RESOLUTION

Ninth Session, Twelfth National Assembly Term

(From March 21 to March 29, 2011)

OF THE NATIONAL ASSEMBLY
SOCIALIST REPUBLIC OF VIET NAM

BASED ON THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM IN 1992 AS AMENDED AND COMPLEMENTED BY RESOLUTION NO. 51/2001/QH10;

BASED ON THE LAW ON THE ORGANIZATION OF THE NATIONAL ASSEMBLY AND THE INTERNAL REGULATIONS OF THE NATIONAL ASSEMBLY SESSIONS;

ON THE BASIS OF CONSIDERING THE REPORTS OF THE NATIONAL ASSEMBLY’S ORGANIZATIONS, THE STATE PRESIDENT, THE GOVERNMENT, THE PRIME MINISTER, THE SUPREME PEOPLE'S COURT, THE SUPREME PROSECUTOR’S OFFICE, THE RELEVANT ORGANIZATIONS, AND THE OPINIONS OF NATIONAL ASSEMBLY DELEGATES;

RESOLUTION:

I. ECONOMIC-SOCIAL AFFAIRS AND STATE BUDGET

1. The National Assembly basically agrees with the Government’s and relevant organizations’ reports on supplementary assessment of the results of implementing the socio-economic development plan and state budget for 2010 and the implementation of the socio-economic development plan and state budget in the early months of 2011.

In 2010, there were positive changes in economic and social conditions, with overall objectives and 16 out of 21 key indicators achieving the planned targets, including some high-achieving indicators such as economic growth rate, total export value, job creation, poverty reduction, state budget revenue... However, in the last two months of 2010 and the early months of 2011, consumer price index and inflation increased at a high level; interest rates and exchange rates fluctuated strongly; the gold and foreign currency markets showed complex developments, increasing macroeconomic instability risks, causing difficulties for production and business operations, and adversely affecting people's lives and social psychology.

In light of this situation, the Government, sectors, levels, people, and business community have made efforts to achieve initial results in many areas of social life in the early months of 2011.

2. The National Assembly requests the Government to focus on several key tasks in the near future to achieve the top priority goal of curbing inflation, stabilizing the macro-economy, and ensuring social welfare:

- Strengthening leadership, management, coordination among state agencies at all levels and sectors to ensure the synchronous, reasonable, resolute, and effective implementation of monetary policy and fiscal policy measures according to the orientation set forth in Conclusion No. 02-KL/TW dated March 16, 2011 of the Politburo on the socio-economic situation in 2011 and Resolution No. 11/NQ-CP dated February 24, 2011 of the Government on major measures to concentrate on curbing inflation, stabilizing the macro-economy, and ensuring social welfare. Regularly inspect, audit, promptly identify and handle new adverse economic and social issues during the implementation process to supplement and adjust mechanisms, policies, and solutions appropriately.

- Reasonably reduce public investment; strictly manage budget expenditures; strictly implement regular cost savings, other non-essential expenditures, and reduce the state budget deficit below 5% of GDP.

- Implement decisive measures to reduce the trade deficit both in absolute terms and as a percentage of total export value. Strengthen inspection and supervision, minimize imports of equipment, materials, and goods that can be produced domestically.

- Focus on resolving difficulties and obstacles to minimize the negative impacts on investment, production, and business operations. Firmly establish and effectively implement measures to manage the official gold and foreign currency markets according to current laws. Vigorously apply market management measures to promptly and effectively prevent and combat illegal gold, foreign currency, fuel smuggling, commercial fraud, speculation, and unreasonable price increases.

- Urgently implement orientations and clearly define the roadmap for transitioning the growth model and restructuring the economy, especially the allocation of resources to industries and sectors within the economy in a rational manner, perfecting socialized investment mechanisms; accelerate the reorganization and shareholding of state-owned enterprises; publicly disclose information about financial status and business operations of state-owned enterprises.

- Effectively implement programs to ensure social welfare, particularly supporting households newly escaped from poverty and those close to poverty. Continue to improve and strictly implement policies for persons with meritorious service, social allowances. Expand the scale while improving the quality of vocational training. Pay special attention to employment for rural laborers, urbanized areas, and veterans.

- Implement a comprehensive and resolute system of solutions to reduce traffic congestion and accidents. Improve the quality and effectiveness of anti-corruption work, thrift, law violations, and crime prevention. Strengthen state management over national defense and security, especially in key areas, border regions, and islands.

- Focus on investing in infrastructure, equipment, and human resources for research and forecasting institutions on natural disasters and climate change; enhance weather, hydro-meteorological forecasting capabilities to serve production, business, and daily life.

3. The National Assembly agrees with the proposal to allocate an additional VND 35,000 billion for Vietnam Oil and Gas Group as reported by the Government. During the implementation process, it is requested that the Government direct the execution according to procedures, use for intended purposes, and achieve high efficiency; strengthen auditing and inspection of this investment capital, ensuring compliance with the Investment Law and State Budget Law.

