CIRCULAR
AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULARS IN THE MARITIME, INLAND WATERWAY, AND INSPECTION SECTORS
Pursuant to the Law on Legislative Regulatory Documents dated February 19, 2025; the Law Amending and Supplementing Certain Articles of the Law on Legislative Regulatory Documents dated June 25, 2025;
Decree No. Decision No. 33/2025/NĐ-CPdated February 25, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
At the proposal of the Director of the Vietnam Maritime Administration and Inland Waterway Inspection Bureau, and the Director of the Vietnam Maritime Administration and Inland Waterway Bureau;
The Minister of Construction issues this Circular amending and supplementing certain articles of circulars in the maritime, inland waterway, and inspection sectors.
PART I
AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 54/2013/TT-BGTVT DATED DECEMBER 16, 2013 OF THE MINISTER OF TRANSPORT REGULATING MARINE INSPECTOR OFFICERS AND CIRCULAR NO. 33/2017/TT-BGTVT DATED SEPTEMBER 28, 2017 OF THE MINISTER OF TRANSPORT AMENDING AND SUPPLEMENTING CERTAIN ARTICLES OF CIRCULAR NO. 54/2013/TT-BGTVT DATED DECEMBER 16, 2013 OF THE MINISTER OF TRANSPORT REGULATING MARINE INSPECTOR OFFICERS
Article 1. Amend Article 12 as follows:
"Article 12. Procedures for Issuing Marine Inspector Officer Cards
1. The Marine Inspector Officer Card issued by the Vietnam Maritime Administration and Inland Waterway Bureau has a validity period of five years and includes two types:
a) The Marine Inspector Officer Card of Vietnam is issued to Vietnamese Marine Inspector Officers according to the model specified in Appendix I of this Circular;
b) The State Marine Port Inspector Officer Card is issued to State Marine Port Inspector Officers according to the model specified in Appendix II of this Circular.
2. The application dossier for issuing cards shall include:
a) A request letter from the Head of the Maritime Port Supervision Unit or the Inland Waterway Supervision Unit under the Vietnam Maritime Administration and Inland Waterway Bureau (hereinafter referred to as the Supervision Unit);
b) The decision recognizing the results of the Marine Inspector Officer examination;
c) Two recent 3x4 cm photographs taken within six months;
3. The Supervision Unit shall submit the dossier specified in Clause 2 of this Article to the Vietnam Maritime Administration and Inland Waterway Bureau either directly or through postal service. The Vietnam Maritime Administration and Inland Waterway Bureau shall accept, check the completeness and validity of the dossier; if the dossier is incomplete or invalid, they shall notify the Supervision Unit to supplement and complete it; valid dossiers shall be processed according to regulations.
4. The Vietnam Maritime Administration and Inland Waterway Bureau shall complete the issuance of the card within a maximum of seven working days from the date of receipt of a complete and valid dossier."
Article 2. Amend Article 13 as follows:
“Article 13. Procedures for Replacing and Reissuing Marine Inspector Officer Cards
1. Conditions for replacing the card:
The Marine Inspector Officer Card can be replaced when it expires, and the individual applying for replacement must meet the following conditions:
a) Having conducted at least 60 inspections of ships over five years or having continuously worked in ship inspection for at least two years;
b) Participating in an update and supplementary training course on ship inspection;
c) Passing the Marine Inspector Officer examination organized by the Vietnam Maritime Administration.
2. The dossier for replacing the card shall include:
a) A request letter from the Head of the unit specifying the number of ship inspections or the continuous work period related to ship inspection;
b) A copy of the Marine Inspector Officer Card;
c) Two recent 3x4 cm photographs taken within six months.
3. Reissuing the card:
The Marine Inspector Officer Card shall be reissued in cases where the card is damaged, lost, or no longer usable. The dossier for reissuing the card shall include:
a) A request letter from the Head of the unit specifying the reason for reissuing the card;
b) A copy of the Marine Inspector Officer Card (if available).
c) Two recent 3x4 cm photographs taken within six months.
