Regulations on job code and qualification standards for specialized meteorological and hydrological control civil servants

Pursuant to the Civil Servant Law No. 58/2010/QH12 dated November 15, 2010;

Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government stipulating regulations ondevelopmentapply, use and manageintention 2. This Circular applies to vocational education teachers in vocational education institutions, vocational education activity institutions, and vocational education and general education centers; other relevant agencies, organizations, and individuals.

Article 1. Persons Paying FeescouncillORS pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, public officials, civil servants, and armed forces; Decree No. 17/2013/NĐ-CP dated February 19, 2013 of the Government amending MANAGEMENT AND USE OF DEPOSITS AT THE ENVIRONMENT PROTECTION FUND some articles of Decree No. 204/2004/NĐ-CP of the Government on salary system for cadres, public officials, civil servants, and armed forces;

Pursuant to Decree No. 21/2013/NĐ-CP dated March 4, 2013, promulgated by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

The Minister of Natural Resources and Environment and the Minister of Home Affairs issue this Circular joint circular regulating job codes and qualification standards for specialized meteorological and hydrological control civil servants.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates job codes, qualification standards, appointment, and grading according to job titles for specialized meteorological and hydrological control civil servants.

Article 2. This Circular applies to specialized meteorological and hydrological control civil servants working in public service units.

Article 2. Job Code and Classification of Specialized Meteorological and Hydrological Control Civil Servants

1. Meteorological and Hydrological Control Officer Level II Code: V.06.04.10

2. Meteorological and Hydrological Control Officer Level III Code: V.06.04.11

3. Meteorological and Hydrological Control Officer Level IV Code: V.06.04.12

Article 3. General Professional Ethics Standards for Specialized Meteorological and Hydrological Control Civil Servants

1. High sense of responsibility towards assigned tasks, always comply with laws; fulfill all duties of a civil servant in professional activities.

2. Have a spirit of inquiry, cooperation, and continuous learning to improve professional knowledge; actively research and proactively apply scientific achievements in meteorological and hydrological control work; be passionate about their work.

3. Not abuse position and authority to harm national defense, security, and national interests; not seek personal benefits; maintain state secrets within their professional scope.

4. Live a healthy lifestyle, set a good example; not engage in bureaucracy or corruption; practice thrift, combat waste, and actively fight negative behaviors.

5. Be honest, united, objective, modest, and refrain from harassment or obstruction when performing tasks related to citizens' rights and interests.

Chapter II

OCCUPATIONAL STANDARDS

Article 4. Meteorological and Hydrological Control Officer Level II - Code: V.06.04.10

1. Duties:

a) Lead the planning of data collection, organize the implementation of meteorological, hydrological, marine, environmental, lightning location data control work (hereinafter referred to collectively as meteorological and hydrological data) according to assigned responsibilities;

b) Lead the review of data correction, relevant documentation on data correction; evaluate the results of analysis, calculation, charting, and explanation of data correction; propose technical solutions to improve data correction quality;

d) Lead the proposal and participate in directing technical inspection of station networks and observation equipment; assess the operation and results of meteorological and hydrological factor observation;

đ) Lead the summary and evaluation of results, draw lessons from data correction and control work according to assigned responsibilities; advise and propose technical solutions to improve data correction quality;

e) Participate in research projects; develop technical standards and regulations for observation and data control;

g) Participate in compiling materials and training for meteorological and hydrological control civil servants at equivalent levels or lower; train on using software for data correction and control.

