||| Considering the proposal of the Director of the Department of Primary Education,

||| The Minister of Education and Training issues this Circular regulating the standards for evaluation and recognition of primary schools meeting minimum quality levels and national standards:

Article 1. ||| Attached to this Circular are the Regulations on Standards for Evaluation and Recognition of Primary Schools Meeting Minimum Quality Levels and National Standards.

Article 2. ||| This Circular takes effect from February 18, 2013.

||| This Circular replaces Decision No. 32/2005/QĐ-BGDĐT dated October 24, 2005 of the Minister of Education and Training promulgating the Regulation on Recognition of Primary Schools Meeting National Standards; Decision No. 55/2007/QĐ-BGDĐT dated September 28, 2007 of the Minister of Education and Training promulgating the Provision on the Minimum Quality Level of Primary Schools.

 

Article 3. ||| The Heads of the Office, the Director of the Department of Primary Education, the Heads of units related to the Ministry of Education and Training; Chairmen of People's Committees of provinces and centrally governed cities; Directors of Departments of Education and Training shall be responsible for implementing this Circular.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This document stipulates the standards, inspection procedures, and recognition criteria for primary schools meeting minimum quality levels and national standards.

2. This document applies to primary schools within the national education system; relevant organizations and individuals.

Article 2. Recognition Levels

Evaluation of primary schools is divided into three levels:

1. Primary schools meeting minimum quality levels;

2. Primary schools meeting national standards level 1;

3. Primary schools meeting national standards level 2.

Article 3. Explanation of Terms

In this document, the following terms are understood as follows:

1. Primary schools meeting minimum quality levels are those that meet basic requirements to ensure appropriate quality in line with primary education objectives;

2. Primary schools meeting national standards level 1 are those that meet necessary standards for national standard primary schools to ensure comprehensive educational activities of high quality in line with primary education objectives;

3. Primary schools meeting national standards level 2 are those that meet necessary standards for national standard primary schools to ensure comprehensive educational activities of higher quality than level 1, laying the foundation for approaching the development level of primary schools in advanced countries in the region and worldwide.

Article 4. Purpose of Recognizing Primary Schools Meeting Minimum Quality Levels and National Standards

1. The minimum quality level serves as a basis for planning investment in resources for primary education, particularly in difficult areas, ensuring that children in any circumstances can access essential and basic education, contributing to the universalization of primary education and eradication of illiteracy.

2. The standards for primary schools meeting national standards serve as a basis for planning investment in resources for primary education, contributing to the universalization of primary education at the correct age, ensuring continuous improvement in the quality and effectiveness of primary education.

Article 5. Conditions and Recognition Period

1. For primary schools meeting the minimum quality level

a) Conditions for primary schools to be inspected and recognized as meeting the minimum quality level:

- Having independent facilities, with all grade levels of the entire educational stage;

- Meeting the standards stipulated in Section 1 of Chapter II of this Circular.

b) The recognition period for primary schools meeting the minimum quality level is five years from the date of signing the Decision on Recognition. Within the five-year period, if a school that has met the minimum quality level violates the prescribed standards, it may have its Recognition Decision revoked depending on the nature and severity of the violation. Five years from the date of signing the Recognition Decision, schools must self-assess, prepare documentation, and submit to the competent authorities for re-inspection and re-recognition. Schools that have met the minimum quality level need to continue striving to meet national standards. Schools that fail to meet the minimum quality level upon inspection need to continue striving and can only request re-inspection in the following academic year.

2. For primary schools meeting the national standard

a) Conditions for primary schools to be inspected and recognized as meeting the national standard:

- Receiving the title of advanced primary school in the previous academic year;

- Meeting the standards stipulated in Section 2 of Chapter II of this Circular for primary schools applying for recognition at national standard level 1, or meeting the standards stipulated in Section 3 of Chapter II of this Circular for primary schools applying for recognition at national standard level 2.

b) The recognition period for primary schools meeting the national standard is five years from the date of signing the Recognition Decision. Within the five-year period, if a school that has met the national standard violates the prescribed standards, it may have its Recognition Decision and Certificate of Recognition revoked depending on the nature and severity of the violation. Five years from the date of signing the Recognition Decision, schools must self-assess, prepare documentation, and submit to the competent authorities for re-inspection and re-recognition. Schools that fail to meet the national standard upon inspection need to continue striving and can only request re-inspection in the following academic year.

Article 6. Competent Authority for Recognizing Primary Schools Meeting the Minimum Quality Level and National Standard

1. The People's Committee of the district, town, city under provincial administration (hereinafter referred to as the District People's Committee) decides on recognition for primary schools meeting the minimum quality level.