4. Procedure and method of implementation:
The Supervision Units under the Vietnam Maritime Administration and Inland Waterway Bureau shall submit the dossier specified in Clauses 2 and 3 of this Article to the Vietnam Maritime Administration and Inland Waterway Bureau either directly or through postal service. The Vietnam Maritime Administration and Inland Waterway Bureau shall accept, check the completeness and validity of the dossier; if the dossier is incomplete or invalid, they shall notify the Supervision Unit to supplement and complete it; valid dossiers shall be processed according to regulations.
5. Processing time limit:
The Vietnam Maritime Administration and Inland Waterway Bureau shall complete the replacement or reissuance of the card within a maximum of five working days from the date of receipt of a complete and valid dossier as prescribed."
Chapter II
AMENDMENTS AND SUPPLEMENTS TO CIRCULAR NO. 23/2017/TT-BGTVT DATED JULY 28, 2017 OF THE MINISTER OF TRANSPORT REGULATING THE TITLES, TASKS ACCORDING TO TITLES OF SEAFARERS AND REGISTRATION OF SEAFARERS WORKING ON VIETNAMESE SHIPS AND CIRCULAR NO. 56/2023/TT-BGTVT DATED DECEMBER 31, 2023 OF THE MINISTER OF TRANSPORT AMENDING AND SUPPLEMENTING CERTAIN ARTICLES OF CIRCULAR NO. 23/2017/TT-BGTVT DATED JULY 28, 2017 OF THE MINISTER OF TRANSPORT REGULATING THE TITLES, TASKS ACCORDING TO TITLES OF SEAFARERS AND REGISTRATION OF SEAFARERS WORKING ON VIETNAMESE SHIPS
Article 3. Amend and supplement Point c Clause 1 Article 53 as follows:
c) The original or legal electronic Certificate of Legalization of Consular Documents Passport for cases where seafarers are foreign citizens.”
Chapter III
AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 40/2016/TT-BGTVT DATED DECEMBER 7, 2016 ISSUED BY THE MINISTER OF TRANSPORT REGULATING THE REGISTRATION OF VIETNAMESE SEAGOING VESSELS
Article 4. Amend and supplement Clause 5 Article 9 of Circular No. 40/2016/TT-BGTVT which has been amended and supplemented by Clause 3 Article 10 of Circular No. 16/2022/TT-BGTVT
“5. Within fifteen (15) days from the date of receiving all necessary documents or according to agreement if it is a new or complex ship design but not exceeding sixty (60) days, the Vietnam Ship Survey Bureau shall conduct an examination of the design. If the requirements are not met, the Bureau will notify the organization or individual; if the requirements are met, the Bureau will issue a certificate of design examination and stamp the examination on the design documents.”
Article 5. Amend and supplement Clause 4 Article 10 of Circular No. 40/2016/TT-BGTVT which has been amended and supplemented by Point c Clause 4 Article 1 of Circular No. 17/2023/TT-BGTVT
“4. Receiving documents: The Inspection Sub-Department receives the documents and checks the components of the documents: if the documents are incomplete, the Sub-Department will guide the organization or individual to complete the documents within the same working day (for direct submission or through the online public service portal) or guide completion within two (2) working days from the date of receipt of the documents (for submission through the postal system and other appropriate methods); if the documents are complete, within no more than four (4) working days from the date of receipt of all documents, the Sub-Department will agree with the submitter on the time for actual inspection at the location requested by the submitter.”
Article 6. Amend and supplement Clause 4 Article 15 of Circular No. 40/2016/TT-BGTVT which has been amended and supplemented by Point c Clause 9 Article 1 of Circular No. 17/2023/TT-BGTVT
“4. Receiving documents: The Inspection Sub-Department receives the documents and checks the components of the documents: if the documents are incomplete, the Sub-Department will guide the organization or individual to complete the documents within the same working day (for direct submission or through the online public service portal) or guide completion within two (2) working days from the date of receipt of the documents (for submission through the postal system and other appropriate methods); if the documents are complete, the Sub-Department will proceed to examine the documents.