2. Qualifications regarding education and training:

a) Hold a bachelor's degree or higher in meteorology, hydrology, oceanography, environment, or related fields; if holding a degree in another field, must complete the professional knowledge and skills enhancement program specified by the specialized meteorological and hydrological control civil servant management agency;

b) Possess foreign language proficiency level 3 as prescribed in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training on the Vietnamese Foreign Language Proficiency Framework (hereinafter abbreviated as Circular No. 01/2014/TT-BGDĐT);

c) Possess basic information technology skills as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on Information Technology Skill Standards (hereinafter abbreviated as Circular No. 03/2014/TT-BTTTT);

d) Hold a certificate for professional development according to the qualification standards for meteorological and hydrological control civil servants at Level II;

3. Qualifications regarding professional expertise and skills:

a) Understand the development strategy of the meteorological and hydrological sector;

b) Have in-depth knowledge of basic meteorological and hydrological survey fields, sufficient professional capacity to perform data control work;

c) Master technical standards and regulations related to the management and observation of basic meteorological and hydrological survey data;

d) Master the functions and effects of observation equipment, methods of meteorological and hydrological data correction calculations;

đ) Master specialized software to implement and monitor meteorological and hydrological data control work;

e) Master geographical and climatic conditions and other factors affecting the quality of meteorological and hydrological data;

g) Have the ability to organize and implement meteorological and hydrological data control activities;

h) Participate in at least one provincial-level or higher scientific and technological project, topic, or task that has been accepted at an acceptable level or above, or lead one such project, topic, or task at the grassroots level that has been accepted at an acceptable level or above.

Article 4. Promotion to the position of Meteorological and Hydrological Control Officer Level II:

A meteorological and hydrological controller promoted from the rank of third-class meteorological and hydrological controller to the rank of second-class meteorological and hydrological controller must have at least nine (9) years of working time holding the rank of third-class meteorological and hydrological controller or equivalent, including at least two (2) years of working time holding the rank of third-class meteorological and hydrological controller.

Article 5. Third-Class Meteorological and Hydrological Controller - Code: V.06.04.11

1. Duties:

a) Reviewing the results of data adjustment, documents, and texts on meteorological and hydrological data;

b) Analyzing and evaluating the results of calculations, creating tables and explanatory notes for data adjustments; proposing technical solutions to improve the quality of meteorological and hydrological data adjustments;

c) Proposing and participating in directing technical inspection work for station networks and observation equipment; evaluating the results of meteorological and hydrological factor observations;

d) Participating in research topics applying in the field of basic meteorological and hydrological surveys; participating in compiling technical materials serving the control and adjustment of meteorological and hydrological data;

đ) Participating in summarizing and drawing lessons from the work of controlling and adjusting meteorological and hydrological data according to assigned responsibilities; proposing solutions to improve the quality of meteorological and hydrological data control and adjustment work;

e) Preparing reports on the control of meteorological and hydrological data; being primarily responsible for the results of the control report;

g) Participating in compiling materials and training for meteorological and hydrological control professionals at equivalent ranks or lower;

2. Qualifications regarding education and training:

a) Hold a bachelor's degree or higher in meteorology, hydrology, oceanography, environment, or related fields; if holding a degree in another field, must complete the professional knowledge and skills enhancement program specified by the specialized meteorological and hydrological control civil servant management agency;

b) Have a foreign language proficiency level of grade 2 as stipulated in Circular No. 01/2014/TT-BGDĐT;

c) Have computer skills meeting the basic information technology standards as stipulated in Circular No. 03/2014/TT-BTTTT;

d) Having a certificate of training according to the standards for the position of third-class meteorological and hydrological controller;

3. Qualifications regarding professional expertise and skills:

a) Mastering professional knowledge in the field of meteorological and hydrological observation and survey; having sufficient professional capacity to perform the work of controlling meteorological and hydrological data;

b) Mastering technical standards and specifications for meteorological and hydrological data observation;

c) Understanding the functions, principles, and effects of various types of observation machines and equipment; understanding and skillfully using calculation methods for data adjustments;

d) Being able to use specialized software to perform the work of controlling meteorological and hydrological data;

đ) Understanding geographical and climatic conditions and other factors affecting the quality of meteorological and hydrological data;

Article 4. Promotion to the rank of third-class meteorological and hydrological controller:

a) In cases where the initial recruitment has a college degree or higher, there must be a minimum of two (2) years of working time holding the rank of fourth-class meteorological and hydrological controller;

b) In cases where the initial recruitment has a secondary vocational degree, there must be a minimum of three (3) years of working time holding the rank of fourth-class meteorological and hydrological controller.

