CIRCULAR
Amending and supplementing some points of Circular No. 99/2006/TT-BNN dated November 6, 2006 of the Ministry of Agriculture and Rural Development,
guiding the implementation of certain provisions of the Forest Management Regulation,
issued together with Decision No. 186/2006/QĐ-TTg dated August 14, 2006 of the Prime Minister,
On the basis of Decree No. 23/2006/NĐ-CP dated March 3, 2006 of the Government on the enforcement of the Law on Protection and Development of Forests;
On the basis of Decision No. 186/2006/QĐ-TTg dated August 14, 2006 of the Prime Minister on the issuance of the Forest Management Regulation;
Pursuant to the Forest Protection and Development Law 2004;
On the basis of Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Considering the proposal of the Forestry Department,
The Ministry of Agriculture and Rural Development amends and supplements some points of Circular No. 99/2006/TT-BNN dated November 6, 2006 of the Ministry of Agriculture and Rural Development, guiding the implementation of certain provisions of the Forest Management Regulation, issued together with Decision No. 186/2006/QĐ-TTg dated August 14, 2006 of the Prime Minister as follows:
Point 1.1, Clause 1, Section II (Provisions on the division and determination of boundaries of forest management units and land planned for forestry) is amended and supplemented as follows:
"1.1 Forests and land planned for forestry are divided into management units: Sub-districts, compartments, plots according to Article 42 of Decree No. 23/2006/NĐ-CP dated March 3, 2006 of the Government on the enforcement of the Law on Protection and Development of Forests.
1. Sub-districts have an average area of one thousand (1,000) hectares within the same administrative unit of commune, ward, town (hereinafter referred to collectively as commune level). The order of sub-districts is recorded with Arabic numerals within each province, centrally governed city (hereinafter referred to collectively as provincial level), from Sub-district 1 to the last sub-district (for example: Sub-district 1, Sub-district 2).
Compartments have an average area of one hundred (100) hectares. The order of compartments is recorded with Arabic numerals, from Compartment 1 to the last compartment within each sub-district (for example: Compartment 1, Compartment 2).
Plots have an average area of ten (10) hectares, with relatively uniform forest or forestry land status. The order of plots is recorded with Vietnamese letters within each compartment (for example: Plot a, Plot b). Within the same compartment, the names of forest plots shall not be duplicated.
The numbering of sub-districts, compartments, and plots is generally recorded in sequence from top to bottom, left to right, except in cases of subsequent supplementation."
Paragraph a, b, Point 2.2, Clause 2, Section II (Criteria for extremely poor forests and types of extremely poor forests allowed to be improved; measures, procedures, and formalities for improving forests) are amended as follows:
a) The phrase: "For pure wood forests," is amended to: "For wood forests";
2. b) The phrase: "For pure bamboo and rattan forests," is amended to: "For bamboo and rattan forests".
Point 7.3, Clause 7, Section II (Provisions on the combined production of agriculture, forestry, and fisheries in protective forests) is amended as follows:
"7.3. Forest owners may use land without existing forests in protective forests for combined agricultural and fishery production according to Paragraph b, Clause 2, Article 33 of the Forest Management Regulation, issued together with Decision No. 186/2006/QĐ-TTg dated August 14, 2006 of the Prime Minister."
3. This Circular takes effect fifteen days after its publication in the Official Gazette.
Provisions in Circular No. 99/2006/TT-BNN dated November 6, 2006 of the Ministry of Agriculture and Rural Development, guiding the implementation of certain provisions of the Forest Management Regulation, issued together with Decision No. 186/2006/QĐ-TTg dated August 14, 2006 of the Prime Minister that are not contrary to this Circular remain in effect.
During the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to report them to the Ministry of Agriculture and Rural Development for timely amendment and supplementation.
