Amending and supplementing certain Circulars to reduce and simplify administrative procedures related to production and business activities under the management of the Ministry of Science and Technology

Pursuant to the Law on Legislative Acts of Legal Normative Documents No. 64/2025/QH15, amended and supplemented by Law No. 87/2025/QH15;

Pursuant to Decree No. 78/2025/NĐ-CP dated April 1, 2025 of the Government detailing some provisions and measures for organizing and guiding the implementation of the Law on Issuing Legal Normative Documents amended and supplemented by Decree No. 187/2025/NĐ-CP;

Pursuant to Decree No. 55/2025/NĐ-CP dated March 2, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the proposal of the Director of the Legal Department;

The Minister of Science and Technology issues this Circular amending and supplementing certain Circulars to reduce and simplify administrative procedures related to production and business activities under the management of the Ministry of Science and Technology.

PART I
AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF CIRCULAR NO. 23/2013/TT-BKHCN DATED SEPTEMBER 26, 2013 OF THE MINISTER OF SCIENCE AND TECHNOLOGY ON MEASUREMENT FOR GROUP 2 MEASURING INSTRUMENTS

Article 1. Amend and supplement , Clause 1, Clause 2 Article 7a of this Regulation.

Article 7. Application dossier for approval of measurement instrument model

The entity submits the application dossier for approval of measurement instrument model online through the National Public Service Portal, directly or via postal service to the Committee (one set). The dossier includes:

1. Application form for approval of measurement instrument model according to Form 1. DM at Appendix issued together with this Circular.

2. Technical documentation of the model. The documentation must clearly state: Operating principle, schematic structure diagram, user guide; important structures affecting the main metrological characteristics of the model; positions of mechanisms for setting and adjusting the main metrological technical parameters of the model; positions for affixing seals, inspection stamps, sealing, and other features if present on the model; mechanisms or technical features that prevent impacts leading to changes in the main metrological characteristics of the model during use (in Vietnamese or English or both languages).

3. Color photographs of the model and a CD containing electronic data of these photographs. The photographs include: One (1) overall photograph of the model; front (displaying measurement results), back, top, bottom (if applicable), right side, left side photographs of the model; separate photographs showing information about identification marks, type, and main metrological characteristics of the model; circuit board (if applicable), operation keys; position of the product label of the model, position for affixing seals, inspection stamps; sealing positions on the model; other parts directly affecting the main metrological characteristics of the model.

The photographs must be the same size, minimum 100 mm x 150 mm but not larger than 210 mm x 297 mm, attached or printed on A4 paper bound into a booklet. The photographs must be clear and accurately reflect the main metrological characteristics of the model and ensure requirements for comparison, verification, and checking the conformity of measuring instruments produced or imported with the approved model.

4. Test and evaluation report dossier of the model in accordance with Article 12 of this Circular.

In case the entity requests exemption or reduction of testing in the application for approval of measurement instrument model, the dossier includes relevant documents regarding exemption or reduction of testing in accordance with Article 10 of this Circular.”

“2. One (1) month before the decision approving the measurement instrument model expires, if necessary, the entity submits the application dossier for approval of measurement instrument model online through the National Public Service Portal, directly or via postal service to the Committee (one set). The dossier includes:

Request for extension of the validity period of the decision approving the measurement instrument model according to Form 5. DGHPDM of the Appendix issued together with this Circular.”

Article 3. Amend and supplement some points of Article 16

1. Point b Clause 1

“b) Within five (05) working days from the date of receiving complete and valid files, the Committee shall examine and issue a decision to adjust in accordance with Article 13 of this Circular for the adjustment content.”

2. Point b Clause 2

"b) Within five (05) working days from the date of receiving valid files, the Committee shall examine and issue guidance documents for the entity to implement approval of new samples or issue a decision to adjust in accordance with Article 13 of this Circular for the adjustment content."

Article 4. Repeal Model 2. CKPM (Commitment Statement on Software of Measuring Instruments) in Appendix.

Chapter II
AMEND AND SUPPLEMENT SOME ARTICLES OF CIRCULAR NO. 21/2014/TT-BKHCN DATED JULY 15, 2014 OF THE MINISTER OF SCIENCE AND TECHNOLOGY ON MEASUREMENT FOR THE QUANTITY OF PREPACKAGED GOODS

Article 5. Amend and supplement Clause 1 of Article 1

“1. This Circular stipulates measurement requirements for the quantity of prepackaged goods including: technical measurement requirements for the quantity of prepackaged goods; weight marks; declaration of use of weight marks on prepackaged goods group 1 labels.”

