Part I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular applies to agencies managing training, examination, and issuance of driver's licenses; driving schools, examination centers; organizations and individuals related to training, examination, and issuance of motor vehicle driver's licenses throughout the country.

Article 2. Applicability

This Circular does not apply to the training, examination, and issuance of driver's licenses for the police and military forces performing security and defense duties.

1. Trucks, specialized trucks, and specialized vehicles are defined types of motor vehicles as specified in standards TCVN 6211: 2003, TCVN 7271: 2003.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

2. Tractors are a type of road motor vehicle with four wheels driven by an engine, used to pull a trailer carrying goods.

3. Small tractors are a type of road motor vehicle with an engine, connected to a cargo body through a joint, steered by a tiller or steering wheel, with four wheels (two from the tractor and two from the cargo body).

4. The designed load capacity of specialized trucks and specialized vehicles refers to the designed load capacity of similar trucks.

5. The load capacity of trucks used for practice driving is understood as the load capacity according to the manufacturer's design.

6. A driver's license is a certificate issued to a person operating a motor vehicle (driver) allowing them to drive one or more types of motor vehicles.

7. Driving experience time is the period during which a licensed driver has operated the type of vehicle listed on their driver's license.

8. A professional driver is a person who earns a living from driving.

9. The maximum number of trainees for automobile driving training at any given time (per day) is determined by the total number of trainees trained in various categories of driver's licenses (including both theoretical and practical training).

10. Driver's license serial number is a code specified by the manufacturer, recorded on the back of the driver's license, consisting of two letters and subsequent numbers to identify an individual driver's license.

Part II

DRIVER TRAINING MANAGEMENT

PART I

STANDARDS, TASKS AND LIMITATIONS OF DRIVING SCHOOLS

Section 1

Article 4. Driving Schools

1. Driving schools are established by competent authorities, have the function of training drivers and meet technical and professional standards as prescribed in this Circular.

2. Driving schools for automobiles must comply with the planning of the Ministry of Transport.

Article 5. Technical and Professional Standards of Driving Schools

Driving schools must meet the following standards:

1. Specialized classrooms

a) Specialized classrooms must ensure a minimum area of 50 square meters.

b) Driving schools for automobiles must have all specialized classrooms including: Road Traffic Law, Vehicle Construction and Routine Maintenance, Driving Techniques, Transportation Operations, Driver Ethics and Road Safety Culture (which can be combined with Transportation Operations classroom); Practical Maintenance and Repair Classroom; driving schools for motorcycles of category A3, A4 may share these specialized classrooms.2;

c) Driving schools for automobiles with a capacity of 500 trainees or more must have at least two Road Traffic Law classrooms and two Driving Techniques classrooms; with a capacity of 1,000 trainees or more must have at least three Road Traffic Law classrooms and three Driving Techniques classrooms.

c) Driving schools for two-wheeled motorcycles of categories A1, A2 must have one shared classroom for Road Traffic Law and Driving Techniques.

2. Road Traffic Law Classroom

a) Must have audio-visual equipment (screens, projectors), traffic signs, and diagrams.

b) Driving schools for automobiles or categories A3, A4 must have a computer-based Road Traffic Law classroom including: server, printer, and at least ten computers; schools with a capacity of 500 trainees or more must have at least twenty computers; schools with a capacity of 1,000 trainees or more must have at least thirty computers networked and installed with theoretical learning and examination software transferred by the Vietnam Highway Administration.

3. Vehicle Construction and Routine Maintenance Classroom

a) Must have models of cutaway engines, power transmission systems; electrical system models.

b) Must have diagrams or drawings describing the construction and operation principles of engines, power transmission systems, suspension systems, braking systems, steering systems.

4. Driving Techniques Classroom

a) Must have audio-visual aids for teaching (tapes, lights...).

b) Must have diagrams or drawings illustrating basic driving techniques (adjusting the driver's seat, sitting posture, holding the steering wheel...).

c) Must have cars equipped safely for cold and hot shift practice (can be arranged separately).

5. Transportation Operations Classroom

a) Must have charts and tables serving the teaching of specialized professional knowledge on cargo and passenger transportation.

b) Must have drawings of symbols on packages.

6. Practical Maintenance and Repair Classroom

a) Must have ventilation and lighting systems ensuring safety and hygiene requirements.

b) Floor must not cause dust, cracks, or slipperiness.

c) Must have specialized tools for maintenance and repair.

d) Must have operational engine assemblies, power transmission systems, steering systems, electrical systems.

đ) Must have disassembly and assembly benches, charts, chairs for teaching and practice.

7. Teaching Management Room

Must have a schedule of training programs, annual progress, desks, and necessary equipment for training managers.

8. Teacher Preparation Room (may be combined with the teaching management room)

Must have sufficient desks, chairs, boards, and cabinets for storing teaching materials and equipment.

9. General Standards for Driving Instructors

a) Must have good moral character and ethics.

b) Must meet health requirements.

b) Having sufficient health as prescribed;

c) Hold a teaching profession certificate, except for those who have graduated from colleges or universities specializing in education or technical education.

10. Standards for theoretical instructors

In addition to the general standards stipulated in Clause 9 of this Article, the following standards must also be met:

a) Hold a diploma at the college level or higher and possess computer proficiency level A or higher;

b) Instructors teaching traffic law courses must hold a driver's license for automobiles; instructors teaching driving techniques must hold a driver's license corresponding to the category of vehicle being trained or higher.

11. Standards for practical instructors

In addition to the general standards stipulated in Clause 9 of this Article, the following standards must also be met:

a) Hold a diploma at the college level or higher or possess a vocational skills certificate to teach basic level (except for instructors already certified to teach practical driving);

b) Instructors teaching categories A1, A2, A3, A4 driving must hold a driver's license corresponding to the category. Instructors teaching automobile driving must hold a driver's license corresponding to or higher than the training vehicle category, but not lower than category B2; instructors teaching categories B1, B2 must have at least three years of driving experience; instructors teaching categories C, D, E, and F must have at least five years of driving experience;

c) Must have completed training on practical driving instruction according to the program issued by the Vietnam Highway Corporation and obtained a certificate of practical driving instructor according to the model specified in Appendix 1a and Appendix 1b accompanying this Circular.

12. Training Vehicles

a) Must have sufficient training vehicles corresponding to the training volume recorded in the driving training permit;

b) Must be owned by the driving training institution. Contracted vehicles may be used with a term of one year or longer, up to a maximum of 50% of the number of owned vehicles of the same category for training vehicles of categories A3, A4, B1, B2, C, D, E; for training vehicles of category FC, contracted vehicles may be used with terms and quantities appropriate to the training needs;

c) Driving training institutions for automobiles must have automatic transmission vehicles owned or under contract that meet the training requirements, as prescribed in the content and program;

d) Institutions performing both training and examination functions may use examination vehicles for driving instruction but must ensure pre-examination practice and reinforcement time for trainees and examination schedules set by provincial transportation departments; the use of examination vehicles for driving instruction shall be confirmed by the examination center management department but shall not exceed 50% of the examination vehicle usage time;

đ) Automobile cargo trucks for training categories B1, B2 must have a carrying capacity of 1,000 kg or more, with a quantity not exceeding 30% of the total number of training vehicles of the same category of the training institution;

e) Must have a valid safety and environmental protection inspection certificate for motor vehicles;

g) Must have a secondary braking system located on the instructor's seat, securely constructed, convenient, safe, and ensuring effective braking during use;

h) The truck body must have a rain and sun cover and a secure seating arrangement for students;

i) Both sides of the doors or both sides of the vehicle body, including contracted vehicles, must display the name of the training institution, the direct managing authority, and contact phone numbers according to the model specified in Appendix 2 accompanying this Circular;

k) Motor vehicles must have two "DRIVING TRAINING" signs according to the model specified in Appendix 3 accompanying this Circular;

l) Three-wheeled motorcycles and small tractors with a carrying capacity up to 1,000 kg must have two "DRIVING TRAINING" signs according to the model specified in Appendix 3 accompanying this Circular;

m) Must have a training vehicle permit issued by the Vietnam Highway Corporation or the provincial transportation department when meeting the conditions stipulated in Points b, c, d, đ, e, g, h, i, k, l of this Clause. The model of the training vehicle permit is specified in Appendix 4a and Appendix 4b accompanying this Circular.

13. Driving Training Grounds

a) Must be under the control of the driving training institution. If renting a training ground, there must be a contract with a term equal to or longer than the training permit term;

b) Driving training institutions for automobiles with a training volume of 1,000 students or more must have at least two training grounds as prescribed;

c) Automobile training grounds must have a complete set of road traffic signs, sufficient scenarios for each lesson according to the training program content; the size of the training areas must comply with the examination center standards for each corresponding vehicle category;

d) The ground surface must have adequate elevation and drainage systems to prevent waterlogging; the surfaces of lanes and training areas must be paved with asphalt or cement, and must have sufficient lane markings; the training areas for automobile driving must be bordered;

đ) Must have waiting rooms and seating for practical training students;

14. Minimum Area of Training Grounds

15. Driving Training Routes

Driving training routes for automobiles, as defined by the Vietnam Highway Corporation or the provincial transportation department, must include various traffic scenarios suitable for the training program content such as straight roads, narrow roads, uphill roads, roundabout roads, bridges, city streets, towns, and townships. The training route (including those in other provinces or cities) must be clearly stated in the training vehicle permit.

16. Determining the Training Volume for Automobile Drivers

Based on ensuring conditions for classrooms, training grounds, instructor staff, and administrative personnel, the training volume for each category of driver's license is determined by multiplying the number of training vehicles of that category by the number of students allowed per vehicle and then by a factor of 2. The number of students undergoing practical training at any given time must not exceed the capacity of the training vehicles of each category of the training institution.

Article 6. Tasks and Authorities of Driving Training Institutions

1. Organize admissions for driving license categories permitted to train, ensuring conditions for learners as stipulated in Article 8 of this Circular.

2. Sign and terminate training contracts with automobile driving learners.

3. Publicize the admission regulations and management rules of the driving training institution.

4. Organize new training and upgrade driving license category training according to the volume, duration, location, and license category specified in the driving training permit.

5. Be allowed to conduct training on days off, holidays, and outside regular working hours for those who need it, but must ensure the prescribed content, program, and time.

