DECREE
REGULATIONS ON PRIORITY ENROLLMENT AND STUDENT SUPPORT POLICIES FOR CHILDREN IN KINDERGARTEN, STUDENTS, AND COLLEGE STUDENTS OF ETHNIC MINORITIES WITH VERY FEW POPULATION
REGARDING CHILDREN IN KINDERGARTEN, STUDENTS, AND COLLEGE STUDENTS OF ETHNIC MINORITIES WITH VERY FEW POPULATION
Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to the Education Law dated June 14, 2005; the Law Amending and Supplementing Certain Provisions of the Education Law dated November 25, 2009;
At the proposal of the Minister of Education and Training;
The Government promulgates this Decree to regulate priority enrollment and student support policies for children in kindergarten, students, and college students of ethnic minorities with very few population.
Article 1. Scope of Regulation
This Decree regulates priority enrollment and student support policies for children in kindergarten, students, and college students of ethnic minorities with very few population who are studying at educational institutions within the national education system.
Article 2. Applicability
1. Children in kindergarten, students, and college students belonging to 16 ethnic groups with less than 10,000 people: Cong, Mang, Pu Peo, Si La, Co La, Bo Y, La Ha, Ngai, Chut, O Du, Brau, Ro Mam, Lo Lo, Lu, Pa Then, La Hu (hereinafter referred to as ethnic minorities with very few population).
2. Educational institutions, organizations, and individuals related to the implementation of priority enrollment and student support policies for children in kindergarten, students, and college students of ethnic minorities with very few population.
Article 3. Priority Enrollment Policy
Children in kindergarten, students, and college students of ethnic minorities with very few population shall be given priority to enroll in educational institutions according to their preferences:
1. Children in kindergarten shall study at kindergartens or public kindergarten classes.
2. Elementary school students shall study at boarding schools for ethnic minorities or elementary schools.
3. Students completing elementary school shall enroll in boarding schools for ethnic minorities, boarding schools for ethnic minorities, or junior high schools.
4. Junior high school graduates shall be directly admitted to boarding schools for ethnic minorities, general secondary schools, vocational education institutions training at the basic and intermediate levels.
5. Secondary school graduates shall be directly admitted to preparatory university departments, higher education institutions, or vocational education institutions.
Article 4. Student Support Policy
1. Level of support:
a) Children in kindergarten of ethnic minorities with very few population studying at preschool education institutions shall receive a study support amount equal to 30% of the base salary per child per month.
b) Elementary school and middle school students, high school students of ethnic minorities with very few population studying at elementary schools, middle schools, and high schools shall receive a study support amount equal to 40% of the base salary per student per month.
c) Elementary school and middle school students of ethnic minorities with very few population studying at boarding schools for ethnic minorities or boarding students studying at public schools with boarding facilities shall receive a study support amount equal to 60% of the base salary per student per month.
d) Middle school and high school students of ethnic minorities with very few population studying at boarding schools for ethnic minorities shall receive a study support amount equal to 100% of the base salary per student per month.
đ) College students of ethnic minorities with very few population studying at preparatory university departments, higher education institutions, or vocational education institutions shall receive a study support amount equal to 100% of the base salary per person per month.
2. Duration of Support: 12 months/year for those who have a full-time study period of 9 months/year or more; in cases where the study period is less than 9 months/year, support will be provided based on the actual study time.
3. Principles of Support:
a) Students of ethnic minorities with very few population studying at preparatory university departments, higher education institutions, or vocational education institutions, if they study simultaneously in multiple departments within the same institution or in different institutions, shall only receive support once. In cases where students are suspended from studies, the suspension period will not be supported. In cases where students are expelled, the support policy will cease immediately upon expulsion.
b) In cases where children in kindergarten, students, and college students belong to multiple support policies with the same nature, they shall only receive the highest level of support, specifically:
- Students of ethnic minorities with very few population studying at elementary schools, middle schools, and high schools shall receive the study support policy stipulated in this Decree and shall not receive the cost-of-study support policy stipulated in Decree No. 86/2015/NĐ-CP dated October 2, 2015 regarding the mechanism for collecting and managing tuition fees for educational institutions within the national education system and policies for exempting, reducing tuition fees, and supporting study costs from the academic year 2015-2016 to 2020-2021.
- Students of ethnic minorities with very few population studying at boarding schools for ethnic minorities or boarding students studying at public schools with boarding facilities shall receive the study support policy stipulated in this Decree and shall not receive the meal support policy stipulated in Decree No. 116/2016/NĐ-CP dated July 18, 2016 of the Government regarding policies to support students and secondary schools in particularly difficult communes and villages.