Within three (3) working days from the date of receipt of the file, if the result of reviewing the file is found to be incomplete, the Inspection Center shall guide organizations and individuals to complete the file in accordance with regulations; if the result of reviewing the file is found to be complete, it shall respond in writing and agree with the person submitting the file on the time for actual assessment at the facility within no more than three (3) working days from the date of agreement.
Article 7. Amend and supplement certain clauses of Article 16 of Circular No. 40/2016/TT-BGTVT which has been amended and supplemented by certain points of Clause 10 Article 1 of Circular No. 17/2023/TT-BGTVT
1. Amend and supplement Clause 4 which has been amended and supplemented by Point c Clause 10 Article 1 of Circular No. 17/2023/TT-BGTVT as follows:
“4. Receiving documents: The registration authority receives the documents and checks the components of the documents: if the documents are incomplete, the authority will guide the organization or individual to complete the documents within the same working day (for direct submission or through the online public service portal) or guide completion within two (2) working days from the date of receipt of the documents (for submission through the postal system and other appropriate methods); if the documents are complete, the authority will agree with the submitter on the time for actual inspection at the location requested by the submitter within no more than five (5) working days from the date of the request.”
2. Amend and supplement Clause 5 which has been amended and supplemented by Point d Clause 10 Article 1 of Circular No. 17/2023/TT-BGTVT as follows:
“5. Inspection and issuance of certificates: After conducting the inspection, if the inspection results meet the requirements, the registration authority will issue the Certificate in accordance with regulations within two (2) working days from the date of completing the inspection; if the requirements are not met, the authority will notify the organization or individual in writing.”
Article 8. Amend and supplement Clause 5 of Article 18 of Circular No. 40/2016/TT-BGTVT which has been amended by Point d, Clause 12 of Article 1 of Circular No. 17/2023/TT-BGTVT.
“5. Inspection and issuance of Certificate: After conducting practical skill inspection, if the results meet the requirements, the Registration Agency shall issue the Certificate within two working days from the date of completion of the practical skill inspection.”
Article 9. Repeal Article 17 of Circular No. 40/2016/TT-BGTVT.
Chapter IV
AMENDMENTS AND SUPPRESSION OF CERTAIN ARTICLES OF CIRCULAR NO. 48/2015/TT-BGTVT DATED DECEMBER 7, 2016 ISSUED BY THE MINISTER OF TRANSPORT REGULATING INSPECTION OF INLAND WATERWAY VESSELS
Article 10. Amend and supplement certain clauses of Article 9 of Circular No. 48/2015/TT-BGTVT which has been amended and supplemented by Clause 8 of Article 1 of Circular No. 16/2023/TT-BGTVT.
1. Amend and supplement Clause 2 of Article 9 as follows:
“2. The Vietnam Registration Agency or the Registration Branch receives and checks the file; in case the file does not comply with the regulations, it will guide to complete on the same working day (for direct submission) or guide to complete within one working day (for submission through postal service or online public service portal); if the file is complete, then schedule the time for result delivery.”
2. Amend and supplement Clause 3 of Article 9 as follows:
“3. From the date of receiving the complete file according to the regulations, within 13 (thirteen) working days (for design of vessels made of new materials, new functions or vessels operating on inland waterway transport routes along the coast, from shore to islands, between islands; vessels carrying liquefied gas, dangerous chemical liquid cargo; oil tankers with flash point temperature equal to or less than 60°C, with total deadweight of 500 tons or more; high-speed passenger ferries, air-cushion vehicles; floating restaurants, floating hotels, overnight cruise vessels, passenger vessels with capacity of 100 passengers or more) or within five (five) working days (for other designs and guidance documents), the Vietnam Registration Agency or the Registration Branch completes the review of the design and guidance documents, if satisfactory, issue the design approval certificate and notify the design and guidance document review according to the model prescribed in Appendix VI issued together with this Circular (if applicable); if unsatisfactory, notify in writing the organization or individual to rectify the deficiencies.”
3. Amend and supplement Clause 4 of Article 9 as follows:
“4. Within one (one) working day from the date of receiving the corrected design file, if satisfactory, issue the design approval certificate according to Clause 3 of this Article; if unsatisfactory, inform the organization or individual to rectify the deficiencies again.”