6. Register examination periods as prescribed.

7. Maintain and enhance facilities and equipment serving teaching and learning to improve driving training quality.

8. Store training-related files and documents.

9. Ensure that practical driving instructors wear the "Driving Instructor" badge, and learners practicing on the road wear the "Driving Learner" badge. Badges are issued and managed by the driving training institution according to the models specified in Appendix 5a and Appendix 5b promulgated together with this Circular.

10. Organize examinations and issue primary certificates or training certificates for automobile and tractor drivers of category A4.

11. Collect and use tuition fees for driving training in accordance with current regulations.

12. Recruit, manage, and organize professional skill enhancement for instructors to meet established standards.

13. Report registration for examinations

a) For categories A1 and A2 driving training: the training institution prepares an examination registration report according to the model specified in Appendix 6 promulgated together with this Circular, and sends it to the examination management authority and driving license issuing body at least four working days before the examination period; the report must bear the training institution's official seal.

b) For categories A3, A4, B1, B2, C, D, E, and F driving training: the training institution prepares an examination registration report, student list (report 1), list requesting verification of previously issued licenses (for license upgrades), and course training plan according to the models specified in Appendices 7a, 7b, 7c, and 8 promulgated together with this Circular, and sends them to the examination management authority and driving license issuing body immediately after the course commencement for categories A3 and A4; not later than seven days after the course commencement for categories B1, B2, D, E, and F; and not later than fifteen days after the course commencement for category C; the report must bear the training institution's official seal.

c) Report 1 is sent via postal service and data transmission through the driving license information system to the Vietnam Highway Administration or the Department of Transport as prescribed; the Examination Management Board Director checks and signs each page.

Article 7. Training Materials and Management Documents of Driving Training Institutions

1. Teaching materials for driving instruction issued by the Vietnam Highway Administration.

2. Forms and record books used by automobile driving schools include:

a) Training plan according to the model specified in Appendix 8 promulgated together with this Circular;

b) Progress of automobile driving training for various categories according to the model specified in Appendix 9 promulgated together with this Circular;

c) Logbook for practical driving training according to the model specified in Appendix 10 promulgated together with this Circular;

d) Attendance book; theoretical lesson plan book; practical lesson plan book; certificate issuance logbook and training certificate logbook as prescribed by the Ministry of Labor, Invalids, and Social Affairs.

3. Driving training institutions for category A4 use the logs specified in points c and d of Clause 2 of this Article.

4. Driving training institutions for motorcycle categories A1, A2, and A3 use theoretical lesson plan books, practical lesson plan books, and student lists for examination registration.

5. Record retention period

a) Indefinite for certificate issuance logbooks and training certificate logbooks;

b) Two years for final exam papers and remaining documents;

c) Disposal of expired documents in accordance with current regulations.

Section 2

DRIVING STUDENTS

Article 8. Conditions for persons learning to drive

1. Vietnamese citizens or foreigners permitted to reside or work, study in Vietnam.

2. Be of age (as of the date of the driving license examination), meet health and cultural education requirements as prescribed; for persons learning to upgrade their driving licenses, they may study ahead but can only take the examination when they meet the age requirement as prescribed.

3. Persons learning to upgrade their driving licenses must have sufficient driving time or practice period and safe driving distance as follows:

a) From Class B1 (automatic) to Class B1: at least one year of driving experience and over 12,000 kilometers of safe driving;

b) From Class B1 to Class B2: at least one year of driving experience and over 12,000 kilometers of safe driving;

c) From Classes C, D, E to Class FC: at least one year of practice period and over 50,000 kilometers of safe driving;

d) From Class B2 to Class C, from Class C to Class D, from Class D to Class E; from Classes B2, D, E to Class F respectively: at least three years of practice period and over 50,000 kilometers of safe driving;

đ) From Class B2 to Class D, from Class C to Class E: at least five years of practice period and over 100,000 kilometers of safe driving.

4. Persons learning to upgrade their driving licenses to Classes D and E must hold a secondary school graduation certificate or equivalent or higher.

Article 9. Training Forms

1. Persons requiring a driving license for Classes A1, A2, A3, A4, B1 may self-study theoretical subjects, but must register at a training institution authorized to train for review, testing; for Classes A4, B1, they must be tested and issued a training completion certificate.

2. Persons requiring a driving license for Classes B2, C, D, E and driving licenses for Classes F must be trained centrally at an authorized training institution and must be tested and issued a basic training completion certificate or a training completion certificate.

Article 10. Application Files of Persons Learning to Drive

1. Persons learning to drive for the first time establish one application file, submitted directly to the training institution. The file includes:

a) An application form for learning and taking the examination to obtain a driving license according to the model prescribed in Appendix 11 attached to this Circular;

b) A copy of the identity card or passport with the identity card number still valid for Vietnamese citizens; passport still valid for foreigners and Vietnamese citizens residing abroad;

c) A health certificate issued by a competent medical facility according to regulations.

2. Persons learning to upgrade their driving licenses establish one application file, submitted directly to the training institution. The file includes:

a) Documents stipulated in Clause 1 of this Article;

b) A declaration of the practice period and safe driving distance according to the model prescribed in Appendix 12 attached to this Circular and must bear responsibility for the content declared before the law;

c) A copy of the secondary school graduation certificate or equivalent or higher certificate for cases upgrading driving licenses to Classes D and E (presenting the original when checking the examination application file);

d) A copy of the driving license (presenting the original when taking the examination and receiving the driving license).

When submitting the application file, the person learning to drive will be photographed directly by the training institution and retained in the driving license database.

Section 3

STANDARDS, TASKS AND LIMITATIONS OF DRIVING SCHOOLS

Article 11. Vietnam Highway Administration

1. The Vietnam Highway Administration is assigned by the Ministry of Transport the task of uniformly managing driver training throughout the country.

2. To develop plans for training institutions to be submitted to the Ministry of Transport for issuance; to develop training programs, forms, and business records to serve driver training work.

3. To inspect and audit management and training activities.

4. To issue training textbooks and guide uniform implementation nationwide.

5. To reissue driving training licenses for motor vehicles; to issue certificates of instructors teaching practical driving, and driving practice vehicle permits for training institutions directly managed by the Vietnam Highway Administration.

6. To issue content and programs for refresher courses; to organize refresher courses and issue certificates of improved instructors teaching practical driving according to the model prescribed in Appendix 1c attached to this Circular for the national team of practical driving instructors.

7. To implement training management work for training institutions assigned by the Ministry of Transport and store documents as prescribed in Clause 6, Article 12 of this Circular.

Article 12. Department of Transport

1. Shall be responsible for managing driver training within the province or centrally governed city.

2. Approve investment proposals for building new automobile driving schools based on the planning of the Ministry of Transport.

3. Periodically or unexpectedly inspect and supervise driver training activities, issue certificates to driving schools.

4. Issue new or renewed licenses for driving schools to conduct driver training, send copies of issued training licenses along with inspection reports to the Vietnam Highway Corporation.

5. Issue practice vehicle permits; organize training and issue certificates for practical driving instructors according to prescribed content and programs.

6. Store the following documents:

a) List of practical driving instructors according to the model specified in Appendix 13c issued together with this Circular;

b) Record book for issuing practice vehicle permits according to the model specified in Appendix 13d issued together with this Circular;

c) Inspection report of the training institution.

Article 13. Procedures for Issuing Certificates for Practical Driving Instructors

1. Individuals or training institutions shall prepare one set of application documents and submit directly or through postal service or other appropriate means to the Department of Transport or the Vietnam Highway Corporation. The application includes:

a) Application form according to the model specified in Appendix 13a issued together with this Circular;

b) Driver's license (original for verification or certified copy);

c) Graduation certificate from a college level or higher or vocational skill certificate (original for verification or certified copy);

d) Health certificate issued by a competent medical facility as prescribed;

đ) Teaching credential (original for verification or certified copy);

e) Two color photographs measuring 3 cm x 4 cm on blue background, similar to identity card photos;

g) List of instructors applying for practical driving instructor certificates.

2. The Department of Transport or the Vietnam Highway Corporation shall accept individual applications or lists prepared by training institutions according to the model specified in Appendix 13b issued together with this Circular; review and organize training. If individuals do not meet the requirements, the Department of Transport or the Vietnam Highway Corporation must respond in writing and specify the reasons.

Within no more than three working days from the date of successful completion of the training, the Department of Transport or the Vietnam Highway Corporation shall issue a practical driving instructor certificate, record it in the tracking book according to the model specified in Appendix 13c issued together with this Circular.

3. The practical driving instructor certificate has a validity period of five years. The procedures for reissuing the certificate upon expiration follow the provisions of points a, b, d of Clause 1 and Clause 2 of this Article.

4. When a practical driving instructor transfers to a new training institution, the Department of Transport or the Vietnam Highway Corporation shall retrieve and exchange the practical driving instructor certificate according to the name of the new training institution, record it in the tracking book according to the model specified in Appendix 13c issued together with this Circular; notify the issuing authority of the practical driving instructor certificate.

Article 14. Procedure for Issuing Driving School Practice Vehicle Permits

1. The training institution shall prepare and submit one set of documents directly or through postal service or other appropriate means to the Vietnam Road Administration or the Department of Transport under the management authority for examination and issuance of permits. The documents include:

a) A list of vehicles applying for driving school practice vehicle permits according to the form prescribed in Appendix 13d issued together with this Circular;

b) Documents for application of driving school practice vehicle permits including copies of vehicle registration certificates, copies of valid safety and technical inspection certificates for motor vehicles, and copies of valid compulsory liability insurance certificates.

2. Within no more than three working days from the date of receipt of complete documents as stipulated, the Department of Transport or the Vietnam Road Administration shall issue driving school practice vehicle permits to the training institution according to the forms prescribed in Appendices 4a and 4b issued together with this Circular. The validity period of the driving school practice vehicle permit corresponds to the permitted circulation time of the practice vehicle. In case of non-issuance, a written response must be provided with clear reasons stated.

3. The reissue of driving school practice vehicle permits upon expiration shall be carried out in accordance with the provisions of Clause 1 and Clause 2 of this Article.

Article 15. Procedure for Issuing New Driving School Training Licenses

1. Organizations or individuals requiring such services shall prepare and submit one set of documents requesting approval for the establishment of new driving school facilities directly or through postal service or other appropriate means to the Department of Transport. The documents include:

a) A request document for approval to establish a new driving school facility;

b) A project for establishing a driving school facility, which must include location, area, scale, training capacity, number of instructors, and number of training vehicles;

c) An approval document from the local land management agency for the construction of the training facility.

