On the basis of the Constitution of the Socialist Republic of Vietnam;

The National Assembly enacts the Law on Citizen Identity Cards.

 

PART I
GENERAL PROVISIONS

 

Article 1. Scope of Regulation

This Law stipulates citizen identity cards, the Citizen Identity Card Database, and the National Population Database; management and use of Citizen Identity Cards; rights, obligations, and responsibilities of agencies, organizations, and individuals related to these matters.

Article 2. Applicability

This Law applies to Vietnamese citizens; agencies, organizations, and individuals related to these matters.

Article 3. Explanation of Terms

In this Law, the following terms shall be understood as follows:

1. Citizen identification cards Basic information about a citizen's background and identification is defined according to this Law.

2. Identification refers to distinctive and stable external characteristics of an individual for differentiation from others.

3. Citizen Identity Card Archive refers to a system of files and documents about citizen identity cards, managed, classified, and arranged in a specific order for retrieval and exploitation of information.

4. National Population Database is a collection of basic information of all Vietnamese citizens standardized, digitized, stored, and managed through an information infrastructure to serve state administration and transactions of agencies, organizations, and individuals.

5. Citizen Identity Card Database is a specialized database collecting information about Vietnamese citizen identity cards, digitized, stored, and managed through an information infrastructure, and is part of the National Population Database.

6. Specialized Database is a collection of information about one or several specific management fields of ministries or sectors, digitized, stored, and managed through an information infrastructure, and connected to the National Population Database.

7. Information Infrastructure National Population Database and Citizen Identity Card Database is a system of equipment serving the production, collection, processing, storage, transmission, and exchange of digital information about population and citizen identity cards, including telecommunications networks, internet, computer networks, and databases.

8. Citizen Identity Card Management Agency is a specialized agency under the People's Public Security, responsible for managing citizen identity cards, the National Population Database, and the Citizen Identity Card Database.

Article 4. Principles of Citizen Identity Card Management, National Population Database and Citizen Identity Card Database

1. Compliance with the Constitution and laws; ensuring human rights and citizen rights.

2. Ensuring transparency and clarity in management, facilitating citizens.

3. Collecting, updating information and documents fully, accurately, and promptly; centralized, unified, strict, and secure management; maintaining, exploiting, using effectively, and storing long-term.

Article 5. Rights and Obligations of Citizens Regarding Citizen Identity Cards, the National Population Database, and the Citizen Identity Card Database

1. Citizens have the following rights:

a) To ensure personal privacy and family privacy in the National Population Database and the Citizen Identity Card Database, except when providing information and documents as prescribed by law;

b) To request the Citizen Identity Card Management Agency to update or correct information when information in the National Population Database, the Citizen Identity Card Database, or the Citizen Identity Card is missing, inaccurate, or has changed as prescribed by law;

c) To be issued, replaced, or reissued a Citizen Identity Card according to the provisions of this Law;

d) To use their Citizen Identity Card in transactions and to exercise their legitimate rights and interests;

đ) To lodge complaints, file charges, or initiate lawsuits according to the law against violations of the law regarding citizen identity cards, the National Population Database, and the Citizen Identity Card Database.

2. Citizens have the following obligations:

a) To comply with the provisions of this Law and related laws;

b) To complete procedures for issuance, replacement, or reissuance of a Citizen Identity Card according to the provisions of this Law;

c) To provide full, accurate, and timely information and documents about themselves to update the National Population Database and the Citizen Identity Card Database according to the provisions of this Law and related laws;

d) To present their Citizen Identity Card when requested by authorized persons for inspection according to the law;

đ) To keep and maintain their issued Citizen Identity Card; to report promptly to the Citizen Identity Card Management Agency if lost;

e) To return their Citizen Identity Card to the competent authority when it is replaced, revoked, or temporarily detained according to Articles 23 and 28 of this Law.

3. Persons suffering from mental illness or other diseases that impair their ability to recognize or control their behavior shall fulfill the rights and obligations prescribed in this Article through their lawful representatives.

Article 6. Responsibilities of the Citizen Identity Management Authority

1. Collecting and updating accurate information about citizens.

2. Timely correcting when there is evidence that citizen information is inaccurate or has changed.

3. Publicly posting and guiding administrative procedures related to citizen identity cards, the National Population Database, and the Citizen Identity Card Database according to the provisions of this Law for agencies, organizations, and individuals.

