Pursuant to the Law Ton organization and operation of the Government dated December 25, 2001;

||| BASED ON DECREE NO. 36/2012/NĐ-CP DATED APRIL 18, 2012 OF THE GOVERNMENT ON THE FUNCTIONS, DUTIES, POWERS AND ORGANIZATIONAL STRUCTURE OF MINISTRIES AND GOVERNMENTAL AGENCIES OF THE SAME RANK;12/NĐ-CP dated April 18, 202012 of Chapter"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."Government stipulating functions, tasks, powers, and structure organization functions of Ministries, ministerial-level agencies;

At the proposal of the Minister of Construction;

The Government shall issue a Decree prescribing the functions, tasks, powers, and organizational structure of the Ministry of Construction.,

Article 1. Position, f

The Ministry of Construction is a government agency responsible for managing state affairs regarding: Urban planning, architecture; construction investment activities; urban development; technical infrastructure of cities and industrial zones, economic zones, high-tech zones; housing; office buildings; real estate markets; building materials; state management of public services within the scope of the Ministry's state management according to the provisions of the law.

Article 2. Tasks and Authorities

The Ministry of Construction is responsible for performing tasks and powers as stipulated in Decree No. 36/2012/NĐ-CP dated April 18, 2012 of the Government on the functions, tasks, powers, and organizational structure of Ministries, ministerial-level agencies, and the following specific powers:

1. Submit to the Government draft laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees of the Government according to the annual legislative program and plans of the Government and various resolutions, strategies, plans, and important projects and works under the scope of state management of the Ministry as assigned by the Government and the Prime Minister.No.Submit to the Prime Minister draft decisions, directives, and other documents as assigned.

2. Issue circulars, decisions, directives within the scope of state management of the Ministry; establish and issue, or submit to competent authorities for issuance, the system of technical standards, national standards, cost norms, typical designs, model designs in the fields of state management of the Ministry.

3. Direct, guide, inspect, and be responsible for organizing the implementation of normative legal documents, strategies, plans, and programs approved within the scope of state management of the Ministry; promote, publicize, educate about the law and information on these areas under the scope of state management of the Ministry.- technical, design, and other fields of state management of the Ministry. lSpecifically, the Department of Construction under Hanoi City and Ho Chi Minh City does not perform the function of advising and assisting the Municipal People's Committee in state management over the area of urban planning and architecture. lAbout urban planning and architecture:

a) Guide and inspect the implementation of legal provisions on the qualifications of organizations and individuals participating in urban planning and architectural practice; model certificates for architects and urban planning engineers; guide and inspect the issuance and management of architect and urban planning engineer practice certificates. lAbout construction investment activities:policiesGuide and inspect the implementation of legal provisions on project establishment, review, approval, and execution management; participate in project review according to the law.rime Minister cGuide and inspect the work of technical design, construction drawing design, and budget estimation for construction projects; review technical design and construction drawing design for projects funded by the state budget and other projects as prescribed by law.policies Monitor, inspect, and evaluate overall investment in construction activities according to authority; guide and inspect the implementation of important construction projects and national key works according to the law; perform the role of the main investor for important construction projects and national key works assigned by the Prime Minister.

d) Develop orientations, strategies for national housing development for each ten-year period, five-year national housing programs, housing development targets, and housing development plans in the annual socio-economic development tasks of the country and at each stage; direct the implementation after approval by the Prime Minister; lGuide, inspect provincial People's Committees in building local housing development programs, housing development targets, and lhousing development plans in the annual socio-economic development tasks of the locality at each stage;

The Minister of Construction shall submit to the Prime Minister for issuance of a decision specifying the list of remaining public service organizations under the Ministry.

Article 4. Effective date

This Decree takes effect from August 15, 2013, replacing Government Decree No. 17/2008/NĐ-CP dated February 4, 2008, which stipulates the functions, tasks, powers, and organizational structure of the Ministry of Construction. Article 5. Responsibilities for Implementation
