THE MINISTER OF FINANCE
Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of ministries and agencies at the ministerial level;
Pursuant to the Prime Minister's Decision No. 853/1997/CT-TTg dated October 11, 1997 on combating smuggling under new circumstances;
Pursuant to Decree No. 184/CP dated November 30, 1994 of the Government on marriage procedures, acknowledgment of children born out of wedlock, adoption, and guardianship between Vietnamese citizens and foreigners;
Pursuant to Decree No. 83/1998/NĐ-CP dated October 10, 1998 of the Government on civil status registration;
Pursuant to Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the state budget;
After receiving the opinions of the Ministry of Justice (Letter No. 163/TP-HT dated January 31, 2000), the Ministry of Foreign Affairs (Letter No. 06-CV/NG-LS-PL dated January 4, 2000), and in accordance with the proposal of the Director General of the Tax General Department.
DECISION:
Article 1. The fee schedule for civil status registration attached to this Decision includes all related record-keeping costs associated with civil status management work.
Article 2. The subjects required to pay fees according to the rates set forth in this Decision are those individuals whose civil status matters are resolved by state agencies authorized under the law.
Article 3. State agencies responsible for managing civil status affairs, including organizing the collection of civil status fees, include:
1. People's Committees of communes, wards, and towns collect fees according to the rates specified in Section A of the fee schedule.
2. Departments of Justice of provinces and centrally-administered cities collect fees according to the rates specified in Section B of the fee schedule.
3. Diplomatic missions and consular offices of Vietnam abroad collect fees according to the rates specified in Section C of the fee schedule.
People's Committees of communes, wards, and towns, and Departments of Justice of provinces and centrally-administered cities collect civil status registration fees in Vietnamese Dong; diplomatic missions and consular offices of Vietnam collect fees in US dollars or local currency at the exchange rate published by the local bank at the time of collection.
Article 4. The agency collecting fees may temporarily retain 30% of the actual collected fees, while the remaining 70% must be remitted to the state budget. The temporarily retained fees must be balanced against the annual budget estimate and used in accordance with the prescribed regulations. At the end of the year, if not fully utilized, the remainder must be remitted to the state budget. The agency has the responsibility to organize the collection, remittance, and management of fees in accordance with Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges belonging to the state budget and Circular No. 54/1999/TT-BTC dated May 10, 1999 of the Ministry of Finance guiding implementation.
Article 5. This Decision takes effect 15 days from the date of signature and replaces the provisions regarding civil status fees stipulated in Joint Circular No. 33 TT/LB dated April 24, 1995 of the Ministry of Finance and the Ministry of Justice on the system of collection, management, and utilization of marriage registration fees, recognition of marriage, acknowledgment of children born out of wedlock, adoption registration, and recognition of adoption between Vietnamese citizens and foreigners, and in Joint Circular No. 83 TT/LB dated October 4, 1993 of the Ministry of Finance and the Ministry of Foreign Affairs on the collection of foreign consular fees and charges.
Article 6. Organizations and individuals subject to the payment of fees shall be responsible for implementing this Decision, as shall relevant agencies./.