- Students of ethnic minorities with very few population studying at boarding schools for ethnic minorities and preparatory universities shall receive the study support policy stipulated in this Decree and shall not receive scholarships stipulated in Circular Joint No. 109/2009/TTLT/BTC-BGDĐT dated May 29, 2009 of the Ministry of Finance and the Ministry of Education and Training guiding certain financial systems for students in boarding schools for ethnic minorities and preparatory universities for ethnic minorities.
- College students of ethnic minorities with very few population studying at higher education institutions shall receive the study support policy stipulated in this Decree and shall not receive the cost-of-study support policy stipulated in Decision No. 66/2013/QĐ-TTg dated November 11, 2013 of the Prime Minister regarding policies to support the cost of study for college students who are ethnic minorities studying at higher education institutions.
- Students from ethnic minority groups with very small populations studying at vocational education institutions shall not be entitled to scholarships under Decision No. 53/2015/QD-TTg dated October 20, 2015 of the Prime Minister on residential policies for students studying at college and secondary levels, nor shall they be entitled to study cost support under Decision No. 66/2013/QD-TTg dated November 11, 2013 of the Prime Minister on study cost support policies for ethnic minority students studying at higher education institutions.
Article 5. Procedures, timeframes for reviewing and methods of disbursing study support
1. Procedures and timeframes for review
a) For preschool children, students studying at public educational institutions
- At the beginning of the school year, preschool education facilities and general education facilities with preschool children and students from ethnic minority groups with very small populations enrolled must widely disseminate and announce, guiding parents (or caregivers) of preschool children; students eligible for policy benefits to submit applications for study support (as prescribed in the Appendix attached to this Decree).
- At the start of the academic term, preparatory university schools, higher education institutions, and vocational education institutions with students from ethnic minority groups with very small populations enrolled must widely disseminate and announce to students eligible for policy benefits to submit applications for study support (as prescribed in the Appendix attached to this Decree).
- Within twenty working days from the date of posting the announcement, parents (or caregivers) of preschool children; students must submit their applications to the educational institution.
- Within ten working days from the deadline for receiving applications, educational institutions have the responsibility to review the applications for study support, establish and approve lists of beneficiaries, publicly post the list of beneficiaries, report to the direct superior management authority, and implement disbursement.
Preschool children, students studying at public educational institutions only need to submit an application for study support once when they first enroll in an educational institution. In subsequent years, educational institutions will base their lists of preschool children, students from ethnic minority groups with very small populations currently enrolled and new applications from preschool children, students newly enrolling to establish and approve lists of beneficiaries.
b) For preschool children, students studying at non-public educational institutions
- At the beginning of the school year, preschool education facilities and general education facilities with preschool children and students from ethnic minority groups with very small populations enrolled must widely disseminate and announce, guiding parents (or caregivers) of preschool children; students eligible for policy benefits to submit applications for study support (as prescribed in the Appendix attached to this Decree).
- At the start of the academic term, higher education institutions and vocational education institutions with students from ethnic minority groups with very small populations enrolled must widely disseminate and announce to students eligible for policy benefits to submit applications for study support (as prescribed in the Appendix attached to this Decree).
- Within twenty working days from the date of posting the announcement, parents (or caregivers) of preschool children; students must submit their applications to the educational institution. Educational institutions have the responsibility to confirm the applications for study support submitted by parents (or caregivers) of preschool children; students from ethnic minority groups with very small populations.
- Within thirty working days from the start of the school year, academic term, parents (or caregivers) of preschool children; elementary school students, junior high school students must submit applications for study support to the Department of Education and Training, high school students must submit applications for study support to the Department of Education and Training, students studying at vocational education institutions and higher education institutions must submit applications for study support to the Department of Labor, Invalids, and Social Affairs where preschool children, students have permanent residence registration. In cases where students do not directly submit their applications, parents of students may submit them on behalf of the students.
- Within ten working days from the deadline for submitting applications for study support, the Department of Education and Training, the Department of Education and Training, the Department of Labor, Invalids, and Social Affairs have the responsibility to review the applications, establish and approve lists of beneficiaries, publicly post the list of beneficiaries and implement disbursement.
2. Methods of disbursing study support:
a) Public educational institutions shall directly pay study support funds to parents (or caregivers) of preschool children, students. Payment shall be made monthly.
b) The Department of Education and Training, the Department of Education and Training, the Department of Labor, Invalids, and Social Affairs shall directly pay study support funds to parents (or caregivers) of preschool children; students, or through parents of students from non-public educational institutions. Depending on the actual conditions of the beneficiaries, payment can be made monthly or quarterly.
Article 6. Budget preparation, management, utilization, and settlement of funding
1. The preparation and allocation of the budget for implementing the policy of providing educational support funds to preschool children, students, and college students from ethnic minority groups with very small populations shall be carried out in accordance with the provisions of the State Budget Law and guiding documents. The budget must clearly state the funding for implementing the policy of providing educational support to preschool children, students, and college students from ethnic minority groups with very small populations and the number of beneficiaries.