A professional promoted from the rank of fourth-class meteorological and hydrological controller to the rank of third-class meteorological and hydrological controller must have the following working time holding the rank of fourth-class meteorological and hydrological controller:

Article 6. Fourth-Class Meteorological and Hydrological Controller - Code: V.06.04.12

1. Duties:

a) Checking and controlling the quality of observed meteorological and hydrological data, identifying errors, and processing data according to technical standards;

b) Controlling the method of recording, coding data, and implementing current laws;

c) Checking readings from automatic recording machines, calculation methods, diagram reduction, and handling malfunctions in automatic recording diagrams and observation equipment;

d) Evaluating the results of data adjustments according to assigned tasks;

đ) Controlling and editing meteorological and hydrological data reports;

e) Proposing technical solutions to improve the quality of data control and adjustment;

g) Participating in applied research topics in the field of basic surveys; providing comments on technical materials serving the work of controlling meteorological and hydrological data;

h) Participating in summarizing and drawing lessons from the work of controlling meteorological and hydrological data according to assigned responsibilities;

2. Qualifications regarding education and training:

a) Graduating from a secondary vocational degree or higher in meteorology, hydrology, oceanography, marine science, environmental science, or related fields; if graduating from another field, must complete a professional knowledge and skills training program specified by the management agency for meteorological and hydrological control professionals;

b) Having a level 1 foreign language proficiency as stipulated in Circular No. 01/2014/TT-BGDĐT;

c) Having basic information technology skills as stipulated in Circular No. 03/2014/TT-BTTTT;

3. Qualifications regarding professional expertise and skills:

a) Having basic knowledge in the field of meteorology and hydrology, understanding observation methods and data calculation methods;

b) Having practical skills in observation and handling situations during meteorological and hydrological observation;

c) Mastering technical standards and specifications for meteorological and hydrological observation, meteorological and hydrological law codes;

d) Understanding the functions and effects of various types of observation equipment and knowing how to use calculation methods for meteorological and hydrological data adjustments;

đ) Understanding geographical and climatic conditions and other factors affecting the quality of meteorological and hydrological data;

Chapter III

APPOINTMENT AND SALARY GRADING ACCORDING TO PROFESSIONAL TITLES

Article 7. Principles for Appointment and Salary Classification According to Professional Titles

Article 1. The appointment to the professional position and salary classification for meteorological and hydrological control professionals must be based on job positions; educational and training standards; professional and vocational capabilities; and the tasks undertaken by the professional;

Article 2. Professionals appointed to the professional position and salary classification must meet the standards for the position of meteorological and hydrological control professional as stipulated in Chapters I and II of this Joint Circular;

Article 3. When appointing from the current professional grade to the corresponding professional position in meteorological and hydrological control, it shall not combine salary increment and promotion to the professional position.

Article 8. Appointment to occupational titles

In cases where civil servants have been transferred to classification levels and salary grades or appointed to the meteorological and hydrological control ranks as prescribed in Decision No. 07/2008/QĐ-BTNMT dated October 6, 2008 of the Minister of Natural Resources and Environment promulgating the business standards for the ranks of civil servants in the natural resources and environment sector (hereinafter referred to as Decision No. 07/2008/QĐ-BTNMT) and Circular Joint No. 30/2010/TTLT-BTNMT-BNV dated November 25, 2010 of the Ministry of Natural Resources and Environment - Ministry of Home Affairs guiding the transfer to classification levels and salary grades for civil servants in the natural resources and environment sector (hereinafter referred to as Circular Joint No. 30/2010/TTLT-BTNMT-BNV), they shall be appointed to occupational titles as follows:

1. Appoint the occupational title of Meteorological and Hydrological Control Officer Level II (code V.06.04.10) to civil servants holding the rank of Chief Meteorological and Hydrological Control Officer (rank code 14.252).

