CIRCULAR
Regulating the management and supervision of persons prohibited from leaving their place of residence
Based on Criminal Procedure Code No. 101/2015/QH13 amended and supplemented by Articles of certain provisions in Laws Nos. 02/2021/QH15, 34/2024/QH15, 59/2024/QH15, 99/2025/QH15, 106/2025/QH15 and Law No. 128/2025/QH15;
Based on Criminal Procedure Code Implementation Law No. 128/2025/QH15;
Based on Decree No. 02/2025/NĐ-CP dated February 18, 2025 of the Government on the functions, tasks, powers and organizational structure of the Ministry of Public Security, amended by Decree No. 11/2025/NĐ-CP;
In accordance with the proposal of the Director of the Department of Detention and Community Correctional Services;
The Minister of Public Security promulgates this Circular on regulating the management and supervision of persons prohibited from leaving their place of residence.
CHAPTER I
GENERAL PROVISIONS
Article 1. Scope of application
This Circular stipulates the reception, management, and supervision of persons prohibited from leaving their place of residence; the responsibilities of public security units and localities in implementing the measure of prohibiting departure from one's place of residence.
Article 2. Interpretation of terms
In this Circular, the following terms are understood as follows:
1. Pointing up and checking identity refers to the direct encounter or use of measures prescribed by law by management and supervision personnel to confirm, record the presence or absence of a person prohibited from leaving their place of residence at their place of residence.
2. Summoning is the act of the head of the local public security office requesting a person prohibited from leaving their place of residence to appear at the local public security office within the time and location specified in the summons for work purposes.
3. Reporting presence refers to the act of a person prohibited from leaving their place of residence appearing at the local public security office where they are managed and supervised during the period of prohibition from leaving their place of residence as prescribed by law to perform procedures related to the prohibition from leaving one's place of residence.
4. Reporting is the act of a person prohibited from leaving their place of residence reporting to the head of the local public security office in their new place of residence about temporary or permanent accommodation on the local level.
5. Representative is the legal representative of an individual as prescribed by the Civil Code 2015, including: father and mother for minors; guardian for a person under guardianship; person appointed by the court.
Article 3. Principles of managing and supervising persons prohibited from leaving their place of residence
1. Compliance with the Constitution and laws.
2. Ensuring proper authority, procedure, and process as prescribed in the Criminal Procedure Code, Law on Detention and Temporary Residence Prohibition Implementation Law.
3. The work of managing and supervising persons prohibited from leaving their place of residence must be carried out uniformly with close coordination among public security units and localities.
CHAPTER II
RECEIVING, MANAGING, AND SUPERVISING
PERSONS PROHIBITED FROM LEAVING THEIR PLACE OF RESIDENCE
Article 4. Receiving orders and persons prohibited from leaving their place of residence
1. Immediately after receiving the order prohibiting departure from one's place of residence, the head of the local public security office assigns personnel to manage, supervise, and verify. In cases where the person prohibited from leaving their place of residence does not reside in the local area, notify the issuing authority in writing immediately for processing.
2. When a person prohibited from leaving their place of residence reports presence, the head of the local public security office directs the following tasks:
a) Verify and compare information in the order prohibiting departure with personal documents or national population database, VNeID. In case of any discrepancies or errors, notify the issuing authority in writing immediately for processing;
b) Inform them about regulations on pointing up and checking identity, summoning, and other related provisions; inform them of the person responsible for management and supervision during the period of prohibition from leaving their place of residence;
c) Prepare a record of the person prohibited from leaving their place of residence reporting presence; request them to write a written undertaking to comply with obligations as prescribed. In cases where the person prohibited from leaving their place of residence is between 14 and under 18 years old, or has mental or physical defects affecting the writing of an undertaking, such undertaking must be confirmed by a representative;
d) Establish a management file for persons prohibited from leaving their place of residence; record in the book and update information in the national population database and specialized software for managing and supervising persons prohibited from leaving their place of residence;
d) The reception of persons prohibited from leaving their place of residence reporting presence is carried out every day, including weekends, holidays, and festivals.
3. Within three days from the date a person prohibited from leaving their place of residence reports presence, the assigned personnel must develop a management plan, report to leadership for approval. The content of the plan must specify the measures of management and supervision as prescribed in Article 6 of this Circular.
Article 5. Handling Cases of Persons Prohibited from Leaving Their Place of Residence Who Do Not Report Themselves
1. If a person prohibited from leaving their place of residence does not report themselves within three days after receiving the prohibition order, the Chief of the Police Station shall summon such person to the police station's premises to make a written undertaking regarding compliance with obligations. The content of the summons shall specify the time, location, agenda, and participants.