2. The procedure for examining and processing applications for approval to establish new driving school facilities is as follows:

a) If the documents are incomplete according to regulations, within no more than two working days from the date of receiving the documents, the Department of Transport must provide direct guidance or written instructions to organizations or individuals;

b) Within no more than ten working days from the date of receiving complete documents as stipulated, based on the actual training needs of the locality and the planning of training facilities by the Ministry of Transport, the Department of Transport shall examine and issue a written approval to the organization or individual. In case of disapproval, a written response must be provided with clear reasons stated.

3. Upon approval, organizations or individuals shall proceed with the construction and completion of technical and professional standards of the driving school, prepare and submit one set of documents requesting issuance of new driving school training licenses directly or through postal service or other appropriate means to the Department of Transport. The documents include:

a) A letter accompanied by a report requesting issuance of a driving school training license according to the form prescribed in Appendix 14 issued together with this Circular;

b) Copies of the Department of Transport's approval document for the establishment of a new driving school facility;

c) Certified copies or copies with original documents for verification of the decision establishing the vocational education institution with the function of driving school training by the competent authority;

d) Certified copies or copies with original documents for verification of valid instructor teaching practical driving certificates;

e) Certified copies or copies with original documents for verification of vehicle registration certificates; copies of valid safety and technical inspection certificates for motor vehicles; copies of valid driving school practice vehicle permits.

4. The Department of Transport shall examine the application for issuance of new driving school training licenses and carry out the following procedures:

a) If the documents are incomplete according to regulations, within no more than two working days from the date of receiving the documents, the Department of Transport must provide direct guidance or written instructions to organizations or individuals;

b) Within no more than ten working days from the date of receiving the documents as stipulated, the Department of Transport shall lead and coordinate with the local vocational training management agency to conduct an on-site inspection of the training facility, prepare a record according to the form prescribed in Appendix 15a issued together with this Circular;

c) Within no more than five working days from the end of the inspection, if the conditions are met, the Department of Transport shall issue new driving school training licenses to the training facility. In case of non-issuance, a written response must be provided with clear reasons stated.

Article 16. Procedures for Reissuing Driving School Training Licenses for Cars

1. The driving school training license for cars shall be reissued when it expires, when the category of vehicles to be trained is adjusted, or when the training capacity is adjusted.

2. Documents for reissuance upon expiration or adjustment of vehicle categories or training capacity

The training institution prepares one set of documents to submit directly, through postal service, or by other appropriate means to the Department of Transport or the Vietnam Highway Corporation. The documents include the components specified in points a and d, đ Clause 3, Article 15 of this Circular (only supplementing contents that have changed since the last issuance).

3. Within no more than five working days from the date of receiving complete documents as prescribed, the Department of Transport or the Vietnam Highway Corporation will coordinate with the vocational training management agency to conduct on-site inspections of the training institution and prepare inspection records according to the model stipulated in Appendix 15b issued together with this Circular.

4. Within no more than three working days from the end of the inspection, the Department of Transport or the Vietnam Highway Corporation will reissue the driving school training license for cars to the training institution. In cases where the license is not issued, a written response must be provided with clear reasons stated.

5. The acceptance of documents and delivery of results shall be conducted at the office of the authority or through postal service or by other appropriate means.

Article 17. Procedures for Issuing New Driving School Training Licenses for Categories A, A2, A3, and A41, A2, A3 and A4

1. The training institution prepares one set of documents to submit directly, through postal service, or by other appropriate means to the Department of Transport. The documents include:

a) A letter accompanied by a report requesting issuance of a driving school training license according to the form prescribed in Appendix 14 issued together with this Circular;

b) A certified copy or a copy accompanied by the original for verification of the decision establishing the vocational education institution with the function of training drivers, issued by the competent authority;

c) A certified copy of the certificate of practical driving instructor;

d) A certified copy of the vehicle registration certificate of the practice car for categories A3 and A4.

2. Within no more than five working days from the date of receiving complete documents as prescribed, the Department of Transport will organize on-site inspections of the training institution and prepare inspection records according to the model stipulated in Appendix 16 issued together with this Circular.

3. Within no more than five working days from the end of the inspection, the Department of Transport will issue the driving school training license for the training institution. In cases where the license is not issued, a written response must be provided with clear reasons stated.

Article 18. Procedures for Reissuing Driving School Training Licenses for Categories A1, A2, A3 and A4

1. Fifteen days before the driving school training license expires, the training institution prepares one set of documents requesting reissuance of the license, to be submitted directly, through postal service, or by other appropriate means to the Department of Transport. The documents include:

a) A letter with attached report requesting reissuance of the driving school training license according to the model stipulated in Appendix 14 issued together with this Circular;

b) A certified copy of the certificate of practical driving instructor (only supplementing contents that have changed since the last issuance);

c) A certified copy of the vehicle registration certificate of the practice car for categories A3 and A4 (only supplementing contents that have changed since the last issuance).

2. Within no more than three working days from the date of receiving complete documents as prescribed, the Department of Transport will organize on-site inspections of the training institution and prepare inspection records according to the model stipulated in Appendix 16 issued together with this Circular.

3. Within no more than five working days from the end of the inspection, the Department of Transport will reissue the driving school training license for the training institution. In cases where the license is not issued, a written response must be provided with clear reasons stated.

Article 19. Driver Training Permit

1. The driver training permit shall be in accordance with the model prescribed in Appendix 17a and Appendix 17b attached to this Circular.

2. The validity period of the driver training permit is five years, from the date of issuance.

EXAMINATION AND ISSUE OF DRIVER'S LICENSE

PART I

SYSTEM OF DRIVER'S LICENSES

Article 24. Classification of Driver's Licenses vehicles

1. Class A1 is issued to:

a) Drivers controlling two-wheeled motorcycles with engine displacement from 50 cm3 to less than 175 cm3;

b) People with disabilities controlling three-wheeled motorcycles designed for people with disabilities.

2. Class A2 is issued to drivers controlling two-wheeled motorcycles with engine displacement from 175 cm3 and above, and the types of vehicles specified for Class A1 driver's licenses.

3. Class A3 is issued to drivers controlling three-wheeled motorcycles, the types of vehicles specified for Class A1 driver's licenses, and similar vehicles.

4. Class A4 is issued to drivers controlling small tractors with a maximum load capacity of up to 1,000 kg.

5. Class B1 automatic is issued to non-professional drivers controlling the following types of vehicles:

a) Automatic passenger cars up to 9 seats, including the driver's seat;

b) Automatic trucks, including specialized automatic trucks with a design load capacity under 3,500 kg.

6. Class B1 is issued to non-professional drivers controlling the following types of vehicles:

a) Passenger cars up to 9 seats, including the driver's seat;

b) Trucks, including specialized trucks with a design load capacity under 3,500 kg;

c) Tractors towing a trailer with a design load capacity under 3,500 kg.

7. Class B2 is issued to professional drivers controlling the following types of vehicles:

a) Specialized trucks with a design load capacity under 3,500 kg;

b) The types of vehicles specified for Class B1 driver's licenses.

8. Class C is issued to drivers controlling the following types of vehicles:

a) Trucks, including specialized trucks, specialized trucks with a design load capacity of 3,500 kg or more;

b) Tractors towing a trailer with a design load capacity of 3,500 kg or more;

c) The types of vehicles specified for Class B1, B2 driver's licenses.

9. Class D is issued to drivers controlling the following types of vehicles:

a) Passenger cars from 10 to 30 seats, including the driver's seat;

b) The types of vehicles specified for Class B1, B2, and C driver's licenses.

10. Class E is issued to drivers controlling the following types of vehicles:

a) Passenger cars over 30 seats;

b) The types of vehicles specified for Class B1, B2, C, and D driver's licenses.

11. Holders of Class B1, B2, C, D, and E driver's licenses may tow additional trailers with a design load capacity not exceeding 750 kg when driving corresponding vehicles.

12. Class F is issued to holders of Class B2, C, D, and E driver's licenses to control corresponding vehicles towing trailers with a design load capacity greater than 750 kg, semi-trailers, articulated buses, as follows:

a) Class FB2 is issued to drivers controlling vehicles specified in Class B2 driver's licenses towing trailers and controlling the types of vehicles specified for Class B1 and B2 driver's licenses;

b) Class FC is issued to drivers controlling vehicles specified in Class C driver's licenses towing trailers, tractor units towing semi-trailers, and controlling the types of vehicles specified for Class B1, B2, C, and FB2 driver's licenses;

c) Class FD is issued to drivers controlling vehicles specified in Class D driver's licenses towing trailers and controlling the types of vehicles: articulated passenger buses and the types of vehicles specified for Class B1, B2, C, D, E, FB2, and FD driver's licenses;

d) Class FE is issued to drivers controlling vehicles specified in Class E driver's licenses towing trailers and controlling the types of vehicles: articulated passenger buses and the types of vehicles specified for Class B1, B2, C, D, E, FB2, and FD driver's licenses.

13. The classification of driver's licenses for sleeper coaches and city buses (used for commercial passenger transport by bus) shall be implemented according to the provisions of Clause 9 and Clause 10 of this Article. The number of seats on the vehicle is calculated based on the number of seats on the same type of passenger coach or a vehicle of equivalent size only arranged with seating.

Article 25. Validity period of driving licenses

1. Driving licenses for category A1, A2, A3 have no expiration date.

2. Driving licenses for category B1 have a validity period until the driver reaches 55 years old for females and 60 years old for males; in cases where the driver is over 45 years old for females and over 50 years old for males, the issued driving license will be valid for 10 years from the issuance date.

3. Driving licenses for category A4, B2 have a validity period of 10 years from the issuance date.

4. Driving licenses for categories C, D, E, FB2, FC, FD, FE have a validity period of 5 years from the issuance date.

Chapter II

DRIVING LICENSE EXAMINATION

Section 1

DRIVING LICENSE TESTING CENTER

Article 26. Driving License Testing Center

1. Driving License Testing Centers shall be constructed according to National Technical Regulations, in accordance with the planning approved by the Ministry of Transport and classified as follows:

a) Type 1 Testing Center: tests all categories of driving licenses;

b) Type 2 Testing Center: tests up to category C driving licenses;

c) Type 3 Testing Center: tests up to category A4 driving licenses.

