THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 113/2003/NĐ-CP dated October 7, 2003, and Decree No. 191/2007/NĐ-CP dated December 31, 2007, of the Government on management of fertilizer production, business, and use;

Pursuant to Decree No. 179/2004/NĐ-CP dated October 21, 2004, of the Government stipulating state management of product quality;

Pursuant to Decision No. 36/2007/QĐ-BNN dated April 24, 2007, of the Minister of Agriculture and Rural Development on regulations for fertilizer production, business, and use;

At the proposal of the Director of the Crop Production Department,

DECISION:

Article 1. Attached hereto is the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam, including 265 types, divided into:

1. Single mineral fertilizers 09 types;

2. Medium and microelement fertilizers 13 types;

3. Organic fertilizers 02 types;

4. Bio-organic fertilizers 16 types;

5. Combined organic-mineral fertilizers 44 types;

6. Biological organic fertilizers 17 types;

7. Microbial fertilizers 03 types;

8. Foliar fertilizers 161 types;

Article 2. Organizations and individuals meeting the conditions stipulated in Article 5 of Decree No. 113/2003/NĐ-CP dated October 7, 2003, of the Government on management of fertilizer production, business, and use are permitted to produce, trade, and use the types of fertilizers listed in this Supplementary List.

Article 3This Decision shall take effect fifteen days from the date of publication in the Official Gazette. The following types of fertilizers will be removed from the list of fertilizers permitted for production, business, and use in Vietnam from the date this Decision takes effect:

1. Types of fertilizers at Decision No. 40/2004/QĐ-BNN dated August 19, 2004, of the Minister of Agriculture and Rural Development on announcing the List of Fertilizers Permitted for Production, Business, and Use in Vietnam:

a) Microbial fertilizers: Item number 1 page 20;

b) Bio-organic fertilizers: Item number 5 page 22; Item numbers 41, 42, 43 page 24;

c) Foliar fertilizers: Item numbers 264, 269 pages 50, 51; Item numbers 332, 335, 336, 337, 345, 346, 347 pages 55, 56, 57;

2. Types of fertilizers at Decision No. 77/2005/QĐ-BNN dated November 23, 2005, of the Minister of Agriculture and Rural Development on issuing the List of Fertilizers Permitted for Production, Business, and Use in Vietnam:

a) Mineral fertilizers: Item numbers 16, 21, 22, 23, 27, 30, 32, 33 pages 2, 3;

b) Combined organic-mineral fertilizers: Item number 39 page 18; Item numbers 92, 93, 94, 95, 104 page 22;

c) Bio-organic fertilizers: Item numbers 14, 15, 16 page 28;

d) Microbial fertilizers: Item numbers 10, 11 page 30;

đ) Foliar fertilizers: Item number 98 page 38; Item numbers 112, 113 page 40; Item numbers 314, 315, 316, 317 page 54; Item numbers 325, 326 page 55;

3. Types of fertilizers at Decision No. 55/2006/QĐ-BNN dated July 7, 2006, of the Minister of Agriculture and Rural Development on issuing the List of Fertilizers Permitted for Production, Business, and Use in Vietnam:

a) Combined organic-mineral fertilizers: Item numbers 28, 29, 30, 31 page 10; Item numbers 41, 42 page 11;

b) Foliar fertilizers: Item numbers 44, 45, 46, 47, 48 page 16; Item numbers 139, 140, 141, 142, 143, 144, 145, 146, 148, 149, 150, 151, 152, 153, 154, 155, 156, 157 pages 23, 24;

4. Types of fertilizers at Decision No. 10/2007/QĐ-BNN dated February 6, 2007, of the Minister of Agriculture and Rural Development on issuing the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam:

a) Combined organic-mineral fertilizers: Item numbers 14, 15, 16 page 14;

b) Foliar fertilizers: Item numbers 50, 52 page 23; Item numbers 64, 65, 66 page 12; Item numbers 74, 75, 76, 77 page 25;

5. Types of fertilizers at Decision No. 84/2007/QĐ-BNN dated October 4, 2007, of the Minister of Agriculture and Rural Development on issuing the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam:

a) Combined organic-mineral fertilizers: Item number 5 page 2;

b) Bio-organic fertilizers: Item number 6 page 3;

6. Types of fertilizers at Decision No. 102/2007/QĐ-BNN dated December 11, 2007, of the Minister of Agriculture and Rural Development on issuing the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam:

a) Bio-organic fertilizers: Item number 3 page 4;

b) Foliar fertilizers: Item numbers 44, 45 page 8; Item numbers 53, 54 page 9; Item numbers 75, 76 page 11; Item number 99 page 13;

Article 4. The Heads of the Office of the Ministry, the Director of the Crop Cultivation Department, the Head of the Science, Technology, and Environment Department, the Directors of the Departments of Agriculture and Rural Development of provinces and centrally governed cities, the Heads of units, organizations, and individuals related to fertilizer production, business, and use in Vietnam are responsible for implementing this Decision./.