2. Upon the arrival of the person prohibited from leaving their place of residence for work according to the summons, the Chief of the Police Station shall direct the implementation of tasks as specified in points a, b, c, d of Clause 1, Article 4 of this Circular; request such person to report and explain regarding non-reporting. In cases where it is determined that there was no valid reason or objective obstacle for not reporting, after completing the reception procedures, proceed with recordation, handling of violations.
3. If the time limit specified in the summons expires without the person prohibited from leaving their place of residence arriving to work, the Chief of the Police Station shall direct inspection and verification.
a) In cases where the person prohibited from leaving their place of residence is still residing at their place of residence due to valid reasons or objective obstacles and does not report themselves or attend work at the police station as required, depending on the actual circumstances, the Chief of the Police Station shall decide whether to proceed with reception procedures according to points a, b, c of Clause 2, Article 4 of this Circular at their place of residence or send out a second summons requesting them to come to the police station at an appropriate time for work. In cases where there is no valid reason or objective obstacle and the person prohibited from leaving their place of residence does not report themselves or attend work according to the summons, prepare a recordation, handle violation, and notify the agency that issued the prohibition order to process according to authority;
b) In cases where it is determined that the person prohibited from leaving their place of residence has left their place of residence without valid reasons or objective obstacles, or when such obstacles no longer exist but they do not report themselves, prepare a recordation, handle violation behavior, and notify the agency that issued the prohibition order to process according to authority.
Article 6. Management and Monitoring Measures for Persons Prohibited from Leaving Their Place of Residence
1. The Police Station manages residence through activities such as registration (permanent residence, temporary residence, absence reporting, lodging report), inspections, management, and updating information in the National Population Database to manage and monitor persons prohibited from leaving their place of residence.
2. Summoning During the process of management and monitoring, if there is information indicating that a person prohibited from leaving their place of residence has violated obligations, the Chief of the Police Station shall direct inspection and verification or summon such person to the police station's premises for work. The content of the summons shall specify the time, location, agenda, and participants. When working, prepare a recordation with signatures of those participating in the meeting. If the person prohibited from leaving their place of residence is not present at the specified time and location without valid reasons or objective obstacles, the Chief of the Police Station shall direct preparation of a recordation and request relevant agencies or individuals to change preventive measures.
3. Roll Call, Verification In cases where there is information indicating that a person prohibited from leaving their place of residence has left their place of residence without permission, the Chief of the Police Station shall direct verification, roll call, and verification; prepare a recordation, handle violation (if applicable) or request relevant agencies or individuals to process according to authority.
4. Other Measures as prescribed by law
a) The Chief of the Police Station shall direct application of other management and monitoring measures as prescribed by law;
b) Personnel assigned for management and monitoring shall coordinate with local security and order protection forces in managing and monitoring persons prohibited from leaving their place of residence.
Article 7. Resolution of Absence from Place of Residence for Persons Prohibited from Leaving Their Place of Residence
1. In cases where a person prohibited from leaving their place of residence leaves their place of residence without permission due to justifiable reasons or objective impediments, but reports to the authority that issued the prohibition or the police station immediately after such justifiable reasons or objective impediments cease, the Chief of the Police Station shall direct an inspection, verification, prepare a record, and handle any violation of obligations.
2. In cases where a person prohibited from leaving their place of residence submits a request for permission and obtains approval from the authority that issued the prohibition.
a) Upon receipt of a document from the authority that issued the prohibition approving the resolution to allow the person prohibited from leaving their place of residence to be absent from their place of residence, the Chief of the Police Station shall temporarily resolve the absence and notify the Chief of the Police Station at the new temporary place of residence or stay, coordinate management and monitoring; update information in the National Population Database System, registers, and software for managing and monitoring persons prohibited from leaving their place of residence;
b) Upon the person prohibited from leaving their place of residence reporting to the police station, the Chief of the Police Station at the new place of residence shall direct the implementation of procedures for temporary registration of stay or residence; update information in the National Population Database System and software for managing and monitoring persons prohibited from leaving their place of residence;
c) In cases where a person prohibited from leaving their place of residence fails to report or violates other obligations, the Chief of the Police Station at the new place of residence shall notify the Chief of the Police Station responsible for management and monitoring, verify, and handle any violation of obligations;
d) Upon expiration of the temporary stay or residence period, the Chief of the Police Station at the new place of residence shall issue a confirmation of temporary stay or residence for the person prohibited from leaving their place of residence; update information in the National Population Database System and software for managing and monitoring persons prohibited from leaving their place of residence.