2. The People's Committee of the province, centrally-administered city (hereinafter referred to as the Provincial People's Committee) decides on recognition for primary schools meeting the national standard.

Chapter II

STANDARDS FOR EVALUATING PRIMARY SCHOOLS

Section 1

PRIMARY SCHOOLS MEETING THE MINIMUM QUALITY LEVEL

Article 7Standards 1: Organization and Management of the School

1. Organizational Structure of the School

a) The principal, vice-principal, and councils (school council for public schools, management council for private schools, commendation and competition council, and other advisory councils) operate according to current regulations in the Charter of Primary Schools;

b) The school has the Communist Party of Vietnam organization, Trade Union, Ho Chi Minh Communist Youth Union, Ho Chi Minh Pioneer Team, Ho Chi Minh Young Scout Team, and other social organizations according to current regulations in the Charter of Primary Schools;

c) The school has specialized subject groups, office groups, and operates according to current regulations in the Charter of Primary Schools.

2. Classrooms, Number of Students, Schools, Branches

a) Classrooms and number of students per class follow current regulations in the Charter of Primary Schools;

b) Location of the school and branches follows current regulations in the Charter of Primary Schools.

3. Implementation of Party Policies, State Laws, Leadership and Guidance of the Party Committee, Local Government, and Educational Management Authorities; Ensuring Democratic Regulations in School Activities

a) Implementing directives and resolutions of the Party Committee, complying with administrative management by local government, and professional guidance by educational management authorities;

b) Regularly reporting and submitting urgent reports as required;

c) Ensuring democratic regulations in school activities.

4. Administrative Management and Implementation of Competitive Movements

a) Documentation serving educational activities of the school follows current regulations in the Charter of Primary Schools;

b) Properly storing and archiving documents and texts according to the Law on Archives;

c) Implementing campaigns and organizing and maintaining competitive movements according to industry guidelines and state regulations.

5. Management of Educational Activities, Staff, Teachers, Employees, Students, Financial Management, Land, and Facilities

a) Implementing tasks related to managing educational activities and students:

- Implementing the education program and teaching plan issued by the Minister of Education and Training;

- Assigning specific annual tasks to each teacher, staff member, and employee including educational tasks, supporting children in difficult circumstances, and girls;

- Maintaining records and evaluations according to regulations on the quantity and quality of student education over each academic year and five consecutive years;

- Developing plans and measures to guide the management of classes at branches to ensure teaching quality;

- Planning, implementing, and coordinating with preschool institutions to create favorable conditions for students before entering first grade;

- Statistics and tracking students currently enrolled in the school and children aged 6 to 14 outside the school within the commune or ward monitored for universal education (categorized by age, gender, ethnic group, disability, and difficult circumstances);

- Adhering to current laws on asset and financial management; publicly disclosing annual income and expenditure managed by the principal;

- Maintaining communication books with parents or guardians of students.

b) Implementing recruitment and management of staff, teachers, and employees according to current regulations of the Civil Servants Law, Public Servants Law, Charter of Primary Schools, and other relevant laws.

c) Manage and utilize financial resources, land, and infrastructure in accordance with regulations and efficiently to serve educational activities.

6. Ensure security, order, and safety for students and staff members.

a) Implement regulations and develop plans to ensure security, prevent accidents, fires, natural disasters, diseases, food poisoning, and social evils within the school.

b) Ensure safety for students and staff members in accordance with current regulations stipulated in the School Charter for Primary Schools.

c) There should be no discrimination based on gender, violence, or other forms of prejudice within the school.

Article 8Standards 2: Management staff, teachers, employees, and students

1. Competence of management staff

a) The principal and vice-principals must have at least a secondary education in pedagogy. The principal must have at least four years of teaching experience, while the vice-principal must have at least two years of teaching experience (excluding probationary periods).

b) Annually evaluate the principal and vice-principal according to the Standards for Primary School Principals, achieving at least a satisfactory level.

c) The principal and vice-principal must undergo political and educational management training as prescribed.

2. Quantity and Qualifications of Teachers

a) Ensure sufficient teachers to teach mandatory subjects as prescribed by the Ministry of Education and Training. For primary schools operating one session per day, there must be at least 1.2 teachers per class on average; for those operating two sessions per day, there must be at least 1.5 teachers per class on average.

b) Have a teacher responsible for the Vanguard Youth League.

c) At least 90% of teachers must meet or exceed the required qualifications.

d) Implement regular training programs as prescribed by the Ministry of Education and Training.

