CIRCULAR

OF THE MINISTRY OF FORESTRY NUMBER 6/VP DATED APRIL 4, 1990 GUIDING THE IMPLEMENTATION OF DECISION NO. 99-CT DATED APRIL 24, 1989 OF THE CHAIRMAN OF THE STATE COUNCIL ON STRENGTHENING WOOD PROCESSING PRODUCTS EXPORT.

On April 24, 1989, the Chairman of the State Council issued Decision No. 99-CT on strengthening wood processing products export.

On February 3, 1990, the State Council issued Decision No. 34-HĐBT on reorganizing service organizations and wood product import-export.

On March 6, 1990, the Ministry of Forestry, the Ministry of Foreign Economic Relations, and the General Department of Customs issued Circular No. 4-TT/LB stipulating responsibilities, authorities, and coordination relationships among the Forestry, Foreign Economic Relations, and Customs sectors in managing and inspecting wood product import-export.

The Ministry of Forestry issues this Circular to guide localities and business production units to properly implement the aforementioned Decisions No. 99-CT of the Chairman of the State Council and No. 34-HĐBT of the State Council regarding wood and wood processing products export.

1. Regarding natural forest wood and forest specialties

a) Exportable products

From 1990 onwards, roundwood will not be exported but only processed wood products such as: wooden furniture, combined rattan furniture, floorboards, refined floorboards, veneer, plywood, particleboard, fiberboard, sawn timber, etc. Prohibited from export, including sawn timber, are: Red sandalwood, rosewood, teak, agarwood, padauk, narra, ebony, ironwood, sao, blue lam (as per Decision No. 99-CT of the Chairman of the State Council).

For forest specialties and wildlife exports, refer to Circular No. 4 dated March 6, 1990, of the joint ministries.

For rattan, it must be organized for processing into export products with high value, and from 1991 onwards, raw rattan will not be exported.

b) For 1989 export inventory wood that has been inspected and stamped by the Ministry of Forestry's inspection team at the end of 1989 and has valid receipts for forest maintenance fees, if they wish to export, they must also process them into the above-mentioned products.

Units with 1989 export inventory wood that cannot process into export products shall sell to the Forestry Service Production and Export Import Joint Stock Companies I, II, and III under the Ministry of Forestry for processing into exportable products.

c) For rare and precious 1989 inventory wood that has been inspected and stamped by the Ministry of Forestry's inspection teams at the end of 1989, if selling roundwood yields higher prices than processed products, they should register with the Ministry of Forestry for export approval, which the Ministry of Forestry will jointly review with the Ministry of Commerce.

d) For wood harvested from 1990 onwards

For provinces, forestry sector entities directly under the Ministry of Forestry, and sectors managing forests, wood processing products for export may use up to 50% of the annual allowable cut approved in the plan design, the remaining wood to be used domestically and locally.

Absolutely no harvesting of prohibited rare and precious woods.

Units without forests can only export wood products when they have joint venture contracts for logging and processing wood with permitted logging provinces and units, and the quantity of exported wood will be deducted from the permitted export quota of the province and logging unit.

2. Regarding planted forest wood

Planted forest wood types such as eucalyptus, pine, acacia, casuarina, melaleuca, etc., can be exported in round form. Logging units must have approved logging plans.

Export quotas for planted forest wood in paper-producing regions, mining areas, and regions with export-oriented particleboard factories (including planned construction sites) can only be resolved after meeting factory needs and mine support wood requirements. For wood planted by the people, the Forestry Departments and Agriculture-Forestry Departments must assess the exploitable wood volume for the year to prepare export plans and strictly follow technical procedures for concentrated planting areas.

Localities must strictly protect protective forests, special-use forests, coastal forests, and roadside trees to prevent indiscriminate cutting that negatively impacts agricultural protection, environmental conservation, and national landscape.

3. Procedures and deadlines for exporting wood and wood products

All provinces, forestry sector entities directly under the Ministry of Forestry, and sectors with forests permitted to export wood and wood products must submit their logging plans to the Ministry of Forestry for approval by August each year to prepare for the next year's plan.

Units without forests wishing to export wood and wood products must submit joint venture logging and processing contracts with permitted logging units to the Ministry of Forestry.

By October each year, Forestry Departments, Agriculture-Forestry Departments, and units applying for wood and wood product exports must register with the Ministry of Forestry to prepare for the next year's export plan.

The Ministry of Forestry will determine the export quotas for provinces and units based on the actual wood harvest in the planning year, including the portion sourced from provincial forests.

These quotas will be sent to the State Planning Commission and Provincial People's Committees for monitoring and to the Ministry of Commerce as the basis for export quota allocation./.