2. Appoint the occupational title of Meteorological and Hydrological Control Officer Level III (code V.06.04.11) to civil servants holding the rank of Meteorological and Hydrological Control Officer (rank code 14.253).

3. Appoint the occupational title of Meteorological and Hydrological Control Officer Level IV (code V.06.04.12) to civil servants holding the ranks of College Meteorological and Hydrological Control Officer (rank code 14.254) and Intermediate Meteorological and Hydrological Control Officer (rank code 14.255).

Article 9. Salary Grading Method

1. The occupational titles of civil servants specializing in meteorological and hydrological control shall apply the Salary Scale for Professional and Business Staff in State Public Institutions (Scale 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for cadres, civil servants, public employees, and armed forces (hereinafter referred to as Decree No. 204/2004/NĐ-CP), as follows:

a) The occupational title of Meteorological and Hydrological Control Officer Level II applies the grade and salary coefficient of type A2, group 1 (A2.1), from salary coefficient 4.40 to 6.78.

b) The occupational title of Meteorological and Hydrological Control Officer Level III applies the grade and salary coefficient of type A1, from salary coefficient 2.34 to 4.98.

c) The occupational title of Meteorological and Hydrological Control Officer Level IV applies the grade and salary coefficient of type B, from salary coefficient 1.86 to 4.06.

2. Salary grading when civil servants complete their probation period and are appointed to occupational titles:

After completing the probation period as prescribed and being appointed to an occupational title by the competent authority managing civil servants, the following salary grading shall be implemented according to the occupational title appointed:

a) In cases where civil servants with a doctoral degree are appointed to the occupational title of Meteorological and Hydrological Control Officer Level III (code V.06.04.11), they shall be graded at grade 3/9, salary coefficient 3.00 of type A1.

b) In cases where civil servants with a master's degree are appointed to the occupational title of Meteorological and Hydrological Control Officer Level III (code V.06.04.11), they shall be graded at grade 2/9, salary coefficient 2.67 of type A1.

c) In cases where civil servants with a bachelor's degree are appointed to the occupational title of Meteorological and Hydrological Control Officer Level III (code V.06.04.11), they shall be graded at grade 1/9, salary coefficient 2.34 of type A1.

d) In cases where civil servants with an associate degree are appointed to the occupational title of Meteorological and Hydrological Control Officer Level IV (code V.06.04.12), they shall be graded at grade 2/12, salary coefficient 2.06 of type B.

đ) In cases where civil servants with a secondary degree are appointed to the occupational title of Meteorological and Hydrological Control Officer Level IV (code V.06.04.12), they shall be graded at grade 1/12, salary coefficient 1.86 of type B.

3. The salary grading for civil servants appointed to occupational titles as stipulated in Clause 1 of this Article who have been transferred to classification levels and salary grades or appointed to meteorological and hydrological control ranks as prescribed in Decision No. 07/2008/QĐ-BTNMT and Circular Joint No. 30/2010/TTLT-BTNMT-BNV shall be carried out as follows:

a) In cases where civil servants eligible for appointment to occupational titles of specialized meteorological and hydrological control staff have the same salary coefficient and grade as in their previous rank, they shall continue to enjoy the same salary coefficient, grade, and any additional allowances (if applicable) as they were receiving in their previous rank (including the time for the next salary grade increase or the time for enjoying additional allowances in their previous rank) upon appointment to the new occupational title.