3. Evaluation Results and Rights of Teachers

a) Teachers meeting the required qualifications must be evaluated according to the Standards for Primary School Teachers, achieving at least a satisfactory level.

b) At least 40% of teachers must achieve the title of Excellent Teacher at the school level.

c) Training and Development: The school must plan development programs so that all teachers meet or exceed qualification standards; strictly implement regular training programs as prescribed by the Ministry of Education and Training; at least 50% of teachers must be rated as good or excellent in regular training.

d) Ensure teachers' rights as prescribed by the School Charter and relevant laws.

4. The school must have staff members who complete their tasks and are provided with state policies regarding accounting, treasury, clerical work, school health, and equipment technicians.

5. Students

a) Ensure student age requirements as stipulated in the current School Charter.

b) Students must fulfill all duties and not be disciplined for violating prohibited behaviors as stipulated in the current School Charter.

c) Students must be guaranteed their rights as prescribed in the current School Charter.

 

Article 9Standard 3: Infrastructure and Teaching Equipment

1. Campus, Gate, Fence, Playgrounds, and Exercise Areas

a) The campus area and green, clean, beautiful, and airy conditions must meet the requirements for organizing educational activities.

b) Must have a gate, school name sign, and surrounding wall.

c) Must have playgrounds and exercise areas.

2. Classrooms, Blackboards, Desks, and Chairs for Teachers and Students

a) Sufficient classrooms for classes without triple shifts. Classrooms must be built according to specifications and provide adequate lighting.

b) Student desks and chairs must meet hygiene requirements; suitable desks and chairs for students with disabilities must be available.

c) The size, color, and hanging method of blackboards in classrooms must comply with hygiene requirements.

3. Office Rooms and Equipment for Administrative Work, Teaching, and Learning

a) Educational rooms include libraries and equipment storage rooms; administrative rooms include principals' offices and meeting rooms.

c) School health room must have essential medicine cabinets.

d) Must have office equipment (computers, printers) to support management and teaching.

4. Bathrooms, Parking Areas, Clean Water Supply, Drainage Systems, and Waste Collection

a) Separate bathrooms for male and female staff members, and separate bathrooms for male and female students.

b) Safe and convenient parking areas for staff members and students.

c) A clean water supply to meet the needs of staff members and students; drainage and waste collection systems must ensure environmental hygiene.

5. Library

a) The library must be equipped with textbooks, reference materials, newspapers, and magazines to support teaching and learning activities.

b) Library operations must meet the needs of teachers and students for teaching and learning.

c) The library must be replenished annually with books, newspapers, and reference materials.

6. Teaching Equipment and Effectiveness of Equipment Usage

a) Minimum teaching equipment to support teaching and learning must comply with the Ministry of Education and Training's regulations:

- The school must have educational equipment according to the minimum list prescribed by the Ministry of Education and Training.

- Each teacher must have at least one set of necessary office supplies, one set of textbooks, teaching guides, and other necessary materials during teaching.

- Each student must have at least one set of textbooks and basic study materials. Ethnic minority students must be supported with appropriate teaching methods, educational activities, and study materials to assist in learning Vietnamese.

b) Teachers must be aware of using teaching equipment in classes and make some teaching aids to meet the requirements of primary education.

c) Inventory, repair, upgrade, and supplement teaching aids and equipment annually.

Article 10Standard 4: Relationships between the School, Families, and Society

1. Organization and Effectiveness of the Parent-Teacher Association

a) The organization, duties, rights, responsibilities, and activities of the Parent-Teacher Association shall be carried out in accordance with the Charter of the Parent-Teacher Association issued by the Minister of Education and Training;

b) The school creates conditions for the Parent-Teacher Association to operate;

c) Organize meetings between the school and parents, the Parent-Teacher Association to receive opinions on the management work of the school, measures to educate students, resolve parents' requests, and provide suggestions for the activities of the Parent-Teacher Association;

2. Advisory work of the school with the Party Committee, administrative authorities, and coordination with local organizations and associations;

a) The school advises the Party Committee, administrative authorities, and coordinates with organizations and associations to build a healthy educational environment within the school and in the locality;

b) Mobilize and effectively utilize social resources to construct infrastructure, supplement teaching equipment, reward excellent students, and support poor students;

3. The school coordinates with local organizations and associations, mobilizes community participation to educate students about national history and culture, and implement educational goals and plans;

a) Coordinate effectively with organizations and associations to educate students about national history and culture;

b) Promote awareness in the community about the content, methods, and evaluation of elementary school students, creating conditions for community involvement in achieving educational goals and plans;

