Article 1. Position, f

The Ministry of Construction is a government agency responsible for managing state affairs regarding: Urban planning, architecture; construction investment activities; urban development; technical infrastructure of cities and industrial zones, economic zones, high-tech zones; housing; office buildings; real estate markets; building materials; state management of public services within the scope of the Ministry's state management according to the provisions of the law.

Article 2. Tasks and Authorities

The Ministry of Construction is responsible for performing tasks and powers as stipulated in Decree No. 36/2012/NĐ-CP dated April 18, 2012 of the Government on the functions, tasks, powers, and organizational structure of Ministries, ministerial-level agencies, and the following specific powers:

1. Submit to the Government draft laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees of the Government according to the annual legislative program and plans of the Government and various resolutions, strategies, plans, and important projects and works under the scope of state management of the Ministry as assigned by the Government and the Prime Minister.No.Submit to the Prime Minister draft decisions, directives, and other documents as assigned.

2. Issue circulars, decisions, directives within the scope of state management of the Ministry; establish and issue, or submit to competent authorities for issuance, the system of technical standards, national standards, cost norms, typical designs, model designs in the fields of state management of the Ministry.

d) take the lead and cooperate with the Ministry of Labor, Invalids, and Social Affairs to develop and promulgate criteria and conditions for the operation of inspection organizations for machinery and equipment with strict requirements for occupational safety specific to the Construction industry;

d) Guide and inspect the implementation of legal provisions on safety for machinery, equipment, and materials with strict requirements for occupational safety under the scope of management by the Ministry;

e) Guidance For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;inspect construction technical safety work to ensure safety for workers, construction machinery, construction projects, and adjacent structures; coordinatepolicieswith the Ministry of Labor, Invalids, and Social Affairs to handle violations and guide resolution of technical safety incidents during constructionnationalprojects according to the law. 14. On environmental protection:

15. Organize statistical work and archive materials and data on fields under the Ministry's management as prescribed by law.

16. Decide on specific policies and measures and direct the operation mechanism of public service organizations under the Ministry's management as prescribed by law; manage and direct the activities of public institutions under the Ministry.

17. Regarding the exercise of rights and obligations as the owner of state capital in enterprises with state capital under the Ministry's management:

a) Develop plans and overall schemes for restructuring, reorganizing, shareholding,Coattransforming ownership, innovating and developing state-owned enterprises under the Ministry's management to submit to the Prime Minister for approval and direct the implementation of the scheme after approval;

b) Submit to the Prime Minister for decision or decide according to its authority the appointment and removal of positions such as Chairman of the Board of Members, General Director, Member of the Board of Members, and Auditor at corporations and companies with 100% state capital under the Ministry's management;

The Minister of Construction shall submit to the Prime Minister for issuance of a decision specifying the list of remaining public service organizations under the Ministry.

Article 4. Effective date

This Decree takes effect from August 15, 2013, replacing Government Decree No. 17/2008/NĐ-CP dated February 4, 2008, which stipulates the functions, tasks, powers, and organizational structure of the Ministry of Construction.