II. ON SUMMARIZING THE WORK OF THE TWELFTH NATIONAL ASSEMBLY TERM.

The National Assembly basically agrees with the draft report on the entire term's work of the National Assembly presented by the Standing Committee of the National Assembly; the term reports of the National Assembly’s organizations, the State President, the Government, the Prime Minister, the Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy; while emphasizing:

1. The National Assembly, the National Assembly’s organizations, the Delegations of National Assembly Members, and National Assembly Members of the Twelfth National Assembly Term has inherited and developed the achievements and lessons learned from previous sessions of the National Assembly, always upholding a sense of responsibility, unity, continuing comprehensive and strong reforms in both organizational structure and operational methods, effectively performing its functions and responsibilities, achieving many important results, making significant contributions to the overall achievements of the country. Legislative activities have made considerable progress, basically meeting the requirements for building, reforming, developing, and protecting the country, contributing to timely and appropriately institutionalizing the Party's guidelines, enhancing the effectiveness of state management and operation. Supervisory activities have been strengthened, with many innovations, achieving practical results, focusing on pressing issues of concern to voters and the people. Decisions on important national issues regarding the economy and society, state budget, and major national projects have become more quality-oriented, closely aligned, and basically timely in response to practical needs. Diplomatic activities have achieved many positive results, significantly contributing to enhancing the country's position on the international stage. Advisory and support mechanisms have been consolidated and improved gradually, effectively fulfilling their assigned functions and tasks. Working methods and systems have seen many improvements towards scientific and regular practices, promoting democracy, increasing initiative and creativity.

The President of the State has performed his duties and powers well, making significant contributions to the country's overall achievements. The activities of the President of the State have clearly demonstrated the role of the head of state in domestic and foreign affairs, promoting cooperation in various fields between Vietnam and countries and regions around the world; establishing close relations with legislative, executive, judicial bodies, the United Front, and political and socio-political organizations, effectively performing other assigned tasks and powers according to the Constitution and laws.

The Government and the Prime Minister have inherited valuable achievements and experiences from over 20 years of renovation, overcome difficulties, enhanced the effectiveness of management and operation, successfully implemented plans for economic and social development: promptly responding and decisively directing urgent issues, ensuring the full mobilization of the nation's strength, maintaining political stability, public order, and social security, sustaining a relatively high economic growth rate, and ensuring social welfare. The Prime Minister has made significant efforts to fulfill his assigned duties and powers, generally completing his responsibilities well, ensuring that government operations meet the requirements for economic and social development, national defense and security, and foreign relations in new circumstances. The Government and the Prime Minister have made important contributions to the country's overall achievements.

The Chief Justice of the Supreme People's Court and the Procurator General of the Supreme People's Procuracy have effectively fulfilled their functions and responsibilities, positively contributing to the country's overall achievements; judicial reform has been emphasized and accelerated: transparency and democracy in trial activities have shown positive changes; the implementation of prosecution and judicial supervision rights has been better enforced.

2. The National Assembly proposes that in the coming time, the agencies of the National Assembly, the Government, the Prime Minister, the Chief Justice of the Supreme People's Court, and the Procurator General of the Supreme People's Procuracy study and absorb the valuable opinions of National Assembly deputies to enhance the effectiveness of their activities; at the same time, pay attention to the following issues:

- Continuing to reform the legislative process, ensuring consistency and rationality, enhancing the responsibility of agencies proposing draft laws, participating in drafting, reviewing, and finalizing. Urgently promulgating or amending and supplementing laws regulating certain socially pressing areas. Amending and supplementing specific provisions of the Law on the Supervisory Activities of the National Assembly and the Law on the Organization of the National Assembly. Strengthening information work serving the National Assembly's examination and decision-making on important national issues. Supplementing mechanisms and policies to ensure conditions for the activities of National Assembly agencies and deputies, especially specialized deputies.

- Enhancing the quality of commendation and reward work, special amnesty work, ratification of international treaties...

- Implementing effectively resolutions of the National Assembly, particularly those on economic and social matters, state budget, post-supervision resolutions, and legal provisions on reporting systems. Accelerating administrative reform progress, further strengthening discipline and rule-based administration; focusing on the quality of economic growth linked to sustainable development, environmental protection, and social welfare; resolutely directing to create clear changes in anti-corruption work, thrift, complaint resolution, social evil prevention... Emphasizing practical experience summarization to build appropriate economic models linked to improving the socialist-oriented market economic system.

- Developing plans and measures to effectively implement programs for reforming the organization and activities of courts and procuracies according to Resolution No. 49-NQ/TW dated June 2, 2005 of the Politburo on the strategy for judicial reform until 2020, and related resolutions of the National Assembly and the Standing Committee of the National Assembly concerning the organization and activities of the judiciary. Improving laws on forensic expertise and mechanisms to strengthen the procuracy's responsibility towards investigative and judicial supervision activities; reforming and enhancing the quality of court trial activities; coordination in activities between the judiciary and procuracy sectors.

Implementing more urgently solutions regarding organization and training to build a clean, strong cadre team in the judiciary and procuracy, with political integrity, professional ethics, and higher expertise levels, meeting the increasingly high demands of judicial reform and international integration.

Chapter III. The National Assembly calls on compatriots and service members throughout the country to uphold the patriotic and revolutionary traditions, be dynamic and creative, seize opportunities, overcome challenges, and strive to achieve success in implementing the Resolution of the Eleventh National Congress of the Party, the Resolutions of the National Assembly, with the immediate goal of comprehensively completing the plan for economic and social development in 2011, organizing successfully the election of deputies to the Thirteenth National Assembly and People's Council representatives at all levels for the 2011-2016 term, contributing to building and consolidating, and improving the state apparatus in the coming period.

This Resolution was adopted by the National Assembly of the Socialist Republic of Vietnam, the twelfth session, ninth meeting, on March 29, 2011./.