4. Ensuring the safety and confidentiality of information in the National Population Database and the Citizen Identity Card Database.

5. Providing complete, timely, and accurate information and documents about citizens when requested by agencies, organizations, and individuals according to the law.

6. Issuing, renewing, and reissuing Citizen Identity Cards according to the provisions of this Law.

7. Resolving complaints, denunciations, and handling violations according to the law.

Article 7. Prohibited acts

1. Obstructing the implementation of the provisions of this Law.

2. Issuing, renewing, and reissuing Citizen Identity Cards contrary to the law.

3. Harassing, causing inconvenience when processing procedures related to citizen identity cards, the National Population Database, and the Citizen Identity Card Database.

4. Tampering with records and files about citizens, the National Population Database, and the Citizen Identity Card Database; failing to provide, providing incompletely, or providing information and documents about the National Population Database and the Citizen Identity Card Database contrary to the law; misusing citizen information according to this Law causing damage to agencies, organizations, and individuals.

5. Disclosing confidential information belonging to the National Population Database and the Citizen Identity Card Database.

6. Collecting and using fees contrary to the law.

7. Forging, altering, or distorting the content of Citizen Identity Cards; appropriating, illegally using another person's Citizen Identity Card; renting, lending, borrowing, lending out, pledging, receiving pledges, destroying Citizen Identity Cards; using fake Citizen Identity Cards.

8. Illegally accessing, changing, deleting, destroying, or disseminating information in the National Population Database and the Citizen Identity Card Database.

9. Reclaiming or temporarily holding Citizen Identity Cards contrary to the law.

 

PART II

NATIONAL POPULATION DATABASE,
NATIONAL CITIZEN IDENTIFICATION DATABASE

Section 1

THE NATIONAL POPULATION DATABASE

 

Article 8. Requirements for Building the National Population Database

1. The National Population Database shall be centrally managed and uniformly constructed according to technical standards and norms for information technology and economic-technical quotas.

2. Ensuring safety and convenience for data collection, updating, exploitation, and utilization.

3. Ensuring connectivity with specialized databases.

4. Ensure the right to exploit information by agencies, organizations, and individuals in accordance with the provisions of the law.

Article 9. Information about Citizens Collected and Updated in the National Population Database

1. The content of information collected and updated includes:

a) Family name, middle name, and given name at birth;

b) Date of birth;

c) Gender;

d) Place of birth registration;

đ) Place of origin;

e) Ethnicity;

g) Religion;

h) Citizenship;

i) Marital status;

k) Place of permanent residence;

l) Current place of residence;

m) Blood type, if the citizen requests an update and presents a conclusion on blood type testing;

n) Family name, middle name, given name, personal identification number or ID card number, nationality of father, mother, spouse, or legal representative;

o) Family name, middle name, given name, personal identification number or ID card number of the household head and relationship to the household head;

p) Date of death or disappearance.

2. Information about citizens is collected and updated in the National Population Database from archives and the Citizen Identity Card Database, the Residence Database, the Household Registration Database, and other specialized databases through the processing of existing standardized population data.

In cases where the information and documents specified in Clause 1 of this Article are not available or incomplete, they shall be collected and updated from citizens.

Article 10. Management, Exploitation, and Utilization of the National Population Database

1. The National Population Database is a national asset, protected by the State according to the law on protecting important works related to national security.

The National Population Database is a shared database managed by the Ministry of Public Security.

2. Exploiting information in the National Population Database is carried out as follows:

a) Specialized database management agencies, state agencies, political organizations, and political-social organizations may exploit information in the National Population Database within their functions, tasks, and authorities;

b) Citizens may exploit their own information in the National Population Database;

c) Organizations and individuals not covered by points a and b of this clause who wish to exploit information in the National Population Database must obtain the consent of the National Population Database management agency according to the law.

3. Information in the National Population Database serves as a basis for agencies and organizations to check and unify citizen information. When a citizen has already used their own Citizen Identity Card, agencies and organizations shall not request the citizen to present documents or provide information already available in the National Population Database.

4. The Government shall provide detailed regulations on this matter.

Article 11. Relationship between the National Population Registry and specialized databases

1. Specialized databases shall be connected to the National Population Registry to update, share, exploit, and utilize information on citizens as prescribed in Clause 1 of Article 9 of this Law.