Example 1: Ms. Phan Thi A, currently working at the Network Center for Meteorology, Hydrology, and Environment under the National Meteorology and Hydrology Center, has been appointed to the rank of Meteorological and Hydrological Control Officer (rank code 14.253) with grade 5/9 and salary coefficient 3.66 since January 1, 2013. Now, Ms. Phan Thi A meets the conditions and criteria and is appointed by the competent authority to the occupational title of Meteorological and Hydrological Control Officer Level III (code V.06.04.11). She will be graded at grade 5/9, salary coefficient 3.66 of the occupational title of Meteorological and Hydrological Control Officer Level III from the date the decision takes effect; the time for the next salary grade increase will be calculated from January 1, 2013.

b) In cases where civil servants specializing in meteorological and hydrological control hold an associate degree and are currently graded at type A0 according to Decree No. 204/2004/NĐ-CP, now being appointed to the occupational title of Meteorological and Hydrological Control Officer Level IV (code V.06.04.12), their salary grading shall be based on the time of compulsory social insurance contributions according to the state-defined salary scale (excluding the probation period), as follows:

- Starting from grade 2 of the occupational title of Meteorological and Hydrological Control Officer Level IV, every two years (24 months) thereafter, they will be promoted to the next salary grade (if there are interrupted periods without social insurance benefits, these can be accumulated); if during the working period there is a year in which they fail to meet assigned tasks or are disciplined, the promotion period will be extended according to the regular salary grade promotion system.

- After transferring to the salary grade for the meteorological and hydrological controller profession at level IV as mentioned above, if the salary coefficient assigned to the meteorological and hydrological controller profession at level IV plus any seniority allowance exceeding the ceiling (if applicable) is lower than the current salary coefficient of the old position, then the difference coefficient shall be retained to equalize the current salary coefficient (including any seniority allowance exceeding the ceiling, if applicable) of the old position; this retained difference coefficient shall be enjoyed throughout the entire period during which the staff member is assigned the salary grade for the meteorological and hydrological controller profession at level IV. Subsequently, if the staff member is promoted to a higher profession level, the retained difference coefficient shall be added to the current salary coefficient (including any seniority allowance exceeding the ceiling, if applicable) to determine the salary grade for the newly appointed profession upon promotion, and the retention of the difference coefficient shall cease from the date the new profession salary takes effect.

Example 2: Mr. Pham Ngoc B, who graduated from a college specializing in Environmental Technology, was recruited to work at the Southern Regional Meteorological and Hydrological Station under the National Meteorological and Hydrological Center, with social insurance contributions starting from February 1, 2012, and currently holds the position of college-level meteorological and hydrological controller (position code 14.254), grade 2/10, with a salary coefficient of 2.41 for type A0 staff members since August 1, 2015; during his tenure, he has consistently fulfilled assigned tasks without disciplinary actions. Now, Mr. Pham Ngoc B meets the criteria and has been appointed by the competent authority to the meteorological and hydrological controller profession at level IV (code V.06.04.12), and will be assigned grades and salary coefficients as follows:

- The period of service of Mr. Pham Ngoc B from February 1, 2012, excluding the six-month probationary period, will be calculated from grade 2 of the meteorological and hydrological controller profession at level IV, and every two years, he will be promoted one grade. Therefore, on August 1, 2014, Mr. Pham Ngoc B will be assigned grade 3/12, with a salary coefficient of 2.26 for the meteorological and hydrological controller profession at level IV, effective from the date the decision takes effect; the next salary review period will be calculated from August 1, 2014; concurrently, Mr. Pham Ngoc B will enjoy a retention difference coefficient of 0.15 (2.41 - 2.26).

- On August 1, 2016 (after two years), if Mr. Pham Ngoc B meets the conditions, he will be regularly promoted to grade 4/12, with a salary coefficient of 2.46 for the meteorological and hydrological controller profession at level IV, and continue to enjoy the retention difference coefficient of 0.15 (total salary coefficient received is 2.61).

4. Staff members in the meteorological and hydrological control profession who achieve the results of the examination or assessment for promotion and are appointed by the competent authority to a higher adjacent profession level shall have their salary assignment carried out according to the provisions of this Circular and in accordance with the guidance provided in Clause 1, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007, issued by the Ministry of Home Affairs regarding salary assignment when upgrading, transferring positions, or changing types of civil servants and staff members.