2. Based on the proposal of the Provincial People's Committee, the construction of new Type 1 or Type 2 Testing Centers or upgrading from Type 2 to Type 1 must be approved by the General Department of Vietnam Roads. The construction of new or upgraded driving practice fields to become Type 3 Testing Centers shall be examined and decided by the Department of Transport.

3. The General Department of Vietnam Roads shall organize the inspection and issue certificates for Type 1 and Type 2 Testing Centers meeting operational conditions according to the model prescribed in Appendix 18a attached to this Circular. The Department of Transport shall organize inspections and issue certificates for Type 3 Testing Centers meeting operational conditions according to the model prescribed in Appendix 18b attached to this Circular.

4. Certificates for Type 1, Type 2, and Type 3 Testing Centers are valid for five years. Thirty days before the certificate expires or during operation if there are changes in testing software, scoring equipment, types, or quantities of test vehicles, the Testing Center must submit an application for reissuance of the certificate.

Article 27. Procedures for Issuing New Certificates for Type 1 and Type 2 Testing Centers

1. Approval of the Proposal

a) Organizations or individuals wishing to establish a Testing Center shall send a request letter along with a summary report of the project to the Provincial People's Committee directly or through postal service or other appropriate means;

b) Based on the request of the Provincial People's Committee and in accordance with the planning approved by the Ministry of Transport, within three working days, the General Department of Vietnam Roads shall issue a letter approving the establishment of the Testing Center to the Provincial People's Committee and the organization or individual. In case of disapproval, a written response with reasons must be provided.

2. Approval of Overall Layout and Test Course Dimensions

a) Organizations or individuals shall send a request letter along with three sets of documents directly or through postal service to the Department of Transport. The documents include: investment project, overall layout plan, certified copy of construction permit, design documents for test course dimensions, list of vehicle types used for testing, and automatic scoring equipment;

b) Within five working days from the receipt of complete documents, the Department of Transport shall forward three sets of documents and a request letter to the General Department of Vietnam Roads for approval of the overall layout and test course dimensions of the Testing Center. If not requesting, a written response with reasons must be provided;

c) Within five working days from the receipt of complete documents, the General Department of Vietnam Roads shall issue a letter of approval to the Department of Transport and the organization or individual. In case of disapproval, a written response with reasons must be provided.

3. Inspection and Issuance of Certificate

a) After completion, the Testing Center shall submit a request letter to the Department of Transport for inspection and issuance of a certificate confirming its operational readiness;

b) Within ten working days from the receipt of the request letter, the Department of Transport shall inspect and submit a request letter to the General Department of Vietnam Roads for inspection and issuance of a certificate confirming the Testing Center's operational readiness. If not requesting, a written response with reasons must be provided;

c) Within fifteen working days from the receipt of the request letter, the General Department of Vietnam Roads shall organize the inspection and issue the certificate. If not issuing the certificate, a written response with reasons must be provided.

Article 28. Procedures for Issuing New Driving License Examination Center Certificates Type 3

1. Organizations and individuals with the need shall submit a written request for approval of the proposal to build a driving license examination center type 3 directly or through postal service or by other appropriate means to the Department of Transport.

2. Within three working days, the Department of Transport will review and issue a written approval for the proposal to build a driving license examination center type 3 to the organization or individual. In case of disapproval, a written response must be provided with clear reasons stated.

3. After completion of construction, the organization or individual shall submit a written request along with the required documents to the Department of Transport for issuance of a certificate confirming the examination center meets the operational conditions. The documents include: approval letter for the proposal, investment project, certified copy of the construction permit, overall layout plan, design specifications for the examination course dimensions, and vehicle types used for examinations.

4. Within no more than five working days from the date of receipt of all required documents, the Department of Transport will organize inspections and issue the certificate. If the certificate is not issued, a written response must be provided with clear reasons stated.

Article 29. Procedures for Reissuing Driving License Examination Center Certificates

1. For Driving License Examination Centers Type 1 and Type 2

a) The driving license examination center shall submit a written request for reissuance of the driving license examination center certificate to the Vietnam Highway Corporation (directly or through postal service or by other appropriate means).

b) Within fifteen working days from the date of receipt of the request, the Vietnam Highway Corporation will coordinate with the Department of Transport to conduct inspections and reissue the certificate. If the certificate is not issued, a written response must be provided with clear reasons stated.

2. For Driving License Examination Centers Type 3

a) The driving license examination center shall submit a written request for reissuance of the driving license examination center certificate meeting operational conditions to the Department of Transport (directly or through postal service or by other appropriate means).

b) Within five working days from the date of receipt of the request, the Department of Transport will conduct inspections and reissue the certificate. If the certificate is not issued, a written response must be provided with clear reasons stated.

Article 30. Responsibilities of Driving License Examination Centers

1. Ensure material infrastructure and equipment for testing and scoring according to regulations to achieve accurate and objective examination results; report to the Department of Transport and the Vietnam Highway Corporation when testing equipment and vehicles operate inaccurately, unstably, or when changing such equipment and vehicles for timely handling.

2. Invest in motor vehicles for driving license examinations that meet the following conditions:

a) Vehicles for driving license examinations in simulated courses must be owned by the organization or individual operating the examination center; have a valid safety technical inspection certificate and environmental protection certificate for road motor vehicles; have a valid civil liability insurance certificate and be equipped with auxiliary braking systems installed according to regulations. For category FC driving license examination vehicles, contractual vehicles may be used with suitable duration and quantity based on examination needs.

b) Vehicles for driving license examinations on roads must comply with traffic participation conditions stipulated by the Road Traffic Law; have auxiliary braking systems located on the examiner's seat, securely constructed, convenient, safe, and ensuring effective braking during use; contractual vehicles may be used for at least one year with a quantity not exceeding fifty percent of the owned vehicles of the same category of the organization or individual operating the examination center; two "EXAMINATION" signs must be affixed according to the model specified in Appendix 3 attached to this Circular.

3. Cooperate and create favorable conditions for driving schools to bring trainees for practice and for examination boards to organize examinations smoothly and according to schedule.

4. Comply with and cooperate with competent authorities in inspecting and standardizing driving license examination centers.

5. Publicize examination fee rates and prices for other services.

6. Ensure safety for driving license examinations; coordinate with related units and agencies to resolve incidents when they occur.

7. Implement reporting and publicizing examination schedules on the center’s website, and store examination result files as prescribed.

8. Connect information management networks with the Vietnam Highway Corporation and the Department of Transport.

Section 2

APPLICANTS FOR DRIVING LICENSE EXAMINATIONS

Article 31. Examination Application Documents

1. For first-time applicants for driving license examination

The driving school shall prepare one set of application documents to be directly submitted to the Vietnam Highway Administration or the Department of Transport. The documents include:

a) Documents prescribed in Clause 1 of Article 10 of this Circular;

b) Primary certificate or training certificate for those applying for Class A4, B1, B2, and C driving license examinations;

c) List of examination candidates proposed by the driving school with the names of the candidates.

2. For applicants upgrading their driving licenses to Classes B1, B2, C, D, E, and F

The driving school shall prepare one set of application documents to be directly submitted to the Vietnam Highway Administration or the Department of Transport. The documents include:

a) Documents prescribed in Clause 2 of Article 10 of this Circular;

b) Primary certificate or upgraded training certificate;

c) List of examination candidates proposed by the driving school with the names of the upgraded candidates.

3. For re-examination due to expired driving licenses

The driver shall prepare one set of application documents to be directly submitted to the Vietnam Highway Administration or the Department of Transport. The documents include:

a) Documents prescribed in points b and c of Clause 1 of Article 10 of this Circular;

b) Application form for renewal or replacement of driving license according to the model prescribed in Appendix 27 issued together with this Circular;

c) Copy of the expired driving license.

4. For re-examination due to lost driving licenses

The driver shall prepare one set of application documents to be directly submitted to the Vietnam Highway Administration or the Department of Transport. The documents include:

a) Documents prescribed in point b of Clause 1 of Article 10 of this Circular;

b) Application form for renewal or replacement of driving license according to the model prescribed in Appendix 27 issued together with this Circular, indicating the date of receipt by the receiving authority;

c) Original copy of the original driving license application documents (if available).

Article 32. Retention of Examination Results

An applicant may retain the results of a previous examination for one year if they have met the requirements specified in Article 8 for learners and the examination application documents as stipulated in Article 31 of this Circular, and their name appears on the minutes of absence or failure from the previous examination board or examination team.

Section 3

PROCEDURE FOR DRIVING LICENSE EXAMINATION

Article 33. Content and Procedure of Driving License Examination

1. The examination for issuing automobile driving licenses must be conducted at examination centers that meet the operational conditions (hereinafter referred to as examination centers).

2. The examination for issuing driving licenses of Class A1, A2, A3, and A4 in cities classified as level 2 or higher must be conducted at examination centers meeting the operational conditions; in other areas, it must be conducted at examination grounds equipped with basic facilities, theoretical examination rooms, examination grounds, and motor vehicles for each class of driving license as prescribed by the National Technical Regulations on Motor Vehicle Driving License Examination Centers.

3. Content of Driving License Examination

a) Theoretical examination: includes questions related to traffic laws, driving techniques, and additional content related to vehicle structure and routine maintenance, transportation operations (for Class A3 and A4 licenses); vehicle structure and routine maintenance, driver ethics (for Class B1 automobile licenses); vehicle structure and routine maintenance, transportation operations, and driver ethics (for automobile licenses from Class B2 and above).