Article 6. Amend and supplement Clause 5 of Article 10

“5. Retain all inspection and calibration records of measuring instruments, technical measurement assessment records for the quantity of prepackaged goods (self-assessed by the entity).”

Article 7. Amend and supplement some points of Clause 1, 2 of Article 25

1. Amend and supplement Point h Clause 1

“h) Annually before January 31 or at any time upon request of competent state agencies, the entity shall prepare a report on the use of weight marks on prepackaged goods labels (in accordance with Model 3.BCTH in Appendix V issued together with this Circular) and submit it to the Standard Measurement Quality Control Agency that has accepted the declaration.”

2. Amend and supplement Point d Clause 2

“d) Only allow circulation and sale of prepackaged goods that meet technical measurement requirements;”

Article 8. Amend and supplement Clause 5 of Article 26

“5. Every two (02) years once or at any time upon request of competent state agencies, conduct inspections on the acceptance of declarations of use of weight marks by the Standard Measurement Quality Control Agency.”

Article 9. Amend and supplement Clause 2, 5 of Article 28

1. Amend and supplement Clause 2

“2. Accept and confirm the declaration of use of weight marks, establish and record in the tracking and management logbook according to this Circular.”

2. Amend and supplement Clause 5

“5. Annually before March 31 or at any time upon request of competent state agencies, compile and report to the National Standard Measurement Quality Control Committee on the results of accepting declarations of use of weight marks on prepackaged goods labels; the situation and results of inspecting the quantity of prepackaged goods within the jurisdiction.”

Article 10. Replace Model 3.BCTH (Report on the Use of Weight Marks on Prepackaged Goods Labels) in Appendix V with Model 3.BCTH issued together with this Circular.

Article 11. Repeal Article 6; Clause 2 of Article 8; Clause 1 of Article 11; Section 3 Chapter IV comprising Articles 16, 17, 18, 19, 20, 21, 22, 23, 24; Point e Clause 1 of Article 25; Clause 1 of Article 26 and Models 2. ĐNCN, 4. GCN in Appendix V.

Chapter III
REPEAL SOME ARTICLES OF CIRCULAR NO. 01/2018/TT-BKHCN DATED APRIL 12, 2018 OF THE MINISTER OF SCIENCE AND TECHNOLOGY REGULATING THE ORGANIZATION AND MANAGEMENT OF THE NATIONAL STARTUP ECO-SYSTEM SUPPORT PROGRAM FOR INNOVATION AND CREATIVE TECHNOLOGY UNTIL 2025

Article 12. Repeal Article 7.

Chapter IV
AMEND AND SUPPLEMENT SOME ARTICLES OF CIRCULAR NO. 02/2018/TT-BKHCN DATED MAY 15, 2018 OF THE MINISTER OF SCIENCE AND TECHNOLOGY REGULATING REPORTING REQUIREMENTS FOR IMPLEMENTATION OF TECHNOLOGY TRANSFER CONTRACTS UNDER THE LIST OF RESTRICTED TECHNOLOGY TRANSFER; SAMPLE DOCUMENTS IN TECHNOLOGY TRANSFER LICENSE ISSUANCE ACTIVITIES, REGISTRATION OF EXTENSION, MODIFICATION, AND SUPPLEMENTATION OF TECHNOLOGY TRANSFER CONTENT

Article 13. Amend and supplement Point a Clause 1 of Article 3

“a) The sample document for requesting approval of technology transfer shall be implemented in accordance with Model number 01 in Appendix VI issued together with Decree No. 133/2025/NĐ-CP dated June 12, 2025 of the Government stipulating decentralization and delegation in the field of state administration under the Ministry of Science and Technology;”

Article 14. Amending and supplementing Point c Clause 1 Article 3

“c) The model of the application for permission to transfer technology shall be implemented according to Model No. 03 Appendix VI promulgated together with Decree No. 133/2025/NĐ-CP dated June 12, 2025 of the Government stipulating decentralization and delegation of authority in the field of management under the Ministry of Science and Technology;"

Article 15. Replacing Model No. 06 in the Appendix with Model No. 06 promulgated together with this Circular.

