AMENDING AND SUPPLEMENTING CERTAIN CONTENTS OF CIRCULARS NO. 11/2021/TT-BXD DATED AUGUST 31, 2021, ISSUED BY THE MINISTER OF CONSTRUCTION GUIDING CERTAIN CONTENTS ON DETERMINATION AND MANAGEMENT OF INVESTMENT COSTS FOR CONSTRUCTION; CIRCULAR NO. 12/2021/TT-BXD DATED AUGUST 31, 2021, ISSUED BY THE MINISTER OF CONSTRUCTION ADOPTING BUDGET RATES FOR CONSTRUCTION; CIRCULAR NO. 13/2021/TT-BXD DATED AUGUST 31, 2021, ISSUED BY THE MINISTER OF CONSTRUCTION GUIDING METHODS TO DETERMINE ECONOMIC AND TECHNICAL INDICATORS AND QUANTITY TAKE-OFF OF CONSTRUCTION PROJECTS; AND CIRCULAR NO. 14/2021/TT-BXD DATED SEPTEMBER 8, 2021, ISSUED BY THE MINISTER OF CONSTRUCTION GUIDING DETERMINATION OF MAINTENANCE COSTS FOR CONSTRUCTION PROJECTS

Pursuant to Decree No. 06/2021/NĐ-CP dated January 26, 2021 of the Government detailing certain contents on construction quality management, construction works, and maintenance of construction projects;

Pursuant to Decree No. 10/2021/NĐ-CP dated February 9, 2021 of the Government on management of investment costs for construction;

Pursuant to Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

At the proposal of the Director of the Economic Management Department under the Ministry of Construction, and the Director of the Institute of Construction Economics;

The Minister of Construction issues this Circular amending and supplementing certain contents of Circular No. 11/2021/TT-BXD dated August 31, 2021, issued by the Minister of Construction guiding certain contents on determination and management of investment costs for construction; Circular No. 12/2021/TT-BXD dated August 31, 2021, issued by the Minister of Construction adopting budget rates for construction; Circular No. 13/2021/TT-BXD dated August 31, 2021, issued by the Minister of Construction guiding methods to determine economic and technical indicators and quantity take-off of construction projects; and Circular No. 14/2021/TT-BXD dated September 8, 2021, issued by the Minister of Construction guiding determination of maintenance costs for construction projects.

Article 1. Amending and supplementing certain contents of Circular No. 11/2021/TT-BXD dated August 31, 2021, issued by the Minister of Construction guiding certain contents on determination and management of investment costs for construction, amended and supplemented in 2023 and 2025.

1. Amending Point b Clause 3 Article 8 as follows:

“b) The Construction Department shall take the lead and coordinate with relevant agencies to organize surveys, collect information, and publish prices of building materials in the locality according to the guidance in Appendix XI attached to this Circular; publish according to Model 01 in Appendix VIII of this Circular; send the results of publication along with electronic data files (in a unified format) to the Ministry of Construction for monitoring, management, and updating into the database system as prescribed in Clause 3 Article 29 of Decree No. 10/2021/NĐ-CP.”

2. Amending Point d Clause 1 Article 13 as follows:

“d) Specialized construction testing costs are determined based on the estimate specified in Section III of Appendix V of this Circular.” 3. Amending Point d Clause 4 Subsection 2 Appendix II promulgated together with Circular No. 11/2021/TT-BXD as follows:

“d) Estimate for the specialized testing tender package according to the guidance in Section III of Appendix V of this Circular.”

4. Amending certain contents of Appendix III promulgated together with Circular No. 11/2021/TT-BXD.

5. Amending and supplementing certain contents of Appendix V promulgated together with Circular No. 11/2021/TT-BXD.

6. Supplementing Appendix XI Guidance on Surveying, Collecting Information, and Publishing Prices of Building Materials promulgated together with Circular No. 11/2021/TT-BXD.

6. Add Appendix XI Guidelines for Surveying, Collecting Information, and Announcing Prices of Construction Materials issued together with Circular No. 11/2021/TT-BXD.

Article 2. Amend and supplement Appendix II and Appendix VIII issued together with Circular No. 12/2021/TT-BXD dated August 31, 2021, of the Minister of Construction on construction norms, which have been amended and supplemented in 2024 and 2025.

1. Supplement construction budget norms for some works at Appendix II of Circular No. 12/2021/TT-BXD.

2. Amend and supplement Appendix VIII issued together with Circular No. 12/2021/TT-BXD as follows:

a. Amend and supplement the cost norms for consulting services to prepare economic-technical reports issued at Appendix VIII of Circular No. 12/2021/TT-BXD, which has been amended and supplemented in 2025.

b. Amend the content regarding specialized testing costs at Section 1, Part I Explanation on applying cost management project and investment consulting norms at Appendix VIII attached to Circular No. 12/2021/TT-BXD, which has been amended and supplemented in 2024.

Article 3. Supplement the content of Appendix V issued together with Circular No. 13/2021/TT-BXD dated August 31, 2021, of the Minister of Construction guiding methods for determining economic-technical indicators and stripping volumes of works, which have been amended and supplemented in 2025.

Supplement the table of consumption norms, basic data serving as the basis for determining some machine and construction equipment prices at Appendix V of Circular No. 13/2021/TT-BXD.

Article 4. Amend and supplement some contents of Circular No. 14/2021/TT-BXD dated September 8, 2021, of the Minister of Construction guiding the determination of maintenance costs for construction works.

1. Amend Point c Clause 1 Article 3 as follows:

"c) In cases where applying norms at point b of this clause is not suitable for the owner or manager/user of the work based on the type, level of the work, maintenance procedures, specific conditions of operation and management of the work, a maintenance plan for the work and a budget estimate for implementing annual regular maintenance tasks must be established to ensure economy and efficiency."

2. Supplement Article 3a following Article 3 as follows:

"Article 3a. Method for determining, adjusting, and reviewing maintenance and repair norms for construction works

The method for determining, adjusting, and reviewing maintenance and repair norms for construction works shall be carried out according to the guidance provided in Appendix III of Circular No. 13/2021/TT-BXD."

Article 5. Effective Date

This Circular takes effect from February 15, 2026.

Article 6. Transitional provisions

1. For specialized construction testing works that have been approved in the budget according to Article 13, Appendix II, Appendix III attached to Circular No. 11/2021/TT-BXD; Appendix VIII attached to Circular No. 12/2021/TT-BXD, continue to implement according to the approved results. In case of budget adjustment, the competent authority approving the budget expenses shall consider and decide on the application of the provisions of this Circular.

2. For specialized construction testing works that have signed contracts according to Article 13, Appendix II, Appendix III attached to Circular No. 11/2021/TT-BXD; Appendix VIII attached to Circular No. 12/2021/TT-BXD, continue to implement according to the signed contracts.

3. For annual regular maintenance works that have been approved in the budget according to Appendix VIII attached to Circular No. 12/2021/TT-BXD and Article 3 of Circular No. 14/2021/TT-BXD, continue to implement according to the approved results. In case of budget adjustment, the competent authority approving the budget expenses shall consider and decide on the application of the provisions of this Circular.

4. For specialized construction testing works and annual regular maintenance works that have signed contracts according to Appendix VIII attached to Circular No. 12/2021/TT-BXD and Article 3 of Circular No. 14/2021/TT-BXD, continue to implement according to the signed contracts./.