Article 11. Amend and supplement certain clauses of Article 10 of Circular No. 48/2015/TT-BGTVT which has been amended and supplemented by Clause 9 of Article 1 of Circular No. 16/2023/TT-BGTVT.
1. Amend and supplement Clause 2 of Article 10 as follows:
“2. The registration agency receives and checks the file; in case the file does not comply with the regulations, it will guide to complete on the same working day (for direct submission) or guide to complete within one (one) working day (for submission through postal service or online public service portal or other appropriate methods); if the file is complete, then agree on the time and place for inspection.”
2. Amend and supplement Clause 3 of Article 10 as follows:
“3. The registration agency conducts the inspection, within one (one) working day from the end of the on-site inspection, the registration agency issues the certificate of technical safety and environmental protection for inland waterway vessels according to regulations if the inspection results meet the national technical standards and national standards; notify the organization or individual requesting the inspection if the results do not meet the requirements.”
Article 12. Amend and supplement some clauses of Article 11 of Circular No. 48/2015/TT-BGTVT which has been amended and supplemented by Clause 10 of Article 1 of Circular No. 16/2023/TT-BGTVT
1. Amend and supplement Clause 2 of Article 11 as follows:
“2. The inspection unit receives the file and confirms on the form according to Appendix XIII issued together with this Circular; in case the file is not complete as prescribed, guide to complete immediately on the same working day (for cases submitted directly) or guide to complete within 01 (one) working day (for cases submitted through the postal system or online public service portal or other appropriate forms); if the file is complete, agree on the time for actual inspection at the location requested by the submitter.”
2. Amend and supplement Clause 4 of Article 11 as follows:
“4. Within 01 (one) working day from the end of the on-site inspection, the inspection unit issues the certificate of technical safety and environmental protection for inland waterway vessels in accordance with regulations if the inspection results meet the provisions of national technical standards and national standards; notify the organization or individual requesting the inspection if the inspection results do not meet the requirements.”
Article 13. Amend and supplement some clauses of Article 12 of Circular No. 48/2015/TT-BGTVT which has been amended and supplemented by Clause 11 of Article 1 of Circular No. 16/2023/TT-BGTVT
1. Amend and supplement Clause 2 of Article 12 as follows:
“2. The inspection unit receives the file, checks the components of the file, and in the case of imported industrial products, confirms on the form as specified in Appendix XIII issued together with this Circular: if the file is incomplete, guide the organization or individual to complete it immediately on the same working day (for cases submitted directly) or within 01 (one) working day from the date of receipt of the file (for cases submitted through the postal system or online public service portal or other appropriate forms); if the file is complete, agree on the time for actual inspection at the location requested by the submitter.”
2. Amend and supplement Clause 3 of Article 12 as follows:
“3. The inspection unit conducts actual inspection at the location requested by the submitter. From the end of the on-site inspection, within 01 (one) working day, the inspection unit issues the certificate of industrial product used for inland waterway vessels in accordance with regulations if the inspection results meet the provisions of national technical standards or notifies the organization or individual requesting the inspection if the inspection results do not meet the requirements.”
Article 14. Repeal Clause 8 of Article 17 of Circular No. 48/2015/TT-BGTVT dated September 22, 2015 which has been amended and supplemented by Article 4 of Circular No. 26/2020/TT-BGTVT.
Article 15. Repeal
Appendix XIICircular No. 48/2015/TT-BGTVT which has been supplemented by Clause 2 of Article 7 of Circular No. 26/2020/TT-BGTVT.
Chapter V
AMEND AND SUPPLEMENT SOME ARTICLES OF CIRCULAR NO. 35/2011/TT-BGTVT DATED MAY 6, 2011 ISSUED BY THE MINISTER OF TRANSPORTATION ON PROCEDURES FOR ISSUING CERTIFICATES OF QUALITY AND TECHNICAL SAFETY, LOADING AND UNLOADING EQUIPMENT, BOILERS, PRESSURE EQUIPMENT USED IN TRANSPORTATION
Article 16. Amending and supplementing some Articles of Article 5 of Circular No. 35/2011/TT-BGTVT
1. Amending and supplementing Point c Clause 1 Article 5 which has been amended and supplemented by Point a Clause 5 Article 1 of Circular No. 21/2023/TT-BGTVT as follows:
“c) The Vietnam Vehicle Inspection Agency shall conduct the design review within 13 (thirteen) working days from the date of receiving all necessary documents. If the documents do not meet the requirements, it shall notify the design entity in writing; if they meet the requirements, it shall issue a Design Review Certification according to the model prescribed in Appendix II attached hereto and stamp the design documents with the review seal.”