Chapter V
AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF CIRCULAR NO. 10/2020/TT-BKHCN DATED DECEMBER 30, 2020 OF THE MINISTER OF SCIENCE AND TECHNOLOGY GUIDING IMPLEMENTATION OF CERTAIN PROVISIONS OF DECREE NO. 132/2008/NĐ-CP DATED DECEMBER 31, 2008 AND DECREE NO. 74/2018/NĐ-CP DATED MAY 15, 2018 OF THE GOVERNMENT ON THE USE OF PRODUCT CODES AND BARCODES

Article 16. Amending and supplementing Clause 1 Article 7

"1. Organizations and individuals registering to use product codes and barcodes submit their applications online on the National Public Service Portal.

a) The application for issuing a new Certificate of Product Code and Barcode Usage Rights includes: An electronic form with digital signature. The contents of the electronic form comply with the provisions set out in Model No. 12 Appendix promulgated together with Decree No. 13/2022/NĐ-CP dated January 21, 2022 of the Government amending and supplementing certain provisions of Decree No. 132/2008/NĐ-CP dated December 31, 2008, Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government guiding implementation of certain provisions of the Law on Product Quality and Decree No. 86/2012/NĐ-CP dated October 19, 2012 of the Government guiding implementation of certain provisions of the Law on Measurement;

b) Using the electronic identity account VNeID of organizations and individuals engaged in production and business that have been verified to perform the procedure for issuing new usage rights for product codes and barcodes; administrative agencies receiving and processing the procedures exploit and use information already available in databases published by the database management agency to replace parts of the application forms. In cases where the VNeID account has not integrated necessary information, cannot be exploited, or can be exploited but lacks sufficient and accurate information such as establishment decisions, business registration certificates, investment registration certificates or equivalent documents, the competent authorities receiving and processing the procedures require individuals and organizations to supplement the application forms to process the administrative procedures."

Article 17. Amending and supplementing Point a Clause 4 Article 7

“a) Procedure for issuing new Certificates of Product Code and Barcode Usage Rights:

a1) In case the application for issuing a certificate of product code and barcode usage rights is incomplete within the prescribed time frame, the processing agency will notify the organization or individual to amend and supplement the application through the National Public Service Portal within one working day from the date of receipt of the application. Within three working days from the date of notification, the organization or individual must amend and supplement the previously submitted application;

a2) In case the application for issuing new Certificates of Product Code and Barcode Usage Rights is complete and valid, and the organization or individual has paid the required fees, the processing agency is responsible for issuing the certificate of product code and barcode usage rights within ten working days with the contents specified in Model No. 14 Appendix promulgated together with Decree No. 13/2022/NĐ-CP dated January 21, 2022 of the Government amending and supplementing certain provisions of Decree No. 132/2008/NĐ-CP dated December 31, 2008, Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government guiding implementation of certain provisions of the Law on Product Quality and Decree No. 86/2012/NĐ-CP dated October 19, 2012 of the Government guiding implementation of certain provisions of the Law on Measurement;

a3) The validity period of the certificate does not exceed three years from the date of issuance.”

Chapter VI
REPLACING AND REPEALING CERTAIN FORMS ATTACHED TO CIRCULAR NO. 14/2023/TT-BKHCN DATED JUNE 30, 2023 OF THE MINISTER OF SCIENCE AND TECHNOLOGY ISSUING FORMS FOR IMPLEMENTATION OF ADMINISTRATIVE PROCEDURES STIPULATED IN CERTAIN PROVISIONS OF DECREE NO. 76/2018/NĐ-CP DATED MAY 15, 2018 OF THE GOVERNMENT GUIDING IMPLEMENTATION OF CERTAIN PROVISIONS OF THE LAW ON TECHNOLOGY TRANSFER

Article 18. Replacing Forms BM I.1 and BM I.2 in Appendix 1 with Forms BM I.1 and BM I.2 promulgated together with this Circular.

Article 19. Repealing Forms BM I.3 and BM I.4 in Appendix 1.

Chapter VII
IMPLEMENTATION

Article 20. Effective Date

This Circular takes effect from the date of issuance.

Article 21. Transitional Provisions

Applications received by competent authorities before the effective date of this Circular but not yet processed shall continue to be handled in accordance with the laws applicable at the time of receipt of the application.

Article 22. The Director of the Office, Heads of Legal Departments, Heads of agencies and units under the Ministry and other relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
