Regarding the issuance of the Regulation on organization and operation
of the Central Commerce Cadre School
THE MINISTER OF TRADE
cănbased on the Education Law dated December 2, 1998 and Decree No. 43/2000/NĐ-CP dated August 30, 2000 of the Government detailing the implementation of certain provisions of the Education Law;
cănEDUCATION Decree No. 95/CP dated December 4, 1993 of the Government stipulating the functions, tasks, powers, and organizational structure of AND the Ministry of Trade;
Considering the proposal of the Director of the Personnel Department and the Principal of the Central Commerce Cadre School,
DECISION:
Article 1. We hereby promulgate the Regulations on the organization and operation of the Central Commerce Cadre School
Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette.
Article 3. The Heads of the Ministry's Office, the Director of the Personnel Department, the Principal of the Central Commerce Cadre School and the Heads of relevant units under the Ministry shall be responsible for implementing this Decision./.

Organization and Operation of the Central Commerce Cadre School
(Issued pursuant to Decision number 623/2003/QĐ-BTM dated May 27, 2003 of the Minister of Trade)
Chapter 1:
GENERAL PROVISIONS
Article 1. The Central Commerce Cadre School – with the English name National Advanced Training Institute (NATI), is a unit subordinate to the Ministry of Trade, established and operating according to Decision No. 402/TM-TCCB dated April 18, 1994 and Decision No. 898/2002/QĐ-BTM dated July 29, 2002 of the Minister of Trade. The school is part of the organizational structure of the Ministry of Trade as prescribed in Decree No. 95/CP dated December 4, 1993 of the Government regarding the functions, tasks, powers, and organizational structure of the Ministry of Trade.
Article 2. The Central Commerce Cadre School is an educational and scientific and technological institution with income, partially self-financing its regular operational expenses; it operates nationwide in the field of training, upgrading, research, science, and technology related to organization, management, and business operations in the trade sector. The school has legal personality and may use seals as prescribed and open accounts at the State Treasury and the State Bank.
Article 3. The main office of the Central Commerce Cadre School is located in Dong Thien Village, Vinh Tuy Commune, Thanh Tri District, Hanoi.
Chapter 2:
TASKS AND POWERS OF THE CENTRAL COMMERCE CADRE SCHOOL
Article 4. The Central Commerce Cadre School has the following tasks:
1. Training, retraining, and upgrading cadres managing state affairs in commerce, management skills, and business practices, updating knowledge about economic and commercial matters;
2. Organizing scientific research activities, consulting services, production, and technology transfer in the field of trade development;
3. Training skilled workers at high levels and with special characteristics in commerce;
4. Organizing international cooperation activities to fulfill tasks (1), (2), and (3).
Article 5. The school may independently organize the implementation of its tasks, develop and issue regulations specific to its operational characteristics and in accordance with current national and Ministry of Trade regulations.
Chapter 3:
ORGANIZATION OF THE CENTRAL COMMERCE CADRE SCHOOL
Article 6. The organizational structure of the school includes:
1. The Rectorate: the Rector and Deputy Rectors;
2. Functional departments;
3. Faculties and subject departments;
4. Centers;
5. Classes.
Article 7. The Rector is appointed and relieved from duty by the Minister of Trade. The Rector is responsible to the Minister for all activities of the school. The Rector is assisted by Deputy Rectors. Deputy Rectors are appointed and relieved from duty by the Rector upon recommendation to the Minister of Trade.
Article 8. The departments and centers of the school include:
1. General Department;
2. Training Management and Upgrading Department;
3. International Cooperation and Scientific Management Department;
4. Finance and Accounting Department;
5. Library and Equipment Department;
6. Centers (to be established and regulated subsequently).
Article 9. Departments and centers under the school are directly supervised by the Rector. Each department and center has a head and deputy head. The heads and deputies assist the department heads and center directors. These positions are appointed and relieved from duty by the Rector.
Article 10. Faculties and subject departments are established according to specialized fields and are directly supervised by the Rector. Each faculty has a dean and deputy dean. Each subject department has a head and deputy head. These positions are appointed and relieved from duty by the Rector.
For the time being, the following faculties and subject departments will be established:
1. Faculty of Upgrading;
2. Vocational Training Faculty;
3. Commercial Information Technology Subject Department;
4. Foreign Language Subject Department.
The establishment and dissolution of faculties are proposed by the Rector and decided by the Ministry of Trade.
Article 11. Classes are organized into the following groups:
1. Group of cadres and civil servants of the Ministry;
2. Group of civil servants of Provincial Commerce Departments;
3. Group of enterprises;
4. Group of high-level vocational training and special characteristic commerce training.
Classes are under the supervision of the Rector. Each class has a class committee elected by the class members. The Rector decides to recognize or appoint the committee.
