CIRCULAR
Amending and supplementing certain provisions of Circular No. 80/2014/TT-BGTVT dated December 30, 2014 of the Minister of Transport on passenger transport, luggage, and consignment on inland waterways The Minister of Transport issues this Circular amending and supplementing certain provisions of Circular No. 80/2014/TT-BGTVT dated December 30, 2014 of the Minister of Transport on passenger transport, luggage, and consignment on inland waterways.
Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004;
Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Traffic dated June 17, 2014;
Pursuant to Decree No. 110/2014/NĐ-CP dated November 20, 2014 of the Government on conditions for inland waterway transportation business;
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
At the proposal of the Director of the Transport Department and the Director of the Vietnam Inland Waterways Administration,
Article 1. Amending and supplementing certain provisions of Circular No. 80/2014/TT-BGTVT dated December 30, 2014 of the Minister of Transport on passenger transport, luggage, and consignment on inland waterways
"Article 10. Exemption and reduction of passenger ticket prices
1. Amending and supplementing Article 10 as follows:
1. Infants under one year old are exempt from ticket fees but must sit with accompanying passengers. When boarding the vessel, they must present the birth certificate of the infant to be exempted from ticket fees.
2. Elderly persons are entitled to a minimum 15% reduction in ticket prices. When purchasing tickets, they must present their identity card or other lawful documents proving their status as elderly persons to receive the ticket price reduction.
3. Severely disabled persons and those with serious disabilities are entitled to a minimum 25% reduction in ticket prices. When purchasing tickets, they must present a disability confirmation document to receive the ticket price reduction.
4. In addition to the categories specified in Clause 1, Clause 2, and Clause 3 of this Article, organizations and individuals engaged in cargo and passenger transport, luggage, and consignment on inland waterways shall base their regulations on legal provisions to determine the levels of ticket fee exemptions and reductions for passengers."
"1. In cases where checked baggage or consignment is damaged or lost due to the fault of the transportation business operator, compensation shall be made according to the following provisions:
2. Amend and supplement Clause 1 of Article 19 as follows:
a) According to the declared value for checked baggage or consignment with declared value; if the transportation business operator can prove that the actual loss is lower than the declared value, then according to the actual loss value;
b) According to the agreed amount between both parties;
c) According to the market price of the goods at the time of payment and delivery location; in case there is no market price for the goods, according to the average price of similar goods in the area of delivery;
d) In case of undeclared value goods, compensation shall be made according to the following provisions: for checked baggage, the compensation amount does not exceed 20,000 Vietnamese dong per 1 kg of damaged checked baggage; for consignment, the compensation amount does not exceed 20,000 Vietnamese dong per 1 kg of damaged consignment; 7,000,000 Vietnamese dong for each damaged consignment or package."
3. Repealing Article 8.
This Circular takes effect from January 1, 2016.
Article 2. Effective Date
The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Directors of the Vietnam Inland Waterway Administration, the Vietnam Maritime Administration, the Vietnam Ship Survey Bureau, the Directors of Provincial Department of Transport, the Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
Article 3. Implementation Organization
The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of Departments, the Directors of the Vietnam Inland Waterways Administration, the Director of the Vietnam Maritime Administration, the Director of the Department of Transport Services, the Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.