2. Information on citizens as prescribed in Clause 1 of Article 9 of this Law contained in specialized databases must be promptly, fully, and accurately updated into the National Population Registry.

3. In cases where information on citizens in specialized databases or issued documents does not match the information in the National Population Registry, such information must follow the National Population Registry.

4. The connection, updating, sharing, exploitation, and utilization of information between the National Population Registry and specialized databases of agencies and organizations must ensure efficiency, security, and compliance with functions, tasks, and authorities as stipulated by this Law and relevant laws.

5. The Government shall specify the procedures for connecting, updating, sharing, exploiting, amending, and utilizing information, and the timeline for connecting the National Population Registry with specialized databases.

Article 12. Personal Identification Number

1. The Personal Identification Number established from the National Population Registry is used to connect, update, share, and exploit information on citizens in the National Population Registry and specialized databases.

2. The Personal Identification Number is uniformly managed nationwide by the Ministry of Public Security and assigned to each Vietnamese citizen without repetition.

3. The Government shall specify the structure of the Personal Identification Number; the procedure and formalities for issuing the Personal Identification Number.

Article 13. Responsibilities of agencies, organizations, and individuals in collecting, providing, and updating information and documents into the National Population Registry

1. Agencies, organizations, and individuals have the following responsibilities:

a) Adhere to the procedures for collecting, providing, and updating information and documents into the National Population Registry;

b) Ensure that the collection, provision, and updating of information and documents are complete, accurate, and timely;

c) Timely update and notify information about citizens when there are changes or inaccuracies.

2. Individuals tasked with collecting and updating information and documents have the following responsibilities:

a) Verify information and documents about citizens; regularly monitor and update information;

b) Safeguard and maintain confidentiality of related information and documents; refrain from altering, erasing, or damaging documents and bear responsibility for the accuracy and completeness of the updated information.

3. Heads of agencies managing the National Population Registry have the following responsibilities:

a) Organize the management of information and document updates and storage in the database;

b) Inspect and take responsibility for information and documents that have been updated and stored in the National Population Registry.

 

Section 2

NATIONAL CITIZEN IDENTIFICATION DATABASE

 

Article 14. Requirements for Building and Managing the Citizen Identity Card Database

1. The Citizen Identity Card Database shall be constructed and managed at the citizen identity card management agency under the Ministry of Public Security, provincial police departments, centrally-administered city police departments, district police departments, and equivalent administrative units.

2. The Citizen Identity Card Database shall be built to ensure connectivity with the National Population Registry, meeting data standards and technical standards for information technology.

3. Comply with regulations, work file systems, and electronic transactions and information technology.

4. Collect and update information fully, accurately, and promptly; ensure stable, secure, and confidential operations.

Article 15. Information in the Citizen Identity Database

1. The content of information collected and updated includes:

a) Information prescribed in Clause 1, Article 9 of this Law;

b) Portrait photograph;

c) Identifying features;

d) Fingerprints;

đ) Surnames, other given names;

e) Number, date, month, year, and place of issuance of the Identity Card;

g) Occupation, except for active military personnel;

h) Educational level;

i) Date, month, year when the citizen reports the loss of the Identity Card or the Citizen Identity Card.

2. In cases where the information prescribed in Clause 1 of this Article is not available or incomplete in the National Population Database, the Citizen Identity Database, or the Residency Database, the citizen shall supplement such information when applying for issuance, replacement, or reissuance of the Citizen Identity Card.

Article 16. Responsibilities of agencies, organizations, and individuals in collecting, providing, and updating information and documents in the Citizen Identity Database

1. Agencies, organizations, and individuals have the following responsibilities:

a) Comply with regulations on providing information and documents to the Citizen Identity Database;

b) Provide complete, accurate, and timely information and documents as stipulated by this Law;

c) Timely notify changes or inaccuracies in identity-related information and documents.

2. Personnel engaged in citizen identity management, and the Citizen Identity Database shall fulfill the provisions set out in Article 13 of this Law.

Article 17. Exploitation, provision, exchange, and use of citizen identity data

1. Agencies, organizations, and individuals within their respective duties and authorities may provide and exchange information and documents with the Citizen Identity Database.