2. Amending and supplementing Clause 2 Article 5 as follows:
“2. Time limit for resolution: The Design Review Certification shall be issued within 02 (two) working days after completing the review in accordance with the regulations.”
Article 17. Amending and supplementing some Clauses of Article 8 of Circular No. 35/2011/TT-BGTVT
1. Amending and supplementing Point b Clause 1 Article 8 which has been amended and supplemented by Point a Clause 8 Article 1 of Circular No. 21/2023/TT-BGTVT as follows:
“b) The inspection agency shall accept and examine the documents: If the documents are incomplete as required, it shall guide the completion on the same working day (for direct submission) or guide the completion within 02 (two) working days (for submission through postal service or online public service portal); if the documents are complete as required, it shall confirm the State Quality Inspection Registration Certificate within 0.5 (half a) working day and agree on the inspection time and location;”
2. Amending and supplementing Clause 2 Article 8 as follows:
“2. Time limit for resolution: The Certificate of Technical Safety Equipment Import Quality or Notification of Non-Conformity of Technical Safety Equipment Import Quality shall be issued within 02 (two) working days after completing the inspection in accordance with the regulations.”
Article 18. Amending and supplementing Clause 2 Article 11 of Circular No. 35/2011/TT-BGTVT
“2. Time limit for resolution: The Certificate shall be issued within 02 (two) working days after completing the inspection in accordance with the regulations.”
Article 19. Amending and supplementing Clause 2 Article 14 of Circular No. 35/2011/TT-BGTVT which has been amended and supplemented by Clause 14 Article 1 of Circular No. 21/2023/TT-BGTVT
“2. Time limit for resolution: The Certificate shall be issued within 02 (two) working days after completing the inspection in accordance with the regulations.”

AMENDING AND SUPPLEMENTING SOME ARTICLES OF CIRCULAR NO. 27/2011/TT-BGTVT DATED APRIL 14, 2011 ISSUED BY THE MINISTER OF TRANSPORTATION ON THE IMPLEMENTATION OF THE AMENDMENTS AND SUPPLEMENTS OF THE INTERNATIONAL CONVENTION ON SAFETY OF LIFE AT SEA 1974 ACCOMPANYING THE MARITIME SECURITY LAW AND PORTS LAW
Article 20. Amending and supplementing Clause 2 Article 4 which has been amended and supplemented by Clause 6 Article 1 of Circular No. 03/2024/TT-BGTVT dated February 21, 2024 issued by the Minister of Transportation amending and supplementing some articles of Circular No. 27/2011/TT-BGTVT dated April 14, 2011 issued by the Minister of Transportation on the implementation of the amendments and supplements of the International Convention on Safety of Life at Sea 1974 accompanying the Maritime Security Law and Ports Law
“2. Implementation method
a) Shipping companies submit documents directly or through postal service or online public service portal or by other appropriate methods to the Vietnam Vehicle Inspection Agency.
b) Shipping companies receive results directly at the Vietnam Vehicle Inspection Agency or through postal service or online public service portal or by other appropriate methods.”

AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 43/2015/TT-BGTVT OF APRIL 14, 2011 ISSUED BY THE MINISTER OF TRANSPORT REGULATING PROCEDURES FOR ISSUING, APPROVING, AND REVOKING THE ANNOUNCEMENT OF SEAFARER COMPETENCY AND SEAFARER CERTIFICATE
Article 21. Amend and supplement Point c Clause 3 Article 4 of Circular No. 43/2015/TT-BGTVT dated August 20, 2015 issued by the Minister of Transport regulating procedures for issuing, approving, and revoking the Announcement of Seafarer Competency and Seafarer Certificate.