Applicants for Class A1 motorcycle licenses who already hold an automobile license issued by the transport sector are exempted from the theoretical examination;

b) Practical examination in a simulated environment for Classes A1 and A2

The examinee must operate a motorcycle through four examination courses: following an "8" shape, passing straight lines, passing lines with obstacles, and passing rough terrain;

c) Practical examination in a simulated environment for Classes A3 and A4

The examinee must operate a vehicle forward through a "chi" shape and reverse in the opposite direction;

d) Practical examination in a simulated environment for Classes B1, B2, C, D, and E

The examinee must follow the correct sequence and operate a vehicle through the examination courses arranged at the examination center such as: starting, stopping to yield to pedestrians, stopping and starting on a slope, passing tire tracks and right-angle turns, passing intersections with traffic lights, passing winding roads, parking (Class B1, B2, and C perform longitudinal parking; Class B1, B2, D, and E perform lateral parking), temporarily stopping at railway crossings, handling emergency situations, changing gears on flat roads, and concluding;

đ) Practical examination in a simulated environment for Classes FB2, FD, and FE

The examinee must operate a vehicle through an examination course: advancing through a shape with five standard poles and returning;

e) Practical examination in a simulated environment for Class FC

The examinee must operate a vehicle through two examination courses: advancing through a shape with five standard poles and returning; longitudinal parking;

g) Practical examination on public roads: the examinee must operate an examination vehicle, handle traffic situations, and follow the instructions of the examiner.

4. Organization of Driving License Examinations

a) Theoretical examination for Class A1 in cities classified as level 2 or higher is conducted on computers; in other areas, it is conducted through paper-based or computer-based multiple-choice tests; the theoretical examination room has cameras monitoring the examination process;

b) Theoretical examination for Classes A2, A3, A4, B1, B2, C, D, E, and F is conducted on computers; the theoretical examination room has cameras monitoring and publicly displaying the examination process;

c) Practical examination in a simulated environment for Classes A1 and A2 in cities classified as level 3 or higher is conducted at examination centers equipped with automatic scoring devices;

d) Practical examination in a simulated environment for Classes F is conducted at examination centers or grounds meeting the conditions within the examination centers;

đ) Practical examination in a simulated environment for Classes B1, B2, C, D, and E is conducted at examination centers equipped with automatic scoring devices, without an examiner sitting in the examination vehicle;

e) Practical examination on public roads applies to Classes B1, B2, C, D, E, and F;

g) Practical examination on public roads for Classes B1, B2, C, D, and E must use automatic scoring devices and have an examiner in the vehicle.

5. The Vietnam Highway Administration shall provide specific guidance on the implementation of driving license examination and issuance in accordance with the regulations.

Article 34. Preparation for the Examination Period

The Examination Management Board shall perform the following tasks:

1. For the examination period for categories A1 and A2 driver's licenses

a) Receive registration reports for the examination to issue motorcycle driver's licenses of categories A1 and A2 sent by training institutions;

b) Check the application files and examinees' conditions in accordance with Articles 31 and 32 of this Circular;

c) Submit to the Director General of the Vietnam Highway Administration or the Director of the Department of Transport for issuing a decision to organize the examination period; establish the Examination Team and the Supervision Team (if applicable).

2. For the examination period for categories A3, A4, B1, B2, C, D, E, and F driver's licenses

a) Receive registration reports for the examination, student lists (report 1), and requests to verify issued driver's licenses from training institutions according to the models prescribed in Appendices 7a, 7b, and 7c attached to this Circular;

b) Receive examination organization request reports accompanied by candidate lists for the examination (report 2) from training institutions according to the models prescribed in Appendices 19a and 19b attached to this Circular. Report 2 must be sent via postal service and data transmission through the driving license information system to the Vietnam Highway Administration or the Department of Transport seven working days before the examination date;

c) Verify the application files and examinees' conditions for issuing driver's licenses of categories A3, A4, B1, B2, C, D, E, and F in accordance with Articles 31 and 32 of this Circular, and ensure that the examinees' names appear in the student list (report 1), candidate list for the examination (report 2), and have verification certificates of issued licenses (for upgrading purposes);

The person assigned to check and approve candidates' application files shall cooperate with the training institution to prepare a verification report of the application files according to the model prescribed in Appendix 19c attached to this Circular.

d) Propose an examination schedule and notify the training institution and examinees;

đ) Submit to the Director General of the Vietnam Highway Administration or the Director of the Department of Transport for approval and issuance of a decision to organize the driver's license examination period; establish the Examination Committee, Examination Team, and Supervision Team (if applicable) according to the model prescribed in Appendix 20a attached to this Circular, along with the candidate list for issuing driver's licenses of the specified categories according to the models prescribed in Appendices 20b and 20c attached to this Circular.

3. For examinations to reissue driver's licenses due to expiration or loss

a) Review and check the conditions as prescribed, prepare a candidate list for the re-examination according to the model prescribed in Appendix 21 attached to this Circular, and submit to the Director General of the Vietnam Highway Administration or the Director of the Department of Transport for issuing a decision to organize the examination together with the examination periods specified in Clauses 1 and 2 of this Article;

b) In cases where there is no suitable examination period, an Examination Committee and Examination Team may be established as prescribed (the committee and team members shall not include representatives from the training institution);

c) For localities without a Category 1 or Category 2 examination center: if only theoretical re-examinations are conducted, they can be organized locally using the examination questions or software provided by the Vietnam Highway Administration; if both theoretical and practical re-examinations are required, they must be conducted at another locality's examination center in accordance with the regulations.

Article 35. Examination Board

1. The Examination Board shall be established by the Director of the Vietnam Highway Administration or the Director of the Department of Transport.

a) The Board must have at least two-thirds of its members present to conduct work, decisions are made by majority vote; in case of equal opinions among members, the decision will follow the conclusion of the Chairman of the Board;

b) The Examination Board shall dissolve itself upon completion of the examination period.

2. Composition of the Examination Council

a) The Chairman of the Board shall be a leader of the Department of Transport or a representative of the examination management board, holding a driver's license for automobiles, possessing knowledge on training, examination, issuance of driver's licenses, authorized by the Director of the Department of Transport or the Director of the Vietnam Highway Administration;

b) Members include: the Director of the driving examination center, the head of the driving training facility, the Head of the Examination Team, and the secretary member; the secretary member is from the Examination Management Board under the Department of Transport or the Vietnam Highway Administration.

3. Duties of the Examination Board

a) Directing inspections and requiring completion of conditions for organizing the examination period;

b) Assigning and scheduling plans for the implementation of the examination period;

c) Publicizing and guiding regulations and examination rules, announcing examination fees, licensing fees, and necessary regulations for examiners and candidates;

d) Organizing the examination period according to regulations;

đ) Preparing records to handle violations according to the authority granted and reporting to competent authorities;

e) Requesting training facilities and candidates to compensate for damages if accidents occur (caused by candidate errors) during practical driving examinations;

g) Summarizing the results of the examination period and signing to confirm the record;

h) Sending and storing examination-related documents at the training facility, driving examination center, and Examination Management Board.

Article 36. Examination Team

1. The Examination Team shall be established by the Director of the Vietnam Highway Administration or the Director of the Department of Transport.

a) The Examination Team is directly supervised by the Examination Board. The Examination Team issuing Class A1, A2 licenses is directly supervised by the Examination Management Board;

b) The Examination Team shall dissolve itself upon completion of the examination period.

2. The Examination Team consists of a Team Leader and examiners.

a) The Team Leader is an examiner and a member of the Examination Management Board under the Department of Transport or the Vietnam Highway Administration; for automobile driving examinations, they must hold an automobile examiner card;

b) Examiners are employees of the Vietnam Highway Administration, the Department of Transport (excluding inspectors and transport inspectors), and instructors from driving training facilities. Instructors from driving training facilities must have at least three years of continuous teaching experience and insurance coverage, and cannot examine students trained directly by their own facility;

3. Standards for Examiners:

a) Good moral character;

b) Hold a college degree or higher. For examiners who already had a card before this Circular takes effect, if they do not meet this standard, they must complete it within five years;

c) Hold a valid driver's license corresponding to the vehicle category being examined for at least three years;

d) Undergo training in examination procedures and be issued an examiner card by the Director of the Vietnam Highway Administration;

4. The examiner card has a validity period of three years, following the model prescribed in Appendix 22 attached to this Circular.

5. Duties of the Examination Team

a) Inspect vehicles, scoring equipment, examination grounds, and safety measures during the examination process;

b) Require candidates to comply with examination regulations and rules; prevent unauthorized persons from entering the theoretical examination room or examination ground;

c) Prepare records and handle violations within the scope of assigned duties or report to the Examination Board;

d) Conduct examinations, compile results, evaluate the examination period, and report to the Examination Board or the Examination Management Board (for Class A1, A2 license examinations);

đ) Examiners are directly responsible for examination results. The Team Leader of the Examination Team is responsible for the overall results of the examination period;

e) When performing duties, examiners must wear uniforms as directed by the Vietnam Highway Administration.

Article 37. Procedures for organizing examinations

1. Holding the Examination Council meeting and opening the examination period

a) Prior to organizing the examination, the Chairman of the Examination Council shall convene a meeting with the Examination Team, the Supervision Team (if any), and assign tasks to each member for the examination period;

b) Organize the opening ceremony of the examination period to announce the decision on organizing the examination period and disseminate relevant contents of the examination period to those participating in the examination.

2. Conduct examinations according to the examination content and procedures.

3. Conclusion of the examination period

a) For the examination periods for driving categories A3, A4, B1, B2, C, D, E, and F: The Chairman of the Examination Council shall convene a meeting with the Examination Council, the Examination Team, the Supervision Team (if any). The Head of the Examination Team shall report on the examination results and jointly sign the consolidated examination result record according to the model prescribed in Appendix 23a issued together with this Circular. The Chairman of the Examination Council shall sign and stamp the consolidated examination result record for successful candidates according to the model prescribed in Appendix 23a;

b) For the examination periods for motorcycle driving categories A1 and A2: The Head of the Examination Team shall convene a meeting with members of the Examination Team, the Director of the Driving Training Center, the Supervision Team (if any) to review the examination results and jointly sign the consolidated examination result record according to the model prescribed in Appendix 23b issued together with this Circular. The Head of the Examination Management Board shall sign and stamp the agency's confirmation on the consolidated examination result record for successful candidates according to the model prescribed in Appendix 23b.

The consolidated examination result record is the original file, to be handed over to the successful candidates for safekeeping.

Article 38. Supervision of the examination period

1. Based on actual circumstances, the Vietnam Highway Administration and the Department of Transport organize surprise supervision of the examination period.

2. Examination supervisors are inspection officials from the Vietnam Highway Administration or inspection officials and inspectors from the Department of Transport. The number of supervisors for motorcycle driving examinations is two persons, and for automobile driving examinations, it is three persons, including one inspector as the Team Leader.

