ISSUING ECONOMIC AND TECHNICAL STANDARDS FOR PUBLIC SERVICE BUOY GUIDANCE SERVICES

BASED ON THE VIETNAMESE MARITIME CODE dated June 27, 2005;
BASED ON THE DECREE NO. 173/2007/NĐ-CP dated November 28, 2007 OF THE GOVERNMENT ON THE ORGANIZATION AND OPERATIONS OF BUOY GUIDES;
BASED ON THE DECREE NO. 49/2011/NĐ-CP dated June 21, 2011 OF THE GOVERNMENT AMENDING AND SUPPLEMENTING ARTICLE 11 OF THE DECREE NO. 173/2007/NĐ-CP DATED NOVEMBER 28, 2007 OF THE GOVERNMENT ON THE ORGANIZATION AND OPERATIONS OF BUOY GUIDES;
Based on Decree No. 130/2013/NĐ-CP dated October 16, 2013 of the Government on production and supply of public goods and services;
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
At the proposal of the Director of the Department of Science and Technology and the Director of the Vietnam Maritime Administration,
THE MINISTER OF TRANSPORTATION ISSUES THIS CIRCULAR ON ECONOMIC AND TECHNICAL STANDARDS FOR PUBLIC SERVICE BUOY GUIDANCE SERVICES.
Article 1. ATTACHED TO THIS CIRCULAR ARE THE ECONOMIC AND TECHNICAL STANDARDS FOR PUBLIC SERVICE BUOY GUIDANCE SERVICES.
Article 2. THIS CIRCULAR REGULATES ACTIVITIES OF PUBLIC SERVICE BUOY GUIDANCE SERVICES AND SHALL BE APPLIED TO THE BUOY GUIDE COMPANIES (HEREINAFTER REFERRED TO AS THE BUOY GUIDE COMPANY), PERSONS PERFORMING BUOY GUIDANCE TASKS (HEREINAFTER REFERRED TO AS THE BUOY GUIDE), AND AUTHORITIES, ORGANIZATIONS, AND INDIVIDUALS RELATED TO THE ORGANIZATION AND OPERATIONS OF BUOY GUIDES IN VIETNAM.
Article 3. THIS CIRCULAR SHALL TAKE EFFECT FROM JANUARY 1, 2015. ABOLISH THE CIRCULAR NO. 69/2011/TT-BGTVT DATED NOVEMBER 30, 2011 OF THE MINISTER OF TRANSPORTATION ON ECONOMIC AND TECHNICAL STANDARDS FOR PUBLIC SERVICE BUOY GUIDANCE SERVICES AND THE CIRCULAR NO. 42/2013/TT-BGTVT DATED NOVEMBER 14, 2013 OF THE MINISTER OF TRANSPORTATION SUPPLEMENTING THE ANNEX OF THE ECONOMIC AND TECHNICAL STANDARDS FOR PUBLIC SERVICE BUOY GUIDANCE SERVICES ISSUED ALONG WITH THE CIRCULAR NO. 69/2011/TT-BGTVT DATED NOVEMBER 30, 2011 OF THE MINISTER OF TRANSPORTATION.
Article 4. THE DEPARTMENT OF SCIENCE AND TECHNOLOGY IS RESPONSIBLE FOR LEADING AND COORDINATING WITH THE VIETNAMESE MARINE PORTS AGENCY AND OTHER RELATED UNITS TO MONITOR AND EVALUATE THE IMPLEMENTATION OF THE PROVISIONS OF THIS CIRCULAR, ANNUALLY CHECKING THE QUALITY OF PUBLIC SERVICE BUOY GUIDANCE SERVICES IN ACCORDANCE WITH THE PROVISIONS.
Article 5. THE HEAD OF THE MINISTRY’S OFFICE, THE HEAD OF THE MINISTRY’S INSPECTION, THE DIRECTORS OF THE DEPARTMENTS, THE DIRECTOR OF THE VIETNAMESE MARINE PORTS AGENCY, THE GENERAL MANAGER OF THE NORTH VIETNAM NAVIGATION SAFETY CORPORATION, THE GENERAL MANAGER OF THE SOUTH VIETNAM NAVIGATION SAFETY CORPORATION, THE DIRECTORS OF THE BUOY GUIDE COMPANIES, THE HEADS OF THE AUTHORITIES, UNITS, AND INDIVIDUALS RELATED TO THIS CIRCULAR ARE RESPONSIBLE FOR ITS IMPLEMENTATION./.