4. Publicize the school's revenue sources according to current regulations on transparency for national education institutions;

1. Implement the elementary school education program, the teaching plan of the Ministry of Education and Training, and the professional regulations of the local education management agency;

a) Develop annual, semester, monthly, and weekly activity plans in accordance with the current Elementary School Charter;

b) Teach all subjects as prescribed at the elementary level; increase teaching time for Vietnamese and Mathematics for students with cognitive difficulties; closely follow basic requirements of knowledge and skills standards; select appropriate content, duration, methods, and formats suitable for each student group to ensure teaching and learning quality, meet cognitive abilities, and developmental needs under local conditions;

c) Provide remedial education for gifted and struggling students;

2. Extracurricular activities of the school;

a) Have programs and plans for extracurricular educational activities;

b) Organize extracurricular activities according to plans, suitable for students' age groups;

c) Assign and mobilize teachers and staff to participate in extracurricular activities;

3. Universal primary education campaign;

a) Participate in implementing universal primary education targets, preventing illiteracy among the population;

b) Organize "National Day for Sending Children to School"; enroll at least 95% of six-year-olds into first grade; achieve an age-appropriate enrollment rate of 85% or higher;

c) Support children from particularly difficult circumstances and those with disabilities to attend school;

4. Student educational classification results;

a) At least 90% of students classified as average or above;

b) At least 30% of students classified as good, and at least 5% classified as excellent;

c) Students participating in competitions and exchanges organized by various levels;

5. Organizing activities for physical care, environmental protection education;

a) Educate students on self-care for health;

b) Organize health check-ups and vaccinations for students;

c) Organize students to participate in environmental protection activities;

6. School training effectiveness;

a) At least 85% of students complete the elementary school curriculum after five years of study;

b) At least 90% of fourteen-year-olds complete the elementary school curriculum;

7. Life skill education, creating opportunities for students to participate in the learning process;

a) Educate and train life skills appropriate to students' ages;

b) Create opportunities for students to actively, proactively, and creatively participate in the learning process;

c) Encourage students to collect and make their own learning materials; proactively cooperate and help peers in learning;

Section 2

NATIONAL ELEMENTARY SCHOOL STANDARDS LEVEL 1;

 

Contents of patrols and controls2Standards 1: Organization and Management of the School

Meet the provisions of Article 7 of this Circular, supplemented by additional requirements as follows:

1. Fulfillment of tasks by specialized departments and office;

The school regularly organizes professional exchange activities, thematic seminars, field trips, and experience-sharing sessions with other schools, and provides specific reports and evaluations for each activity;

2. Administrative management and implementation of competitive movements;

a) Apply information technology in management work;

b) Actively, innovatively, and achieve high results in implementing campaigns and competitive movements according to industry guidelines and state regulations;

3. Management of educational activities;

a) The school develops annual, semester, monthly, and weekly activity plans; sets development directions for each period; implements plans with appropriate measures;

b) Manage and effectively utilize infrastructure to serve teaching, learning, and other educational activities;

c) Organizations, associations, and school councils operate and function effectively;

d) The school complies with direct professional and vocational guidance from the district education and training department. Strictly report periodically and urgently (if necessary) on elementary education situations in the locality to superiors as stipulated;

Meet the provisions of Article 8 of this Circular, supplemented by additional requirements as follows:

1. Management staff capacity;

a) Principal and deputy principal qualifications from College of Education or higher; principal has at least five years of teaching experience, deputy principal has at least three years of teaching experience (excluding probationary period);

b) Annually evaluate the principal and deputy principal according to the Elementary School Principal Standards Regulations, achieving at least a good rating.

2. Quantity and Qualifications of Teachers

a) Ensure an adequate number and structure of teachers to teach subjects as prescribed by the Ministry of Education and Training. Teachers teaching physical education, music, fine arts, foreign languages, and information technology who have not undergone primary school teacher training must be trained and obtain a Primary School Teacher Certificate;

b) All teachers must meet the required qualification standards, with at least 40% of teachers meeting higher-than-required qualifications;

c) Teacher training and development work: The school has plans to build and develop staff, and training programs so that all teachers meet and exceed qualification standards; strictly implement regular training programs as prescribed by the Ministry of Education and Training; each teacher has a plan and implements self-development to improve their professional expertise; at least 70% of teachers are rated as good or excellent in regular training, including at least 25% rated as excellent, with no teachers failing to complete their plans;

3. Evaluation and classification results for teachers

a) At least 50% of teachers must be rated as good or better, including at least 15% rated as outstanding according to the Professional Standards for Primary School Teachers;

b) At least 50% of teachers must be awarded the title of Excellent Teacher at the school level, with at least 20% achieving this title at the district level or higher; there should be no teachers rated as weak or poor in professional expertise;