3. When performing supervision duties during examination periods, supervisors must wear uniforms as prescribed.

4. Tasks of the Supervision Team when conducting driving examinations at examination centers equipped with automatic scoring devices

a) Supervise the implementation of the examination content and procedures by the Examination Council and the Examination Team; ensure transparency, fairness, and impartiality throughout the examination process;

b) Supervise the identification check of examination participants before entering the theoretical examination room and practical driving examination rooms in simulators and on roads; unauthorized personnel are not allowed to enter the theoretical examination room;

c) Supervise the adherence to permitted routes for organizing road driving examinations; monitor and collect information related to the examination period;

d) Supervisors work independently, do not enter the theoretical examination room, do not board the examination vehicle, and do not perform the duties of an examiner.

5. Tasks of the Supervision Team when conducting driving examinations at examination centers not equipped with automatic scoring devices

In addition to the tasks stipulated in points a, b, and d of Clause 4 of this Article, supervise the preparation of theoretical examination questions in accordance with regulations, without being marked.

6. Powers of the Supervision Team

a) Upon discovering violations, they must prepare a record and promptly request the Examination Council and the Examination Team to handle them in accordance with regulations;

b) Report to the Director-General of the Vietnam Highway Administration or the Director of the Department of Transport for consideration and handling.

7. At the conclusion of the examination period, the Team Leader of the Supervision Team shall submit a written report on the supervision results to the Director-General of the Vietnam Highway Administration or the Director of the Department of Transport.

Article 39. Recognition of Examination Results

The Examination Management Board shall review and consolidate examination results, and submit to the Director of the Vietnam Road Administration under the Ministry of Transport or the Director of the Department of Transport for issuing a decision recognizing successful candidates in the examination period, along with a list of successful candidates eligible for a driving license according to the forms prescribed in Appendix 24a and Appendix 24b issued together with this Circular.

Article 40. Archiving Examination Result Files

1. After each examination period, the Examination Management Board shall be responsible for archiving the examination files, including:

a) List of trainees (report 1);

b) List of examinees participating in the examination (report 2);

c) Minutes of the examination candidate file inspection;

d) Decision organizing the driving license examination period;

đ) Minutes of the examination board's task assignment;

e) Minutes of the examination team's task assignment;

g) Minutes summarizing the examination results;

h) List of examinees absent or failed in the examination period;

i) Decision recognizing successful candidates in the examination period;

k) List of successful candidates eligible for a driving license;

l) Other relevant documents related to the examination period.

2. Training institutions shall archive examination files, including:

a) Documents at points a, b, c, d, g, h, i, k of Clause 1 of this Article;

b) Archive and preserve theoretical examination papers and practical examination minutes of driving on the road and in simulators of each examinee.

3. Examination centers shall archive examination files, including:

a) Documents prescribed at points d and g of Clause 1 of this Article;

b) List and results of theoretical examinations;

c) List and results of practical examinations in simulators;

d) List and results of practical examinations on the road;

đ) Monitoring data from the theoretical examination room.

4. Examinees shall keep their driving license files themselves.

5. Record retention period

a) Indefinitely for documents prescribed at points i and k of Clause 1 of this Article;

b) Five years for documents prescribed at points a, b, c, d, đ, e, g, h of Clause 1; points b, c, d of Clause 3 of this Article;

c) One year for documents prescribed at point đ of Clause 3 of this Article;

d) Two years for final graduation exams and remaining documents;

đ) Disposal of expired documents in accordance with current regulations.

Chapter IV

MANAGEMENT OF EXAMINATIONS AND ISSUANCE OF DRIVING LICENSES

Article 41. Examination Management and Driving License Issuance Authorities

1. The Vietnam Road Administration under the Ministry of Transport is assigned by the Ministry of Transport to manage examinations and issuance of driving licenses nationwide.

2. The Vehicle and Driver Management Department under the Vietnam Road Administration performs the functions and tasks of the National Examination Management Board.

3. The Department of Transport is responsible for managing examinations and issuance of driving licenses within its province or centrally-administered city.

4. The departmental unit tasked with managing training, examinations, and issuance of driving licenses under the Department of Transport performs the functions and tasks of the Provincial Examination Management Board.

Article 42. Tasks of the National Examination Management Board under the Vietnam Road Administration

1. Develop a system of forms, ledgers, and seals for business management and specialized services for managing examinations and issuance of driving licenses, submit to competent authorities for approval and uniform application nationwide.

2. Conduct random or periodic inspections of driving examination centers, ensure the accuracy of automatic scoring devices as prescribed, temporarily suspend operations if necessary to rectify issues; inspect examination periods at examination centers, handle or report to competent authorities for handling violations according to current regulations.

3. Study and apply information technology to organize and manage examinations and issuance of driving licenses; establish an information network connecting the National Examination Management Board with examination centers, Provincial Examination Management Boards, and training institutions.

4. Advise the Director of the Vietnam Road Administration

a) To direct the implementation of training, examinations, and issuance of driving licenses nationwide;

b) To provide professional guidance on establishing driving examination centers;

c) To implement and guide professional matters for Departments of Transport to provide public services for exchanging driving licenses;

d) To direct professional matters, guide, and supervise activities, calibrate vehicles, equipment, and facilities of driving examination centers according to regulations;

đ) To provide professional guidance and supervision for Provincial Examination Management Boards;

e) To develop training programs and plans, direct and organize training sessions, issue examiner cards for national examiner teams, and archive examiner files according to regulations; directly manage the examiner team under the National Examination Management Board;

g) To organize examinations and issuance of driving licenses for trainees at training institutions assigned by the Ministry of Transport.

5. Receive and process applications for exchanging driving licenses transferred by Departments of Transport; organize issuance and exchange of driving licenses for the following groups:

a) Drivers of central agencies of the Party, State, mass organizations, and international and diplomatic organizations headquartered in Hanoi;

b) Drivers managed by the Vietnam Road Administration.

6. Update violations of drivers into the Driving License Information System provided by the authority responsible for administrative penalties.

7. Perform other tasks related to examinations and issuance of driving licenses assigned by the Director of the Vietnam Road Administration.

8. Publicize schedules and locations for the next month's driving license examination periods before the 25th of the previous month on the Vietnam Road Administration’s official website.

Article 43. Tasks of the Examination Management Board of the Department of Transport

1. Advise the Director of the Department of Transport:

a) Organize the implementation of regulations of the Ministry of Transport and guidelines of the Vietnam Highway Corporation regarding examination procedures and issuance of driving licenses;

b) Develop plans for training needs, upgrading, and directly manage and store the files of examiners under the Examination Management Board;

c) Direct the construction, management of activities of examination centers within the locality;

d) Implement information networking with examination centers, training institutions in the locality, and with the Vietnam Highway Corporation;

đ) Implement public services for exchanging driving licenses;

e) Organize examination sessions for students at driving schools managed by the Department of Transport; in cases where examinations are organized at examination centers not directly under its management, the Examination Management Board of the Department of Transport shall select to have appropriate examination plans;

2. Receive and process information on exchanging driving licenses, reissuing expired driving licenses transferred from the Vietnam Highway Corporation or other Departments of Transport; organize issuing new, reissuing lost driving licenses, and exchanging driving licenses for drivers who need them;

3. Update violations of drivers into the Driving License Information System provided by administrative penalty authorities;

4. Perform other tasks related to examinations and issuance of driving licenses assigned by the Director of the Department of Transport;

5. Publicize schedules and locations for driving license examination sessions of the following month before the 25th day of the current month on the Department of Transport's electronic information website.

Article 44. Model of Driving License

1. The model of the driving license shall be implemented according to the provisions in Appendix 25 issued together with this Circular;

2. The Vietnam Highway Corporation shall print, distribute, guide, and manage the use of driving licenses throughout the country.

Article 45. Use and Management of Driving Licenses

1. Each person shall be granted only one driving license management number made of PET material;

2. Each person shall be granted one driving license made of PET material without expiration date (categories A1, A2, A3) and one driving license made of PET material with an expiration date (categories A4, B1, B2, C, D, E, and F);

3. People who already have integrated driving licenses combining both valid and expired ones, if they wish to separate the driving licenses, must follow the separation procedures stipulated in Article 50 of this Circular;

4. Holders of driving licenses may only drive vehicles specified on their driving licenses;

5. When exchanging, reissuing, or upgrading driving licenses, the issuing authority shall cut the corner of the old driving license and hand it over to the driver for safekeeping;

6. Driving licenses must be carried by the driver when operating a vehicle;

7. Driving licenses may be suspended or revoked according to the provisions of the law;

8. Holders of category B1 driving licenses wishing to operate commercial vehicles and those seeking to upgrade their driving licenses must attend training courses and examinations to obtain new driving licenses;

9. Holders of automatic transmission category B1 driving licenses are not allowed to drive manual transmission cars; if they wish to drive manual transmission cars, they must undergo additional training and practical driving examinations to obtain a category B1 driving license;

10. Foreign individuals or Vietnamese residing abroad wishing to drive in Vietnam shall proceed as follows:

a) If they hold a national driving license, they must apply for conversion to a corresponding Vietnamese driving license;

b) In cases where international treaties on driving licenses to which Vietnam is a party provide otherwise, such treaty provisions shall apply;

11. Valid driving licenses are those issued by the Vietnam Highway Corporation or the Department of Transport, bearing a driving license serial number matching the serial number in the driving license management information system;

12. Holders of categories FD, FE driving licenses first issued by the transport sector before July 1, 2009, if they wish to operate trucks towing trailers or tractor-trailers, may exchange for category FC;

13. A valid driving license is a driving license issued by the Vietnam Highway Corporation or the Department of Transport, bearing a serial number matching the serial number in the driving license management information system;

14. Individuals who erase, alter information on driving licenses; use fake driving licenses or driving license files; or engage in other fraudulent acts to obtain exchanges, reissues, or new issuances of driving licenses, in addition to having their driving licenses and original files revoked by the driving license management authority, shall bear legal responsibility and shall not be issued driving licenses for five years from the date of discovery of the violation. If they wish to reissue a driving license, they must study and take examinations as if applying for a driving license for the first time.

Article 46. Verification of Driving Licenses

1. When receiving a list of requests to verify driving licenses issued from training institutions; when exchanging or reissuing driving licenses, the General Department of Vietnam Highway or the Department of Transport must search and print information about the driving license of the person applying for an upgrade and exchange of driving licenses from the management system of driving licenses (the verification report of motor vehicle driving licenses); in cases where there is no information, a request for verification of the issued driving license must be made in writing; the application for verification of motor vehicle driving licenses according to the model prescribed in Appendix 26a issued together with this Circular, the verification report of motor vehicle driving licenses according to the model prescribed in Appendix 26b issued together with this Circular.