Accessing the Citizen Identity Database or researching files and documents in the Citizen Identity Archive must be approved by the head of the citizen identity management agency.

2. The Minister of Public Security shall specify the procedures for providing and exchanging information and documents from the Citizen Identity Database to agencies, organizations, and individuals.

 

Chapter III

CITIZEN IDENTITY CARD
AND MANAGEMENT OF CITIZEN IDENTITY CARDS

Section 1

CITIZEN IDENTITY CARD

 

Article 18. Content displayed on the Citizen Identity Card

1. The Citizen Identity Card includes the following information:

a) The front side of the card displays the Emblem of the Socialist Republic of Vietnam; the phrase "Socialist Republic of Vietnam", "Independence - Freedom - Happiness"; the phrase "Citizen Identity Card"; portrait, card number, surname, middle name, given name at birth, date of birth, gender, nationality, place of origin, place of permanent residence, expiration date;

b) The back side of the card contains an encrypted information storage section; fingerprints, identifying features of the cardholder; issue date; surname, middle name, given name, position, signature of the issuer, and the seal bearing the Emblem of the issuing agency.

2. The Minister of Public Security shall specify in detail the format, language, shape, size, material of the Citizen Identity Card.

Article 19. Citizens who are issued a Citizen Identity Card andNo. Citizen Identity Card

1. Vietnamese citizens aged 14 years or older are eligible to obtain a Citizen Identity Card.

2. The Citizen Identity Card number is the individual identification number.

Article 20. Usage value of Citizen Identity Card

1. The Citizen Identity Card is a personal document of Vietnamese citizens that serves as proof of citizen identity for the cardholder to conduct transactions within the territory of Vietnam.

2. The Citizen Identity Card can be used instead of a passport in cases where Vietnam and foreign countries have signed international treaties or agreements allowing citizens of the signatory countries to use the Citizen Identity Card instead of a passport in each other's territories.

3. Agencies, organizations, and individuals with authority may request citizens to present the Citizen Identity Card for verification of identity and the information specified in Article 18 of this Law; they may use the individual identification number on the Citizen Identity Card to verify the cardholder's information in the National Population Database and specialized databases as prescribed by law.

When citizens present the Citizen Identity Card upon request by agencies, organizations, or individuals with authority, such agencies, organizations, or individuals shall not require additional documents to verify the information specified in Clause 1 and Clause 3 of this Article.

4. The State protects the rights and legitimate interests of citizens holding the Citizen Identity Card as prescribed by law.

Article 21. Age for Replacing the Citizen Identity Card

1. The Citizen Identity Card must be replaced when citizens reach the ages of 25, 40, and 60.

2. In cases where the Citizen Identity Card is issued, replaced, or reissued within two years prior to the ages specified in Clause 1 of this Article, it shall remain valid until the next age for replacement.

 

Section 2

ISSUE, REPLACE, REISSUE, WITHDRAW, TEMPORARILY HOLD
CITIZEN IDENTITY CARD

 

Article 22. Procedures and formalities for issuing the Citizen Identity Card

1. The procedures and formalities for issuing the Citizen Identity Card are carried out as follows:

a) Fill out the application form according to the prescribed model;

b) The person assigned the task of collecting and updating information and documents as stipulated in Clause 2 of Article 13 of this Law shall check and compare the information from the National Population Database to accurately identify the citizen who needs the Citizen Identity Card; in cases where the citizen does not have information in the National Population Database, they must present legal documents regarding the information required on the application form according to the prescribed model.

For those currently serving in the People's Army or the People's Public Security, they must present identification cards issued by the People's Army or the People's Public Security along with letters of introduction from their unit leaders.

c) Staff of the citizen identity management agency take photographs and collect fingerprints of the person applying for the procedure;

d) Staff of the citizen identity management agency issue a receipt for the Citizen Identity Card to the person applying for the procedure;

đ) Return the Citizen Identity Card at the time and location specified in the receipt according to the provisions of Article 26 of this Law; in cases where the citizen requests the card to be returned at a different location, the citizen identity management agency will return the card at the requested location and the citizen must pay for the service fee for delivery.

2. In cases where the citizen suffers from mental illness or other diseases that impair their ability to recognize or control their behavior, a legally authorized representative must accompany them to complete the procedures as stipulated in Clause 1 of this Article.