Contents of patrols and controls4. Standard 3: Infrastructure and Teaching Equipment

Meet the requirements set out in Article 9 of this Circular, supplemented by the following additional requirements:

1. Area, Campus, Playgrounds, and Exercise Fields

a) The area, campus, playgrounds, and exercise fields shall comply with the current regulations stipulated in the Charter of Primary Schools;

b) For schools located in cities, towns, and townships built before 1997, due to special conditions, the area of the school campus may be calculated based on the usable floor area; there must be playgrounds and exercise fields that ensure students can practice regularly and effectively; organize at least one session per month for students to learn outside the classroom;

c) Ensure a green, clean, beautiful, quiet, ventilated, and convenient environment for students' study and play; there should be no stalls or residences within the school area; the surrounding environment of the school should be clean, beautiful, and safe;

d) The area of playgrounds and sports exercise fields (or multi-purpose halls) shall be arranged and constructed in accordance with the current regulations stipulated in the Charter of Primary Schools; the schoolyard should have shade trees and grass cover;

2. Classrooms, Blackboards, Desks, and Chairs for Teachers and Students

a) The school shall have a maximum of 30 classes; each class shall have a maximum of 35 students. There must be one classroom per class. The classroom area must meet the current standards set by the Ministry of Health;

b) The size, material, structure, style, and color of student desks and chairs must comply with the current regulations set by the Ministry of Education and Training, the Ministry of Science and Technology, and the Ministry of Health;

3. Office Rooms and Equipment for Administrative Work, Teaching, and Learning

a) The blocks for learning support and administrative management shall comply with the current regulations stipulated in the Charter of Primary Schools;

b) The kitchen and dormitory areas (if any) must ensure health and safety conditions for students;

4. Bathrooms, Parking Areas, Clean Water Supply, Drainage Systems, and Waste Collection

a) The sanitation facilities for staff, teachers, employees, and students must meet safety, convenience, cleanliness requirements, and be located appropriately in relation to the school's landscape;

b) There must be parking facilities for staff, teachers, employees, and students, ensuring safety and convenience;

5. Library

a) The library must meet the standard or higher as prescribed by the Ministry of Education and Training regarding the standards for school libraries;

b) The library's activities must meet the research and teaching needs of staff, teachers, and the learning needs of students;

6. Teaching Equipment and Effectiveness of Equipment Usage

Utilize teaching equipment during lessons and teachers must make some teaching aids to ensure effectiveness and meet the requirements for content and method reform as stipulated in the Primary Education Program;

Contents of patrols and controls5. Standard 4: Relationships between the School, Families, and Society

Meet the requirements set out in Article 10 of this Circular, supplemented by the following additional requirements:

1. The school must take the initiative and actively advise Party committees, authorities, and coordinate with local organizations to create a healthy educational environment both within the school and in the community;

2. The school must cooperate with local organizations and mobilize community participation to educate students about historical traditions, cultural heritage, moral values, laws, arts, and physical education, and to achieve educational goals and plans;

3. Care for historical and revolutionary sites, cultural works, and families of war heroes, those who have made contributions to the country, and mothers honored as heroic;

4. Mobilize contributions from organizations, individuals, and families to build infrastructure, supplement teaching and learning equipment, reward excellent teachers and students, and support impoverished students;

Contents of patrols and controls6. Standard 5: Educational Activities and Educational Outcomes

Meet the requirements set out in Article 11 of this Circular, supplemented by the following additional requirements:

1. Implementation of the Curriculum and Teaching Plan

a) Teach all subjects according to the curriculum and plan, ensuring the requirements of knowledge and skills standards; select appropriate content, duration, methods, and forms of teaching suitable for different groups and meet the cognitive abilities of individual students;

b) At least 50% of students must attend school for two sessions per day, with annual plans to increase the number of students attending two sessions per day;

2. Extracurricular activities of the school;

Organize extracurricular activities according to the plan with various forms suitable for the age group of students and achieve practical results;

3. Universal primary education campaign;

a) The school must meet the criteria for universal primary education at level 1 or above; there should be no illiteracy phenomena in the locality;

b) Organize the "National Day for Sending Children to School" well; enroll 100% of six-year-old children into first grade; the enrollment rate for the correct age group must reach 90% or more;

4. Student educational classification results;

a) The percentage of students rated as average or better in education must be at least 96%;

b) The percentage of students rated as good or excellent in education must be at least 50%, with at least 15% rated as excellent;

c) Students must participate in and win awards in competitions and exchanges organized by the district level or higher.