2. Implementation of verification of driving licenses

a) The verification of driving licenses must be carried out immediately through telephone, email, or fax, and then sent in writing;

b) After obtaining the verification results, the General Department of Vietnam Highway or the Department of Transport must update the information about the driving license into the management system of driving licenses; in cases where an issued driving license is found to be invalid, a decision to revoke it must be made; notify the General Department of Vietnam Highway to handle the matter, update violations into the management system of driving licenses; announce on the electronic information website of the Department of Transport and the electronic information website of the General Department of Vietnam Highway so that the validity of the issued driving license is not recognized; handle violations according to Clause 13, Article 45 of this Circular.

3. Time limit for verification

a) From the date of receipt of the list requesting verification of driving licenses or valid files as stipulated in Article 50 of this Circular, the General Department of Vietnam Highway or the Department of Transport must issue a request for verification of the issued driving license in writing;

b) Upon receiving the verification request, the General Department of Vietnam Highway or the Department of Transport must respond to verify the issued driving license.

Article 47. Issuance of New Driving Licenses

1. People who achieve the examination results will be issued a driving license corresponding to the category they have passed.

2. Based on the decision recognizing the successful examination period, the Director of the General Department of Vietnam Highway, the Director of the Department of Transport shall issue a driving license to the successful candidate.

The date of success recorded on the back of the driving license is the date of signing the decision recognizing the successful examination period.

3. The time limit for issuing a driving license shall not exceed 10 working days from the end of the examination period.

Article 48. Reissuance of Driving Licenses

1. People holding expired driving licenses

a) From three months up to less than one year since the expiration date, must retake the theory exam to reissue the driving license;

b) One year or more since the expiration date, must retake both the theory and practical exams to reissue the driving license.

The application for retaking the exam follows the provisions of Clause 3, Article 31 of this Circular.

2. People holding lost driving licenses, still within the validity period or expired for less than three months, whose names appear in the examination management agency's records, upon checking the driver's violation in the Driving License Information System, if no authority is found to be confiscating or processing them, two months after submitting complete files as required, may be considered for reissuance of the driving license.

Drivers prepare one set of files to submit directly to the General Department of Vietnam Highway or the Department of Transport. The file includes:

a) An application for exchange or reissue of driving licenses according to the model prescribed in Appendix 27 issued together with this Circular;

b) Original primary file consistent with the driving license (if available);

c) Health certificate issued by a competent medical facility according to regulations, except for the reissue of unlimited-term driving licenses for categories A1, A2, A3;

d) Photocopies attached to the original for comparison include: identity card (for Vietnamese citizens) or passport still within its validity period (for foreigners and Vietnamese residing abroad).

When reissuing the driving license, the issuing authority will take a photograph of the driver.

3. People holding lost driving licenses, expired for three months or more, whose names appear in the examination management agency's records, upon checking the driver's violation in the Driving License Information System, if no authority is found to be confiscating or processing them, two months after submitting complete valid files as required, must retake the following exams:

a) Expired for three months up to less than one year, must retake the theory exam;

b) Expired for one year or more, must retake both the theory and practical exams.

The application for retaking the exam follows the provisions of Clause 4, Article 31 of this Circular.

4. People holding lost driving licenses for the second time, if they need to reissue:

a) Within two years from the date of reissuance of the first lost driving license; their names appear in the examination management agency's records; upon checking the driver's violation in the Driving License Information System, no authority is found to be confiscating or processing them; two months after submitting complete valid files as required, must retake the theory exam to reissue the driving license;

b) More than two years from the date of reissuance of the first lost driving license, will be processed as if it were the first loss.

The application for retaking the exam follows the provisions of Clause 4, Article 31 of this Circular.

5. People holding lost driving licenses for the third time or more, if they need to reissue:

a) Within two years from the date of reissuance of the previous lost driving license; their names appear in the examination management agency's records; upon checking the driver's violation in the Driving License Information System, no authority is found to be confiscating or processing them; two months after submitting complete valid files as required, must retake both the theory and practical exams to reissue the driving license;

b) More than two years from the date of reissuance of the previous lost driving license, will be processed as if it were the first loss.

The application for retaking the exam follows the provisions of Clause 4, Article 31 of this Circular.

6. The date of success recorded on the back of the reissued (restored) driving license is calculated based on the date of success of the old driving license.

7. The time limit for reissuing a driving license is the same as for issuing a new one.

8. A person who retakes the examination and wishes to review may register with driving schools to receive guidance for review, must pay the review fee as prescribed, without having to relearn according to the training program.

9. A person holding a valid driver's license but lacking the original file, whose name appears in the management examination agency's records, may request to recreate the original file if needed.

The driver shall submit one set of application documents directly to the General Department of Vietnam Transportation or the Department of Transport (where the driver's license was issued). The application includes:

a) An application for exchange or reissue of driving licenses according to the model prescribed in Appendix 27 issued together with this Circular;

b) A copy of the driver's license, identity card, or passport still within validity period.

The issuing authority shall check, confirm, stamp, and clearly record: the number and category of the issued driver's license, examination date (if applicable), and training institution name (if applicable) on the upper right corner of the application form for license renewal or replacement, and return it to the driver for self-preservation as a substitute for the original file.

Article 49. Renewal of Driver's License

1. A paper-based driver's license that is still valid can be renewed into a driver's license made of PET material according to the schedule specified in Article 57 of this Circular.

2. A person holding a driver's license that is still valid or has expired less than three months from the expiration date, or a damaged driver's license, may apply for renewal if they wish to continue using it.

3. A person holding a Category E driver's license who is 55 years old for males and 50 years old for females, if they wish to continue driving and meet the health requirements, may apply for renewal to a lower category license such as Category D or below.

4. In case the birth year, surname, given name, and middle name recorded on the driver's license differ from those on the identity card, the driver's license management agency shall process the renewal of the driver's license to match the information on the identity card.

5. Persons eligible for driver's license renewal include:

a) Vietnamese citizens and foreigners trained, examined, and granted a driver's license in Vietnam;

b) Persons holding a damaged driver's license issued by the transportation sector;

c) Vietnamese citizens and foreigners residing permanently in Vietnam who have obtained a Vietnamese driver's license converted from a foreign driver's license, when their license expires and they wish to renew it;

d) Persons holding a military driver's license that is still valid upon discharge (retirement, demobilization, transfer to another profession, retirement...), if they wish to renew their driver's license;

đ) Police officers holding a driver's license issued by the Public Security Sector after July 31, 1995, which is still valid, when leaving the sector or retiring, if they wish to renew their driver's license;

e) Persons holding a motorcycle driver's license issued by the Public Security Sector before August 1, 1995, which is damaged and needs to be renewed, listed in the registration book, may be considered for renewal of a new driver's license;

g) Foreigners residing, working, or studying in Vietnam for at least three months, holding a national driver's license that is still valid, if they wish to drive in Vietnam, may be considered for conversion to a corresponding Vietnamese driver's license;

h) Foreign tourists driving vehicles registered abroad entering Vietnam, holding a national driver's license that is still valid, if they wish to drive in Vietnam, may be considered for conversion to a corresponding Vietnamese driver's license;

i) Vietnamese citizens (holding Vietnamese nationality) residing, studying, or working abroad, holding a national driver's license issued by a foreign country that is still valid, if they wish to drive in Vietnam, may be considered for conversion to a corresponding Vietnamese driver's license.

6. Driver's licenses will not be renewed in the following cases:

a) Temporary foreign driver's licenses; international driver's licenses; foreign, military, or police driver's licenses that have expired according to regulations, been erased, torn, and no longer contain sufficient elements for renewal, or have significant differences in identification; foreign driver's licenses not issued by authorized agencies;

b) Driver's licenses issued by the Transportation Sector but not found in the driver's license information system, list of issued driver's licenses (management book);

c) Discharge decisions exceeding six months from the date of renewal procedures for military driver's licenses issued by the Ministry of Defense;

d) Persons who do not meet the required health standards.

7. Validity period and permitted vehicle categories:

a) The validity period of a Vietnamese driver's license renewed for foreigners shall correspond to the duration stated in the entry visa or temporary residence permit, and the validity period of the foreign driver's license, but shall not exceed the validity period stipulated for the Vietnamese driver's license;

b) The validity period of a Vietnamese driver's license renewed for foreign tourists driving vehicles registered abroad entering Vietnam shall correspond to the duration of their stay in Vietnam (from entry to departure) but shall not exceed the validity period stipulated for the Vietnamese driver's license;

For foreign tourists driving vehicles into Vietnam without the opportunity to present passports and foreign driver's licenses, when renewing the driver's license, the basis can be the immigration list of the Ministry of Public Security and the translation of the driver's license (accompanied by a copy of the foreign driver's license), preparing driver's licenses for the number of people registered. The driver's license shall only be issued to those who actually enter Vietnam after verifying the foreign driver's license and passport;

c) National driver's licenses issued for persons renewing multiple categories of vehicles can be converted into Vietnamese driver's licenses to operate corresponding categories of vehicles;

d) Valid military driver's licenses allowing operation of multiple categories of vehicles can be converted into valid transportation sector driver's licenses to operate corresponding categories of vehicles.

8. Time limit for renewing driver's licenses:

a) Not more than five working days from the date all valid application documents are received;

b) When renewing a driver's license, the issuing authority shall cut the corner of the old driver's license (except for driver's licenses issued by foreign countries).

Article 50. Documents for exchanging driving licenses issued by the Transport Ministry

The driver shall prepare one set of application documents to be directly submitted to the Vietnam Highway Administration or the Department of Transport. The documents include:

1. Application form for exchanging or reissuing driving licenses according to the model prescribed in Appendix 27 attached hereto.

2. Health certificate issued by a competent medical facility, except for the following cases:

a) Holders of driving licenses for category A1, A2, A3;

b) Persons exchanging driving licenses for category A4, driving licenses for motor vehicles with remaining validity of more than three months from paper to PET material;

c) Cases where a driving license with a term and without a term is separated.

