PRIME MINISTER

 

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Education Law dated December 2, 1998;

Pursuant to Decree No. 88/2001/NĐ-CP dated November 22, 2001 of the Government on the implementation of universal secondary education;

Pursuant to Decree No. 43/2000/NĐ-CP dated August 30, 2000 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

At the proposal of the Minister of Labor, Invalids and Social Affairs,

 

DECISION:

 

Article 1. To stipulate policies to support Vietnamese adolescents aged 11 to 18 who are studying at the lower secondary level and implementing universal secondary education as prescribed in Decree No. 88/2001/NĐ-CP dated November 22, 2001 of the Government.

Article 2. Recipients of Support

1. Students who are children of烈士后代;

2. Students who are children of wounded veterans, children of disabled veterans, and those receiving benefits equivalent to wounded veterans, children of military personnel injured in work accidents with a loss of labor capacity of 81% or more;

3. Students who are children of wounded veterans, children of disabled veterans, and those receiving benefits equivalent to wounded veterans, children of military personnel injured in work accidents with a loss of labor capacity of 61% to 80%;

4. Students who are children of wounded veterans, children of disabled veterans, and those receiving benefits equivalent to wounded veterans, children of military personnel injured in work accidents with a loss of labor capacity of 21% to 60%, and children of military personnel suffering from occupational diseases with a loss of labor capacity of 41% to 60%;

5. Students who are persons with disabilities (as defined in this Decision), regardless of the cause of disability, having deficiencies in one or more body parts or functions manifested in various forms of disability, reducing their ability to function, making labor, living, and studying very difficult.

6. Orphaned students in any of the following cases:

a) Orphans of both parents;

b) Orphans of one parent, but the remaining parent is missing or unable to provide care according to current laws;

c) Abandoned, deprived of means of support, and without relatives to rely on.

7. Students belonging to ethnic minorities.

8. Students from households classified as poor under current laws.

Article 3. Support Policies

1. For recipients specified in Clauses 1, 2, 3, and 4 of Article 2 of this Decision, the provisions of current laws regarding preferential policies for those affected by war shall apply.

2. For recipients specified in Clause 5 of Article 2 of this Decision, the following support shall be provided:

a) A minimum reduction of 50% in tuition fees and contributions for school construction.

b) In cases where they belong to poor households: They shall be exempted from 100% of tuition fees and contributions for school construction, and shall be granted a one-time minimum amount of VND 120,000 per year per student to purchase textbooks, notebooks, and learning materials.

3. For recipients specified in Clause 6 of Article 2 of this Decision, the following support shall be provided:

Exemption from 100% of tuition fees and contributions for school construction, and a one-time grant of a minimum amount of VND 120,000 per year per student to purchase textbooks, notebooks, and learning materials.

4. For recipients specified in Clause 7 of Article 2 of this Decision, the following support shall be provided:

a) In cases where they belong to poor households, they shall be exempted from 100% of tuition fees, contributions for school construction, and shall be provided with textbooks, notebooks, and learning materials.

b) Those specified in Clause 7 of Article 2 who are currently benefiting from support policies under Decision No. 168/2001/QĐ-TTg dated October 30, 2001 of the Prime Minister on long-term orientation, five-year plan 2001-2005, and basic solutions for economic and social development in the Central Highlands; Decision No. 186/2001/QĐ-TTg dated December 7, 2001 of the Prime Minister on economic and social development in six particularly difficult mountainous provinces in the North during the period 2001-2005 (Cao Bang, Bac Kan, Lao Cai, Ha Giang, Son La, Lai Chau); Decision No. 173/2001/QĐ-TTg dated November 6, 2001 of the Prime Minister on economic and social development in the Mekong Delta region for the period 2001-2005; National Target Program on Education and Training until 2005 shall continue to benefit according to current regulations.

c) When the policies mentioned in point b of Clause 4 of this Decision end, those specified in Clause 7 of Article 2 shall benefit from the support policy stipulated in point a of Clause 4 of this Decision.

5. For recipients specified in Clause 8 of Article 2, the following support shall be provided:

A minimum reduction of 50% in tuition fees and contributions for school construction.

Article 4. The funds required to implement the support policies as stipulated in this Decision shall be guaranteed by local budgets.

Article 5. The Ministry of Labor, Invalids, and Social Affairs shall take the lead and coordinate with the Ministry of Finance and the Ministry of Education and Training to guide localities in identifying beneficiaries, types of education, and allocating budget funds annually to implement the system as prescribed in this Decision.

Article 6. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 7. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities are responsible for implementing this Decision./.