5. Organizing activities for physical care, environmental protection education;

a) Organize regular health check-ups and vaccinations for students;

b) Organize for students to participate in environmental protection activities, recreational activities, physical education and sports...

6. School training effectiveness;

a) The proportion of students completing the primary school curriculum within five years shall be at least 90%;

b) The proportion of children aged 11 who complete the primary school curriculum shall be 95% or higher.

Section 3

NATIONAL STANDARD SCHOOL FOR PRIMARY EDUCATION LEVEL 2

 

Article 17Standards 1: Organization and Management of the School

 

Meet the provisions set out in Article 12 of this Circular, supplemented with the following requirements:

1. Administrative Management

Effectively apply information technology to various fields of school management.

2. Management of Educational Activities, Management of Staff, Teachers, and Employees

a) Implement administrative work creatively, fully utilizing the capabilities of teachers and staff in building and developing the school;

b) Assign specific annual tasks to each teacher, staff member, and employee in educational activities, including support for children from difficult circumstances and girls;

c) Organize for 100% of teachers to participate in regular training and practical thematic sessions.

Article 18: Standards 2: Management staff, teachers, employees, and students

Meet the provisions set out in Article 13 of this Circular, supplemented with the following requirements:

1. Management staff capacity;

a) The headmaster and deputy headmaster must have a minimum qualification of a Bachelor's degree from a Teacher Training University;

b) Annually evaluate the headmaster and deputy headmaster according to the Headmaster Standard for Primary Schools, achieving an excellent level.

2. Quantity, Qualifications, and Competence of Teachers

a) Have specialized teachers for physical education, music, fine arts, foreign languages, and computer science; have a dedicated team leader for the Young Pioneer Organization;

b) All teachers must meet the standard qualifications, with at least 70% of teachers having qualifications above the standard;

c) Professional competence:

- Be flexible and creative in using positive teaching methods and educating students. Each year, teachers must have innovative ideas or improvements in teaching methods or applied educational research results that achieve good or excellent levels from the school level upwards;

- Develop individual lesson plans for outstanding and weak students in the class;

- Effectively apply information technology in teaching;

- Fully participate in all professional activities, thematic sessions, and social activities organized by the school or coordinated with other organizations;

- Each teacher must have a development plan after being evaluated according to the Vocational Standard issued by the Ministry of Education and Training to continuously improve their qualifications and professional competence. This plan must be kept in the teacher's personal file.

3. Evaluation and classification results for teachers

a) At least 75% of teachers must achieve a good grade or higher, with at least 25% of teachers achieving an excellent grade according to the Primary School Teacher Standard;

b) At least 60% of teachers must receive the title of Excellent Teacher at the school level, with at least 30% of teachers receiving the title of Excellent Teacher at the district level or higher; there should be no teachers with poor professional or vocational performance;

c) At least 90% of teachers must be rated as good or excellent in regular training, with at least 30% of teachers rated as excellent in regular training, and no teachers failing to complete their plans.

Contents of patrols and controls9Standard 3: Infrastructure and Teaching Equipment

Meet the provisions set out in Article 14 of this Circular, supplemented with the following requirements:

1. Student Desks and Chairs

Ensure compliance with current standards for desks and chairs in primary schools, secondary schools, and high schools.

2. Classrooms and Equipment for Management, Teaching, and Learning

a) Have separate rooms for teaching music, fine arts, and computer science; have a permanent office room, and a special classroom for students with particular difficulties;

b) Functional rooms must have essential equipment arranged reasonably and scientifically to serve school activities and recorded comprehensively in the logbook;

c) The kitchen, dining hall, and dormitory areas must ensure healthy and safe conditions for students;

d) There must be a place to store common files and documents.

3. The library must meet the needs of research and teaching for staff, teachers, employees, and students, and maintain a comprehensive logbook of library activities.

4. Equipment for Teaching and Learning

a) The school must have modern equipment (computers, projectors) to serve teaching and learning activities;

b) Provide filing cabinets and teaching materials for teachers and students in each classroom;

c) Self-made teaching aids must be used effectively and supplemented annually.

Article 20. Standard 4: Relationships between the School, Families, and Society

Meet the provisions set out in Article 15 of this Circular, supplemented with the following requirements:

Annually, the school advises the People's Committee of the commune, ward, or town (hereinafter referred to as the Commune-level People's Committee) to organize roundtable discussions, commitments, and sign minutes between the school and community organizations, parents of students regarding the maximum mobilization of children of school age, especially those from difficult circumstances and disabled children.