3. Copy of the driving license, identity card or passport still valid with the identity card number recorded (for Vietnamese citizens) or passport still valid (for foreigners, Vietnamese residing abroad).

When exchanging driving licenses, the issuing authority shall take photographs of the drivers.

Article 51. Documents for exchanging military driving licenses issued by the Ministry of National Defense

The driver shall prepare one set of application documents to be directly submitted to the Vietnam Highway Administration or the Department of Transport. The documents include:

1. Application form for exchanging or reissuing driving licenses according to the model prescribed in Appendix 27 attached hereto.

2. Copy of the decision on demobilization within six months from the date signed by the brigade-level commander or higher, accompanied by the original for verification.

3. Health certificate issued by a competent medical facility as prescribed, except for the case of exchanging driving licenses for category A1, A2, A3.

4. Original military driving license still valid.

5. Copy of the identity card still valid, accompanied by the original for verification.

When submitting the documents, the driver will be photographed by the issuing authority.

The documents for exchanging military driving licenses are original documents including the materials listed in Clause 1 and Clause 2 of this Article and the military driving license that has been cut at the corner, handed over to the driver for self-preservation.

Article 52. Documents for exchanging driving licenses issued by the Public Security Ministry

1. Documents for exchanging motorcycle driving licenses issued by the Public Security Ministry before August 1, 1995

The driver shall prepare one set of application documents to be directly submitted to the Vietnam Highway Administration or the Department of Transport. The documents include:

a) An application for exchange or reissue of driving licenses according to the model prescribed in Appendix 27 issued together with this Circular;

b) Copy accompanied by the original for verification including: driving license, identity card still valid;

c) Original documents (if available).

When submitting the documents, the driver will be photographed by the issuing authority.

2. Documents for exchanging driving licenses issued by the Public Security Ministry from August 1, 1995.

The driver shall prepare one set of application documents to be directly submitted to the Vietnam Highway Administration or the Department of Transport. The documents include:

a) An application for exchange or reissue of driving licenses according to the model prescribed in Appendix 27 issued together with this Circular;

b) Copy accompanied by the original for verification including: decision on leaving the profession or retirement by the competent authority, identity card still valid;

c) Health certificate issued by a competent medical facility as prescribed, except for the case of exchanging driving licenses for category A1, A2, A3;

d) Original driving license issued by the Public Security Ministry still valid.

When submitting the documents, the person exchanging the driving license will be photographed by the issuing authority.

The documents for exchanging Public Security driving licenses are original documents including the materials listed in point a and point b of Clause 2 of this Article and the Public Security driving license that has been cut at the corner, handed over to the driver for self-preservation.

Article 53. Documents for exchanging foreign driving licenses or permits

1. The driver prepares one set of documents, submitted directly to the General Department of Vietnam Roads or the Department of Transport (at the place of permanent residence, temporary residence, or long-term residence). The documents include:

a) Application form for exchanging or reissuing driving licenses (for Vietnamese citizens according to the model prescribed in Appendix 27 attached hereto; for foreigners according to the model prescribed in Appendix 28 attached hereto);

b) Certified Vietnamese translation of the foreign driving license, quality guaranteed by a Notary Office or Embassy, Consulate in Vietnam where the translator works, stamped with a matching seal on the copy of the driving license; in case of doubt, the issuing authority may request the Embassy, Consulate of the country issuing the driving license in Vietnam to verify;

c) Copy accompanied by the original for verification, including: passport (the number, name, photo page, validity period, and entry visa page), copy of the identity card, diplomatic or service passport issued by the Ministry of Foreign Affairs of Vietnam, or copy of the residence card, temporary residence card, temporary stay card, permanent residence card, documents verifying long-term residence in Vietnam for foreigners.

When exchanging driving licenses, the issuing authority shall take photographs of the drivers.

2. The documents for exchanging driving licenses given to the driver by the issuing authority are original documents including the materials specified in Clause 1 of this Article and the foreign driving license.

Article 54. Documents for exchanging driving licenses or foreign driving licenses issued to foreign tourists for driving in Vietnam

1. The applicant shall prepare one set of documents and submit them directly or through postal service to the Department of Transport. The documents include:

a) An application form for exchanging a driving license according to the model prescribed in Appendix 28 attached to this Circular;

b) A certified Vietnamese translation of the foreign driving license, guaranteed by a notary office or the Embassy or Consulate of the issuing country in Vietnam where the translator works, stamped with a matching copy of the driving license; in case of doubt, the issuing authority may request the Embassy or Consulate of the issuing country in Vietnam to verify;

c) A certified copy of the entry-exit list from the Ministry of Public Security or a copy of the passport including the passport number, name, and photo of the holder, validity period, and the entry visa page to Vietnam;

d) One color photograph measuring 3 cm x 4 cm on a blue background, similar to an identity card.

When collecting the driving license, the driver must present a valid passport and the foreign driving license for verification.

2. The issuing authority must record in the management file that the driving license has been exchanged once.

Part IV

TRAINING AND TESTING FOR CERTAIN SPECIAL CASES

Article 55. Training for Driving Licenses

1. Training for persons with disabilities operating three-wheeled motorcycles for persons with disabilities to obtain a Class A1 driving license

a) The learner can self-study theory and practice; if they wish to attend concentrated training, they may register with the training institution to follow the prescribed curriculum;

b) The training institution may waive or reduce tuition fees for the learner.

2. Training for Class A1 motorcycle licenses for ethnic groups with very low educational levels

The Department of Transport shall develop and submit to the Provincial People's Committee for issuance conditions and forms of training suitable to local realities.

Article 56. Testing for Driving Licenses

Testing for issuing Class A1 motorcycle licenses to persons with disabilities and ethnic groups with very low educational levels shall be conducted by the Department of Transport based on the testing content and procedures already established, developing appropriate testing content and organizing plans, and submitting to the Provincial People's Committee for consideration and decision.

Part V

IMPLEMENTING PROVISIONS

Article 57. Transition to Driving Licenses Made of PET Material

Driving licenses made of paper covers must be converted to new licenses made of PET material according to the following schedule:

1. Driving licenses for cars and Class A4: before December 31, 2016.

2. Unexpired driving licenses (Classes A1, A2, A3): before December 31, 2020.

Six months after the transition schedule specified in Clause 1 and Clause 2 of this Article, holders of driving licenses made of paper covers must retake the theoretical test to obtain a new license.

Article 58. Reports on Training, Testing, and Issuing Driving Licenses

1. Annually, in January and July, the Department of Transport shall conduct mid-year and year-end reviews of the training, testing, and issuing of driving licenses in their locality and submit reports to the Vietnam Highway Corporation for consolidation and reporting to the Ministry of Transport.

2. Monthly (before the 5th day of the following month), all Departments of Transport shall submit consolidated reports on issuing and exchanging driving licenses to the Vietnam Highway Corporation for consolidation and reporting to the Ministry of Transport according to the model prescribed in Appendix 29 attached to this Circular.

Article 59. Inspection and Audit

1. The Vietnam Highway Administration shall carry out inspection and audit of training, examination, and issuance of driving licenses throughout the country.

2. The Department of Transport shall conduct inspection, audit, and supervision of training and examination activities for drivers at training facilities and examination centers under its management.

3. The inspection and audit of training, examination, and issuance of driving licenses shall be carried out in accordance with the provisions of the law.

Article 60. Effective Date

1. This Circular takes effect from January 1, 2016.

2. The following consolidated documents are abolished:

a) Decision No. 02/2008/QD-BGTVT dated January 31, 2008, of the Minister of Transport approving the model of driving license;

b) Circular No. 35/2010/TT-BGTVT dated November 15, 2010, of the Minister of Transport amending and supplementing Decision No. 02/2008/QD-BGTVT dated January 31, 2008, of the Minister of Transport approving the model of driving license;

c) Circular No. 46/2012/TT-BGTVT dated November 7, 2012, of the Minister of Transport stipulating regulations on training, examination, and issuance of motor vehicle driving licenses;

d) Circular No. 38/2013/TT-BGTVT dated October 24, 2013, of the Minister of Transport amending and supplementing certain articles of Circular No. 46/2012/TT-BGTVT dated November 7, 2012, of the Minister of Transport stipulating regulations on training, examination, and issuance of motor vehicle driving licenses;

đ) Circular No. 48/2014/TT-BGTVT dated October 15, 2014, of the Minister of Transport amending and supplementing certain articles of Circular No. 46/2012/TT-BGTVT dated November 7, 2012, of the Minister of Transport stipulating regulations on training, examination, and issuance of motor vehicle driving licenses;

e) Circular No. 67/2014/TT-BGTVT dated November 13, 2014, of the Minister of Transport amending and supplementing certain articles of Circular No. 38/2013/TT-BGTVT dated October 24, 2013, of the Minister of Transport amending and supplementing certain articles of Circular No. 46/2012/TT-BGTVT dated November 7, 2012, of the Minister of Transport stipulating regulations on training, examination, and issuance of motor vehicle driving licenses;

g) Circular No. 87/2014/TT-BGTVT dated December 31, 2014, of the Minister of Transport amending and supplementing certain articles of Circular No. 46/2012/TT-BGTVT dated November 7, 2012, of the Minister of Transport stipulating regulations on training, examination, and issuance of motor vehicle driving licenses;

h) Circular No. 30/2015/TT-BGTVT dated July 14, 2015, of the Minister of Transport amending and supplementing certain articles of Circular No. 46/2012/TT-BGTVT dated November 7, 2012, of the Minister of Transport stipulating regulations on training, examination, and issuance of motor vehicle driving licenses.

3. The implementation of examinations for category B1, B2 parallel parking at the designated location as provided in point d, Clause 3, Article 33 of this Circular shall take effect from April 1, 2016.

4. Point c and point g, Clause 4, Article 33 of this Circular shall take effect from July 1, 2016.

5. Clause 3, Article 45 of this Circular shall take effect from November 1, 2015.

Article 61. Responsibility for Implementation

1. The Vietnam Highway Administration, Departments of Transport of provinces and centrally governed cities shall be responsible for organizing the implementation of this Circular.

2. The Director of the Ministry's Office, the Director of the Ministry's Inspectorate, Heads of Departments, the Director of the Vietnam Highway Administration, Directors of Departments of Transport of provinces and centrally governed cities, Heads of agencies, organizations, and individuals related to this matter shall be responsible for implementing this Circular./.