Chapter IV

IMPLEMENTING PROVISIONS

Article 10. Provisions on Application

The agencies and units authorized to manage and utilize staff members are responsible for creating conditions for staff members to supplement the remaining standards of the meteorological and hydrological control profession staff member specialty as stipulated in this Joint Circular for staff members who have been transferred to new positions and salary grades or appointed to meteorological and hydrological control positions in accordance with Decision No. 07/2008/QĐ-BTNMT and Joint Circular No. 30/2010/TTLT-BTNMT-BNV.

Article 11. Implementation Organization

1. This Circular serves as the basis for implementing the recruitment, utilization, and management of staff members in the meteorological and hydrological control profession in public service units.

2. Non-public service organizations may apply these regulations to recruit, utilize, and manage personnel engaged in meteorological and hydrological control work.

3. The heads of public service units directly managing and utilizing civil servants shall be responsible for:

a) Review job positions within the unit, develop a plan to transfer staff members holding meteorological and hydrological control positions to the meteorological and hydrological control profession staff member specialty (hereinafter referred to as the transfer plan) for staff members under the management scope as specified in the attached model of this Joint Circular, submit to the superior management agency for consolidation and submission to the competent authority for approval;

b) Appoint the meteorological and hydrological control profession staff member specialty according to the authority or delegated authority after the transfer plan has been approved by the competent authority.

4. The head of subordinate agencies, units under ministries, agencies equivalent to ministries, government agencies, provincial people's committees, and centrally-administered city people's committees is responsible for:

a) Consolidating the transfer plans of subordinate agencies and units, submitting them to the ministry, agency equivalent to a ministry, government agency, provincial people's committee, or centrally-administered city people's committee for consideration and approval;

b) Appoint the meteorological and hydrological control profession staff member specialty according to the authority or delegated authority after the transfer plan has been approved by the competent authority.

5. Ministries, agencies equivalent to ministries, and provincial people's committees are responsible for:

a) Directing subordinate agencies and units to implement the transfer of profession titles;

b) Approving the transfer plans of subordinate agencies and units; resolving issues within their authority during the process of transferring profession titles;

c) Appointing the meteorological and hydrological control profession staff member specialty according to their authority;

d) Annually reporting the results of appointing profession titles and assigning salaries for staff members in the meteorological and hydrological control profession under their management to the Ministry of Natural Resources and Environment and the Ministry of Home Affairs.

Article 12. Effective Date

1. This Joint Circular takes effect from February 1, 2016.

2. Abolish the provisions on the titles and codes of meteorological and hydrological control staff member positions in Decision No. 01/2008/QĐ-BNV dated August 4, 2008, issued by the Minister of Home Affairs regarding the issuance of titles and codes for staff member positions in the natural resources and environment sector.

3. Repeal the provisions on the professional standards for categories of specialized meteorological and hydrological control civil servants set out in Decision No. 07/2008/QĐ-BTNMT dated October 6, 2008, issued by the Minister of Natural Resources and Environment regarding the professional standards for categories of civil servants in the natural resources and environment sector.

4. Repeal the provisions on guidelines for transferring and grading categories and salaries of specialized meteorological and hydrological control civil servants set out in Circular Joint Circular No. 30/2010/TTLT-BTNMT-BNV dated November 25, 2010, issued by the Ministry of Natural Resources and Environment and the Ministry of Home Affairs guiding the transfer and grading of categories and salaries of civil servants in the natural resources and environment sector.

Article 13. Responsibility for Implementation

1. The Minister, heads of ministries equivalent to ministries; heads of government agencies under the central government, Chairpersons of provincial People's Committees directly under the central government shall be responsible for implementing this Joint Circular.

2. In case of any difficulties during implementation, they are requested to report to the Ministry of Natural Resources and Environment for consolidation and coordination with the Ministry of Home Affairs to consider and resolve them.