“c) Within 03 (three) working days from the date of receiving complete files as stipulated in Clause 2 of this Article, the Vietnam Ship Registry must complete the file review; if the review result does not meet the requirements, it shall request the ship owner to supplement and perfect;”

AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 33/2011/TT-BGTVT OF APRIL 19, 2011 ISSUED BY THE MINISTER OF TRANSPORT REGULATING PROCEDURES FOR ISSUING QUALITY SAFETY TECHNICAL AND ENVIRONMENTAL PROTECTION CERTIFICATES FOR VESSELS, EQUIPMENT FOR EXPLORATION, EXPLOITATION, AND TRANSPORTATION OF OIL ON THE SEA
Article 22. Amend and supplement Clause 4 Article 5 of Circular No. 33/2011/TT-BGTVT dated April 19, 2011 issued by the Minister of Transport regulating procedures for issuing quality safety technical and environmental protection certificates for vessels, equipment for exploration, exploitation, and transportation of oil on the sea
“4. Time limit for resolution
The time for reviewing design and issuing the Certificate or notifying that the design file does not meet the requirements shall be no later than 18 (eighteen) working days from the date of receiving complete files as prescribed. In cases where the marine construction design is new or complex, the design review period must be extended, the Inspection Authority will negotiate with the Design Institution.”
Chapter IX
AMENDMENTS, SUPPLEMENTS, AND REPEALS OF CERTAIN ARTICLES OF CIRCULAR NO. 49/2015/TT-BGTVT OF SEPTEMBER 22, 2015 ISSUED BY THE MINISTER OF TRANSPORT REGULATING STANDARDS, TASKS, RIGHTS, AND LIMITATIONS OF LEADERS, INSPECTORS, AND STAFF OF VESSEL INSPECTION UNITS
Article 23. Repeal certain points and clauses of Article 23 of Circular No. 49/2015/TT-BGTVT amended and supplemented by Clause 16 Article 1 of Circular No. 02/2024/TT-BGTVT.

Within 03 (three) working days from the date of receiving complete files as prescribed, the Vietnam Ship Registry must agree with the inspection unit on the time, location, and assignment of inspectors to conduct practical skills assessment for the person proposed to be recognized as an inspector. Within 03 (three) working days after completing the practical skills assessment of the person proposed to be recognized as an inspector, the inspector and the inspection unit must complete the practical skills assessment report of the inspector according to the model attached as Appendix VI to this Circular. The maximum time for completing the practical skills assessment is 03 (three) months from the date of receiving complete files as prescribed.”
Article 25. Amend and supplement Clause 2 of Article 25 of Circular No. 49/2015/TT-BGTVT which has been amended and supplemented by Clause 18 of Article 1 of Circular No. 02/2024/TT-BGTVT
“2. In cases where the Inspection Certificate of the inspector has expired but not more than 18 (eighteen) months, within three (three) working days from the date of receiving complete files as prescribed, the Recognition Board for Inspectors shall propose the Director of the Vietnam Inspectorate Bureau to decide on re-recognition of the inspector and issue an Inspection Certificate with the validity period specified in Clause 3 of Article 24 of this Circular. In cases where the Inspection Certificate of the inspector has been expired for more than 18 (eighteen) months, the procedures for re-recognition shall be carried out in accordance with the provisions of Clauses 2, 3, 4, and 5 of Article 24 of this Circular.”
Article 26. Amend and supplement Article 28 of Circular No. 49/2015/TT-BGTVT which has been amended and supplemented by Clause 21 of Article 1 of Circular No. 02/2024/TT-BGTVT
"Article 28. Reissue of the Inspection Certificate
In cases where the Inspection Certificate of the inspector is still valid but lost or damaged, the inspection unit shall submit a request for reissue according to the form at Appendix VIII issued together with this Circular. The Vietnam Inspectorate Bureau will reissue the Inspection Certificate within two (two) working days from the date of receipt of the request. If it does not reissue, it shall provide a written explanation of the reasons. The validity period of the reissued Inspection Certificate shall be equal to the remaining validity period of the lost or damaged Inspection Certificate.”
