prime Minister the following contents:
Evaluation of the implemented parts of the Program;
The necessity and reasons for adjustment;
Content of adjustment;
The Ministry of Planning and Investment shall lead and coordinate with the Ministry of Science and Technology and the Ministry of Finance to review the adjusted content and submit it to the Prime Minister for consideration and decision.
III. MANAGEMENT MECHANISM OF THE PROGRAM
Article 8. The Minister in charge of the Program兼任该计划的主任,对所负责的计划的制定、实施指导、管理和活动效果向政府总理负责。
Article 9.- The Ministers, Heads of ministerial-level agencies, Heads of government agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for the construction, organization of implementation, management, and effectiveness of assigned projects within the Program and shall regularly report to the Head of the Program Management Board on the implementation status of these projects.
Article 10.- Tasks, powers, and organizational structure of the Office of the Program Management Board:
1. The Head of the Program Management Board shall be accountable to the Prime Minister for all activities of the Program.
The Deputy Head of the Program Management Board assists the Head in planning and directing the overall operations of the Program and represents the Head in handling regular Program tasks.
Members of the Program Management Board shall fulfill the tasks assigned by the Head of the Program Management Board.
2. Each Program Management Board has an assisting Office located at the leading ministry of the Program, which uses the seal and account of the leading ministry. The specific functions of the Office are stipulated by the Minister of Science and Technology who concurrently serves as the Head of the Technical-Economic Program Management Board.
3. The Program Management Board has the following tasks and powers:
To develop comprehensive plans, five-year plans, and annual plans for implementing the Program, submit them to the Prime Minister for approval, and organize their implementation, including the review, approval, and allocation of funds for projects of ministries, sectors, and localities participating in Program tasks.
To monitor, guide, and inspect the implementation of projects by ministries, sectors, and localities; handle issues arising during Program implementation within their authority or refer such issues to the Prime Minister for resolution.
To coordinate with relevant agencies in developing policies, systems, and measures to implement the Program, submit them to the Prime Minister for issuance; issue guiding documents and inspect compliance with government regulations.
To monitor and inspect the operational status of enterprises producing products aligned with Program guidelines; advise state functional agencies on preferential regimes for key product-producing enterprises; assist enterprises in science and technology matters.
To periodically report on the Program's implementation status as prescribed and collaborate with related agencies to evaluate and accept Program outcomes.
IV. MANAGEMENT MECHANISM OF THE PROGRAM
Article 11. Tasks of the Ministry of Science and Technology and Environment:
As the lead agency assisting the Government in monitoring and consolidating the situation regarding the development and implementation of the four Programs, it is responsible for coordinating with the Ministry of Planning and Investment and the Ministry of Finance in managing, inspecting, and evaluating Program implementation; quarterly and annually reporting to the Prime Minister; identifying difficulties and obstacles during Program implementation and proposing timely solutions to the Prime Minister.
To take the lead, in coordination with the Ministry of Planning and Investment, in guiding methodological approaches to Program development, integrating strategic and scientific and technological development contents into the Program, and submitting to the Prime Minister for issuance policies, measures, and common management mechanisms for all four Programs.
To take the lead, in coordination with the Ministry of Planning and Investment, the Ministry of Finance, and related ministries, sectors, and localities, in organizing evaluations and acceptance of Program results according to each phase of the five-year plan.
Article 12. Tasks of the Ministry of Planning and Investment:
To take the lead and coordinate with the Ministry of Science, Technology and Environment, the Ministry of Finance, and relevant ministries, sectors, and localities to organize the review of the overall plan and phased plans for each five-year plan of the Programs, and submit them to the Prime Minister for consideration and then to the National Assembly for approval.
To take the lead and coordinate with the Ministry of Science, Technology and Environment, and the Ministry of Finance to compile the tasks and objectives of the Programs and propose the balancing of resources to ensure the achievement of the Program's goals and tasks during the planning period.
Article 13. Tasks of the Ministry of Finance:
To take the lead and coordinate with the Ministry of Planning and Investment and the Ministry of Science, Technology and Environment to balance the state budget allocation for the Programs within the total state budget estimate for the Government to consider and submit to the National Assembly for approval.
To allocate funds for each Program and project that has been reviewed according to the plan; to guide and inspect the implementing ministries to comply with current financial and accounting regulations. To compile the annual fund allocation situation for each Program and approve the final accounts of the Program and completed projects, and report to the Prime Minister, while sending copies to the Ministry of Planning and Investment and the Ministry of Science, Technology and Environment.
Article 14. Tasks of the leading ministry of the Program:
Annually, following the guidance on building plans from the Ministry of Planning and Investment and the Ministry of Finance, the leading ministry of the Program evaluates the implementation status of the year, compiles comprehensive reports, and proposes needs regarding objectives, tasks, and resources for the next year's Program plan including state budget capital (construction investment capital, public service capital, government foreign loans and aid, domestic and foreign credit capital, and self-funded capital of participating units...), and sends these to the Ministry of Planning and Investment, the Ministry of Finance, and the Ministry of Science, Technology and Environment.
After receiving the total funding limit for the Program from the Ministry of Finance, the leading ministry of the Program leads the coordination with the Ministry of Finance, the Ministry of Planning and Investment, and the Ministry of Science, Technology and Environment to allocate the Program's budget estimate according to the assigned objectives and tasks to ministries, sectors, and localities, and sends it to the Ministry of Finance, the Ministry of Planning and Investment, and the Ministry of Science, Technology and Environment for consolidation into each ministry, sector, and locality's plan to be submitted to the Prime Minister for assignment of planning targets.
The leading ministry of the Program is responsible for managing, directing, and effectively utilizing the Program's investment funds, and reporting quarterly and annually on the use of funds to the corresponding financial authorities for monitoring, allocation, and inspection.
To coordinate with related ministries, sectors, and localities in evaluating and accepting the results of the Program's implementation annually and preparing a comprehensive completion report of the Program to submit to the Prime Minister.
Article 15. Sources, mechanisms for allocating and managing Program funds shall be implemented as follows:
The state budget allocated for the Programs is balanced from the central budget. For projects directly managed by ministries and sectors, the Ministry of Finance allocates capital directly to the ministries and sectors for implementation. Projects managed by localities are allocated through the Department of Finance and Price Control. For projects using construction investment capital, domestic and foreign credit capital, and foreign aid (repayable and non-repayable), they must be implemented in accordance with current regulations governing these sources of capital.
Management of Program expenditure and settlement of accounts shall be carried out in accordance with Decision No. 531/TTg dated August 8, 1996 of the Prime Minister on the management of national programs and the guiding documents for the implementation of this Decision./.
