Directive No. 618/CT-TTg on land inventory and construction of land use status maps for the year 2010

DIRECTIVE

Regarding the land inventory and the construction of the 2010 land use status map

To implement the Land Law 2003 and to assess the land use status nationwide up to 2010, evaluate the enforcement of land laws during the period 2005-2010, and serve the planning of land use for the period 2011-2020 and the land use plan for the period 2011-2015, the Prime Minister assigns the Ministry of Natural Resources and Environment to take the lead and coordinate with ministries, ministerial-level agencies, government agencies, and provincial and centrally-administered city People's Committees to organize the implementation of the land inventory and the construction of the 2010 land use status map, with the following main contents:

1. Requirements for the land inventory and the construction of the 2010 land use status map

- The 2010 land inventory must clearly determine the natural area of administrative levels, the current land fund under management and use, unused land that has been put into use but left idle, unused land; assess the actual situation of land management and use and changes in land compared to the previous inventory, the implementation of land planning and land use plans that have been approved; propose solutions to improve the efficiency of land management and use.

- The results of the land inventory will be reflected in statistical tables and on the 2010 land use status map across the country, geographical-economic regions, and at the provincial, district, and commune levels.

2. Contents of the land inventory and the construction of the 2010 land use status map

a) Land inventory:

- The land area inventory is conducted nationwide according to administrative levels, where communes, wards, towns (hereinafter referred to as commune level) are the basic units for conducting the land inventory. The results of the commune-level land inventory form the basis for compiling the land inventory data at the district, provincial, and national levels; land inventory data of geographical-economic regions are compiled from the land inventory data of provinces and cities within those regions;

- The 2010 land inventory data must fully cover the natural area of administrative levels; the area and number of land users according to types of land and types of land users specified in Article 9, Article 13 of the Land Law 2003; Article 2, Article 3, and Article 6 of Decree No. 181/2004/NĐ-CP dated October 29, 2004 of the Government on implementing the Land Law and guiding circular No. 08/2007/TT-BTNMT dated August 2, 2007 of the Ministry of Natural Resources and Environment on guiding the implementation of land statistics, land inventory, and the construction of the land use status map, with particular emphasis on the inventory of irrigated rice fields and land currently used for forestry purposes; the area of land allocated or leased but not yet put into use; the area for which land recovery decisions have been made but not yet completed; Additionally, it is necessary to review and compile the area certified with land use rights certificates, the area surveyed for cadastral purposes, and the area with cadastral files established.

b) Construction of the 2010 land use status map nationwide at the commune, district, provincial, and national levels and geographical-economic regions.

c) Report on the results of the 2010 land inventory: reports on the results of the 2010 land inventory at all administrative levels must fully reflect the land use situation up to January 1, 2010; the land changes over the past five years, based on which the implementation of each content and task of state land management is evaluated and measures to address current shortcomings and weaknesses in land management are proposed.

3. Inventory date and completion deadline:

a) The 2010 land inventory date is uniformly implemented nationwide on January 1, 2010;

b) The completion deadline for the land inventory, construction of the land use status map, and reporting on the results of the land inventory is as follows:

- Commune level completes and reports the results before April 30, 2010;

- District level completes and reports the results before June 30, 2010;

- Provincial level completes and reports the results before August 15, 2010;

- Geographical-economic regions and the entire country complete before October 31, 2010.

4. The cost of the 2010 land inventory and construction of the land use status map is guaranteed by the state budget.

5. Responsibilities of ministries, provincial and centrally-administered city People's Committees

a) Ministry of Natural Resources and Environment:

- Prepare the budget for the 2010 land inventory and construction of the land use status map for activities carried out by the Ministry of Natural Resources and Environment;

- Guide forms, methods for the land inventory and construction of the land use status map;

- Direct, guide, organize training, and inspect the land inventory and construction of the land use status map nationwide;

- Provide remote sensing images and base maps at the provincial and commune levels to localities that do not have base maps or whose base maps do not meet the requirements set by the Ministry of Natural Resources and Environment to serve the land inventory and construction of the land use status map, prioritizing areas without cadastral maps, areas with administrative boundary adjustments, and areas with significant land changes due to aquaculture development, industrial development, irrigated rice fields, and forest land;

- Compile and construct reports on the 2010 land inventory and construction of the land use status map for geographical-economic regions and the entire country to report to the Government.

b) The Ministry of National Defense and the Ministry of Public Security shall take the lead and coordinate with the Ministry of Natural Resources and Environment and provincial and centrally-administered city People's Committees based on the results of the land fund inventory of organizations according to Directive No. 31/2007/CT-TTg dated December 14, 2007 of the Prime Minister, to review, adjust, supplement, and unify the data on the current land use status of defense and security units to compile and report to the Prime Minister.

c) Provincial People's Committees: based on the guidance for land inventory and the creation of the 2010 land use status map issued by the Ministry of Natural Resources and Environment, and the budget preparation guidance issued by the Ministry of Finance to carry out the plan, guidelines, training for land inventory and allocation of funds for implementation; inspecting all levels of government and relevant departments in organizing the land inventory and creating the 2010 land use status map.

d) The Ministry of Finance:

- Taking the lead and coordinating with the Ministry of Natural Resources and Environment to guide the Ministry of Defense, the Ministry of Public Security, and provincial-level People's Committees in preparing budgets for land inventory activities and the creation of the 2010 land use status map according to the principle that the central budget will ensure tasks carried out by central ministries and agencies, while local budgets will ensure tasks carried out by provincial, district, and commune levels; for areas facing difficulties in funding sources, the central budget will consider providing partial support.

- Taking the lead and coordinating with the Ministry of Natural Resources and Environment to compile the financial needs for implementing the land inventory and the creation of the 2010 land use status map for the Ministry of Defense, the Ministry of Public Security, and localities, and propose the level of central budget support for each locality, reporting to the Prime Minister for consideration and decision.

- Taking the lead and coordinating with the Ministry of Natural Resources and Environment to inspect the use of funds for land inventory activities and the creation of the 2010 land use status map for central ministries and agencies and localities.

6. Ministers, heads of ministerial-level agencies, heads of agencies under the Government, and Chairpersons of provincial-level People's Committees are responsible for implementing this Directive./.