Article 12. The functions, tasks, powers, and the number of staff members of officials and civil servants, teachers of each organization under the School shall be decided by the Rector.
Chapter 4:
TASKS AND POWERS OF THE RECTOR
Article 13. The Rector of the Central School of Commerce Officials has the following tasks:
1. To develop annual long-term training and capacity-building plans and work policies to effectively fulfill the school's functions and tasks, as well as those assigned by the Minister of Commerce;
2. To organize and direct the implementation of training and capacity-building plans and other work policies to ensure quality improvement and efficiency, successfully completing annual tasks;
3. To organize and direct the research and improvement of training and capacity-building objectives, the compilation of course curricula, textbooks, and materials, the improvement of teaching methods, serving the training and capacity-building activities of the school and higher-level leadership bodies (when required). To direct the establishment and implementation of internal regulations, organizing and directing the implementation of science and technology plans assigned by the Ministry, service contracts;
4. To direct the organizational and personnel work of the school, taking care of the training and capacity-building of the school's teachers and civil servants;
5. To direct the implementation of state policies for officials and civil servants, teachers in the school. To organize a good material and spiritual life for officials, civil servants, teachers, and students in the school;
6. To organize and direct the construction of physical facilities and technical equipment, using investment capital efficiently, managing the school's assets and finances properly according to state regulations;
7. To organize and direct social security work within the school premises;
8. To direct inspection and audit work on the use of capital, financial work, the use of equipment, and the use of land within the school;
9. To organize and direct external relations work of the school, cooperation with other schools, scientific research institutes, and international cooperation to serve the school's training and capacity-building activities.
Article 14. The Rector of the Central School of Commerce Officials has the following powers:
1. To decide on policies, measures, and organizational activities of the school;
2. To issue regulations within the school to organize and direct training and capacity-building activities and manage the school;
3. To decide on the appointment, dismissal, commendation, and disciplinary actions for officials, civil servants, and teachers in the school according to management levels;
4. To recognize graduation and issue certificates based on the training and capacity-building tasks assigned by the Ministry of Commerce;
5. To be the account holder of the school, deciding on expenditures and the use of the school's financial resources according to state regulations.
Article 15. Deputy Rectors assist the Rector in specific areas of work assigned by the Rector and are responsible to the Rector for the tasks assigned. When the Rector is absent due to official duties, a Deputy Rector will be assigned to represent and handle school affairs and be responsible to the Rector for their decisions, reporting back the results of their work when the Rector returns to the school.
Chapter 5:
COUNCILS OF THE SCHOOL
Article 16. The Central School of Commerce Officials has councils that provide advisory services to the Rector on directions and major work policies of the school in each field of work at different times to effectively carry out all school activities.
Article 17. The Central Commercial Cadre School has the following councils:
1. Scientific Council 2. Teaching Council; 3. Graduation Examination Council; 4. Competition and Reward Council; 5. Admissions Council.
Chapter 6:
RELATIONSHIP OF WORK BETWEEN THE ORGANIZATIONS OF THE SCHOOL
Article 18. Departments, centers, faculties, and subject groups operate based on the provisions of this Regulation and concretize their activities through specific regulations established by the Rector to ensure maximum autonomy in professional work.
Article 19. Departments, centers, faculties, and subject groups have the responsibility to coordinate in performing tasks according to their functions and plans assigned or approved by the Board of Directors.
Chapter 7:
FINANCIAL AND ACCOUNTING WORK
Article 20. The school receives regular funding for training, enhancement, science and technology programs, basic construction investment programs, and other funds according to the current regime for revenue-generating public institutions. Financial accounting books must be opened and financial transactions recorded in accordance with state regulations.
Article 21. Revenues that cover expenses shall allocate profits in accordance with the current regime.
Article 22. The school's activities are carried out according to plans and budget estimates and are approved by the Rector. Upon completion of the work, they must be inspected and settled.
Chapter 8:
REWARD AND DISCIPLINE
Article 23. Staff members who achieve results in fulfilling their duties shall be rewarded in accordance with the law.
Article 24. Staff members who violate the provisions of this Regulation shall be disciplined according to the law, depending on the nature and severity of the violation.
Chapter 9:
IMPLEMENTING PROVISIONS
Article 25. This Regulation takes effect fifteen days from the date of publication in the Official Gazette.
Article 26. During implementation, if any provision is found to be inappropriate, the school shall submit a report to the Ministry for supplementation and amendment./.