Article 8. Resolution of Cases Where Persons Prohibited from Leaving Their Place of Residence Change Their Place of Residence, Workplace, Employment, or Education
1. In cases where a person prohibited from leaving their place of residence changes their place of residence within the administrative boundaries of the police station and the new place of residence does not fall under the management and monitoring scope of the assigned officer, the Chief of the Police Station shall assign an officer responsible for the new area to manage and monitor. The newly assigned officer shall be responsible for drafting plans and implementing measures for managing and monitoring persons prohibited from leaving their place of residence in accordance with regulations.
2. In cases where a person prohibited from leaving their place of residence changes their place of residence outside the administrative boundaries of the police station where they currently reside: Upon receipt of a new prohibition order from the authority that issued the prohibition, within three days, the Chief of the Police Station responsible for management and monitoring shall direct:
a) An evaluation of compliance with obligations by the person prohibited from leaving their place of residence;
b) Updating information in the National Population Database System, registers, and software for managing and monitoring persons prohibited from leaving their place of residence;
c) Handing over documents to the Chief of the Police Station at the new place of residence for management and monitoring. The handover must be documented with a transfer record and retained in the business file system that preserves records reflecting the work on managing and monitoring persons prohibited from leaving their place of residence as stipulated in paragraph 2 of Article 11 of this Circular.
Article 9. Review of Compliance with Obligations by Persons Prohibited from Leaving Their Place of Residence
1. On a regular basis on the last working day of the month or when the place of residence of a person prohibited from leaving their place of residence is changed, or upon expiration of the prohibition period, the Chief of the Police Station shall direct the assigned personnel responsible for managing and monitoring to review compliance with obligations by persons prohibited from leaving their place of residence, and keep records of such management and monitoring.
2. Timeframes for Review:
a) Regular Monthly Review: The timeframe for regular monthly reviews is from the first day of the month or from the date when a person prohibited from leaving their place of residence reports to the last day of the month;
b) Other Reviews: The timeframe for other reviews is from the first day of the month or from the date when a person prohibited from leaving their place of residence reports until the date they change their place of residence or the expiration of the prohibition period.
Article 10. Information Exchange
1. When a person prohibited from leaving their place of residence dies or is apprehended by an agency that did not issue the order prohibiting them from leaving, the Chief of the Police Station responsible for managing and monitoring such persons shall notify in writing the issuing authority to handle the matter according to its jurisdiction.
2. Upon receipt of a decision, directive, or document regarding changes, cancellation, suspension of investigation, or wanted status of a person prohibited from leaving their place of residence who has fled, the authority that issued the order prohibiting them from leaving shall notify in writing the Chief of the Police Station responsible for managing and monitoring such persons.
Article 11. Management and Monitoring Files for Persons Prohibited from Leaving Their Place of Residence
1. The management and monitoring file for a person prohibited from leaving their place of residence is part of the specialized business file that retains a system of documents reflecting the work of managing and monitoring such persons.
2. The management and monitoring file for a person prohibited from leaving their place of residence includes:
a) Order prohibiting departure from place of residence;
b) Undertaking given by the person prohibited from leaving their place of residence;
c) Minutes of meetings with persons prohibited from leaving their place of residence;
d) Reviews by the Chief of the Police Station regarding compliance with obligations by persons prohibited from leaving their place of residence;
e) Minutes and notifications concerning violations of obligations by persons prohibited from leaving their place of residence (if applicable);
f) Documents related to handling absences, changes in place of residence, work, labor, or education (if applicable);
g) Other relevant documents (if applicable).
3. Forms and registers for managing and monitoring persons prohibited from leaving their place of residence are implemented according to the Circular issued by the Minister of Public Security specifying forms and records for public security work, including temporary detention, temporary custody, and prohibition from leaving one's place of residence in the People’s Police.
4. The establishment, registration, management, and storage of specialized business files for managing and monitoring persons prohibited from leaving their place of residence are carried out according to current regulations of the Ministry of Public Security concerning public security business file work.
Article 12. Conclusion of Management and Monitoring
When a person prohibited from leaving their place of residence flees, is subject to an arrest warrant, dies, is apprehended; when measures are changed, canceled, or suspended during investigation, wanted status is lifted; when a final judgment becomes effective, the Chief of the Police Station shall direct the conclusion of management and monitoring for persons prohibited from leaving their place of residence.
