Circular No. 57/2025/TT-BXD on announcing maritime port waters and marine areas within the jurisdiction of Nghe An Province and the management area of the Nghe An Marine Transport Port Office

Announcement of Port Waters and Maritime Areas within the Administrative Boundaries of Nghe An Province and under the Management of the Nghe An Maritime Branch
and the management area of the Quang Vu Hang Hai Nghe An (Nghệ An Maritime Branch)

Pursuant to the Vietnam Maritime Code on November 25, 2015;

Pursuant to Decree No. 58/2017/NĐ-CP dated May 10, 2017 of the Government detailing certain provisions of the Vietnam Maritime Code on maritime activity management and subsequent amendments and supplements;

Pursuant to Decree No. 33/2025/NĐ-CP dated March 1, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

At the proposal of the Director of the Vietnam Maritime and Inland Waterway Administration;

The Minister of Construction hereby issues this Circular announcing the port waters and maritime areas within the administrative boundaries of Nghe An Province and under the management of the Nghe An Maritime Branch.

Article 1. Announcement of Port Waters within the Administrative Boundaries of Nghe An Province

The port waters within the administrative boundaries of Nghe An Province, measured at the highest tidal level, include the following areas:

1. Dong Hoi Area with the scope:

a) Seaward boundary: delimited by straight lines connecting points from DH1 to DH5, with the following coordinates:

DH1: 19°17'16,6"N, 105°48'10,3"E;
DH2: 19°16'31,6"N, 105°50'24,3"E;
DH3: 19°13'21,6"N, 105°53'05,3"E;
DH4: 19°12'21,6"N, 105°53'05,3"E;
DH5: 19°12'21,6"N, 105°43'59,3"E.

b) Landward boundary: from point DH1 running along the coast of Quynh Lap Commune southwards, continuing through a straight line connecting two points HM1 with coordinates: 19°13'37,6"N, 105°45'20,3"E and HM2 with coordinates: 19°13'58,8"N, 105°45'15,4"E (Hoang Mai River mouth), running along the coast of Quynh Phuong Commune to point DH5.

2. Cu Lo - Ben Thuy Area with the scope:

a) Seaward boundary: delimited by straight lines connecting points NA1 to NA5, with the following coordinates:

NA1: 18°52'55,6"N, 105°40'24,3"E;
NA2: 18°52'55,6"N, 105°50'53,3"E;
NA3: 18°46'15,6"N, 105°50'53,3"E;
NA4: 18°46'15,6"N, 105°46'19,3"E (south bank of Cu Hoai River);
T1: 18°46'02,5"N, 105°45'48,5"E (center of Cu Hoai - Ben Thuy Channel);
NA5: 18°45'52,6"N, 105°45'25,3"E (north bank of Cu Hoai River).

b) Landward boundary in the Cau Cam area: from point NA1 running along the coast southwards to Cau Cam River, then along the right bank of Cau Cam River (from sea inland), passing through the lower reaches of Nghia Quang Dam to the left bank of the river (from sea inland), continuing towards the sea, passing through Cu Lo Port, running along the coast of Cu Lo Town to point NA5;

c) Landward boundary in the Lam River area: From point NA5 and point T1 with coordinates: 18°46'02,5"N, 105°45'48,5"E (center of Cu Hoai - Ben Thuy Channel) running along the centerline of the channel and the right bank of Lam River (from sea inland) upstream to a transverse line across the river, 200 meters upstream from the upper end of Bridge No. 06 - Ben Thuy Port.

3. The boundaries of the port waters within the administrative boundaries of Nghe An Province specified in this Circular are determined on nautical charts issued by the Vietnam Ship Safety Assurance Corporation, including VN30005 and VN40014 updated to the latest version in 2025. The coordinates of the points specified in this Circular are based on the VN-2000 coordinate system and are converted to the WGS-84 coordinate system as set out in the Appendix attached to this Circular.

Article 2. Maritime Areas within the Administrative Boundaries of Nghe An Province

The port waters within the administrative boundaries of Nghe An Province consist of two maritime areas:

1. Dong Hoi Maritime Area.

2. Cu Lo - Ben Thuy Maritime Area.

Article 3. The area under management of the Port Maritime Administration of Nghe An Province

The Port Maritime Administration of Nghe An Province manages state administrative affairs in the maritime sector at seaports within the territory of Nghe An Province, maritime areas specified in Article 2 of this Circular, and the Xuan Hai maritime area within the waters of the seaport of Ha Tinh Province as defined in Clause 2, Clause 3, Article 1 and Clause 2, Article 2 of Circular No. 54/2025/TT-BXD dated December 23, 2025 issued by the Minister of Construction to announce the waters of the seaport and maritime areas within the territory of Ha Tinh Province and the management area of the Port Maritime Administration of Ha Tinh Province.

Article 4. Implementation provisions

1. This Circular takes effect from February 15, 2026.

2. Repeal Circular No. 26/2016/TT-BGTVT dated October 11, 2016 issued by the Minister of Transport to announce the waters of the seaport within the territory of Nghe An Province and the management area of the Port Maritime Administration of Nghe An Province.

3. Repeal item number 06 in the Appendix List of Maritime Areas within the Management Scope of the Port Maritime Administrations issued together with Circular No. 32/2019/TT-BGTVT dated September 4, 2019 issued by the Minister of Transport to announce the List of Maritime Areas within the Management Scope of the Port Maritime Administrations.