Article 23. Cases for Replacing and Reissuing the Citizen Identity Card1. The Citizen Identity Card shall be replaced in the following cases:

a) The cases specified in Clause 1 of Article 21 of this Law;

b) The card is damaged and cannot be used;

c) Changes in surname, middle name, given name, and physical characteristics;

d) Determination of gender and place of origin;

đ) Errors in the information on the Citizen Identity Card;

e) At the request of the citizen.

2. The Citizen Identity Card shall be reissued in the following cases:

a) Loss of the Citizen Identity Card;

b) Restoration of Vietnamese citizenship according to the provisions of the Vietnamese Citizenship Law.

Article 24. Procedures and Formalities for Replacing and Reissuing the Citizen Identity Card

1. Carry out the procedures as stipulated in Clause 1 of Article 22 of this Law.

2. In cases where the Citizen Identity Card is replaced due to changes in information as specified in Points c, d, and đ of Clause 1 of Article 23 of this Law and there is no information in the National Population Database, the citizen must submit a copy of the document issued by the competent authority regarding the change in these pieces of information.

3. Collect the previously used Citizen Identity Card in cases as specified in Clause 1 of Article 23 of this Law.

Article 25. Time Limit for Issuing, Replacing, and Reissuing the Citizen Identity Card

From the date of receiving all necessary documents as stipulated in this Law, the citizen identity management agency must issue, replace, or reissue the Citizen Identity Card for the citizen within the following time limits:

1. In cities and towns, not exceeding seven working days for new issuance and replacement; not exceeding fifteen working days for reissuance;

2. In mountainous, highland, border, and island districts, not exceeding twenty working days for all cases;

3. In other areas, not exceeding fifteen working days for all cases;

4. According to the administrative reform roadmap, the Minister of Public Security shall specify a shortened time limit for issuing, replacing, and reissuing the Citizen Identity Card.

4. In accordance with the administrative procedure reform roadmap, the Minister of Public Security shall stipulate the reduction of the processing time for issuing, replacing, and reissuing Citizen Identity Cards.

Article 26. Places for Processing Issuance, Replacement, and Reissuance of Citizen Identity Cards

Citizens may choose one of the following places to process the issuance, replacement, or reissuance of Citizen Identity Cards:

1. At the citizen identity management agency under the Ministry of Public Security;

2. At the citizen identity management agency under the provincial or centrally governed city public security department;

3. At the citizen identity management agency under the district, town, or provincial city public security department and equivalent administrative units;

4. The citizen identity management agency with authority may organize the processing of Citizen Identity Card issuance at communes, wards, towns, agencies, units, or at the place of residence of citizens when necessary.

Article 27. Authority for Issuing, Replacing, and Reissuing Citizen Identity Cards

The head of the citizen identity management agency under the Ministry of Public Security has the authority to issue, replace, and reissue Citizen Identity Cards.

Article 28. Revocation and Temporary Detention of Citizen Identity Cards

1. The Citizen Identity Card shall be revoked in cases where a citizen loses their nationality, renounces Vietnamese nationality, or has their decision to acquire Vietnamese nationality annulled.

2. The Citizen Identity Card shall be temporarily detained in the following cases:

a) A person who is serving a decision to be placed in a juvenile education center, compulsory educational facility, or compulsory drug rehabilitation facility;

b) A person who is under temporary detention, pretrial detention, or serving a prison sentence.

3. During the period of temporary detention of the Citizen Identity Card, the citizen is permitted by the agency detaining the Citizen Identity Card to use their Citizen Identity Card to conduct transactions as prescribed by law.

The Citizen Identity Card will be returned to the citizen upon completion of the temporary detention, pretrial detention, completion of the prison sentence, or completion of the decision to be placed in a juvenile education center, compulsory educational facility, or compulsory drug rehabilitation facility.

4. Authority for Revoking and Temporarily Detaining Citizen Identity Cards:

a) The citizen identity management agency with authority shall revoke the Citizen Identity Card in the case stipulated in Clause 1 of this Article;

b) The agency executing the temporary detention or pretrial detention order, the agency executing the prison sentence, or the agency executing the decision to be placed in a juvenile education center, compulsory educational facility, or compulsory drug rehabilitation facility shall have the authority to temporarily detain the Citizen Identity Card in the case stipulated in Clause 2 of this Article.