Chapter III
RESPONSIBILITY OF POLICE AT THE LOCAL LEVEL IN IMPLEMENTING MEASURES TO PROHIBIT TRAVEL OUTSIDE RESIDENCE
Article 13. Management of Temporary Detention, Custody and Prohibition from Leaving Place of Residence Department of Public Security
1. Draft and implement legal documents; organize the implementation of laws related to the enforcement of measures prohibiting travel outside residence.
2. Direct operational matters, provide guidance to police at local levels on the uniform application of legal provisions concerning the enforcement of measures prohibiting travel outside residence.
3. Develop, manage, operate, utilize, and use a database for temporary detention, custody, and prohibition from leaving place of residence.
4. Inspect the enforcement of measures prohibiting travel outside residence within their jurisdiction.
5. Provide training and education on the enforcement of measures prohibiting travel outside residence.
6. Report, compile statistics, organize interim reviews, and final evaluations regarding the implementation of measures prohibiting travel outside residence in the public security force.
7. Perform other tasks related to the enforcement of measures prohibiting travel outside residence.
Article 14. Management of Temporary Detention, Custody and Prohibition from Leaving Place of Residence Provincial Public Security Bureau
1. Direct operational matters, provide guidance to local police on the implementation of measures prohibiting travel outside residence.
2. Manage, utilize, and use a database for temporary detention, custody, and prohibition from leaving place of residence within the jurisdiction of the provincial public security bureau.
3. Inspect the enforcement of measures prohibiting travel outside residence within their jurisdiction.
4. Provide training and education on the enforcement of measures prohibiting travel outside residence to local police.
5. Report, compile statistics, organize interim reviews, and final evaluations regarding the implementation of measures prohibiting travel outside residence in the provincial public security bureau's jurisdiction.
6. Perform other tasks related to the enforcement of measures prohibiting travel outside residence.
Article 15. Local Police
1. Receive, directly manage and monitor individuals prohibited from leaving their place of residence.
2. Establish, register, manage, and store records and documents concerning the management and monitoring of individuals prohibited from leaving their place of residence.
3. Update, manage, utilize, and use a database for temporary detention, custody, and prohibition from leaving place of residence within the jurisdiction of local police.
4. Implement guidance and instructions from higher-level public security authorities regarding the management and monitoring of individuals prohibited from leaving their place of residence.
5. Assign personnel to manage and monitor individuals prohibited from leaving their place of residence in accordance with task requirements and实际情况。
6. Report and compile statistics on the work of managing and monitoring individuals prohibited from leaving their place of residence within their jurisdiction.
7. Perform other tasks related to the enforcement of measures prohibiting travel outside residence.
Article 16. Information Reporting System
1. On a regular basis, monthly, quarterly, semi-annually, or annually, or as required by the provincial public security bureau management authority and local people's committee, report statistics on the management of individuals prohibited from leaving their place of residence within their jurisdiction. The reporting period is determined according to regulations set by the Ministry of Public Security or as requested. The content of the report shall include data on subjects (such as those transferred from previous periods; new subjects received during the period; subjects whose prohibition has ended, such as death, expiration of the prohibition period, change in place of residence, or change in preventive measures; subjects who violated their obligations and the forms of punishment; subjects currently being managed and monitored); the situation and results of work on managing and monitoring subjects; difficulties and challenges encountered, along with proposals and recommendations (if any); other contents as required.
2. On a regular basis, monthly, quarterly, semi-annually, or annually, or as required by the provincial public security bureau management authority and local people's committee, compile and report statistics on the work of managing and monitoring individuals prohibited from leaving their place of residence within their jurisdiction.
Chapter IV
PROVISIONS FOR IMPLEMENTATION
Article 17. Enforceability
This Circular shall take effect from July 1, 2026.
Article 18. Implementation Responsibilities
1. The Head of the Management Authority, who is responsible for temporary detention and house arrest, as well as prohibiting departure from residence, within the Ministry of Public Security; the Heads of units under the Ministry; and the Directors of provincial and municipal public security bureaus shall bear responsibility for directing the implementation of this Circular.
2. The Department of Community Temporary Detention and Criminal Execution is responsible for guiding, monitoring, organizing inspections, and urging the implementation of this Circular.
3. In case of any difficulties during implementation, units and localities of the public security shall report to the Ministry of Public Security (through the Department of Community Temporary Detention and Criminal Execution) for timely guidance.