Funding for educational support for preschool children and students studying at public educational institutions shall be balanced within the annual state budget allocated to these public educational institutions.
Funding for educational support for preschool children, students, and college students studying at non-public educational institutions shall be balanced within the annual state budget allocated through the Department of Education and Training (for preschool children, elementary school students, and junior high school students), the Department of Education and Training (for senior high school students), or the Department of Labor, Invalids, and Social Affairs (for college students and vocational education students) where the preschool children, students, and college students have their permanent residence.
2. Agencies allocated budgets in accordance with this Decree shall be responsible for preparing the budget, managing, disbursing educational support funds to the correct recipients, and settling accounts with the state budget in accordance with the relevant laws.
The procedures, responsibilities, and authorities in preparing the budget, executing, and settling accounts for educational support funds shall be carried out in accordance with the State Budget Law and the current administrative levels of management.
3. Financial agencies at all levels shall be responsible for ensuring the funding for support, guiding management, and inspecting and supervising the implementation.
4. The State Treasury shall implement control, disbursement, and payment of educational support funds in accordance with the current regulations of the Ministry of Finance on guiding the management, disbursement, and payment of budget expenditures through the State Treasury; consumption regulations, and the provisions of this Decree.
5. Annually, the People's Committee of the province shall base on guidelines for building the state budget, the number of beneficiaries to build the budget for educational support funds, consolidate in the local state budget expenditure plan and send it to the Ministry of Finance together with the report on the state budget plan for the planning year; at the same time, send reports to the Ministry of Education and Training, the Ministry of Labor, Invalids, and Social Affairs for coordination in management.
Article 7. Sources of funding for implementing the educational support policy
1. The funding for implementing the educational support policy for preschool children, students, and college students from ethnic minority groups with very small populations as stipulated in this Decree shall be balanced within the annual regular operating expenses for education and training according to the current administrative levels of budget management.
2. The central budget shall provide support to local budgets in accordance with the State Budget Law, guiding documents, and mechanisms for supporting localities from the central budget to implement social welfare policies.
Article 8. Implementation organization
1. Ministry of Education and Training
a) Take the lead and coordinate with related ministries and sectors to inspect, evaluate, and compile the situation of implementing the policy stipulated in this Decree, and annually report
b) Inspect, evaluate, and compile the situation of implementing the policy stipulated in this Decree for preschool education institutions, general education institutions, and higher education institutions.
c) Guide contents related to preferential admission policies for preschool children, students, and college students from ethnic minority groups with very small populations in the admission regulations under the functions managed by the Ministry.
2. Ministry of Finance
Allocate regular funding to support localities in implementing the policy stipulated in this Decree in the annual state budget plan according to the current administrative levels of management.
3. Ministry of Labor, Invalids and Social Affairs
a) Inspect, evaluate, and compile the situation of implementing the policy stipulated in this Decree for vocational education institutions, and annually report to the Ministry of Education and Training for compilation and reporting
b) Guide contents related to preferential admission policies for students and college students from ethnic minority groups with very small populations in the admission regulations of vocational education institutions.
4. The Ethnic Committee
Coordinate with the Ministry of Education and Training, central ministries and sectors, and localities to direct, inspect, and supervise the implementation of policies stipulated in this Decree.
5. Provincial People's Committees and municipalities directly under the Central Government
a) Direct the Department of Education and Training, the Department of Labor, Invalids, and Social Affairs, related departments and agencies, and the People's Committee of the district to properly organize the implementation of the system and policies for preschool children, students, and college students from ethnic minority groups with very small populations.
b) Direct local functional agencies to regularly inspect and supervise to ensure that the policies are implemented correctly, with the appropriate level of support, and within the specified timeframe; annually summarize, evaluate, and report the results of implementation to the Ministry of Education and Training, the Ministry of Finance, the Ministry of Labor, Invalids, and Social Affairs, and the Ethnic Committee for compilation and reporting.
Article 9. Transitional Provisions
Preschool children, students, and college students from ethnic minority groups with very small populations who are currently benefiting from the educational support policy pursuant to Decision No. 2123/QĐ-TTg dated November 29, 2010 of the Prime Minister approving the Project on Developing Education for Ethnic Minority Groups with Very Small Populations for the period 2010-2015 shall continue to benefit from the support policy stipulated in this Decree from the date this Decree takes effect but do not need to reapply and undergo review until the end of the academic year. For subsequent cases, the above subjects shall follow the provisions of this Decree.
Article 10. Effectiveness and Responsibility for Implementing the Decree
1. This Decree takes effect from July 1, 2017.
2. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree./.