 

Chapter IV
ENSURING CONDITIONS
FOR ACTIVITIES
MANAGING CITIZEN IDENTIFICATION,
NATIONAL POPULATION DATABASE AND
NATIONAL CITIZEN IDENTIFICATION DATABASE

 

Article 29. Ensuring Infrastructure for the National Population Database and Citizen Identification Database

1. The infrastructure for the National Population Database and Citizen Identification Database must be developed, ensuring quality, synchronization, accuracy, completeness, and timeliness; it must be constructed and managed uniformly from central to local levels.

2. The State ensures the infrastructure for the National Population Database and Citizen Identification Database in accordance with requirements for national defense, security, and economic and social development.

Article 30. Personnel Engaged in Managing Citizen Identification, National Population Database, and Citizen Identification Database

1. Personnel engaged in managing citizen identification, National Population Database, and Citizen Identification Database include: Managers; individuals assigned tasks to collect, update, and store information and documents related to the National Population Database and Citizen Identification Database; personnel processing the issuance, replacement, and reissuance of Citizen Identity Cards.

2. Personnel engaged in managing citizen identification, National Population Database, and Citizen Identification Database must be trained and professionally instructed in accordance with the tasks and authorities delegated to them.

Article 31. Ensuring Funding and Material Bases for Citizen Identity Management Activities, National Population Database, and Citizen Identity Card Database

1. The State ensures the budget and material bases for citizen identity management activities, the National Population Database, and the Citizen Identity Card Database.

2. The State prioritizes investment in infrastructure, human resources, and technology to ensure the construction and management of the National Population Database.

3. The State encourages organizations and individuals both within and outside the country to sponsor and support the construction and management of the National Population Database and the Citizen Identity Card Database.

Article 32. Fees for Exploiting and Using Information in the National Population Database and Processing Fees for Issuing, Replacing, and Reissuing Citizen Identity Cards

1. When exploiting and using information in the National Population Database, agencies, organizations, and individuals must pay fees in accordance with the laws on fees and processing fees, except in cases specified in points a and b of Clause 2, Article 10 of this Law.

2. Citizens are not required to pay processing fees when issuing a Citizen Identity Card as stipulated in Article 19 of this Law.

3. Citizens must pay processing fees when replacing or reissuing a Citizen Identity Card, except in the following cases:

a) Replacing a Citizen Identity Card as stipulated in Article 21 of this Law;

b) Errors in information on the Citizen Identity Card due to the fault of the citizen identity management agency.

4. The Ministry of Finance shall specify the specific rates and exemptions or reductions of processing fees when replacing or reissuing a Citizen Identity Card.

Article 33. Protection of the National Population Database and the Citizen Identity Card Database

The citizen identity management agency has the following responsibilities:

1. Applying information technology to enter, process, and extract population and citizen identity card information, ensuring data security according to the principles and formats of database systems;

2. Ensuring the safety of devices for collecting, storing, transmitting, processing, and exchanging population and citizen identity card information;

3. Protecting population and citizen identity card information security on computer networks; ensuring the safety of stored information in databases; preventing and combating unauthorized access, illegal use, and damage to the National Population Database and the Citizen Identity Card Database;

4. National population and citizen identity card data are stored on mainframe computers that have been secured against unauthorized access through the database management system and network operating system security measures;

5. The Government shall prescribe the procedures for backing up and restoring national population and citizen identity card data.

 

CHAPTER V

RESPONSIBILITIES FOR MANAGING CITIZEN IDENTITIES,
NATIONAL POPULATION DATABASE AND
NATIONAL CITIZEN IDENTIFICATION DATABASE

 

Article 34. Responsibilities for State Management of Citizen Identities, the National Population Database, and the Citizen Identity Card Database

1. The Government shall uniformly manage state affairs concerning citizen identities, the National Population Database, and the Citizen Identity Card Database.

2. The Ministry of Public Security shall be responsible before the Government for managing state affairs concerning citizen identities, the National Population Database, and the Citizen Identity Card Database.

Article 35. Responsibilities of the Ministry of Public Security

1. Issuing, jointly issuing, or submitting to competent authorities for issuance of normative legal documents on citizen identities, the National Population Database, and the Citizen Identity Card Database.