Article 21. Standard 5: Educational Activities and Educational Outcomes

Meet the provisions set out in Article 16 of this Circular, supplemented with the following requirements:

1. Implementation of the Curriculum and Teaching Plan

a) Develop specific educational plans to nurture students with talents, provide remedial classes for weaker students, and integrate education plans for disabled students;

b) Set an appropriate educational theme each academic year based on the unique characteristics of the school;

c) At least 80% of students attend school for two sessions per day, and develop plans for all students to attend two sessions per day.

2. Extracurricular Activities

a) Organize extracurricular activities according to plans with diverse forms to meet the developmental needs of students and achieve good results;

b) Strengthen life skills education suitable for the age group of students;

c) Allocate appropriate time for students to engage in extracurricular studies and activities throughout the academic year.

3. Universal primary education campaign;

a) The commune where the school is located must be recognized as having achieved universal primary education at Level I or higher. There should be no illiterate individuals in the eligible age group;

b) Develop specific plans and measures to maximize the enrollment of children of school age and support students from particularly difficult circumstances.

4. Student educational classification results;

a) The proportion of students rated as average or higher in education must be at least 98%;

b) The proportion of students rated as good or excellent in education must be at least 70%, with at least 25% rated as excellent;

c) Students must participate and achieve awards in competitions and exchanges organized by provincial authorities or higher.

5. Organizing activities for physical care, environmental protection education;

a) Strengthen activities for students' entertainment and physical exercise to develop their physical health; identify, create conditions, and nurture students with talents;

b) Organize for students to participate in environmental protection activities, building green, clean, beautiful, and safe schools.

6. School training effectiveness;

a) The proportion of students completing the primary school program within five years shall be at least 95%;

b) Children aged 11 who complete the primary school program shall reach 98% or more.

 

Chapter III

RECORDS, PROCEDURES FOR INSPECTION AND RECOGNITION

PRIMARY SCHOOLS MEETING THE MINIMUM QUALITY STANDARDS,

PRIMARY SCHOOLS MEETING NATIONAL STANDARDS

Article 22. Recovery File

1. For primary schools applying for recognition of minimum quality standards, the dossier submitted to the Department of Education and Training shall include:

a) Self-inspection reports of the school according to each specified content, confirmed by the People's Committee of the commune;

b) A document from the school requesting the Department of Education and Training to inspect and recognize.

2. For primary schools applying for recognition of national standards

a) The dossier submitted to the People's Committee of the district shall include:

- Self-inspection reports of the school according to each specified content, confirmed by the People's Committee of the commune;

- A document from the Chairman of the People's Committee of the commune requesting the People's Committee of the district to inspect and review;

b) The dossier submitted to the People's Committee of the province shall include:

- Self-inspection reports of the school according to each specified content, confirmed by the People's Committee of the commune;

- Reports on the results of the inspection team's review at the district level;

- A document from the People's Committee of the district requesting the People's Committee of the province to inspect and recognize.

 Article 23. Procedures and formalities for inspection, examination, and recognition

1. For schools meeting the minimum quality standards:

a) Based on the criteria stipulated for the minimum quality standards, the primary school and the People's Committee of the commune shall conduct self-inspections and evaluations. If deemed satisfactory, the People's Committee of the commune shall prepare a document along with the inspection record to request the Department of Education and Training to review and evaluate;

b) Within 20 (twenty) working days from the date of receiving a valid dossier, the Department of Education and Training shall decide to establish an inspection team and complete the review of the inspection results of the primary school and the People's Committee of the commune. In case the dossier is incomplete or does not comply with regulations, the Department of Education and Training shall return the dossier or send a document requesting the school and the People's Committee of the commune to supplement the dossier to make it valid;

c) Based on the inspection results, the Department of Education and Training shall prepare a document along with the inspection record to request the Chairman of the People's Committee of the district to decide on recognition for primary schools meeting the minimum quality standards;

d) Within 20 (twenty) working days from the date of receiving the request document from the Department of Education and Training, the Chairman of the People's Committee of the district shall examine and decide on recognition for primary schools meeting the minimum quality standards.