2. Directing and organizing the implementation of normative legal documents on citizen identities, the National Population Database, and the Citizen Identity Card Database; organizing the dissemination and education on laws related to citizen identities, the National Population Database, and the Citizen Identity Card Database.

3. Suspending or abolishing, or recommending competent authorities to abolish, regulations on managing citizen identities, the National Population Database, and the Citizen Identity Card Database issued by agencies and organizations that contravene this Law.

4. Directing the production and management of Citizen Identity Cards.

5. Managing the National Population Database and the Citizen Identity Card Database; directing and guiding business operations related to managing citizen identities, the National Population Database, and the Citizen Identity Card Database.

6. Specifying detailed procedures and processes for issuing, replacing, and reissuing Citizen Identity Cards; issuing forms used in managing citizen identities; prescribing regulations on managing citizen identity archives.

7. Organizing organizational structures, equipping means, training, and instructing staff engaged in managing citizen identities, the National Population Database, and the Citizen Identity Card Database; organizing mid-term and final reviews, scientific research on managing citizen identities, the National Population Database, and the Citizen Identity Card Database.

8. Conducting state statistics on citizen identities, the National Population Database, and the Citizen Identity Card Database.

9. Inspecting, auditing, resolving complaints and denunciations, and handling violations in managing citizen identities, the National Population Database, and the Citizen Identity Card Database in accordance with the law.

10. International cooperation in managing citizen identities, the National Population Database, and the Citizen Identity Card Database.

Article 36. Responsibilities of Ministries and Sectors

1. Ministries and sectors shall have the following responsibilities:

a) Guide agencies, organizations, and individuals under their administrative management to implement legal provisions on citizen identification cards and the National Population Database;

b) Coordinate with the Ministry of Public Security and the People's Committees of centrally governed cities and provinces in state management of citizen identification cards and the National Population Database.

2. The Ministry of Justice shall organize the implementation and direct civil status registration agencies to provide and update information on civil status of citizens for the National Population Database.

3. The Ministry of Information and Communications shall take the lead and coordinate with relevant ministries and sectors to develop mechanisms and policies related to information technology concerning the National Population Database.

4. The Ministry of Finance shall take the lead and coordinate with the Ministry of Public Security to allocate regular funds for the operation of the National Population Database and the Citizen Identification Card Database; funds to ensure the issuance, replacement, and reissuance of Citizen Identification Cards; and specific regulations on the subjects, rates, and management and use of fees for accessing and using information in the National Population Database.

5. The Ministry of Planning and Investment shall take the lead and coordinate with the Ministry of Public Security, the Ministry of Finance, and the Ministry of Information and Communications to allocate state budget capital for the construction and maintenance of the National Population Database and the Citizen Identification Card Database, ensuring the issuance, replacement, and reissuance of Citizen Identification Cards.

Article 37. Responsibilities of Provincial and Central City People's Committees

1. Implement and organize the enforcement of legal instruments on citizen identification cards, the National Population Database, and the Citizen Identification Card Database at the local level.

2. Organize the dissemination and education of laws on citizen identification cards, the National Population Database, and the Citizen Identification Card Database.

3. Inspect, audit, resolve complaints and denunciations, and handle violations of laws on citizen identification cards, the National Population Database, and the Citizen Identification Card Database according to legal provisions.

 

CHAPTER VI
IMPLEMENTING PROVISIONS

 

Article 38. Effective Date and Transitional Provisions

1. This Law takes effect from January 1, 2016.

2. Identity cards issued before this Law comes into effect shall remain valid until their expiration date as stipulated; when citizens request, they may be exchanged for Citizen Identification Cards.

3. Legal documents that have been issued and use information from Identity Cards shall retain their legal validity.

Forms that have been issued and specify the use of information from Identity Cards shall continue to be used until December 31, 2019.

4. Localities that do not have the conditions for infrastructure, material resources, technical capabilities, and personnel to manage citizen identification cards, the National Population Database, and the Citizen Identification Card Database to implement this Law shall continue to manage citizens according to previous legal provisions until January 1, 2020, at the latest, and must then uniformly implement the provisions of this Law.

5. The Government shall specify the implementation of this Law during the transitional period from the effective date of this Law to December 31, 2019.

Article 39. Detailed provisions

The Government and relevant agencies shall provide detailed regulations for the Articles and Clauses assigned to them in the Law.