2. For schools meeting national standards:

a) Based on the criteria stipulated for primary schools meeting national standards, the primary school and the People's Committee of the commune shall conduct inspections and evaluations according to the levels of compliance (Level 1 or Level 2). If the school meets the national standards at a certain level, the People's Committee of the commune shall prepare a document along with the inspection record to request the People's Committee of the district to organize reviews at that level;

b) Within 20 (twenty) working days from the date of receiving a valid dossier, the People's Committee of the district shall decide to establish an inspection team and complete the review according to the request of the People's Committee of the commune. In case the dossier is incomplete or does not comply with regulations, the People's Committee of the district shall return the dossier or send a document requesting the People's Committee of the commune to supplement the dossier to make it valid;

The inspection team at the district level (comprising representatives of relevant agencies designated by the Chairman of the People's Committee of the district) shall conduct reviews of the inspection and evaluation results of the People's Committee of the commune. Based on the review results, if the school meets the national standards at a certain level, the inspection team shall prepare a report and the People's Committee of the district shall prepare a proposal to request the People's Committee of the province to organize reviews at that level;

c) Within 20 (twenty) working days from the date of receiving a valid dossier, the People's Committee of the province shall decide to establish an inspection team and complete the review according to the request of the People's Committee of the district. In case the dossier is incomplete or does not comply with regulations, the People's Committee of the province shall return the dossier or send a document requesting the People's Committee of the district to supplement the dossier to make it valid;

The inspection team at the provincial level (comprising representatives of relevant agencies designated by the Chairman of the People's Committee of the province) shall conduct reviews of the inspection and evaluation results of the People's Committee of the district. Based on the review results, if the school meets the standards at a certain level, the inspection team at the provincial level shall prepare a document along with the inspection record to request the Chairman of the People's Committee of the province to decide and issue a Certificate of Recognition of National Standards at that level;

d) Within 20 (twenty) working days from the date of receiving the request document from the provincial inspection team, the Chairman of the People's Committee of the province shall decide and issue a Certificate of Recognition of National Standards (Level 1 or Level 2) for the primary school.

Article 24. Content of Inspection and Evaluation

1. Inspect records and books: registration books, universal education completion books, student assessment and classification records, communication books between families and schools, lists of students completing the primary school program, principals' annual plans, teachers' teaching plans, school property books, and other related documents required by the inspection team.

2. Inspect infrastructure, classrooms, functional rooms, and teaching equipment of the school.

3. Collect opinions of organizations and individuals inside and outside the school regarding the school's educational activities and other related issues if necessary.

4. Observe classes and assess the quality of teaching by teachers and learning by students.

5. Record inspection and evaluation results for each criterion and provide a general conclusion.

Article 25. Inspection and Reconfirmation of Primary Schools Meeting Minimum Quality Standards and National Standards

At the end of five years from the date of signing the decision recognizing primary schools as meeting minimum quality standards or national standards, such schools shall conduct self-inspections and submit applications to competent authorities for reinspection and reconfirmation.

PART IV

IMPLEMENTATION

Article 26Responsibilities of Primary Schools

1. Advise local Party committees and administrative bodies to develop plans for building and developing schools to meet minimum primary school quality standards or national standards.

2. Organize self-assessments and request competent authorities to inspect and confirm that the school meets minimum quality standards or national standards if it is deemed to satisfy the criteria stipulated in this Circular.

3. For primary schools recognized as meeting minimum quality standards or national standards, they must continue to maintain, strengthen, and promote achieved results, and advise local Party committees and administrative bodies to develop plans to strive for higher primary school standards.

Article 272. Direct and inspect the BDTX work of teachers and managers at educational institutions under their management authority.

1. Advise the People's Committee of the district on planning for construction and investment in primary schools within their jurisdiction to meet minimum quality standards or national standards.

2. Urge, supervise, and inspect primary schools in their efforts to achieve minimum quality standards or national standards. Recommend the Chairman of the People's Committee of the district to decide on recognition for primary schools meeting minimum quality standards; advise the People's Committee of the district to request the People's Committee of the province to inspect and evaluate primary schools striving for national standards.

Article 28 Implement the coordination mechanism as stipulated in Article 13 of this Regulation.

1. Advise the People's Committee of the province on directing the People's Committee of the district to develop plans for construction and investment in primary schools within their jurisdiction to strive for national standards. Urge, supervise, and serve as the permanent advisory body to the People's Committee of the province in forming inspection teams to review and verify the evaluation results of the People's Committee of the district regarding primary schools applying for inspection and confirmation of national standards.

2. Advise the People's Committee of the province on requesting the Chairman of the People's Committee of the province to decide and issue certificates confirming national standards for primary schools meeting standards at each level as prescribed; revoke decisions and certificates confirming national standards for schools previously recognized but failing to maintain and enhance their achievements.

3. Annually conduct summaries and evaluations of the movement to build national standard schools in the locality.

4. Annually, at the end of the academic year, departments of education and training shall report on the results of building and recognizing primary schools meeting national standards to the Ministry of Education and Training.
